THANK YOU. THIS EVENING, OUR CONSENT AGENDA. WE HAVE CONSENT AGENDA ITEMS THREE A THROUGH

[CONSENT AGENDA]

THREE H ON OUR AGENDA. THIS EVENING. DID ANY OF THE COMMISSIONERS WANT TO PULL ANY CONSENT AGENDA ITEMS FOR DISCUSSION THIS EVENING? I BELIEVE THAT JUST ABOUT ALL THINGS THAT ARISE. COMMISSIONER BLANCHARD WOULD LIKE TO PULL THREE E, THREE F AND H, ANY OTHERS THAT NEED TO BE PULLED. THIS EVENING. IF NOT, I'LL ENTERTAIN A MOTION ON THE OTHER CONSENT AGENDA ITEMS FOR APPROVAL. MOVE TO APPROVE CONSENT AGENDA ITEMS. NUMBER THREE A, THREE B, THREE C, THREE D AND THREE G. OKAY, SO WE HAVE A MOTION ON THE FLOOR TO APPROVE SAID CONSENT AGENDA ITEMS FROM COMMISSIONER HAMILTON. DO WE HAVE A SECOND? WE HAVE A SECOND FROM COMMISSIONER HARRIS. SO ALL THOSE IN FAVOR OF APPROVING, ACCORDING TO TOWN STAFF RECOMMENDATIONS, CONSENT AGENDA ITEMS THREE, THREE, THREE C, THREE D AND THREE G, PLEASE RAISE YOUR HAND AND THE MOTION CARRIES 5 TO 0. ALL IN APPROVAL OR 6 TO 0. I SHOULD SAY SIX OF

[3e. Consider and act upon a request for a Preliminary Plat of Legacy Gardens, Phases 3- 4, on 136.1± acres, located on the south side of Frontier Parkway and 1,100± feet west of Dallas Parkway. (DEVAPP-24-0060)]

US 6 TO 0. SORRY SO THOSE ARE APPROVED. SO WE'LL GO ON TO WAS IT 3E3. OKAY. OKAY. SO THREE E IS A PRELIMINARY PLAT FOR PHASES THREE AND FOUR OF THE LEGACY GARDENS, THE PURPOSE IS TO CONSTRUCT THE THIRD AND FOURTH PHASE OF THE LEGACY GARDENS RESIDENTIAL SUBDIVISION, IT CONSISTS OF 271 SINGLE FAMILY LOTS, 25 COMMON AREA LOTS. AND THESE LOTS HAVE SPECIFIC LOT TYPES. THE FIRST TYPE IS A TYPE EIGHT F LOT WHICH IS 8000FT■!S 6 BY 125 PER THE PLANNED DEVELOPMENT HAS TO HAVE A MINIMUM OF AT LEAST 23 OF THESE LOTS, WHICH THE PLAT DOES, FOR THE OTHER TYPE ARE NINE F LOTS, WHICH ARE 9000FT■!S, THAT ARE 7T WIDE AND 130FT DEEP, THE PD STATES THAT THERE HAS TO BE AT LEAST A MINIMUM OF 101 OF THESE TYPE OF LOTS, WHICH THERE ARE IN THE PRELIMINARY PLAT, AND THEN THE LAST LOT TYPE IS TYPE TEN LOTS, WHICH ARE 10,000FT■!S, AND THIS STANDARD DIMENSIONS FOR THOSE ARE 86 BY 130. THE PD CALLS FOR A MINIMUM OF 147 OF THESE TYPE OF LOTS, WHICH ARE ON THE PRELIMINARY PLAT, AND THEN FOR THE SPECIFIC TRAILS, THERE IS A NORTH TO SOUTH TRAIL THAT EXTENDS FROM FRONTIER PARKWAY TO SHAWNEE TRAIL AND CONNECTS TO THE COMMON AREA LOTS, I'LL GO BACK TO THE SO YOU CAN SEE THIS. THIS IS THAT NORTH TO SOUTH LOT THAT GOES FROM FRONTIER AND IT CONNECTS ALL THE THROUGH YOUR COMMON AREA LOTS TO THE ROUNDABOUT AND THE BANCROFT, AND THEN IT CONNECTS TO THIS EXISTING TRAIL THAT WILL GO TO SHAWNEE, AND THEN THE EAST TO WEST TRAIL. IS FROM SHAWNEE. IT GOES HERE AND IT'LL GO ACROSS THESE LOTS. THIS IS EXISTING, AND THEN THIS AREA IN GREEN IS WHERE THEY WILL CONNECT THE TRAIL. THERE THAT IS ON THAT. SO I WILL TAKE QUESTIONS ON THIS CASE. NOW OKAY. SO MY QUESTION A COUPLE OF QUESTIONS. ONE ON THE PD REQUIREMENTS. YES. SO THE NUMBER OF LOTS THAT YOU'VE IDENTIFIED FROM THE PD REQUIREMENTS HERE ONLY RELATE TO THE THIRD AND FOURTH PHASES. IS THAT THE WAY THE PD IS? IS IT BROKEN DOWN BY PHASES LIKE THAT. IT IS. SO PD 115 I BELIEVE ONLY DEALS WITH PHASES THREE AND FOUR. OKAY. NOT NOT PHASES ONE AND TWO. CORRECT. WHICH I ASSUME AT ONE AND TWO MUST BE THE NEIGHBORHOOD THAT'S ALREADY BUILT THERE. IS THAT RIGHT? SO THERE'S NOT A GRAND TOTAL OF LOTS THAT IT'S JUST BY PHASE. IT'S JUST BY FAITH. OKAY. ALL

[00:05:04]

