[CONSENT AGENDA]

ALRIGHT. THIS TIME WE'LL MOVE TO THE CONSENT AGENDA. ITEMS PLACED ON THE CONSENT AGENDA ARE CONSIDERED ROUTINE IN NATURE AND NONCONTROVERSIAL CONSENT AGENDA MAY BE ACTED UPON IN ONE MOTION.

ITEMS MAY BE REMOVED FROM THE CONSENT AGENDA BY THE REQUEST OF COUNCIL MEMBERS ARE STAFFED.

NONCONTROVERSIAL ROUTINE PLANNING AND ZONING ITEMS WHERE THERE WAS NO OPPOSITION AT THE PLANNING IS ONLY COMMISSION AND WERE UNANIMOUSLY APPROVED AND NO COMMENTS IN OPPOSITION HAVE BEEN RECEIVED BY THE TOWN COUNCIL PRIOR TO THIS MEETING ALSO MAY BE ACTED UPON DURING THIS PORTION OF THE MEETING. ANY PLANNING AND ZONING ITEM ON THE CONSENT AGENDA MAY BE REMOVED AT THE REQUEST OF COUNCIL MEMBERS. STAFF REMEMBER ANY MEMBER OF THE PUBLIC? IS THERE ANYONE WHO WOULD LIKE TO PULL AN ITEM FROM THE CONSENT AGENDA? 15. OKAY, ANYONE ELSE? ALRIGHT THEN I WOULD ENTERTAIN A MOTION TO APPROVE THE CONSENT AGENDA ITEMS FOUR THROUGH 14 AND 16 THROUGH 18 MOTION BY CHARLES COTTON. WELCOME BACK CRAIG ANDRES ALL IN FAVOR. THAT MOTION PASSES UNANIMOUSLY. THANK YOU. FOR ITEM 15 HEWLIN, WOULD YOU PLEASE STEP FORWARD? THANKS TO YOU ONE. SO

[15. Consider and act upon authorizing the Mayor to execute an Amendment to Ultimate Boundary Line Agreement between the City of McKinney, Texas, and the Town of Prosper, Texas, related to the maintenance of improvements along Christie Farms Boulevard in the City of McKinney to serve the Christie Farms development. (HW)]

ON ITEM 15. I KNOW IT'S AN AGREEMENT WITH THE CITY MCKINNEY AND TON OF PROSPER TO THE BOUNDARY LINE WITH THE UM, NEWLY CREATED ROAD BOUNDARY SHIFTED A LITTLE BIT ONLY CONCERN WAS THAT THE BOUNDARY SITS RIGHT ON KRISTY BARNES. AND UM, WITH THE AMOUNT OF SPACE THAT'S IN THE GREEN SPACE FROM THE PROSPER BOUNDARY TO CUSTER ROAD. I JUST WANT TO MAKE SURE THAT WE PRESERVE OR HAVE SOME WEIGHT IF WE'RE MAKING AN AGREEMENT WITH THE CITY OF MCKINNEY TO TRY TO GET SOME AGREEMENT WITH THEM THAT THAT STAYS A GREEN SPACE WHERE POSSIBLE, I WOULD HATE TO SEE CONVENIENCE STORE. WHATEVER PUT RIGHT ON THE BACK OF SOMEBODY ELSE'S HOME. SO, UM ALL RIGHT. SOMEBODY CAN INCORPORATE. WE'RE NOT MOVING THE BOUNDARY STAYING THERE ON THE WEST SIDE OF WHAT WAS THE CURRENT OR PREVIOUS ALIGNMENT OF CUSTOMER ROAD. WE'RE JUST TRYING TO GET TO THE ABILITY FOR CHRISTIE FARMS, TOO. A COUPLE THINGS TO MAINTAIN THAT TRACK, WHICH WILL WORK ON A SEPARATE AGREEMENT OF THAT, BUT WHEN THEY FIRST APPROACHES THEY WERE SINCE THEIR ENTRANCE WAS SO NOW SET FURTHER AWAY FROM CUSTER ROAD. DO THE REALIGNMENT. UH THEY COME TO US AND SAY, CAN WE PUT UP A STOP SIGN WITH THE STANDARD TOWN OF PROSPER NAMED BLAZES? YOU KNOW, STREETLIGHTS, THINGS LIKE THAT. SO THAT'S WHAT THAT AGREEMENT WILL ALLOW US THROUGH MCKINNEY, TOO. TO ACTUALLY ENCROACH INTO THEIR CITY LIMITS AND PUT, YOU KNOW TRAFFIC IMPROVEMENTS IN IN THAT IN THAT AREA THAT'S HIGHLIGHTED HERE. AS FAR AS THE PROPERTIES THAT ARE IN BETWEEN THERE. THE SOUTHERN TRACK THAT'S SOUTH OF THIS IS CURRENTLY IT'S ALL TEXT OUT RIGHT AWAY, SO WE DON'T KNOW WHAT TEXT ON IT'S GOING TO DO WITH THAT. UH IT'S NOT A LARGE TRACK, BUT WE DON'T HAVE CONTROL IF THEY DO. SELL THAT OFFER TO ANYONE THAT WOULD WANTIT. AS FAR AS THE KIND OF THE PURPLE AREA PROPERTY THERE TO THE NORTH. THAT'S OWNED BY THE. OKAY, SO.

[00:15:03]

YEAH THAT'S THE BROTHER HAGGARD FAMILY TRACK TO ACTUALLY DOES HAVE A RESIDENT THAT LIVES IN THE SUBDIVISION. SO I THINK, YOU KNOW WHATEVER THEY END UP DOING WITH THAT TRACTOR IN MCKINNEY.

I'M SURE THEY'LL HE'LL BE VERY MINDFUL OF HIS NEIGHBORS, BUT YEAH, WE HAVE LITTLE CONTROL. ON WHAT MCKINNEY MAY DO IN THAT AREA. YEAH I JUST HAD A CONCERN WITH IT BEING SO CLOSE AND WITH THE REALIGNMENT AS IT USED TO BE CUSTOM ROAD AND SO APPRECIATE YOU DRESSING UP. THAT I'M GOOD FROM HERE TO MAKE A MOTION COMMOTION APPROVED 15. WE HAVE A MOTION TO APPROVE AGENDA ITEM NUMBER 15. SECOND. MARCUS RAY SECOND BY CRAIG ANDERSON ALL IN FAVOR. THAT MOTION PASSES UNANIMOUSLY ALSO, THANK YOU VERY MUCH. THANKS, HEWLIN. ALRIGHT WE'RE GONNA NOW MOVE ON TO

[CITIZEN COMMENTS]

CITIZENS COMMENTS THE PUBLIC IS INVITED TO ADDRESS THE COUNCIL ON ANY TOPIC. HOWEVER THE COUNCIL IS UNABLE TO DISCUSS OR TAKE ACTION ON ANY TOPIC NOT LISTED ON THE AGENDA. IF YOUR COMMENTS PERTAIN TO A SPECIFIC AGENDA ITEM, PLEASE HOLD YOUR COMMENTS UNTIL THAT PARTICULAR ITEM. COMMENTS ARE LIMITED TO THREE MINUTES OR MULTIPLE INDIVIDUALS WHO WISH TO SPEAK ON A TOPIC THEY MAY YIELD THERE THREE MINUTES TO ONE INDIVIDUAL APPOINTED TO SPEAK ON THEIR BEHALF. ALL INDIVIDUALS YIELDING THEIR TIME MUST BE PRESENT AT THE MEETING AND THE APPOINTED INDIVIDUAL BE LIMITED TO A TOTAL OF 15 MINUTES. I DO HAVE SEVERAL SPEAKERS TO ADDRESS THE COUNCIL THIS EVENING. THE FIRST ONE THAT I HAVE HERE IS IVANKA HARARE. PLEASE PLEASE JUST STEP FORWARD AND JUST STATE YOUR NAME AND ADDRESS FOR EVERYONE. THANK YOU. UM I WOULD ACTUALLY LIKE TO, UM , GIVE MY MINUTES TO MY NEIGHBOR, LAURA. SHE HAS A PRESENTATION FOR YOU GUYS. AND IT WILL GIVE HER TIME TO ACTUALLY THANK YOU VERY MUCH. ELABORATE ON THE SUBJECT. WE'LL GIVE THAT TIME TO HER. ASHLEY MCDORMAN. ACTUALLY. ARE YOU HERE? OKAY. I WILL READ ASHLEY'S COMMENTS. HE HAS SAYS. I'M A RESIDENT OF WINSTON RANCH, AND I'M WRITING SUPPORT OF MY NEIGHBORS WHO ARE ATTENDING THE TOWN COUNCIL MEETING. WITH THE FUTURE WIDENING OF THE ROAD THAT HAS PLANNED THE RESIDENTS IN THE CROSS WATER SECTION OF THE COMMUNITY WILL CONTINUE TO FEATURE CHALLENGES AND DANGER. WHEN ENTERING AND EXITING ROADWAYS FOR SAFETY PURPOSES. A STOPLIGHT NEEDS TO BE PLACED AT GE IN NICOSIA. ONE OF THE REASONS PEOPLE MOVED TO THE TOWN OF PROSPEROUS FOR ITS SMALL TOWN FIELD WITHIN OUR COMMUNITY OF WINDSONG RANCH. THE SCHOOLS ARE WALKABLE AND BIKE KABLE. WE HAVE SEASONAL EVENTS LIKE THE STAR SPANGLED BASHED THE WINE AND MUSIC FEST AND THE SLIDING OUT OF SUMMER EVENT. IT IS NOT UNCOMMON TO SEE THE COMMUNITY RIDING GOLF CARTS AND BIKES OR DRAGGING WAGONS FULL OF CHILDREN TO THESE FAMILY FRIENDLY EVENTS.

