WHEN THE PRIOR DEVELOPER FOR CREEKSIDE, THEY WERE WILLING TO BUILD A PARK, BUT REALLY THEY WEREN'T GOING TO BE ANY AMENITIES. AND WHEN WE TALKED ABOUT THAT, YOU ALL APPROVED IT, BUT SAID, WE REALLY WANT TO FIND THE FUNDS TO BE ABLE TO MONETIZE THAT PARK AS QUICKLY AS POSSIBLE. AT THE TIME, I DIDN'T KNOW, NOT KNOW ABOUT THIS DEVELOPMENT THAT WAS COMING IN. SO ESSENTIALLY THIS THIS DEVELOPMENT WILL BE ABOUT 270 HOUSES. ALL TOLD BETWEEN WITH THEIR PARK IMPROVEMENT FEES AND PARK DEDICATION FEES, TOTALS A LITTLE OVER $1.8 MILLION. THEY ARE NOT BUILDING A PARK. THEY ARE GOING TO DO SOME TRAIL DEVELOPMENT. AND THAT'S WHAT'S HERE. SO AND I'LL SHOW YOU THIS ON AN UPCOMING SLIDE. SO WHAT'S GOOD ABOUT THIS? AND I GUESS I'LL JUST KEEP GOING HERE. WHAT WE'RE EXCITED ABOUT IS THOSE DOLLARS CAN BE USED TO MONETIZE CREEKSIDE PARK. SO INSTEAD OF JUST HAVING IRRIGATED TURF AND TREES AND A TRAIL, WE CAN USE THESE DOLLARS TO COME IN AND PUT UP BACKSTOPS AND PLAYGROUNDS AND POSSIBLY PAVILIONS. COUNCIL DIDN'T LIKE THAT. COUNCIL WANTED THE DEVELOPER TO COVER THE COST OF THE PARK, AND THROUGH SOME NEGOTIATIONS, THE DEVELOPER AGREED TO DO SO. SO THE DEVELOPER IS FOR THE CREEKSIDE DEVELOPMENT. PUT UP THE 710,000. REALLY? REALLY. ALL HE WAS SUPPOSED TO DO WAS ABOUT $336,000. BUT HE FELT IT WAS IMPORTANT ENOUGH FOR HIS COMMUNITY THAT HE WAS GOING TO GO AHEAD AND MOVE FORWARD WITH THAT. SO WE HAVE HAVE THE CREEKSIDE DEVELOPER REALLY STEPPED UP AND MOVED FORWARD, BUT WE STILL DIDN'T HAVE ANY, YOU KNOW, FUN STUFF TO PUT IN THE PARK. BUT ALL THOSE ALL THAT MONEY IS WHAT MAKES UP ALL THE ALL THE FEES, MINUS THE CREDITS FOR THESE TRAILS, MAKES UP THAT $1.8 MILLION THAT WE'RE STILL GOING TO BE ABLE TO TAKE. SO WHAT I'M SORRY. SO WHAT WE WANT, WHAT WE WANT TO DO IS FOR YOU ALL TO APPROVE THE DEVELOPMENT AGREEMENT, WHICH SHOWS THE DEVELOPER IS GOING TO COME IN AND BUILD TRAILS TO, TO HELP GET THE SURROUNDING COMMUNITIES. AND OBVIOUSLY THIS LEGACY GARDENS DEVELOPMENT WRAPS ALL THE WAY AROUND THAT. SO IT'S REALLY A GOOD FIT FOR BOTH COMMUNITIES. AND IT'S A GREAT WAY TO BUILD A PARK WITHOUT THE TOWN HAVING TO COME UP WITH ANY, ANY DOLLARS. AND WE'RE PROBABLY ANTICIPATING OUT OF THAT 1.8, PROBABLY ANYWHERE FROM 6 TO $700,000, WE COULD PULL OFF OF THAT AND REALLY DO SOME NICE THINGS IN THAT PARK AND STILL BE ABLE TO FUND THE PARK IMPROVEMENT FEE FUND WITH PROBABLY AROUND $1 MILLION. SO, SO THAT'S WHAT I WANT TO BRING TO YOU TONIGHT AND SEE HOW YOU FELT ABOUT IT AND SEE IF YOU WERE GOOD WITH WHAT'S BEING PROPOSED. AND THIS WILL GO TO COUNCIL ON THE 28TH OF THIS MONTH. AND THEN THEY KIND OF ASKED US, YOU KNOW, HOW ARE YOU GOING TO FUND THE IMPROVEMENTS? AND WE TOLD THEM THERE WAS ANOTHER DEVELOPMENT COMING AND WE WOULD PRESENT THAT TO THEM NEXT MEETING. DID WE WANT TO MAKE A MOTION TO APPROVE THE AGREEMENT? SO YEAH, THAT ONE. OKAY. AND HOW BIG IS THIS PARK? THE EXISTING THE PARK THAT'S ALREADY THERE. THOSE TREE MITIGATION FEES REALLY CAN'T NECESSARILY BE USED TO BUILD A PARK. IT'S USED CAN BE USED TO REESTABLISH TREES, IRRIGATION, ANYTHING RELATED TO THAT.