RIGHT. SO I JUST WANT TO CLARIFY THAT. THE OTHER THING I WAS CONCERNED ABOUT ON THIS, I NOTICED THAT THE PHASES THREE AND FOUR, IF YOU IF YOU PULL UP THE PLAT, IS THERE A SPECIFIC SECTION JUST. YEAH. THE TOP, THE ONES BY, FRONTIER. FRONTIER. OKAY. YEAH. SO CAN YOU ACTUALLY KEEP GOING? THERE'S ANOTHER ONE THAT SHOWS THE WHOLE AREA THERE. LET'S SEE THE WHOLE THIS ONE TO THAT ONE. YEAH. OKAY. SO ALONG FRONTIER PARKWAY, THERE'S ONLY ONE ENTRANCE IN AND OUT OF THAT NEIGHBORHOOD, NOT EVEN THERE'S NOT EVEN ANY OUT OF PHASES THREE AND FOUR. THEY ARE NOT COUNTING THE ONES DOWN BELOW. THERE'S ONLY ONE ENTRANCE. THERE'S NOT EVEN AN ENTRANCE ON SHAWNEE TRAIL. SO, IS THERE ARE THERE DO WE HAVE ANY CONCERNS ABOUT THE FACT THE LACK OF, VERY MANY ENTRANCES? I MEAN, YOU'RE GOING TO HAVE TO. THAT WHOLE NEIGHBORHOOD HAS TO PRETTY WELL DRIVE THROUGH THE ENTIRE NEIGHBORHOOD TO GET IN AND OUT OF IT. SO. WELL, SO THERE IS A, IF YOU SEE ON BANCROFT DRIVE, IT GOES AND EXTENDS AND IT'LL CONNECT ALL THE WAY OUT TO SHAWNEE TRAIL. OKAY. WHICH IS PART OF THE, I GUESS, PHASE 1 OR 2. YEAH. IT'S NEXT TO THOSE PHASES THAT ARE ALREADY EXISTING. I REALIZE THERE'S A CONNECTION, AND I ASSUME THERE WILL BE A CONNECTION LATER WHEN PHASE THREE IS STUBBED OUT TO THE NEXT NEIGHBORHOOD OVER AND EVERYTHING LIKE THAT. BUT IT JUST SEEMS LIKE A RATHER LARGE NEIGHBORHOOD TO HAVE ONLY ONE ENTRANCE OUT OF PHASES THREE AND 4 OR 1 EXIT. I MEAN, I'M JUST I'M SURPRISED THAT THAT THAT'S ALL WE'RE GOING TO. YEAH. AND OUR FIRE DEPARTMENT TYPICALLY CHECKS THOSE. THEY USUALLY REQUIRE THOSE TWO POINTS OF ACCESS, BUT THERE WERE NO CONCERNS ABOUT, WHERE THE ACCESS POINTS WERE LOCATED AT. OKAY. SO AS. OKAY. AND I GUESS LET ME JUST EXPRESS MY I UNDERSTAND WHAT YOU'RE SAYING. IT MEETS THE REQUIREMENTS AND STUFF. I JUST, I GET CONCERNED ANYTIME I SEE A LARGE NEIGHBORHOOD WITH ONLY ONE ACCESS. I MEAN, I'VE SEEN THAT BEFORE IN OTHER NEIGHBORHOODS THAT, THAT I'VE BEEN A PART OF AND THE INABILITY TO GET IN AND OUT, ESPECIALLY ON A BUSY ROAD LIKE FRONTIER PARKWAY, WILL WILL BE IT WILL BECOME BUSIER AND BUSIER. SO IT'S KIND OF JUST, IT JUST SEEMS TO ME LIKE THAT'S WE WOULD'VE BEEN BETTER OFF WITH ANOTHER ACCESS SOMEWHERE, EITHER ON SHAWNEE TRAIL OR SOMEWHERE UP OUT OF THOSE PHASES. BUT YEAH. AND I THINK THE INTENT WAS, AND I UNDERSTAND YOUR POINT. I THINK THE INTENT WAS TO HAVE THE CONNECTION THROUGHOUT THE PHASES. BUT WE DO UNDERSTAND YOUR POINT ABOUT THOSE AREAS OF ACCESS. IF I RECALL, THAT WAS THE ORIGINAL ISSUE WE HAD WITH THIS IN THE BEGINNING, BECAUSE THE PHASE ONE, PHASE TWO, I THINK IT ONLY HAD THE ONE ENTRANCE. AND THEN YOU WERE SAYING THAT THEY WERE GOING TO BUILD MULTIPLE HOUSES. THAT WAS BUILT OUT. AND, YOU KNOW, I GUESS THE FIRE DEPARTMENT HAD A CONCERN WITH THAT BACK THEN. AND THEY TOOK A STEP BACK AND TRIED TO STEAL JUST ONE ENTRANCE, UP TOP AND I JUST, I GUESS I WAS JUST MAKING A CALL ON IT RIGHT BEFORE WE STARTED TALKING. AND I REMEMBER THIS, THIS WHOLE THING, AND I THINK I WAS BORN IN 1979, BUT I. JUST JUST FOR CLARIFICATION SAKE, WHY ARE YOU GUYS DISCOUNTING BANCROFT DRIVE? AND THAT TAKES YOU TO SHAWNEE TRAIL, WHICH IS A THOROUGHFARE THAT TAKES YOU TO PROSPER TRAIL TO WHAT IF THAT WASN'T THERE IS A TOTALLY DIFFERENT SITUATION, RIGHT? BUT WHAT? WELL, I MEAN, YOU'RE DRIVING INTO THE NEXT PHASE YOU'RE GOING PAST. I MEAN, THEY'RE ONLY I MEAN, IT JUST SEEMS LIKE A LONG DISTANCE TO NOT HAVE ANOTHER EXIT. I MEAN, I REALIZE THERE'S I REALIZE BANCROFT IS THERE, AND YOU CAN DRIVE THROUGH THE ENTIRE NEIGHBORHOOD AND PROBABLY GET DOWN. THERE'S ANOTHER ONE DOWN BELOW THAT I THINK, TOO. SO YOU CAN DRIVE. I JUST DON'T THINK IF YOU WANT TO GET ON A MAJOR ROAD, YOU WANT TO GET OUT OF THE NEIGHBORHOOD AND GET IN AND OUT, AND NOT ALL THE TWISTS AND TURNS TO DO THAT. SO IT SEEMS THAT THE OUTSKIRTS WHERE YOU'RE THINKING, I WOULD LIKE TO HAVE SEEN ONE ABOUT WHERE THAT STREET S IS, I'LL GO THERE TO SHAWNEE TRAIL OR SOMETHING LIKE THAT, OR TO.

OKAY THANK YOU. THANK ANY OTHER COMMENTS OR QUESTIONS ON 3D? IF NOT, LET'S REVIEW THREE F. WE

[00:10:05]

CAN WE CAN MAKE A MOTION NOW, OR WE CAN HOLD THEM ALL TO THE END IF WE WANT. DO ABOUT ONE AT A TIME. HOWEVER YOU WANT TO DO IT. OKAY. WE CAN SURE DO THAT. SO IF WE WANT TO ENTERTAIN A MOTION ON ITEM THREE. A MOTION THAT WE. PAST CONSENSUS AGENDA ITEM THREE. WE HAVE A MOTION ON THE FLOOR. COMMISSIONER HARRIS. DO WE HAVE A SECOND? SECOND. SECOND FROM COMMISSIONER CARSON. ALL THOSE IN FAVOR OF APPROVING ITEM THREE, PLEASE RAISE YOUR HAND.

WE'VE GOT ONE, TWO, THREE, FOUR IN FAVOR. ALL OPPOSED AND TWO OPPOSED. MOTION CARRIES 4 TO 2

[3f. Consider and act upon a request for a Preliminary Site Plan for Bank and Restaurant/Retail Buildings on Gates of Prosper, Block E, Lots 3-4, on 3.0± acres, located on the west side of Preston Road and 470± feet south of First Street. (DEVAPP-24-0082)]

ON ITEM THREE. LET'S GO TO ITEM THREE. F. I CAN SAVE A LITTLE BIT OF TIME.