HOWEVER BECAUSE OF THE DANGEROUS ROAD CONDITIONS ARE NEIGHBORS ACROSS WATER DO NOT HAVE SAFE ACCESS TO THE COMMUNITY AMENITIES. THE SHIFT TO A SIX LANE ROADWAY WILL MAKE COMMUTING BY CAR IMPOSSIBLE. PLEASE CONSIDER A STOPLIGHT TO KEEP PROSPER RESIDENTS SAFE. THE NEXT SPEAKER IS JAMES RUSSELL. I'M ALSO A RESIDENT OF WINDSOR UNCROSS WATER FOR MY TIME TO LAURA. THANK YOU. THANK YOU. LAST NAME CO. HELLO? HOW. ALSO A RESIDENT. WINDSONG. RANTS AND ALSO YIELD MY TIME TOMORROW. THANK YOU. BRANDON BOGUE. GOOD EVENING. MY NAME IS BRANDON BOAKYE LIVIN WINDSONG RANCH. MY FAMILY AND I RELOCATED HERE IN APRIL OF 2017 FROM THE KANSAS CITY MARKET. SO JUST AS A QUICK MOMENT OF LEVITY BEFORE SOME MORE SERIOUS COMMENTS. KANSAS CITY BARBECUE TEXAS BARBECUE. I'D LIKE TO VOLUNTEER TO BE THE SOCIAL CHAIRMAN FOR FUTURE TOWN OF PROSPER BARBECUE COMPETITION , SO LIKE THE TOWN TO TAKE THAT UNDER CONSIDERATION AND NOTE THAT IN THE RECORD, PLEASE I COULD HAVE MOVED ANYWHERE IN THE SOUTH ACROSS FIVE OR SIX STATES FOR THE JOB THAT I TOOK INTERNALLY WITH MY COMPANY, WHICH OWNS TEXAS. WE CHOSE DFW.

WE ENDED UP IN PROSPER. I NEEDED A 35 MINUTE COMMUTE TO LOVE FIELD FOR BUSINESS TRAVEL, AND WE HAD NEVER HEARD OF PROSPER TEXAS. THE TIME TO MAYBE BUILD OR BUY A HOUSE IN FRISCO HIT SAILED, I THINK IN 2016 2017, AND WE LOVE IT HERE OF LOVE PROSPER. IT'S BEEN GREAT. BUT I'M A SALES GUY AND A CAPITALIST AT HEART. BUT WHAT I DON'T LOVE IS GROWTH AT ALL. COSTS WERE UNPLANNED, POORLY EXECUTED GROWTH. ECONOMIC DEVELOPMENT CAN BE MESSY. OVERDEVELOPMENT LEADS TO UNNAVIGABLE AND DANGEROUS ROADS. DO WE REALLY WANT TO SEE GP LUPE'S NAIL SALONS IN CHIPOTLE'S ON EVERY MAJOR THOROUGHFARE THROUGHOUT PROSPER? SO I THINK JUST BECAUSE WE CAN DOESN'T MEAN WE SHOULD AND SO I WOULD ENCOURAGE THE TOWN IN THE APPROPRIATE ECONOMIC DEVELOPMENT

[00:20:02]

STAKEHOLDERS TO REALLY THINK THROUGH SO MANY THINGS. THERE'S A LOT OF BLAME AND GRAY AREAS THAT GO AROUND WITH 3 80 MESS. N G ROAD, AND AS I SAID, ECONOMIC DEVELOPMENT CAN BE MESSY AS WE ALL KNOW. BUT WHAT I CAN TELL YOU LIVING IN WINDSONG THE LAST 6.5 YEARS. AND THREE HOUSES DOWN FROM THE ROAD IN THAT ACACIA INTERSECTION. WE BACK UP THE ROAD. FOR THE LAST 6.5 YEARS. AT SOME POINT, THERE'S GOING TO BE A FATALITY. SAME THING WITH 3 80 THAT G 4 23 ENTRANCE IN FRONT OF KROGER. BETWEEN MAUDE AND FUZZIES. IF YOU'RE FAMILIAR WITH THAT SIDE OF PROSPER I MEAN, IT'S A IT'S A IT'S A MESS THERE. IT'S REALLY BAD. SO CITY COUNTY STATE. PRIVATE DEVELOPERS SHOULD NEVER PLANNED OR ALLOWED FISH TRAP AND ZERO TO FLOW WEST AT 13 85. THAT'S JUST THAT'S JUST THE FACT THAT THE GROWTH IN HOME SITES THAT DIRECTION THAT FLOWS SOUTH IN TERMS OF TRAFFIC UP THE ROAD FOR 3 80 ACCESS IS NOT SUSTAINABLE. THAT BRIDGE SHOULD NEVER HAVE BEEN BUILT. BUT SINCE THAT SHIP HAS SAILED, THIS GOVERNING BODY NEEDS TO TURN ITS ATTENTION TO WHAT IT CAN CONTROL. AND WHAT ACTION IT CAN TAKE AT GE NICOSIA AND GN 4 23. SO THE TOWN WITH RESPECT TO ECONOMIC DEVELOPMENT NEEDS TO ASK THAT QUESTION. SHOULD WE NOT JUST CAN WE AND I THINK WE SHOULD AND WE CAN PUT A PERMANENT CROSSWALK. FOR ALL RESIDENTS AND THE PEOPLE PASSING THROUGH. I MEAN, WE SEE THE ACCIDENTS ALL THE TIME WHERE I LIVE. SO MR MAYOR IS A RETIRED AIR FORCE PILOT. GRADUATE OF THE AIR FORCE ACADEMY. YOU KNOW, DOUBT ARE ACQUAINTED WITH THE LEGENDARY COLONEL BOYD. AND THE PRINCIPLES OF THE BOYD LOOP AS A VETERAN MYSELF FROM THE MARINE CORPS. AND THE SALES GUY. WE'RE CONSTANTLY CHALLENGED TO USE THE PRINCIPLES OF O D A IN BUSINESS.

DISCOVERING BODY NEEDS TO TAKE ACTION. FOR 6.5 YEARS. I RIDE BIKES WITH KIDS. I WALK THE DOG.

THE ROAD IS UNSAFE EDUCATION. AND SO IT IS AT THAT ENTRANCE TO THAT. THAT FUZZY AND MODS BY KROGER. THANK YOU FOR ATTEMPTING TO PUT IN THAT PARCEL CROSSWALK. IT'S NOT GONE FAR ENOUGH IS THE BOTTOM LINE. IT DOESN'T WORK. IT'S JUST IT'S JUST NOT ENOUGH SALT WRAP UP AND JUST SAY IT'S ONLY A MATTER OF TIME UNTIL SOMEONE GETS SPLATTERED ALL OVER THE ROAD. I'D LIKE TO INVITE THE MAYOR AND THE COUNCIL TO MY HOUSE ANYTIME OF DAY DURING BUSINESS HOURS OR AFTER HOURS TO OBSERVE THE MESS. YOU'RE ALWAYS WELCOME FOR A CUP OF COFFEE. I SEE AND HEAR THE ROAD RAGE WHEN WORKING FROM THE HOME OFFICE WHEN I'M NOT TRAVELING WE I MEAN , WE JUST WE CAN SEE IT HERE. WE HEAR THE WRECKS 15 MINUTES LATER AT 32ND CONVERSATION WITH THE POLICE PRIOR TO THIS TOWN HALL MEETING. THEY CONFIRMED ITS TWO X THEIR RESPONSE TIME. IN CROSS WATER AT THAT INTERSECTION TWO X 15 MINUTES TO GET THERE FROM ANYWHERE ELSE IN PROSPER. THAT'S A 32ND CONVERSATION IN THE HALLWAY. SO AGAIN, I RECENTLY PUT IN A PUBLIC REQUEST FORM TO REQUEST SOME STATISTICS ON DATA.

SORRY THREE MINUTES. TIME IS UP. YEAH THANKS. GIVE YOU SOME EXTRA TIME TO TAKE ACTION. THANK YOU VERY FAMILIAR WITH THE OUTER LOOP. SO I KNEW YOU WERE. THANK YOU. THE NEXT SPEAKER IS AH! IT'S GOING TO BE GABRIEL FATTEN AND GO AHEAD. THE YIELD MY TIME FOR LAURA, PLEASE. THANK YOU.

OKAY? AT THIS TIME. OUR NEXT SPEAKER IS LAURA RABAH. AND LAURA, YOU HAVE A TOTAL OF 15 MINUTES BECAUSE YOUR NEIGHBORS HAVE YIELDED ALL THEIR TIME TO YOU. THANK YOU AND LAURA DOES HAVE A PRESENTATION FOR THE COUNCIL. THANK YOU FOR YOUR TIME TODAY. MY NAME IS LAURA RABAH. I AM HERE ON BEHALF OF THE CROSS WATER SECTION OF WINDSONG RANCH. MICHAEL YES. THANK YOU TO DISCUSS THE G ROAD IN NICOSIA PARKWAY CROSSING. FIRST A BACKGROUND THERE ARE OVER 100 HOMES IN THE CROSS WATER SECTION OF WINDSONG RANCH TOTALING ABOUT 4 TO 500 INDIVIDUAL RESIDENTS.

CROSSING THE INTERSECTION OF GN ACACIA IS THE ONLY WAY FOR US AND CROSS WATER TO GET TO OUR NEIGHBORHOOD SCHOOLS, THE WINDSONG AMENITIES WE DO PAY AN H O A P FOUR OR TO ANYTHING OUTSIDE OF OUR SECTION OF HOMES. IT'S ALSO THE WAY THE MAIN SECTION OF WINDSONG WOULD LIKE TO ACCESS G AND 4 23, BUT THEY ACTIVELY AVOIDED AT THIS TIME. ENTERING AND EXITING IS CURRENTLY EXTREMELY UNSAFE, WHETHER IN A CAR GOLF CART BIKE OR ON FOOT. AND WE ALL KNOW THIS IS DUE TO INCREASED TRAFFIC OVER THE YEARS. THE CURVE OF THE ROAD HIGH SPEEDS WHICH THE SPEED LIMIT BEING 45 MILES AN HOUR, THOUGH MANY CARS ARE GOING FASTER. TODAY IS UNFORTUNATE, DISTRACTED DRIVING HABITS AND TWO DRIVERS, BUT LEE IGNORING CROSSWALK MARKINGS. IN RECENT MONTHS WE'VE ENGAGED WITH MAYOR BRISTOL THE PROSPER POLICE PROSPER ENGINEERING, THE

[00:25:02]

WINDSONG H O AND TELUS GROUP TO FIND A SOLUTION BEFORE G OPENS TO FOUR LANES THIS SPRING AND EVENTUALLY SIX LANES BY 2026. OUR GOAL IS A FOUR WAY TRAFFIC LIGHT. BEFORE WE TRAFFIC LIGHT IS THE ONLY SOLUTION THAT PROVIDES A SAFE METHOD OF CROSSING FOR PEDESTRIANS, BIKES, GOLF CARTS AND VEHICLES. WHILE THE HAWK SIGNAL PRESENTED AT THE WINDSONG MEETING LAST WEEK MIGHT HAVE SOME IMPACT SHORT TERM. IT'S NOT A LONG TERM SOLUTION WHEN SHE IS SIX LANES, AND IT DOES NOTHING TO HELP VEHICLE ACCIDENTS AT THIS INTERSECTION. IN FACT, MY FEAR IS THAT IT WILL MAKE PEDESTRIANS FEEL MORE COMFORTABLE WHILE CARS ARE STILL BLOWING PAST IT. PEOPLE ARE NOT SUPER FAMILIAR WITH THAT, AND THERE'S DEFINITELY SITES OF, YOU KNOW, PEOPLE JUST NOT UNDERSTANDING AND IT CREATING MORE HAZARD THAN IT SAVES. IT DOES SEEM LIKE A GREAT IDEA, BUT NOT FOR THIS INTERSECTION. A LOWER SPEED LIMIT WOULD ALSO BE BENEFICIAL. WE USED TO HAVE A SCHOOL ZONE IN THAT SECTION AND A CROSSING GUARD AND BOTH WERE TAKEN AWAY DURING COVID. YOU CAN SEE HERE. THE CURVE OF THE ROAD FACING WEST, THE CAR CIRCLED IN BLUE IS BLIND TO ONCOMING TRAFFIC GOING SOUTHBOUND ENERGY. YOU HAVE TO START OUT, HOPING THAT THERE IS A BREAK IN TRAFFIC WHILE THE PERSON TO THE LEFT OF YOU BASICALLY FLAGS YOU THROUGH, AND CARS ARE GOING 45 MILES AN HOUR OR MORE AROUND THE BEND. THE RIGHT PICTURE IS THE VIEW FROM MY CAR. THIS WOULD BE THE VEHICLE CIRCLED IN BLUE FACING WEST AND ACACIA. THIS IS ME TRYING TO GET HOME FROM THE POOL AT 6 41 PM AND AN EVENING IN JULY WITH MY THREE KIDS IN THE CAR. SO TONIGHT. I HAVE THREE QUESTIONS FOR YOU. HOW WHO AND WHAT? HOW. BASED ON A TRAFFIC STUDY IN MAY OF 2022, THE INTERSECTION DID NOT MEET THE CRITERIA FOR A STOPLIGHT. HOW IS THAT POSSIBLE? ANYONE WHO STOOD AT THE INTERSECTION INCLUDING MAYOR BRISTOL AND HIS WIFE LAST WEEKEND AGREE THAT IT'S DANGEROUS TO CROSS STANDING IN THE SAME SPOT WITH THE MAYOR, PROSPER ENGINEERING AND 30, PLUS CROSS WATER RESIDENTS ON THAT MEETING ON SATURDAY, SEPTEMBER 16TH CARS CONTINUE TO FLY PAST US NOT STOPPING FOR PEDESTRIANS TO CROSS SAFELY TO GET TO THAT MEETING, EVEN WITH A LARGE GROUP GATHERED THIS IS A VIDEO OF MY FAMILY WALKING HOME FROM GETTING COFFEE AT THE COMMONS AND SATURDAY MORNING WHEN TRAFFIC IS AS LIGHT AS IT GETS. MY FIVE YEAR OLD SON PUSHES THE CROSSWALK SIGNAL AND WE STILL HAVE TO PLAY FROGGER TO CROSS. IT'S ALSO SAD THAT IT'S TEACHING OUR KIDS THAT CARS DON'T RESPECT PEDESTRIANS, AND ULTIMATELY, WE'RE DRIVING EVERYWHERE WHEN WE'RE LIVING IN WINDSONG AND WANT TO BE ACTIVE IN THE COMMUNITY. THE TRAFFIC STUDY CITED THREE CRASHES SINCE 2019 3 IT ALSO REFERENCES THE SCHOOL CROSSWALK, WHICH WAS TAKEN AWAY AND IS ANYTHING BUT EFFECTIVE AS YOU JUST SAW IN THE VIDEO. THE EXAMPLES HERE MAKE YOU WONDER IF THAT PORTION OF THE TRAFFIC STUDY COULD BE INCORRECT. WHAT ELSE IS INCORRECT IN THE STUDY? AND WE ARE BEHOLDEN TO THIS TRAFFIC STUDY AS THE REASON FOR NO LIGHT. SO THERE'S. UM THE VIEW OF WHAT THE TRAFFIC STUDY SAID, AND HERE ARE EXAMPLES OF ACCIDENTS ON G. THERE'S MORE. SO A NEW QUESTION ONE. WHEN WILL SOMETHING CHANGE? AND WHEN IS ENOUGH ENOUGH? THESE ARE 17 EXAMPLES I PULLED FROM SIMPLE SEARCHES OF THE WORD ACCIDENT OR CRASH ON G. THESE ARE 17 PEOPLE WHO WENT OUT OF THEIR WAY TO POST ON A FACEBOOK GROUP. THERE ARE LIKELY MANY MORE. THE TRAFFIC STUDY SITES. THREE ACCIDENTS SINCE 2019 AND THE TRAFFIC STUDY IS THE REASON WE DON'T HAVE A LIGHT. THE NEXT TWO TO WHO IS BENEFITING FROM NOT HAVING A STOPLIGHT HERE. WE ALL SEEM IN AGREEMENT. WHO OWNS AND MAINTAINS G ROAD, WHO HAS ULTIMATE RESPONSIBILITY FOR WHAT HAPPENS ON THIS ROAD. WE FEEL YOU'RE SUBSIDIZING AUBREY'S GROWTH WHILE PAYING PROSPER PROPERTY TAXES. IT'S THE MAIN THOROUGHFARE TO THE ROBUST EXPANSION OF THEIR ARE WE PRIORITIZING FINANCES OVER LIFE SAFETY TODAY IT WAS ANNOUNCED. THERE'S GOING TO BE A $94 MILLION FOOTBALL STADIUM FOR THE WINDSONG RESIDENTS, BUT WE CAN'T GET A LIGHT TO GET TO THAT STADIUM. IT'S CLEAR WHO WAS PAYING THE PRICE AND THE RESIDENTS OF CROSS WATER AND ALL OF WINDSONG, REALLY, WHICH ULTIMATELY INCLUDES HUNDREDS OF PROSPEROUS KIDS. SO THE ONLY THING LEFT TO ASK IS WHAT WHAT WILL HAVE TO HAPPEN TO MAKE A CHANGE. THE SECOND MOST RECENT ACCIDENT A COUPLE OF WEEKS AGO ON SEPTEMBER 13TH WAS THE SCARIEST THE NEXT ACCIDENT COULD BE A CHILD AND A BIKE JUST WANTING TO RIDE TO SCHOOL, LIKE THEIR FRIENDS AND THE REST OF THE NEIGHBORHOOD. GET TO DO. YOUR FAMILY ON A GOLF CART COMING HOME FROM ENJOYING THE WINDSONG LAGOON. IT COULD BE MY FAMILY OR ANOTHER COST WATER FAMILIES. AND THE REASON I'M UP HERE TODAY IS MAINLY BECAUSE MY FEAR OF MY KIDS GETTING HIT BY A CAR IS OUTWEIGHING MY FEAR OF PUBLIC SPEAKING RIGHT NOW, AND I NEED TO PREVENT MY FAMILY FROM BECOMING ONE OF THESE PICTURES.