I HAVE JUST ONE QUICK QUESTION ON THIS ONE. SO IT'S. YES, SIR. I DON'T NECESSARILY NEED THE WHOLE DESCRIPTION. IF YOU PULL UP THE SITE PLAN, PERHAPS JUST CURIOUS BETWEEN RIGHT THERE. SO THE. IS THIS I CAN'T I COULDN'T REALLY TELL. IS THAT A ROAD OR WHAT IS THAT BETWEEN THE, THE PLAT THAT WE'RE CONSIDERING AND THE NEIGHBORING CAR WASH. YOU SEE THERE'S A, THERE'S ALL THE TIME RIGHT HERE. I'M LOOKING AT SIX YEARS. IT'S ALMOST PARKING SPACES HERE, WHICH I UNDER WHICH I BELIEVE ARE WHERE THE CAR WASH PEOPLE GO TO. DRY OFF THEIR CARS AND THAT KIND OF STUFF. VACUUM, WHATEVER. SO I'M JUST CURIOUS WHAT WHAT THE HOW THE DIVIDER IS BETWEEN THESE TWO. HOW DO WE MAKE SURE THAT THE PEOPLE THAT WANT TO GO INTO THIS NEW BUILDING THAT'S BEING BUILT THERE AREN'T PARKING OVER THERE IN THAT, IN THAT AREA? ARE THEY ARE THEY DIFFERENTIATED ENOUGH AT THE MOMENT? THERE IS, THERE IS LANDSCAPING THAT DIVIDES THOSE TWO LOTS. COULD YOU REFERRING TO THIS, THIS LOCATION HERE TODAY? WAS TALKING ABOUT THAT, RIGHT? YES SO THIS IS LIKE A ONE FAMILY LANDSCAPE, RIGHT THERE. AFTER THIS, PLATS DRAWN, BUILT OUT, IT LOOKS LIKE IT'S ALL JUST A ROAD THAT. SEGMENT OF THAT ROAD IS. YES, THAT IS CORRECT. THAT IS A ROAD THAT GOES INTO THAT CAR WASH. OKAY. RECENTLY I WAS OUT THERE AND THIS IS FOR THE MOST PART, IT IS DEVELOPING AT THE MOMENT, I CAN CIRCLE BACK AND FIND OUT EXACTLY HOW WHAT THE DEVELOPER'S PLANS ARE FOR THAT PARTICULAR SPOT WITH IT. AM I AM I CORRECT THAT THAT'S A THAT THAT'S SPECIFICALLY FOR THE USE OF THE CAR WASH, THOSE PARKING SPACES. THAT IS CORRECT. OKAY OKAY. BUT YOUR CONCERN IS THAT IT COULD BE USED BY ANYBODY. OR IS THERE A SEPARATION OR SOMETHING THERE THAT NATURALLY WOULD KEEP IT SEPARATED FROM THE NEW BUILD? I MEAN, I SUPPOSE, I MEAN, IF THERE'S NOTHING ON THE PLAT THAT SHOWS ANY KIND OF SEPARATION, IT LOOKS LIKE JUST REGULAR PARKING SPACES ON THE PLAT. I SUPPOSE THERE COULD BE SIGNS THAT CAN BE PUT UP THAT SAYS IT'S PARKING ONLY FOR THE CAR WASH OR WHATEVER, BUT I WAS JUST CURIOUS HOW HOW THIS IS. SO I GUESS MY QUESTION IS, IS IT PARKING ONLY FOR THE CAR WASH OR CAN ANYBODY KNOW? I GUESS IT SHOULD BE PARTICULARLY FOR THE CAR WASH, BECAUSE THE CAR WASH, YOU GOT THE CAR WASH. THAT'S A THAT'S ESTABLISHED AND THEN YOU HAVE THE ONLY THING OVER THERE IS THAT, IS THAT THAT, DESPERATELY IS CALLED ME. AND THE, THE BANK IS COMING IN, AND THEN THERE WILL BE ANOTHER, THEY HAVEN'T EVEN STARTED BUILDING ON THIS. THE RESTAURANT. ANY OTHER QUESTIONS OR COMMENTS ON THREE F, THAT'S ALL MY CONCERN. OKAY. THANK YOU. COMMISSIONER BLANCHARD. DO WE HAVE A MOTION ON ITEM THREE F THIS EVENING? MOVED TO APPROVE THE CONSENT AGENDA. ITEM THREE F. CAN YOU

[00:15:05]

REPEAT THAT? I MOVED TO APPROVE CONSENT AGENDA ITEM THREE F. YOU DIDN'T HEAR YOU GOOD. SO? SO WE HAVE A MOTION ON THE FLOOR FROM COMMISSIONER HAMILTON TO APPROVE THREE F. DO WE HAVE A SECOND ON THAT? A SECOND? WE HAVE A SECOND FROM COMMISSIONER JACKSON. ALL THOSE IN FAVOR OF APPROVING CONSENT AGENDA ITEM THREE F, PLEASE RAISE YOUR HAND AND THE MOTION CARRIES 6 TO 0. THE LAST

[3h. Consider and act upon a request for a Site Plan for a Parking Lot Expansion on Victory at Frontier, Block A, Lot 3, on 1.2± acres, located on the west side of Preston Road and 250± feet south of Frontier Parkway. (DEVAPP-24-0095)]

ITEM THAT WAS PULLED THIS EVENING IS CONSENT AGENDA ITEM THREE H. OKAY, SO THREE H IS A SITE PLAN FOR A PARKING LOT EXPANSION, IS TO CONSTRUCT A PARKING LOT CONSISTING OF 24 NEW PARKING SPACES FOR AN EXISTING CONVENIENCE STORE, IT CONSISTS OF 14 STANDARD NINE BY 20 SPACES, SIX LARGER SPACES THAT ARE 12 BY 50. AND THEN FOR ELECTRIC VEHICLE ONLY SPACES THAT ARE NINE BY 20 AS WELL. AND IT ALSO INCLUDES LANDSCAPING. SO A LANDSCAPE PICNIC AREA WITH SHADE TREES. I WILL NOT TAKE ANY QUESTIONS YOU GUYS HAVE FROM ME ON THIS CASE. OKAY. SO HELP ME THROUGH THIS, PLEASE. JUST LOOKING AT THE PLAT. HOW THIS LOOKS, I MEAN, READING HERE'S HERE'S MY CONCERN. SO YOU GET TO HELP YOU SEE IF YOU CAN HELP ME GET OVER THESE CONCERNS. OKAY.

SO THIS IS SORT OF AN ENTRY POINT INTO OUR CITY. YOU COME ON ON A MAJOR ROAD. AND SO IT IT LOOKS TO ME LIKE THIS IS A BIG, GIGANTIC PARKING LOT FOR BIG TRUCKS AND RVS. NOT EXACTLY WHAT I'D CALL THE MOST ATTRACTIVE KIND OF ENTRANCE INTO OUR CITY. SO HELP ME UNDERSTAND WHAT THIS IS. IS THAT. IS IT. IS THAT WHAT IT IS? IT'S JUST A BIG PARKING LOT. THAT AND I MEAN, IT ESSENTIALLY IS A BIGGER PARKING LOT. AND THOSE SPACES ARE SPECIFICALLY FOR BIGGER VEHICLES. TO KIND OF ALLEVIATE THAT CONCERN A LITTLE BIT, IF YOU CAN SEE THIS AREA RIGHT HER, BECAUSE WE UNDERSTAND THE CONCERN ABOUT BEING A BIG PARKING LOT AT THE FRONT ENTRY, BUT THERE IS A LANDSCAPED AREA WITH PICNIC TABLES, AND LARGE SHADE TREES, WHICH THEY DIDN'T HAVE TO DO, BUT WE NEGOTIATED THAT WITH THEM, IN ORDER TO MAKE THAT AREA UP A LITTLE MORE. SO WHERE WHERE ARE YOU? I MEAN, SO THE RIGHT HERE. OKAY. THERE'S THAT'S A PICNIC AREA. YEAH. SO THIS IS A LANDSCAPING HERE. AND THEN THESE ARE THE SHADE TREES, AND THEN THESE ARE THE PICNIC TABLES. BUT IT'S JUST A KIND OF AMENITIZED AREA A LITTLE BIT INSTEAD OF JUST A PARKING LOT, IF YOU WILL. SO THE AND THEN THE PARKING OVER HERE TO THE WEST, THE LEFT SIDE OF THAT, THAT'S FOR THE LARGE LARGER VEHICLES ARE WE. WE'RE TALKING ABOUT AGAIN. ARE THEY EXPECTING THAT TO BE A PARKING AREA FOR SEMIS RV WHAT KIND OF TRUCKS ARE WE LOOKING AT HERE? I ASSUME IT'S GOING TO BE THOSE, KIND OF SEMI TRUCKS BECAUSE WE NEED TO FUEL UP AS WELL, I THINK THAT'S THE INTENT FOR THOSE. OKAY. THIS 7-ELEVEN FOR INSTANCE, THAT'S THAT'S IMMEDIATELY NORTH OF THIS SITE. THERE IS AN AN EXXON STATION. IT'S OVER AT THE CORNER OF PRESTON TRAIL AND PRESTON AND 1 OR 2 OTHERS THAT I GUESS I SHOULDN'T BE NAMING NAMES AND DOING ADVERTISING, BUT WHAT IS OCCURRING IN SEVERAL OF THESE LOCATIONS IS PRETTY MUCH THROUGHOUT THE PERIOD, A LITTLE BIT IN THE MORNING. BUT GENERALLY BETWEEN MAYBE 1030, 11 TO ABOUT 130 TO 2 IN THE AFTERNOON. PEOPLE THAT PREDOMINANTLY ARE IN THE LANDSCAPING BUSINESS, THAT HAVE PICKUPS, THAT HAVE SOME TYPE OF, OF A VEHICLE SIMILAR TO A PICKUP WITH THE TRAILERS THAT ARE ATTACHED THAT HAVE ALL THE LANDSCAPING EQUIPMENT. THEY MAY HAVE THE DEBRIS FROM TRIMMING TREES AND OTHER THINGS. THEY, FREQUENT THESE ESTABLISHMENTS FOR LUNCH. AND SO THEY'LL BE THERE FOR HOWEVER LONG THAT THAT IT TAKES THEM TO EAT LUNCH. ALL OF THEM HAVE THE ONE I MENTIONED AT PRESTON TRAIL AND PRESTON HAS A SUBWAY SANDWICH SHOP, FRANKLY, I'VE FORGOTTEN WHAT IT IS THAT THAT THE 7-ELEVEN HAS, BUT BUT THEY GET OVERWHELMED DURING THAT PERIOD WITH THE TRAILERS AND THE AMOUNT OF PEOPLE THAT THAT ARE THERE FOR THAT, THAT LUNCH ACTIVITY FOR 2 OR 3 HOURS THAT