[00:30:01]

WE LIVE IT EVERY DAY. WE VOCALIZED. WE WERE SCARED AND NOTHING HAS BEEN DONE TO MAKE US FEEL MORE COMFORTABLE. WE'RE READY TO GO TO ANY LENGTHS OF LOCAL OR TEXAS STATE GOVERNMENT TO MAKE A CHANGE. WE CAN'T KEEP RELYING ON A TRAFFIC STUDY THAT CLEARLY IS NOT CAPTURING THE REALITY OF LIVING IN THIS CHAOS. SO BACK TO THE THREE NOW. FOUR QUESTIONS. HOW HOW ARE WE GOING TO DO THIS? WE ARE NOT GOING TO RELY ON SOLELY AND OUTDATED AND POSSIBLY INCORRECT TRAFFIC STUDY TO MAKE DECISIONS REGARDING LIFE SAFETY WHO IS GOING TO DO THIS? IT'S GOING TO BE US PARTNERED WITH YOU TOWN COUNCIL AND THE RESIDENTS OF CROSS WATER AND ALL OF ONE SONG. WHAT THE SOLUTION IS A FOUR WAY TRAFFIC LIGHT. AND ONE. THE TIME IS NOW. TODAY I'M ASKING FOR A COMMITMENT TO RECONSIDER SEPARATE FROM JUST A TRAFFIC STUDY BASED ON THE EVIDENCE PROVIDED THIS EVENING, INSTALLING A FOUR WAY TRAFFIC LIGHT BEFORE THE FOUR LANES OF G OPEN. WE CAN'T WAIT FOR ANOTHER TRAFFIC STUDY TO BE COMPLETED IN SPRING OF 2024. SOMETHING TRAGIC CAN HAPPEN BEFORE THEN. THANK YOU. THANK YOU, LAURA. SO LAURA , AS YOU KNOW, AND CITIZENS, AS YOU KNOW, THE COUNCIL CANNOT COMMENT ON REMARKS BACK ON THAT, BUT I'D LIKE TO ASK OUR TOWN MANAGER TO JUST CITE A FEW ITEMS THAT MAY HAVE TAKEN PLACE. UH, AS A RESULT OF THIS. SURE, THANK YOU, MAYOR. MEMBERS OF COUNCIL MEMBERS OF THE COMMUNITY THANKS FOR YOUR COMMENTS, AS MAYOR MENTIONED COMMENTS CAN BE MADE BECAUSE IT'S NOT ON THE AGENDA. BUT JUST UM MR ROBERT, YOU MENTIONED THAT THE MAYOR MEANT WITH YOU ALL MANY OF YOUR RESIDENTS A COUPLE OF WEEKS AGO. THERE'S BEEN A LOT OF ACTIVITY.

UH, JUST IN RECENT RECENT DAYS FROM OUR STAFF, POLICE DEPARTMENT HAS INSTALLED THE TWO SPEED TRAILERS AGAIN JUST TO KNOW PEOPLE SPEEDS. IT'S ALSO COLLECTING DATA. UH OUR ENGINEERING PUBLIC WORKS DEPARTMENT HAVE GONE OUT THERE AND RE STRIVED THE CROSSWALK JUST AGAIN BECAUSE IT FADED OR WORN OUT. AND SO IT'S BEEN COMPLETED AS OF YESTERDAY. THAT THE FLASHERS THAT WERE INOPERABLE HAVE BEEN REPAIRED. AND SO THEY'RE OPERATING AGAIN.

AND SO I KNOW THAT YOU'VE BEEN IN COMMUNICATIONS WITH HUMAN WEB OR COUNTY ENGINEER. UH, BUT I DO HAVE MY POLICE CHIEF HERE. HUMAN WEBS HERE AS WELL. WE CERTAINLY WANT TO EXCHANGE BUSINESS CARDS FOR YOU AND YOUR FOLKS AND BE HAPPY TO CONTINUE WORKING WITH YOU. JUST LIKE YOU MENTIONED.

IT'S WORKING TOGETHER, AND SO WE WANT TO CONTINUE WORKING THROUGH THAT. I CAN'T MAKE ASSURANCES AND I DON'T THINK THE COUNCIL CAN BE THERE ABOUT WE'RE GOING TO INSTALL THE TRAPS TOMORROW.

IT'S JUST NOT POSSIBLE, BUT WE WANT TO WORK WITH WITH WITH THE RESIDENTS AND ALSO WORK WITH HOMEOWNERS ASSOCIATION. THEY'VE BEEN IN CONTACT WITH THE H O A AS WELL TO LOOK AT SIGHTLINES AND DOING SOME SOME TRIMMING BACK OF LANDSCAPE. AND SO IT'S COLLECTIVELY GOING THROUGH MULTIPLE NUMBERS OF SOLUTIONS THAT WE WOULD LIKE TO DO THAT AND SO CONTINUE WORKING WITH YOU. TO MAKE SURE IT IS SAFE. THAT'S THIS IS I CAN ASSURE YOU FROM COMMUNICATING WITH MY POLICE DEPARTMENT AND MY TOWN ENGINEERING STAFF. THIS IS NOT A BACKBURNER ISSUE. IT'S FRONT OF MINE WERE VERY CONCERNED ABOUT THAT. THERE IS A LOT OF TRAFFIC THROUGH THERE. AND SO WE WANT TO CONTINUE WORKING THROUGH THAT. SO HUMANS HERE WITH HIS BUSINESS CARDS. CHIEF WALKS IS HERE WITH HIS BUSINESS CARDS AND SO LOVE TO CONTINUE WORKING WITH YOU AND OTHERS FACE TO FACE, PREFERABLY BECAUSE A LOT OF CAN GET LOST IN TRANSLATION TO BE EMAILS AND PHONE CALLS. SO IF WE CAN WORK TOGETHER IN PERSON, THAT'D BE FANTASTIC. I'VE GOT TO SAY THANK YOU. WAS THERE ANYONE ELSE WHO WANTED TO SPEAK DURING CITIZENS COMMENTS? ALRIGHT IN THAT CASE, WE'LL NOW MOVE TO OUR REGULAR AGENDA AND THE REGULAR GENDERS PURSUANT TO SECTION 551.007 OF THE TEXAS GOVERNMENT CODE, INDIVIDUALS WISHING TO ADDRESS THE COUNCIL FOR ITEMS LISTED AS PUBLIC HEARINGS WILL BE

[19. Conduct a public hearing and consider and act upon a request to rezone 0.2± acres from Single Family-15 (SF-15) to Downtown Retail (DTR), for Mitchell Addition, Block 3, Lot 3D, located on the southwest corner of West Seventh Street and North Coleman Road. (ZONE-23-0016) (DH)]

RECOGNIZED WHEN THE PUBLIC HEARING IS OPEN AGENDA ITEM NUMBER. 19 IS TO CONDUCT A PUBLIC HEARING AND CONSIDER AND ACT UPON A REQUEST TO REZONE 0.2 ACRES FROM SINGLE FAMILY 15 TO DOWNTOWN RETAIL. FOR MITCHELL EDITION BLOCK THREE LOT THREE D, LOCATED IN THE SOUTHWEST CORNER OF WEST SEVENTH STREET AND NORTH COLEMAN ROAD, MISTER DAVID HOOVER. THANK YOU. MAYOR COUNCIL. OKAY HAS MENTIONED THIS PROPERTY IS THAT THE CORNER OF SEVENTH AND COLEMAN YOU MAY REMEMBER IT FROM GOING BY THERE. IT'S THE TRAILER. THAT IS CURRENTLY IN EXISTENCE RIGHT NOW , WHICH WILL BE MOVED AS THIS PROCESS GOES FORWARD, HOPEFULLY . THEY'RE REZONING REQUEST IS AS I MENTIONED IS TO DEMOLISH THE MOBILE HOME THAT THERE THE REQUEST IS TO GO TO DOWNTOWN RETAIL BECAUSE THE DOWNTOWN EXCUSE ME. RETAIL OFFERS THE OPPORTUNITY FOR OFFICE, WHEREAS THE DOWNTOWN OFFICE DOES NOT EXCUSE ME, AND THE APPLICANT IS LOOKING TO POSSIBLY HAVE A MIX

[00:35:06]

OF THE OFFICE AND RETAIL. THE ONE THING THEY KNOW THEY WANT FOR SURE IS ICE CREAM SHOP AND THAT WAS A HIT AT THE PLANNING AND ZONING COMMISSION. THE SPACE ITSELF DOES NOT ALLOW FOR VERY LARGE BUILDING. IT WILL BE ONE STORY SOMEWHERE AROUND 6000 SQUARE FEET AND WITHOUT THE PARKING THAT'S ADDED INTO IT. IT IS FAIRLY LIMITED AS TO WORK AND GO THERE. SURROUNDING AREA IS A LITTLE BIT OF A MIX OF THE RESIDENTIAL. MAYBE I SHOULD TAKE A STEP BACK THE DOWNTOWN MASTER PLAN REALLY HAS FOUR SUBSETS TO IT. THAT WAS DONE A WHILE BACK YEAR AND A HALF AGO ISH. YOU KNOW, AND THE COMPREHENSIVE PLAN HAS IT AS DOWNTOWN DISTRICT AND THEN THERE'S FOUR SUB DISTRICTS THAT ARE WITHIN THAT AREA. ONE IS DOWNTOWN OFFICE. ONE IS DOWNTOWN RETAIL. ONE IS DOWNTOWN RESIDENTIAL AND THE FOURTH IS DOWNTOWN COMMERCIAL. YEAH AND THE SURROUNDING PROPERTIES OR A MIX PRIMARILY OF THE OLD RESIDENTIAL CATEGORY AS AS WELL AS DOWNTOWN RETAIL. EXCUSE ME.

BUT, UM. BE PLANNING AND ZONING COMMISSION HEARD THIS CASE AND RECOMMENDED APPROVAL UNANIMOUSLY . THERE WERE I BELIEVE SOME SOME QUESTIONS THAT HAD COME UP THAT WILL BE HAPPY TO ANSWER. I MEAN, TRYING TO REMEMBER A COUPLE OF THEM JUST TO GIVE YOU A FEEL FOR WHAT'S GOING ON HERE. BEING.

DOWNTOWN DISTRICT WITH THE SUB DISTRICTS, THE FOUR SUBDISTRICTS ACTUALLY HAVE A SET OF ARCHITECTURAL STANDARDS AND GUIDELINES THAT GO WITH EACH OF THE FOUR SUB DISTRICTS. BY DOING A REGULAR ZONING. THERE'S NOT A PROVISION THAT THAT FORCES DEVELOPMENT AGREEMENT, BUT THE APPLICANT WANTS TO DO THAT. AND WHAT THE PRIMARY PURPOSE OF THAT WOULD BE IS TO MAKE SURE THAT THE ARCHITECTURAL STANDARDS THAT ARE WITHIN THE DISTRICT SUBDISTRICT ARE MAINTAINED AS WELL AS LIMITING. THERE'S A LIST OF PROBABLY 40 SOME ODD USES THAT COULD ACTUALLY GO AT THIS LOCATION AND PROPOSAL IS TO LIMIT THAT DOWN TO ABOUT FIVE OR SIX, WHICH IS PRIMARILY OFFICE RETAIL. AND THINGS THAT ARE SIMILAR ART GALLERIES AND A FEW THINGS LIKE THAT, AND SO IT WILL REMOVE. UM THE THINGS THAT NUMBER ONE PROBABLY WOULDN'T FIT , BUT NUMBER TWO ARE PROBABLY NOT GOING TO BE DESIRABLE IN THE LOCATION. AND SO STAFF BELIEVES THAT THAT THAT COMBINATION OF THE DEVELOPMENT AGREEMENT AND THE ZONING AND THE ARCHITECTURAL STANDARDS THAT ARE THERE WOULD MAKE FOR A GOOD CHANGE, ESPECIALLY FROM THE MOBILE HOME THAT STARE AT THE MOMENT AND SO STAFF RECOMMENDS APPROVAL OF IT AS WELL AS I MENTIONED, THE PLANNING AND ZONING COMMISSION RECOMMENDS APPROVAL. THERE'S ANY OTHER QUESTIONS. I'LL BE HAPPY TO ANSWER SESSIONS FOR DAVID DID . UM YES, SIR DAVID. MY LAST RECOLLECTION OF THE EXPANSION OF COLEMAN. AGAIN. SORRY. MY LAST RECOLLECTION. OF THE EXPANSION OF COLEMAN, WHICH I THINK IS HAPPENING AND LIKE 24 25 TIMEFRAME. THAT PART IS GOING TO BE THE TWO LANES WITH THE CENTER. YES, SIR. WITH THE UM.

APPARENTLY NOT, I GUESS. PARALLEL PARKING OR IS IT ANGLE PARKING? IT WOULD BE PARALLEL PARKING PARALLEL PARKING, SO THIS SITE WOULD HAVE A LITTLE BIT OF PARALLEL PARKING, AS WOULD THE SITES TO THE NORTH AND THE SOUTH OF IT. LOGISTICALLY SPEAKING THE PROPOSAL THAT THEY HAVE WOULD HAVE THEIR DRIVEWAY COMING IN OFF OF SEVENTH STREET. A LOT OF THE STREETS, CALLING THE SIDE STREETS THAT ARE IN THIS AREA ACTUALLY ARE PRETTY SMALL AND RIGHT OF WAY THEY'VE GOT MAYBE 30 FT TOTAL RIGHT OF WAY. THE STREETS OR 2022 FT WIDE , SO IN THERE, THERE ARE NO PLANS TO WIDEN NOSE AND SO ANY TYPE OF STREET PARKING ALONG THERE WOULD PROBABLY BE DIFFICULT TO DO AND MAY NOT BE ALLOWED. THEIR ENTRY WOULD BE COMING INTO THE BACK WHERE THE PARKING WOULD BE OFF OF SEVENTH STREET AND SO THE OPPORTUNITY FOR ADDITIONAL PARKING BECAUSE

[00:40:02]

OF THE SIZE OF THE LOT ALONG COMB AND MAY ALLOW THEM TO HAVE A COUPLE OF MORE SPACES, BUT IT'S NOTHING SIGNIFICANT THAT WILL CAUSE ANY TYPE OF TRAFFIC PROBLEM THERE, RIGHT. WELL, THE REASON I ASK IS BECAUSE OBVIOUSLY, THAT'S A FAIRLY SMALL PIECE. RIGHT THERE AND YOU'RE TRYING TO SQUEEZE ANY KIND OF PARKING ON THE SITE LOOKS LIKE IT'S GOING TO BE. FAIRLY FAIRLY TIGHT. IT WILL, AND THAT IS WHAT'S CAUSING THE SIZE OF THE BUILDING TO BE A SMALL THEY COULD BUILD A TWO STORY BUILDING. BUT THEN THERE'S NOT ENOUGH PARKING TO DO IT AND SO THEY'RE THEY'RE LIMITED TO THE SINGLE STORY TO ALLOW THE PARKING OKAY, NOW THAT'S THAT'S AND THEN, UM, JUST FOR CLARIFICATION. I THINK I KNOW THE ANSWER IS OBVIOUSLY NO. NO MEDIAN ON THAT PART OF COLEMAN WHEN IT GETS EXPANDED. DON'T WORRY ABOUT WITH MEDIAN CUTS OR ANY OF THAT, OKAY, THAT'S WHAT OTHER QUESTIONS FOR STAFF. ALL RIGHT. THANK YOU, DAVID AT THIS TIME, THEN I'LL GO AHEAD AND, UH OPENED THE PUBLIC HEARING. IS THERE ANYONE LIKE TO SPEAK ON THIS ITEM? SAYING NO. ONE I'LL CLOSE THE PUBLIC HEARING AT THIS TIME COUNCIL DISCUSSION. UM SO MY CONCERN WITH SHOULDN'T GO TOO FAR. DAVID YEAH, MY CONCERN WAS JUST A STRAIGHT ZONING. WELL FOR ONE, THE LETTER THAT WAS IN OUR PACKET. INDICATED THAT THE APPLICANT TENDED TO DO OFFICE SO AND I DIDN'T UNDERSTAND WHY THEY DIDN'T REQUEST THE ZONING FOR D T O VERSUS D TR UNLESS THEY'RE JUST CHANGING THEIR SCOPE AT THIS POINT. BECAUSE OF THE ICE CREAM. OKAY SO, YEAH, THAT WASN'T MENTIONED IN THE LETTER THAT THEY THAT I'M NOT SURE WHEN THAT CAME ABOUT, BUT LIKE I SAID , WHEN THEY GOT TO PLANNING COMMISSION THAT WAS THE BIG DEAL . SO MY ONLY MY CONCERN WITH WITH JUST A STRAIGHT ZONING OF GTR. UM AS YOU KNOW, YOU KNOW A LOT OF THESE THINGS THAT COME ALONG. WE ASKED FOR PDS SO WE CAN CLARIFY USES. AND PERMITTED USES. AND, UM THEY'RE ASKING FOR STRAIGHT ZONING, WHICH MEANS A LOT OF USES THAT, UM, ARE JUST ALLOWED BY, RIGHT. I DON'T THINK WE WOULD WANT TO SEE THERE. SO I'M GLAD TO HEAR YOU SAY THEY WANT TO ENTER INTO A DEVELOPMENT AGREEMENT. I GUESS MY QUESTION WOULD BE FOR TERRY. YOU KNOW IF WHEN I LOOK AT THE ZONING WHAT'S ALLOWED IN GTR? IF THERE ARE SPECIFIC THINGS WE WANT TO EXCLUDE. DO I NEED TO TELL YOU THAT TODAY OR IS THAT SOMETHING STAFF CAN WORK THROUGH? OKAY SO YOU CAN EXCLUDE CERTAIN USES.