[00:20:07]

THE CONSTANTLY ARE TRYING TO FIGURE OUT HOW TO, HOW TO MANAGE THAT. AND SO THE 7-ELEVEN CAME TO US REPRESENTATIVES FROM 7-ELEVEN CAME TO US, WELL, GOSH, PROBABLY CLOSE TO SIX MONTHS AGO NOW, AND SAID, HEY, WE WANT TO DO TWO THINGS. NUMBER ONE, WE WANT TO ADD SOME EV CHARGING STATIONS. WE DON'T HAVE ANY AT THIS LOCATION, AND WE'D LIKE TO PUT A FEW. AND THAT'S PART OF WHAT THEY'RE DOING. THOSE ARE THE FOUR DEDICATED SPOTS FOR THE EVS BECAUSE THEY'LL HAVE THE CHARGERS THERE. AND THEN THE OTHER THING THEY WANTED TO DO SOMETHING TO WHERE THEY WOULD BETTER BE ABLE TO ACCOMMODATE THE FOLKS THAT ARE COMING WITH THE TRAILERS AND THE EQUIPMENT.

AND THAT'S WHAT THESE LONGER SPOTS ARE FOR, IS FOR THE FOLKS WITH THE TRAILERS, IS TO BE ABLE TO PULL IN TO THEM. IT'S NOT INTENDED FOR SEMIS. MY BELIEF IS THERE WILL PROBABLY BE SIGNS THAT SAY IT'S NOT FOR SEMIS, BECAUSE THAT WOULD DEFEAT THE WHOLE PURPOSE OF WHY THEY'RE DOING ALL THIS IN THE FIRST PLACE WAS TO ACCOMMODATE THE PEOPLE THAT THAT ARE COMING THERE FOR LUNCH, BE REASON THAT THAT WE PUSH FOR THE PICNIC AREA AND THE PICNIC TABLES AND THE TREES. AND THEY WERE VERY ACCOMMODATING TO THAT WHEN WE SUGGESTED IT, THAT THOUGHT THAT WAS A GREAT IDEA IS BECAUSE, FRANKLY, I'VE BEEN TO SEVERAL OF THESE PLACES DURING THE LUNCH HOURS, EITHER GETTING GAS MYSELF OR JUST SEEING WHAT WAS GOING ON FROM AN ACTIVITY PERSPECTIVE TO BE ABLE TO BETTER ADDRESS WHAT 7-ELEVEN WAS WANTING TO DO. AND WE'D NOTICED IT EVEN BEFORE 7-ELEVEN CAME TO US, THAT THAT THESE SITUATIONS WERE OCCURRING AROUND TOWN. AND, YOU KNOW, WHAT COULD BE DONE TO HELP BETTER MANAGE THAT AND SO BY ACTUALLY VIEWING WHAT WAS OCCURRING THERE WASN'T ANY PLACE NOT ONLY FOR THE FOLKS TO BE ABLE TO PARK THEIR VEHICLES WITH THEIR TRAILERS, BUT THERE WASN'T ANY PLACE FOR THEM TO ACTUALLY SIT OTHER THAN BACK IN THE TRUCK OR ON THE CURB OR SOMETHING. AND SO THIS SEEMED LIKE AN OPPORTUNITY TO EVEN FURTHER ADDRESS THE SITUATION, TO BETTER ACCOMMODATE THE FOLKS. AND SO THAT'S KIND OF HOW THIS THIS BECAME WHAT IT WAS. AND THEN THE SECOND PART IS WE DIDN'T WANT THIS WHOLE LOT TO BE ENTIRELY CONCRETE. I MEAN, IT WOULD HAD A MINIMAL AMOUNT OF REQUIREMENTS FOR LANDSCAPING REQUIREMENTS, BUT WE ALSO FELT LIKE IT WOULD BE BETTER TO CUT DOWN ON THE HEAT AND EVERYTHING ELSE. SO THAT'S HOW IT WOUND UP.

THIS WAY. AND THERE WAS A PROVISION IN THIS PARTICULAR PD THAT ALLOWED, NOT SO MUCH 7-ELEVEN PER SE, BUT THEY HAPPEN TO BE THE ONE THAT WAS ADJACENT THAT WAS DOING THIS, THAT THIS LOT COULD BE DEVELOPED AS A SECONDARY USE WITHOUT A PRIMARY USE BEING ON IT, WHICH IS WHY 7-ELEVEN WAS WAS ABLE TO COME IN AND, AND PUT IN THIS, THIS LANDSCAPING AND THE EV CHARGING AND THE OTHER THINGS THAT THEY WERE TRYING TO DO. SO I DON'T KNOW THAT THAT WAS THE ORIGINAL THOUGHT WHEN THE PD WAS DONE OR I MEAN, SPECIFICALLY FOR 7-ELEVEN, OR IF IT WAS JUST DONE FOR WHATEVER REASON AT THE TIME OF THE PD. IT PREDATES ALL OF US AS FAR AS THAT GOES. BUT THAT'S THAT'S KIND OF THE WHOLE STORY OF HOW IT EVOLVED AND WHAT IT'S SUPPOSED TO BE. AND WE FRANKLY, I DON'T THINK WOULD ALLOW THEM TO TURN IT INTO A TRACTOR TRAILER RIG, PARKING AND SO FORTH, BECAUSE IT WOULD OBVIOUSLY IT DEFEATS THE WHOLE PURPOSE OF WHAT WE WERE TRYING TO DO IN THE FIRST PLACE. SO THAT'S THAT'S HELPFUL TO UNDERSTAND UNDERSTAND WHAT THE PD IS REQUIRING. I BUT LET ME ASK THIS QUESTION. YES, SIR. IS THERE ANYTHING IN THE PD OR IN THE IN THE, IN OUR, IN OUR ORDINANCES OR WHATEVER THAT WOULD PREVENT THIS FROM BEING SOME OVERNIGHT SEMI TRAILER OR, YOU KNOW, OR RV PARKING SPACE THAT THEY MAY PARK THERE OVERNIGHT OR WHATEVER. WE WOULDN'T ALLOW THAT FROM A USE PERSPECTIVE. AND I LIKE I SAID, I IF IT TURNED IN THAT OR IT TURNED OUT THAT THERE WERE TRUCKS, TRACTOR TRAILER RIGS THAT WOUND UP BEING PARKED THERE, WE WOULD BE IN A POSITION TO TELL 7-ELEVEN TO PUT SOME SIGNS OUT THERE THAT YOU CAN NO LONGER DO THAT. AND I THINK WE HAVE ORDINANCES THAT WOULD PREVENT, FOR INSTANCE, THAT'S WHY YOU DON'T SEE TRACTOR TRAILER RIGS PARKED IN WALMART PARKING LOT, TARGET PARKING LOT, ALL THESE OTHER NAMES. I SHOULDN'T BE NAMING. BUT YOU

[00:25:03]

KNOW, THAT'S SUPPOSED TO BE GIVEN FREE ADVERTISING. BUT WE HAVE REGULATIONS THAT PREVENT THAT FROM OVERNIGHT PARKING. SO BETWEEN THE RULES THAT WE HAVE AND THE INTENT THAT THAT 7-ELEVEN HAS, THEY'RE NOT GOING TO WANT TO DO THAT BECAUSE THAT'S GOING TO IMPACT THEIR IMAGE AND THEIR OVERALL USE OF THE FACILITY AS WELL. SO I THINK BETWEEN THE TWO WOULD BE ABLE TO LIMIT THAT FROM HAPPENING IN TH. AREA TO THE WEST OF THIS IS JUST VACANT LAND RIGHT NOW. IS AM I CORRECT? THERE ARE SEVERAL THINGS THAT WE ARE WORKING ON RIGHT NOW WITH THE OWNERS OF ALL OF THIS. THIS AREA, THE UP ON THE TOP. LET'S SEE, WHAT WOULD IT BE? THE NORTHWEST CORNER OF THE OVERALL DEVELOPMENT HAS A BIG USER THAT WE'VE BEEN WHERE THEY'RE IN THE PROCESS OF COMING THROUGH. THERE IS A SMALLER AREA THAT IS GOING TO BE USED AS SOMEWHAT OF A DETENTION POND.

THEY'RE NOT REQUIRED TO HAVE DETENTION, BUT BECAUSE OF THE WAY THE WHOLE THING IS WORKING OUT, THEY THEY CAN'T MANAGE THE DRAINAGE WITHOUT HAVING A LITTLE BIT OF DETENTION. SO THAT'S GOING TO BE IMMEDIATELY THE GREEN AREA THAT YOU SEE ON THIS SLIDE IS, IS GOING TO BE THERE.

BUT THERE IS A PLAN TO LITERALLY HAVE ALL OF THIS AREA DEVELOPED IN PROBABLY THE NEXT TWO YEARS.

AS FAR AS CONSTRUCTION IS CONCERNED. SO WE'VE WE'VE SEEN WHAT THE LAYOUT IS SUPPOSED TO LOOK LIKE. IT'S NOT OBVIOUSLY ALL GOING TO BE BUILT AT THE SAME TIME. BUT BUT THERE IS PROPOSALS TO, TO OTHERS BASICALLY. AND WHAT, WHAT I'M TRYING TO GET TO IS BECAUSE YOU'VE, YOU'VE WE'VE GOT PLENTY OF LANDSCAPING, WE'VE GOT AN ATTEMPT AT LANDSCAPING TO BLOCK A LOT OF THIS PARKING LOT FROM PRESTON. IT LOOKS LIKE THE TREES AND STUFF. THERE'S SOME LANDSCAPING ON THAT OTHER SIDE, BUT I DIDN'T KNOW WHAT WAS, YOU KNOW, GOING TO BE OVER THERE TO SEE IF WE CAN PROTECT THE VIEW FROM THAT SIDE, FROM THIS, FROM WHAT'S NOT GOING TO BE. IT'S NOT GOING TO I JUST IT'S NOT GOING TO BE AN ATTRACTIVE SITE. AND AGAIN, IT JUST CONCERNS ME THAT THIS IS WHAT WE'RE GOING TO HAVE ENTERING INTO THE CITY. AND, YOU KNOW, SO ANYWAY, I JUST BUT I, YOU HELP ME UNDERSTAND WHAT'S GOING ON HERE. AND SO ONE THING I'LL ADD IS A, I GUESS A PRECEDENT IF YOU GO BACK TO THAT PICTURE YOU JUST HAD, THIS IS THE AERIAL. THE AERIAL. YEAH. I MEAN, IT KIND OF ANSWERS THE NEED FOR THE PARKING. YOU SEE HOW MANY TRUCKS ARE PARKED RIGHT IN FRONT OF THAT GAS STATION. YOU SEE A LANDSCAPER TRUCK LEAVING. YOU'RE TALKING ABOUT LUNCHTIME. THIS PLACE IS CRAZY NUTS AT 5:00 TILL 7:00 AT NIGHT. COMING OUT OF THE HIGH SCHOOL.

COMING DOWN. PRESTON, YOU'VE GOT A MIX OF A LOT OF LANDSCAPERS, BUT YOU HAVE A LOT OF LITTLE, LITTLE KID TEAMS GOING IN THERE GETTING THEIR SLUSHIES AND WHATNOT. IT'S REALLY, REALLY DANGEROUS. AND IT'S DEBATABLE IF IT'S A GOOD LOOK ALREADY. BUT AT THAT LOCATION. SO I WOULD SAY THIS WITH WHERE IT'S AT, MORE PARKING IS DEFINITELY NEEDED BECAUSE IT I'VE BEEN THERE MANY TIMES IN THE EVENING AND I GET NERVOUS EVERY TIME I GO THERE. IT'S JUST IT'S JUST OVERCROWDED.

SO I CAN SEE WHY IT'S NOT THE BEST LOOK THERE. MAYBE THE PARKING IS DEFINITELY NEEDED AND IT IS. IT'S JUST CRAZY. AND I DON'T KNOW A TIME WHEN IT'S NOT THIS NICE. SO WHAT THIS STORE IS, IT'S A 7-ELEVEN FLAGSHIP STORE, IT'S. THEY ONLY HAVE A FEW OF THEM AROUND THE COUNTRY.