OKAY? OKAY? SO IN THAT CASE. I WOULD NOT BE COMFORTABLE WITH JUST A STRAIGHT GTR ZONING. THEM BECAUSE I JUST THINK THERE'S TOO MUCH THERE'S TOO MUCH I MEAN, I KNOW THEY SAY AN ICE CREAM SHOP, BUT WE ALL KNOW THAT CAN CHANGE. THEY CAN SELL THE PROPERTY SOMEBODY COULD DO AND SOMEBODY COULD PUT A LIQUOR STORE THERE TO BE HONEST OR ANYTHING, ANYTHING ELSE THAT WE WOULDN'T NECESSARILY WANT THERE AT THAT LOCATION, SO UM MY ENCOURAGEMENT WOULD JUST TO BE TO COME BACK WITH THE PD AND SEE WHAT WE CAN WHAT WE CAN HIM OR OUT THERE. IF I COULD NOT TO GET INTO YOUR DELIBERATION. I APOLOGIZE FOR THAT IN ADVANCE, BUT WHEN THE STAFF WAS DECIDING HOW TO GUIDE THEM THROUGH THE PROCESS FOR WHAT THEY WANTED TO DO THE REASON WE DIDN'T PUT OUR SUGGESTED PD IS BECAUSE THERE ARE NO PDS IN THE DOWNTOWN DISTRICT AND THEY'RE ALL OUR EITHER ONE OF THE OLDER SUB DISTRICTS OR ALREADY ONE OF THE NEWER SUB DISTRICTS. AND SO WE THOUGHT BY FOLLOWING THE GUIDELINES AND FOLLOW FOR BOTH THE ARCHITECTURAL STANDARDS AS WELL AS LIMITING WHAT THEY USE IS WE'RE GOING TO BE IN SOME FORMAT THAT THAT THAT WOULD BE PREFERABLE. INSTEAD OF HAVING 45 OR 50. P D. S IN THE DOWNTOWN DISTRICT ALONE. ONE OF THE THOUGHTS THAT THAT WE'VE HAD IS TO WORK ON AN OVERLOAD DISTRICT THAT WOULD PREVENT THAT FROM OR THAT TYPE OF SITUATION GOING FORWARD WHERE WE HAD 45 OR 50 DIFFERENT SPECIFIC ZONING DISTRICTS, AND I DON'T KNOW IF SOMETHING LIKE THAT. WOULD APPEASE WHAT? WHAT YOU'RE WANTING TO DO IF WE DO CHANGE THIS PROBABLY HAVE TO RE NOTICE TO CHANGE IT TO P D. WE COULD GO THROUGH THAT PROCESS, BUT THEN AT THE SAME TIME, WE COULD JUST START A LITTLE FASTER ON AND

[00:45:03]

OVER LIGHT TO WHERE WE COULD UTILIZE THE WORK THAT'S ALREADY BEEN DONE WITH THE SUB DISTRICTS AND ARCHITECTURAL STANDARDS AND THE USES THIS THERE'S A LIST AND WE DIDN'T SEND IT OF ALL THE PERMITTED USES. SO I AGREE. 110% WITH WHAT YOU'RE SAYING THIS LIST IS RIDICULOUS IN MY OPINION , AND THAT SMALL SPACE YOU COULDN'T DO 50% OF THESE THINGS , AND SO WE NEED TO DO SOMETHING ABOUT THAT, UM. AGAIN I JUST NOT COMFORTABLE WITH GTR. THAT'S WHAT THAT'S THAT'S THE KEY AND I AGREE WITH YOU ON AN OVERLAY. I JUST THIS IS THE CASE WE'RE TAKING UP TODAY. SO WE HAVE TO MAKE A DECISION. OKAY. WITH STRAIGHT ZONING ON A D T R I WOULD BE OKAY WITH PTO BECAUSE YOU KNOW USES ARE SO MUCH MORE LIMITED. UM BUT I'M NOT COMFORTABLE WITH THE GTR HERE.

JUST A STRAIGHT ZONING. AS REQUESTED. AGAIN IF I COULD, AND I'M SORRY THAT THE DTL REALLY DOES NOT LIMITED ALL THAT MUCH MORE. THEY'RE THEY'RE PROBABLY STILL THIRTYSOMETHING USES THAT COULD BE DONE IN THERE. SO MY SUGGESTION IS IF THE COUNCIL IS INTERESTED IN IN DOING THOSE LIMITATIONS, EITHER. LET'S CONTINUE THIS OR TABLE IT FOR MEETING OR TWO SO WE CAN GET IT SWITCHED TO THE PD WILL COME UP AND WE KNOW WHAT THE SPECIFIC LIST OF USES THAT WE'RE TALKING ABOUT OUR AND THEIR SIX AND SO THERE THERE ARE A LOT MORE PREFERABLE THAN THAN THIS. SO I'LL QUIT TALKING. I'M SORRY. I JUST MY HAS MORE TO DO WITH THIS EXTENDED DISCUSSION. UM AND IT'S POSSIBLE THAT WE NEED TO JUST CHANGE. THAT BASED ONLY BECAUSE I'M NOT THINKING THAT THERE'S ANYWHERE IN DOWNTOWN RETAIL. WE WOULD WANT SOME OF THESE OTHER ISSUES. IS THERE MORE MAINSTREAM TYPE THING. SO ANYWAY, THAT'S MY ONLY COMMENT ABOUT THAT. I'M I AGREE. I FEEL A LITTLE UM, UNEASY ABOUT THE CURRENT LIST FOR THE STRAIGHT, TONY. HELLO. OH, OKAY, SO WE'RE WE'VE REACHED THAT STAGE. DO WE? DO WE HAVE A MOTION THAT WE WANT TO EXCUSE, RATHER THAN CONTINUED DISCUSSION. BE THE. PROCESS IF WE JUST TABLED IT, YOU WOULD JUST WORK WITH THE APPLICANTS.

YOU BRING SOMETHING DIFFERENT OR WHAT? I DON'T THAT'S A TERRY QUESTION. TO DENY IT.

SO I NEED TO GO BACK TO PLANNING AND ZONING, OKAY? SO DAVID, IF WE CHOSE THAT ROUTE I MEAN, ARE WE? ARE WE SAYING THAT EVERY TIME THE CASE COMES UP LIKE THIS, WE'RE GONNA BE DOING A P D. I'M SORRY. ARE WE GOING TO BE DOING IT? OR I'M WONDERING, WHICH ARE WE GONNA BE DOING AN OVERLAY WHICH WHICH WE'RE GONNA BE DOING CAN WE'D HAVE TO UNTIL WE GET THE OVERLAY AND PLACE.

YES SIR. AND WE WOULD START WORKING ON THE OVERLAY RIGHT AWAY. WE'VE ACTUALLY BEEN DISCUSSING THAT AT THE STAFF LEVEL. UM REALIZING THAT THIS WAS GOING TO BE AN ISSUE GOING FORWARD FROM THE QUESTIONS THAT WE WERE GETTING ABOUT HOW TO MANAGE THAT THAT PROCESS, AND SO THERE'S QUITE A BIT OF WORK. THAT IS DONE IN THE DIFFERENT PLACES. IT JUST NEEDS TO BE PUT TOGETHER AND COMPACTED A LITTLE BIT AND THEN CUT OUT QUITE FRANKLY, A WHOLE LOT OF THESE USES. THEY'RE JUST I DON'T SEE HIM EVER REALLY FITTING IN A LOT OF THESE LOCATIONS AND SO WE CAN CAN GET ALL THAT DONE. IT'LL PROBABLY TAKE US A COUPLE OF MEETINGS TO GET IT BACK TO YOU.

THE OVER ONE MORE. UM BECAUSE OF THE OVERLAY PROCESS AND NOTICE THAT WE'LL HAVE TO DO TO CORRECT THIS ONE. WE CAN CORRECT THIS ONE AND GET IT BACK QUICKER, SO IT DOESN'T HOLD UP THE APPLICANTS ANY LONGER THAN IT HAS TO, BUT WILL IMMEDIATELY START WORKING ON THE OVERLAY TO GET THAT BACK TO YOU AS SOON AS WE CAN. YEAH, I MEAN, I WOULD LIKE TO, UM, CONTINUE TO SEE THE DOWNTOWN. AREA. UM BRING FAMILY FRIENDLY. SERVICES AND RESTAURANTS AND ICE CREAM SHOPS . WHATEVER UH, BUT TO YEAH, TO HAVE A BLANKET ZONING LIKE LIKE AMY WAS SAYING. UM DOES SEEM A LITTLE UH, SCARY. SO IF WE COULD FIX THAT. TO MAKE IT SO THAT THERE IS NOT A LIQUOR STORE OR

[00:50:10]

OR SIMILAR THINGS DOWN THERE. I THINK THAT'S THE DIRECTION THAT I WANT TO GO ANYWHERE. THE APPLICANT HERE. I'M JUST CURIOUS. OKAY? FOR COMMENT, UM, APPRECIATE THEM BRINGING THIS FORWARD. I WISH WE WOULD HAVE HAD THE AWARENESS THAT YOU KNOW THE OPTION WAS BASICALLY TO DENY. TABLE IT. WE STILL DON'T GET THE OUTCOME THAT WE'RE LOOKING FOR. BASED ON WHAT I HEAR. UM, I DON'T WANT TO. BUT THE APPLICANT OUT, BUT I DO THINK IT. IT'S THE COMMENTS MADE BY THE COUNCIL THUS FAR I SUPPORT UM, I WOULD LIKE TO SEE I DID HAVE CLARIFICATION QUESTIONS THAT I APPRECIATE STAFF GETTING BACK TO ME ON GTR VERSUS GTO AND THE DOWNTOWN APARTMENT ZONE AND ABATEMENTS THAT PERTAINED TO THOSE. SO MY UNDERSTANDING IS THE D T. O VERSUS GTR HAD THE SAME ABATEMENTS, UM, WITH THAT BEING SAID UM, BASED ON CURRENT FEEDBACK, AND IF YOU'RE LOOKING FOR A MOTION, I WOULD SAY. IN THE ABSENCE OF HAVING THE ABILITY TO PUT TOGETHER A DEVELOPERS AGREEMENT. THAT WOULD MAKE A MOTION TO DENY WITH THE RECOMMENDATION. TO COME BACK WITH THE RIGHT. PROCEDURAL DOCUMENTATION SO WE CAN MOVE THIS FORWARD TO. OKAY? THEN THAT WOULD BE MY MOTION. DENY WITHOUT PREJUDICE. MOTION BY MARCUS RADIO. HAVE A 2ND 2ND BY AMY BARTLEY ALL IN FAVOR. THAT MOTION PASSES UNANIMOUSLY. THANK

[20. Consider and act upon a resolution establishing loan terms between the Utility Fund and the Solid Waste Fund for financing the purchase of solid waste and recycling carts. (RBS)]

YOU VERY MUCH. THANKS, DAVID. THANK YOU. AT THIS TIME, WE'LL ITEM NUMBER 20 CONSIDERING ACT UPON A RESOLUTION ESTABLISHING LOAN TERMS BETWEEN THE UTILITY FUND AND THE SOLID WASTE FUND FOR FINANCING THE PURCHASE OF SOLID WASTE AND RECYCLING CARTS, MR BOB SCOTT. OKAY? MAYOR AND TOWN COUNCIL. AH ON JUNE 27TH WE ACTUALLY UH, PAST THIS. ITEM AWARDING SOLID WASTE SERVICES TO REPUBLIC SERVICES. AND AS PART OF THAT AWARD WE PROVIDED FOR THE PURCHASE OF CARTS, SOLID WASTE CARDS. AND. UH TONIGHT. WHAT WE'RE DOING IS WE'RE SIMPLY ARRANGING FOR THE FINANCING. THE ACTUAL PURCHASE OF THE CARDS WERE PREVIOUSLY AUTHORIZED BY COUNCIL. AND SO WE HAVE UH, GONE THROUGH WITH THE COMMUNICATION DEPARTMENT AND VARIOUS STAKEHOLDERS COME UP WITH THE CARTS THAT WE WANT. AND THESE CARTS FOR TRASH OR GOING TO BE GREAT CHARCOAL BASE WITH A BLACK COVER. I HAVE RECEIVED FEEDBACK FROM THE MAYOR THAT SOME OF THE CURRENT CARDS OF THE CURRENT CONTRACTOR ACTUALLY COLLAPSE IN AND COLLECT WATER. SO THAT WHEN YOU TIP THEM TO ROLL THEM, THEY SPILL WATER ON YOU SO WE HAD THE CONTRACTOR BRING UP VARIOUS LIDS. SO THAT WE COULD INSPECT THE LEADS AND MAKE SURE THAT UH , THAT WILL NOT HAPPEN ON THESE CURRENT CARDS. DID YOU DID YOU? I BELIEVE THERE'S AN ADDITIONAL INSPECTION PERIOD YOU GAVE OF THAT YOU ACTUALLY HAD THE LIDS DELIVERED TO YOUR OFFICE. I HAD THE LIDS DELIVERED TO MY OFFICE FOR INSPECTION OF THE LID. SO THANK YOU ACTUALLY STEPPED ON THE LIDS TO MAKE SURE THAT TO SEE WHICH ONES WERE STRONGER.

YEAH. IT'S THE DETAILS. IT'S ALWAYS THE DETAILS SO THIS WOULD BE THE TRASH CART. THIS WOULD BE THE RECYCLING CART. YOU'LL NOTICE THE ON TOP OF BOTH OF THE CARDS. THERE ARE UH, WHAT'S CALLED IN THE BUSINESS AND IN MOLD AND RATHER THAN JUST A STICKER, YOU PLACE ON THE CART.

UH, THEY HAVE A PROCESS WHERE THEY MELT. THE LABEL ONTO THE TOP OF THE CART. AND THE REASON THAT'S IMPORTANT IS BECAUSE IT'S MUCH MORE DURABLE. IT'S LESS LIKELY TO FADE UNDER THE SUN.

AND MOST IMPORTANTLY, THAT LITTLE Q R CODE ON TOP WILL BE READABLE AND WILL BE READABLE FOR MANY, MANY YEARS, SO IF A CITIZEN. THEY GO AND THEY GO. THEY DIDN'T COLLECT MY CARD.

WELL THEY HAVE TO DO IS USER PHONE TO SCAN THE QR CODE AND REPORTED HAS PHONE NUMBERS, ETCETERA, AND SO IT WILL BE VERY USER FRIENDLY. FOR THEM TO USE ALL THE ACCEPTABLE RECYCLING MATERIALS WILL BE ON THE LABELS SO THAT THEY WON'T KNOW EXACTLY WHAT THEY CAN PUT IN THE CAR.

[00:55:07]

AND WHAT WILL HAVE TO BE DISCARDED IF THEY PUT IT IN THE CART. AND THEN FOR THE TRASH CAN ACTUALLY BE A TRASHED A CHECKLIST, WHICH WILL LET THEM KNOW. KEEP THE CARDS FOR 4 FT APART. AH AWAY FROM ANY OBSTACLES SUCH AS CARS OR MAILBOXES, AND, UH TRASH AND RECYCLING SAVED DAY CARD OPENING FACING THE STREET. SO. AS WE WENT THROUGH THE VARIOUS POSSIBILITIES, WE FELT THESE WERE THE BEST OPTIONS AND, UM. WHAT WE'RE ASKING FOR TONIGHT IS APPROVAL OF THE RESOLUTION FOR THE LOAN FROM THE UTILITY FUND TO THE SOLID WASTE FUND. IT WOULD BE FOR $2 MILLION REPAYABLE IN 10 YEARS MAXIMUM OF 10 YEARS. NO PENALTY FOR PRE PAYMENT FIVE AND A QUARTER PERCENT INTEREST. AND MONTHLY PAYMENTS FOR REPAYMENT. WE HAVE INCLUDED AS PART OF THE MONTHLY FEE A $2 FEE FOR THE CARDS, WHICH WILL BE ADEQUATE TO REPAY THIS LOAN OVER TIME. AND THE INITIAL ORDER WILL BE APPROXIMATELY 34,000. UH CARTS WHICH WERE EX DOWN TO 19,000. OF THE TRASH CARDS AND 15,000. RECYCLING CARDS, WHICH GIVES US ABOUT A YEAR AND A HALF TO TWO YEAR SUPPLY WITH THE INITIAL ORDER. AND THEN, AS THE CUSTOMER ACCOUNT GROWS OR HAVE ENOUGH MONEY TO PURCHASE ADDITIONAL CARD SAYS NEEDED. THANK YOU, BOB. ANY QUESTIONS? ON THIS PARTICULAR ITEM. WHAT IS WHAT IS THAT DUE TO THE FEE? THE RESIDENTS PAY. THE FEE IS GOING UP SLIGHTLY, UH, ABOUT. AH IT WILL GO TO 18. I BELIEVE 75 WHICH OR ESTIMATING IF WE HAD NOT SWITCHED CONTRACTORS, THE CURRENT CONTRACTOR WOULD BE ELIGIBLE UNDER THE OLD CONTRACT FOR 5% INCREASE, THEY'LL BE PAYING A 7% INQUIRIES. BUT SO IT'S A SLIGHTLY HIGHER INCREASE . BUT THE ADVANTAGES WE HAVE A TRUCKS RATHER THAN FIVE TRUCKS PICKING UP AND WE REALLY EXPECT MOST OF THE SERVICE TO BE COMPLETED MUCH EARLIER THAN IT CURRENTLY IS. THANK YOU. OTHER QUESTIONS. MAYBE WE COVERED THIS BEFORE. OBVIOUSLY WE'VE GOT YOU SAID 19,000 OF THE REGULAR TRASH. KARTS CORRECT CURRENTLY HAVE JUST UNDER 15,000 DEPLOYED RIGHT NOW. AND SO WE'RE ALLOWING FOR 4000. CUSHION FOR GROWTH. AND ON THE, UH, RECYCLING SIDE.