AND I THINK IN THE DFW AREA. SO THIS IS ONLY GOING TO GET WORSE AND WORSE JUST BECAUSE OF THIS FLAGSHIP STORE. YOU GOT THE RAINBOW TACO THEY HAVE. THEY SELL WINE AND FINE CHEESE, AND THEY DO EVERYTHING IN THOSE FLAGSHIP STORES, IT'S A LARGE SCALE STORE, BUT THE LUNCH CROWD, WHEN YOU THINK OF THINK OF CONVENIENCE STORES, YOU GOING TO THINK OF THEM AS LITTLE RESTAURANTS, RIGHT? THEY ARE DOING THAT AND EVERYBODY IS GETTING GAS TOO. AND THEY'VE GOT THESE LONG TRAILERS. SO IT'S I MEAN, WE HAD THE SAME DISCUSSION ABOUT 380 AND LASEMA AND WE TALKED ABOUT THE PARKING ISSUE AND, AND THIS PICTURE, AS YOU MENTIONED, THERE'S SIX TRUCKS, RIGHT THERE RIGHT NOW THAT ARE NOT IN A PARKING SPOT THAT ARE JUST ON THE ROAD, AND YOU CAN SEE THEM PARKED ALL THE WAY REALLY TO THE ENTRANCE OFF PRESTON THERE. RIGHT. YOU KNOW, AND IT'S JUST IT'S A REALLY I TRY TO AVOID THAT PLACE RIGHT NOW TO BE HONEST. IT'S JUST IT'S TOO CROWDED. SO IN THAT REGARD, LET ME ASK THIS QUESTION. AND WITHOUT BEATING THIS UP MORE, IF WE'RE GOING TO ADD THE EXTRA PARKING HERE, IS THERE A WAY TO REQUIRE TO MINIMIZE THE PARKING ALONG IN, IN NON PARKING SPACES AS THERE ARE AS SHOWN IN THIS PICTURE? I MEAN IS THERE

[00:30:02]

ARE WE GOING TO ARE WE STILL GOING TO HAVE THE SAME PROBLEM, THE SAME LOOK. BUT JUST ADD A PARKING SPACE AND A BIGGER PARKING LOT SOMEWHERE BUT STILL HAVE THAT. I MEAN HOW DO WE HOW DO WE CONTROL AT LEAST THE ALL SORTS OF THINGS, THE ESTHETICS, THE, THE TRAFFIC, ALL THE CONCERNS THAT WE HAVE HERE THAT WE HOPE THIS ALLEVIATES? HOW DO WE KNOW? HOW CAN WE MAKE SURE THAT IT ALLEVIATES THIS PART OF THE TRAFFIC FLOW? IF YOU WILL, IS REGULATED ALREADY BY WHETHER IT'S A FIRE LANE OR NOT. AND IF THEY'RE FIRE LANES, THEY'RE NOT SUPPOSED TO BE PARKED IN THEM.

PERIOD AND THAT'S PART OF WHAT THE ISSUE IS. AND EACH OF THESE FACILITIES, LIKE I'VE ONLY PICKED ON TWO, SO TO SPEAK, BUT THERE'S ACTUALLY SEVERAL, AND IT'S, IT'S VERY COMMON.

OBVIOUSLY IN THE SUMMER, THERE ARE A LOT OF PEOPLE IN THE LANDSCAPE BUSINESS, AND ALL OF THEM GENERALLY GET HUNGRY AND THIRSTY. AND SO YOU SEE THIS, THIS SIMILAR OCCURRENCE GOING ON IN A LOT OF DIFFERENT PLACES, I THINK, AND I THINK THE FOLKS AT 7-ELEVEN REALIZED THAT THIS ISN'T THE ONLY LOCATION WHERE THERE'S A 7-ELEVEN. JUST AS COMMISSIONER JACKSON SAID, THIS IS TO A CERTAIN EXTENT, IT IS A AN ATTEMPT ON THEM TO THIS, I THINK, IS GOING TO BE THE FIRST ONE EXACTLY LIKE THIS THAT THEY'VE DONE WITH THE EV CHARGING STATIONS AND THE OTHER THINGS. AND I THINK, YOU KNOW, THEY'RE PLANNING ON LEARNING A LITTLE BIT FROM THIS FOR WHEN THEY'RE BUILDING NEW FACILITIES, BUT ALSO WHEN THEY'RE DOING ADJUSTMENTS OR ADDITIONS TO EXISTING FACILITIES. AND I KNOW IT'S A LONG ANSWER TO YOUR QUESTION, BUT I THINK THERE'S A LOT OF DIFFERENT PIECES AT PLAY. WE'LL BE ABLE TO REGULATE, WHICH WE DID AS IT WAS GOING THROUGH THE SITE PLAN PROCESS. AND WE HAVE AN ELABORATED ON IT. BUT A LOT OF THE TURNS AND THE ANGLES AND THE RADII ON, ON SOME OF THE, THE RAISED AREAS, THE LANDSCAPE AREAS IS A LITTLE SUBTLY DIFFERENT THAN IT IS IN OTHER LOCATIONS TO ACCOMMODATE THE TRAILERS BEING ABLE TO ADJUST A LITTLE BETTER AND HAVING A BETTER TRAFFIC FLOW TO ALLOW NO PARKING TO BE IN THE FIRE LANES, WHICH FIRE MARSHAL CAN COME OUT AND WRITE TICKETS IF IT BECOMES A PROBLEM THAT PEOPLE ARE JUST BLOCKING THE FIRE LANES AND ALL THAT HAS HAPPENED IS WE'VE EXACERBATED THE PROBLEM AND MADE IT WORSE INSTEAD OF MAKING IT BETTER. WE HAVE NOT CHOSEN TO DO THAT RIGHT AWAY BECAUSE IT'S, YOU KNOW, THEY'RE TRYING NOT NOT SO MUCH 7-ELEVEN, BUT, YOU KNOW, THEY'RE TRYING TO REGULATE. AND AS YOU SAY, IT'S DIFFICULT TO GET IN WHEN THERE'S SO MANY PEOPLE AS AS, SHERIFF DANIEL WAS, WAS TALKING ABOUT IF YOU'VE BEEN TO ANY OF THESE PLACES DURING THESE SPECIFIC TIMES, THEY'RE BUSY. AND I YOU KNOW, YOU DON'T WANT TO FAULT SOMEBODY FOR BEING BUSY, BUT WE WANT TO DO WHAT WE CAN TO HELP THEM TRY AND ACCOMMODATE THAT, THAT TRAFFIC AND THE PATTERNS THAT THAT IT'S CAUSING. AND SO I THINK, I THINK THIS IS A PLUS. IT'S POSITIVE MOVEMENT. IS IT GOING TO SOLVE THE PROBLEM INSTANTLY AND MAKE IT BETTER? I CAN'T SAY THAT, YOU KNOW, I THINK WE HAVE TO TRY AND SEE HOW IT'S GOING TO GO, BUT I DO DEFINITELY THINK IT'S AN IMPROVEMENT FROM WHAT'S THERE. AND I THINK THAT'S, YOU KNOW, WHAT WE'RE HOPING TO ACCOMPLISH THAT MAYBE WE CAN USE AS A GUIDE, BECAUSE MOST ALL OF THE PLACES WITH THE FUEL AND THE CONVENIENCE STORE HAVE SPECIFIC USE PERMITS. AND WHAT WE LEARNED, WE CAN CARRY THAT FORWARD INTO FUTURE FACILITIES THAT THAT GO INTO PLAY. SO I THINK IT'S ALL POSITIVE, BUT I CAN'T TELL YOU IT'S GOING TO BE A PERFECT SOLUTION RIGHT OFF THE BAT. ANY OTHER COMMENTS OR QUESTIONS? ON 3/8 THIS EVENING? THANK YOU FOR THE REVIEW. I GUESS I'LL ENTERTAIN A MOTION ON ITEM THREE H. I'D LIKE TO MAKE A MOTION TO APPROVE AGENDA ITEM THREE H. WE HAVE A MOTION ON THE FLOOR FROM COMMISSIONER HAMILTON TO APPROVE. WE HAVE A SECOND. I'LL SECOND. SECOND.

I RESIDE IN THE GREENSPOINT SUBDIVISION AND HAVE BEEN A RESIDENT OF PROSPER SINCE 2007, I UNDERSTAND THAT YOU CAN'T ADDRESS MY CONCERNS TODAY, BUT I JUST WANT TO GET THEM OUT INTO THE INTO THE DISCUSSION, BECAUSE I'M VERY CONCERNED ABOUT CONSTRUCTION THAT'S GOING ON IN FIRST STREET AND COIN, AND MY BACKYARD. FROM DAY ONE, WHEN PRIOR TO EVEN PURCHASING MY HOME IN THE GREEN POINT SUBDIVISION, I CONTACTED THE CITY TO FIND OUT WHAT WAS GOING TO BE BUILT IN THE FUTURE IN THAT AREA. AND THEY TOLD ME RETAIL AND THEY LAID EVERYTHING OUT AND EVEN GAVE ME A PERSPECTIVE ON WHAT WAS GOING TO BE THERE. THEY ALSO THE OTHER THING THAT WORRIED ME ABOUT THAT AREA WAS THAT THE TOPOGRAPHY, BECAUSE IT'S MUCH HIGHER THAN WHAT MY PROPERTY IS. I SIT DOWN AND EVERY TIME IT WOULD RAIN, YOU COULD SEE THE FLOODING GOING ON THROUGH BEHIND MY BACKYARD. WELL, THEY ASSURED ME THAT THERE WAS NOT GOING TO BE ANY MAJOR CHANGES TO THE TOPOGRAPHY AT THE TIME. NOW, I REALIZE THIS IS 2007 WE'RE TALKING ABOUT, AND THINGS HAVE DRASTICALLY CHANGED SINCE THAT PERIOD. BUT MY CONCERN IS THAT, IN JULY, SOME SURVEYOR CAME TO MY HOME AND WAS KNOCKING ON THE DOOR. HE WANTS TO GET INTO MY BACKYARD, AND HE SAYS, WHERE HE SURVEYING THAT CORNER OF COIT AND FIRST STREET, BECAUSE IT'S GOING TO BE DIVIDED INTO THREE SEPARATE LOTS. YOU KNOW, THIS IS THE FIRST TIME I EVER HEARD ABOUT IT BEING DIVIDED INTO THREE SEPARATE LOTS. IT WAS JUST ALL ONE AT THE TIME. THEN ABOUT A MONTH LATER, ALL OF A SUDDEN I HEAR ALL THIS NOISE OUT IN THE BACKYARD AND I LOOKED OVER AT THE FENCE THERE, AND THERE'S TRUCKS JUST COMING AND COMING AND COMING IN AND DUMPING ALL SORTS OF DIRT. AND EVENTUALLY THAT DIRT GOT TO THE HEIGHT THAT IF YOU'RE STANDING ON THAT, YOU'RE WAY ABOVE MY FENCE LINE. AND I GOT AN EIGHT FOOT FENCE IN MY BACKYARD. AND HERE WE HAVE, YOU KNOW, YOU'RE STANDING ON THE LOT LOOKING RIGHT ON IN NOW, I DON'T I USUALLY STAY UP ON A LOT OF THE, AGENDAS AND THINGS WITH TOWN COUNCIL AND WITH THE PLANNING AND ZONING. BUT FOR SOME REASON, YOU KNOW, I'M GETTING OLDER HERE. I'VE KIND OF BEEN LAX ABOUT IT AND HAVEN'T BEEN REALLY FOLLOWING IT. WELL, IMMEDIATELY I GOT ON TO THE INTERNET AND I SAW THAT THIS WAS APPROVED, ON THE 6TH OF AUGUST, AND I WAS KIND OF SHOCKED THAT I'D MISSED IT. I WAS A LITTLE BIT EMBARRASSED WITH MY NEIGHBORS TO, BUT NOBODY HAS EVER COME OUT AND TALKED TO US ABOUT WHAT WAS GOING TO BE GOING THE CHANGES THAT WERE GOING TO BE TRANSPARENT AND EVERYTHING ELSE THERE. NOW, OVER THE YEARS, THERE'S BEEN NUMEROUS THINGS THAT THEY WERE GOING TO BE BUILDING THERE. THEY WERE GOING TO HAVE A RETIREMENT HOME AT ONE TIME, ANOTHER TIME THEY WERE TALKING ABOUT PUTTING TOWNHOMES IN THERE. AND AT LEAST SOMEBODY WOULD COME TO US AND TALK TO US BECAUSE IT'S RIGHT IN OUR BACKYARD. BUT HERE, THERE HAS NEVER BEEN ANYTHING NOBODY HAS EVER SAID A DARN THING ABOUT WHAT'S COMING. AND WHAT I'M REALLY CONCERNED ABOUT RIGHT NOW IS WHAT DO WE, MY NEIGHBORS AND MYSELF, HAVE? SO WHAT ARE WE GOING TO COMMENT? HAVE WE MISSED A COMMENT PERIOD WHERE WE CAN NEVER ADDRESS OUR CONCERNS HERE BECAUSE WE DO HAVE A LOT OF CONCERNS, ESPECIALLY THE WAY THE DIRT IS BEING LEVELED SO MUCH HIGHER THAN OUR HOMES WOULD BE SAFE. AND THEN ONE OF THE THINGS THAT IT SAYS THERE THAT THEY'RE TALKING ABOUT A TWO STORY, PROFESSIONAL AND MEDICAL BUILDING, WELL, IT'S ALREADY ABOVE OUR HOMES. AND WHAT'S THIS TWO STORY MEDICAL PROFESSIONAL BUILDING GOING TO BE LIKE? AND IT'S IT MIGHT AS WELL BE LIVING

[00:40:05]

IN A DOWNTOWN DALLAS OR SOMETHING. AND YOU START LOOKING AT THINGS LIKE THAT. SO I'M JUST CONCERNED AND WOULD LIKE TO SEE THAT MYSELF AND MY NEIGHBORS ARE GIVEN SOME KIND OF NOTIFICATION WHEN WE MAY COME IN COMMENT. AND SOME OF THE THINGS THAT ARE GOING ON THERE. I DO REALIZE THAT THIS IS A PRELIMINARY, BUT WHEN YOU'RE DROPPING ALL THAT DIRT LIKE THAT, TO ME THIS SEEMS LIKE IT'S FURTHER ALONG. ON PRELIMINARY. SO THAT'S THE MAIN THING I WOULD LIKE TO MAKE SURE THAT WE HAVE A CHANCE. AN OPPORTUNITY TO AT LEAST COMMENT. I MEAN, THERE'S A LOT OF PROS THAT WE DO HAVE ON A LOT OF TIMES WE HAVE ON IT, BUT WE WOULD LIKE TO AT LEAST GET OUR CONCERNS ADDRESSED. SO I WOULD APPRECIATE THAT IF THE COMMISSION WOULD CONSIDER MY REQUEST TO HAVE SOME KIND OF AGENDA ITEM IN THE FUTURE TO GIVE US THE OPPORTUNITY TO PLEASE COME OUT AND ADDRESS OUR CONCERNS. AND THAT'S ABOUT ALL I HAVE TO SAY, BUT I THANK YOU. I APPRECIATE YOUR COMMENTS, MR. GOLDMAN. THANK YOU FOR BEING HERE AND BEING INVOLVED IN THE COMMUNITY. I WOULD ENCOURAGE YOU TO GET SEVERAL MEMBERS OF THE TOWN PLANNING DEPARTMENT HERE.

I'VE HEARD YOU MAYBE AFTER THE CONCLUSION OF THE MEETING THIS EVENING, YOU AS A CITIZEN, YOU CAN REACH OUT AND EMAIL THESE FOLKS ANYTIME ABOUT ANY QUESTIONS ON ANYTHING THAT'S IN PROGRESS OR WILL BE DOWN THE ROAD. SO YOU ALWAYS HAVE THAT OPTION. ALL RIGHT. THANK YOU VERY MUCH. THANK YOU FOR YOUR TIME I APPRECIATE IT. THANK YOU. JUST MOVE TO OUR REGULAR AGENDA.

[4. Review actions taken by the Town Council and possibly direct Town Staff to schedule topic(s) for discussion at a future meeting.]

THIS EVENING. EVENING. ITEM NUMBER FOUR IS REVIEW ACTIONS TAKEN BY THE TOWN COUNCIL AND POSSIBLY DIRECT TOWN STAFF TO SCHEDULE TOPICS FOR DISCUSSION AT A FUTURE MEETING. ALL RIGHT, SO AT THE PREVIOUS TOWN COUNCIL MEETING ON THE 27TH, DIDN'T HAVE ANY CONSENT AGENDA ITEMS. THERE WAS A REGULAR AGENDA ITEM IS THAT MULTI-FAMILY ORDINANCE, WAS APPROVED FOR THE UPCOMING TOWN CHANGES ON THAT. DID THEY MAKE ANY MODIFICATIONS TO OR FOLLOW THE COMMENTS THAT WERE ADDED JUST FOR THAT? THEY THEY DID NOT ADD, ANY OTHER ITEMS? NO. AND THEY DID INCORPORATE COMMISSIONER PARSONS SUGGESTIONS. EVERYBODY THOUGHT THAT WAS A GOOD IDEA. YEAH WANT TO THAT ONE UP? YEAH RIGHT NOW IT WAS UNANIMOUS. THAT'S A COUPLE OF QUESTIONS. BUT NOTHING HAPPENED AT ALL LIKE IT WAS THE FIRST TIME. SO OKAY, UPCOMING ON THE 10TH, NEXT WEEK, THERE WILL BE THE NOTICE OF APPEALS FOR THE ITEMS, THE SITE PLANS AND PRELIMINARY SITE PLANS THAT YOU SAW TODAY, NOTHING ON THE REGULAR AGENDA FOR UPCOMING PRNS MEETING ON THE 17TH, SO YOU GUYS KNOW THERE WILL BE A JOINT WORK SESSION WITH TOWN COUNCIL? SCHEDULED TO BEGIN AT FIVE.

HOWEVER, WE WANTED TO HAVE A DISCUSSION WITH YOU GUYS ABOUT WHEN WE WANTED TO HAVE OUR ACTUAL MEETING BECAUSE IT DOES FALL ON A PACK MEETING DATE, IF YOU IF WE PLACE THE MEETING AT FIVE, AND HAVE THE JOINT WORK SESSION AFTER, DO YOU THINK THAT WE WILL HAVE ENOUGH PEOPLE TO HAVE A QUORUM FOR MEETING AT FIVE? SO ONE COMMENT IS, THE WAY IT LOOKS RIGHT NOW IS THAT THE REGULAR MEETINGS ARE GOING TO BE CONSENT ITEMS. YES. SO NO PUBLIC HEARINGS, NO PUBLIC. SO IT SHOULD BE A QUICK MEETING. OKAY AND DO WE NEED A WE DO ALWAYS HAVE TO HAVE A QUORUM FOR THE WORK SESSION. FOR THE REGULAR MEETING YOU'D HAVE TO HAVE THE REGULAR MEETING FIRST BECAUSE IT'S JUST CONSENT. AND THEN GO INTO THE WORK SESSION AFTER. SO THE QUESTION IS WHO CAN ALL BE HERE BY 5:00 FOR THE REGULAR MEETING? AND THE REASON IS BECAUSE IF WE DID IT AFTER, LET'S SAY THE JOINT WORK SESSION ENDS AT 630, BUT WE ON OUR AGENDAS, WE POSTED THAT THE Y'ALL'S MEETING WOULD BEGIN AT SEVEN. WE'D HAVE TO WAIT 30 MINUTES UNTIL SEVEN TO BEGIN THE MEETING. OR IF WE MISS THE TIME POSTED, WHAT WOULD HAPPEN THEN? WE'D HAVE TO. I THINK WE COULD JUST GO RIGHT INTO IT AFTER THAT. ARE YOU GOING TO HAVE TO TELL YOU YOU WOULDN'T IF WE SET IT AT 630, IT'S GOT TO START AND THEN IT STARTS. AND IF IT DOESN'T START 630 AND YOU'D HAVE TO START THE WORK SESSION. SO THAT'S WHAT YOU'RE SAYING YOUR MEETING AND THEN DO THE WORK SESSION AT THAT TIME. AND WE JUST DON'T KNOW HOW LONG THE WORK SESSION IS GOING TO RUN. WE DON'T KNOW. CAN'T ANTICIPATE HOW LONG THAT DISCUSSION IS GOING TO BE. SO I GUESS THAT'S THE QUESTION. WE CAN BE HERE ABOUT FIVE FOR A REGULAR MEETING ON THE 17TH. YEAH, WE GOT ONE, TWO TWO, THREE, FOUR. SO WE WE'LL PROBABLY HAVE A PROMISE. LET'S GO FOR THAT OKAY. A COUPLE OF US MAY BE HERE SLIGHTLY AFTER THAT, BUT WE'LL SEE WHAT HAPPENS. IT'S GOING TO GO ALL RIGHT, AND THEN FOR JUST UPCOMING ZONING CASES, LIKE I SAID, THERE WON'T BE ANY ZONING CASES ON THE 17TH, SO

[00:45:02]

THESE ARE ALL POTENTIALLY BE IN OCTOBER. NONE OF THESE HAVE BEEN NOTICED YET, BUT JUST ARE KIND OF CLOSE, THERE'S A PLANNED DEVELOPMENT AT THE NORTHWEST CORNER OF DAERR AND FIRST, FOR, FITNESS CENTER MEDICAL OFFICES, RETAIL, RESTAURANT, THOSE TYPE OF USES. I TOLD YOU GUYS ABOUT THIS UPCOMING ONE, THE TWIN CREEK SCREENING WALL, THEY PLACED A SCREEN WALL IN FRONT OF THE LANDSCAPING. SO THEY'RE HAVING TO AMEND THE PD TO GET THAT, THE NEXT ONE IS WHAT THE JOINT WORK SESSION WILL BE OVER FOR THE GATES OF PROSPER PD AMENDMENT, THAT WILL BE THE TOPIC OF DISCUSSION ON THE 17TH FOR THE WORK SESSION, AND THEN THERE IS A PLAN DEVELOPMENT FOR CREEKSIDE, I WILL JUMP BACK BECAUSE IT IS RIGHT NEXT TO THE LEGACY GARDENS AREA. SO IF YOU SEE THIS LITTLE L SHAPE THAT IS CREEKSIDE AND THEY ARE TRYING TO AMEND THE PD TO HAVE RETAIL UP HERE AT THE HARD CORNER AND THEN RESIDENTIAL LOTS HERE. BUT SO IT WILL BE RIGHT ADJACENT TO THE LEGACY GARDEN. SO THOSE ARE THE UPCOMING ZONING CASES THAT WE POTENTIALLY WILL HAVE IN OCTOBER. AGAIN, NONE OF THOSE HAVE BEEN NOTICED YET, BUT, THEY'RE CLOSE. SO JUST WANTED TO MAKE YOU GUYS AWARE OF THOSE. ALL RIGHT. THANKS FOR THE UPDATE. ANY QUESTIONS FOR TOWN STAFF. THANK YOU. SO I GUESS LET'S GO FOR 5:00, 5:00 REGULAR MEETING ON THE 17TH. ITEM NUMBER FIVE. I ENTERTAIN A MOTION TO ADJOURN. I MOVED TO LEAVE THAT AS A MOTION. COMMISSIONER JACKSON, WE HAVE A SECOND. SECOND. COMMISSIONER HARRIS. ALL THOSE IN FAVOR OF ADJOURNMENT? MOTION CARRIES 6 TO