WE HAVE JUST OVER 12,000. SO WE'RE ALLOWING ABOUT 3000 FOR GROWTH BECAUSE MOST PEOPLE ONLY GET ONE RECYCLING CART. WORSE IT'S FAIRLY COMMON HERE FOR PEOPLE TO HAVE MORE THAN ONE TRASH COVERED FOR THOSE THAT HAVE MOLD LIKE FIRE. IF YOU HAVE TWO CARDS TODAY FOR TRASH AND ONE FOR RECYCLED, RECOVERED ON THE MULTIPLE, ABSOLUTELY RIGHT. GOOD. ANYONE WANT TO MAKE A MOTION ON THIS ONE? I MOVED TO APPROVED RESOLUTION ESTABLISHING LOAN TERMS BETWEEN UTILITY FUND AND THE SOLID WASTE FUND TO FINANCE PURCHASE OF SOLID WASTE AND RECYCLING CARTS. Q EMOTIONALLY JEFF HODGES ALL IN FAVOR. MOTION PASSES UNANIMOUSLY. THANK YOU VERY

[21. Receive an update on the Lakewood Preserve Park project. (DB)]

MUCH. AGENDA ITEM NUMBER 21 TO RECEIVE AN UPDATE ON THE LAKE WOULD PRESERVE PARK PROJECT MR DAN BAKER. MAYOR COUNCIL. THANK YOU FOR LET ME COME TO YOU TONIGHT TO GIVE YOU AN UPDATE ON LIQUID PRESERVE. UH, LET YOU KNOW WHERE WE ARE. UM SO FIRST, A LITTLE BACKGROUND ON THE PROJECT. AS YOU KNOW, WE'VE THIS PROJECT'S BEEN TAKE A LITTLE WHILE TO GET ACROSS THE FINISH LINE, AND WE FEEL WE'RE THERE NOW. UM PROJECT FUNDING IS JUST UNDER $5 MILLION AND IT'S COMPRISED OF 2020 BOND. TRADE MITIGATION, PARK IMPROVEMENT DEVELOPMENT FEES AND SOME GENERAL FUND DOLLARS. UM WE'RE ALSO VERY EXCITED TO RECEIVE A DONATION FROM PASO OF $500,000,

[01:00:02]

AND THAT WAS IN LIEU OF THE PROJECT COVERING A RESTROOM AND I KNOW COUNCILMAN RIG. I'LL GET INTO THAT QUESTION YOU SENT OVER EARLIER. UM. PART OF THE DEVELOPER AGREEMENT WITH WITH THE DEVELOPER HINDS. THEY WILL BE MANAGING THE PROJECT. IN LIEU OF THEIR. PARK DEVELOPMENT FEES , BUT THEY ALSO WILL BE COVERING EXPENSES THAT INCLUDE DESIGN COSTS IN PLANNING EXPENSES. UM.

AND THE TOWN HAS ENTERED INTO A FACILITY AGREEMENT WITH HEINZ, WHICH DEFINES ALL OF THIS.

SCOPE. UM. SINCE THIS PROJECT FIRST. WAS PRESENTED TO YOU BEFORE I WAS PARKS DIRECTOR. UM THERE HAVE BEEN SOME SCOPE CHANGES. THERE WERE SOME POND DESIGN REFINEMENTS, INCLUDING LOCATION, DEPTH, AND SOME OTHER THINGS ARE WORKED OUT WITH OUR ENGINEERING DEPARTMENT. UM INITIALLY PLANNED ON THIS PARK OR IN THIS PARK OR SAND VOLLEYBALL COURTS. WE WERE ASKED TO BUY COUNCIL TO TAKE A LOOK AT THAT AND POTENTIALLY REMOVE THEM IN EXCHANGE FOR THAT, WE ADDED FOUR PICKLEBALL COURTS. UM WE'VE ALSO SINCE THAT TIME I HAD A CRICKET PITCH, WHICH, SO THESE WILL BE OUR FIRST PICKLEBALL COURTS IN TOWN IN THE PARK SYSTEM. AND ALSO OUR FIRST CRICKET PITCH AND THEN ALSO, WE'VE ADDED A RESTROOM AND INFRASTRUCTURE. THE RESTROOM JUST TO BE CLEAR THE RESTROOM WAS NOT. IT WAS PART OF THE INITIAL DESIGN. BUT BECAUSE OF WE FELT THAT THE PROJECT MAY HAVE BEEN UNDERFUNDED, WE DID PUT THAT AS A BIT ALTERNATE ITEM, SO WE ARE ABLE TO, UM INCLUDE THAT IN THE IN THE WITH WITH THE FUNDING WE NOW HAVE. UH PARK AMENITIES. IN TOTAL. WE TALKED ABOUT THE PICKLE BALL COURTS CRICKET PITCH. IT WILL INCLUDE THREE LIGHTED SOCCER FIELDS. UM A PLAYGROUND EXPANSION, SO RIGHT NOW THERE IS A PLAYGROUND STRUCTURE IN THE PARK. UH IT'S INTENDED FOR 2 TO 12 YEAR OLD PLAY. THAT'S NOT REALLY THE BEST. WHERE TO GO ON PLAYGROUNDS, SO WE'RE GOING TO ADD A 2 TO 5 YEAR OLD PLAYGROUND. UM BASKETBALL COURT. BASEBALL BACKSTOPS. RESTROOM TRAILS. LANDSCAPING IN 76 PARKING SPACES ARE ALL PART OF THE PARK AMENITY PACKAGE. UH IN FRONT OF YOU. YOU CAN SEE, UM OUT OF THE PARK. UH, HAPPY TO GO THROUGH THAT. MAYBE ITEMS OF INTEREST. UM TO THE NORTHEAST.

WE WERE ABLE TO INCLUDE THAT PICKLE. THE EXCUSE ME THE CRICKET PITCH. BETWEEN TWO SOCCER FIELDS, SO THIS WILL NOT BE A STANDALONE CRICKET FACILITY. BUT IT WILL BE ABLE TO BE USED WHEN SOCCER IS NOT IN PLAY, AND VICE VERSA. SO THE CRICKET PITCH IS OFF OF THE SOCCER FIELD, SO IT'S NOT GONNA INTERFERE WITH SOCCER. UH, YOU KNOW, BUT AGAIN, CRICKET AND SOCCER WON'T BE ABLE TO PLAY AT THE SAME TIME. OBVIOUS REASONS. UM OF NOTE. YOU MAY ALSO SEE WE'VE GOT THE PARKING LOT JUST OFF ACQUIT ROAD. UM FOR THE FOUR PICKLEBALL COURTS AND BASKETBALL COURT ALL GROUPED KIND OF THAT SOUTHWEST CORNER. AND THEN JUST VARIOUS TRAIL. PLAYGROUNDS, THINGS ALONG THOSE LINES. SO WHEN THIS BID CAME IN BACK IN JULY, IT CAME IN AT 5.162 MILLION THAT DID NOT INCLUDE THE RESTROOM OR PLAYGROUND INSTALLATION AND LET ME CLARIFY, I'M GOING TO GET INTO WITH THE PLAYGROUND IS ABOUT ON THIS ONE. WE DID HAVE A BUDGET OF 4.995 MILLION, SO OBVIOUSLY BUT THE BILLS CAME IN OVER BUDGET. THROUGH SOME NEGOTIATION BETWEEN THE DEVELOPER HINDS RIGHT, LEFT THE CONTRACTOR AND THEN THE TOWN . WE WERE ABLE TO GET THAT PRICE DOWN TO 4.866 MILLION. A LITTLE OVER THAT AND THAT DOES INCLUDE THE RESTROOM AND PLAYGROUND INSTALLATION DID NOT INCLUDE THE 2 TO 5 YEAR OLD PLAYGROUND AND THE REASON BEING A YEAR AGO. THE PLAYGROUND UM PROVIDER CAME TO US AND SAID, WE ARE LOOKING AT SOME INCREASED PRICES ON PLAYGROUNDS. SO AT THAT TIME WE CHOSE TO GO AHEAD AND PROCURE THAT, OR UM ENCUMBER THOSE FUNDS SO THE FUNDS ARE COMING OUT OF THE PROJECT. BUT NOT THROUGH THE BID. WE ESSENTIALLY PURCHASED OR SET ASIDE FUNDS FOR THE PLAYGROUND AHEAD OF THE BIG PROCESS BECAUSE THE TIME THE PROJECT WAS TAKING. WE DIDN'T WANT TO HAVE TO PAY ADDITIONAL FUNDING. SO THE PLAYGROUND EQUIPMENT IS SITTING IN A WAREHOUSE RIGHT NOW WAITING TO BE COVERED. UNDER THE PROJECT BUDGET, BUT NOT UNDER THE 4.866. DOES THAT MAKE SENSE? OKAY I JUST WANT TO BE CLEAR. I'M NOT TRYING TO HIDE ANYTHING OR DO THEY JUST WANT TO LET YOU KNOW WHERE WE ARE. SO THE ACTUAL TOTAL COST OF THIS PROJECT IS NOT THE 4995. IT'S 4997933 $4,197,000. SO, UM. SO THAT'S THE ACTUAL COST OF THIS PROJECT, INCLUDING ALL THE ITEMS WE'VE DISCUSSED. IS THAT CLEAR? OKAY?

[01:05:07]

SO MOVING FORWARD. WE ARE READY TO MOVE FORWARD. UM A AGREEMENT HAS BEEN SIGNED BETWEEN THE DEVELOPER AND RATLIFF HARDSCAPE. UM THEY'RE READY TO GO. THE ONLY THING WE NEED TO DO TO START.

THIS PROJECT IS FOR THE TOWN TO EXECUTE. THE TOWN JOINDER. AND WHAT THAT DOES IS THAT BECAUSE AS YOU ALL BEEN TOLD OR INFORMED ON PRIOR PRESENTATIONS THIS IS GOING TO BE A PROJECT WHERE BY THE DEVELOPER IS MANAGING AND HAS IT WILL HAVE THE CONSTRUCTION AGREEMENT WITH THE CONTRACTOR. WE'RE GOING TO FUND IT. WE WERE PART OF THE PLANNING. WE WILL BE IN ALL THE CONSTRUCTION MEETINGS. WE WILL BE THERE TO MAKE ALL THE DECISIONS. WE WILL APPROVE ANY PAYMENTS GOING TO THE CONTRACTOR AS WELL. OKAY SO THAT TOWN JOINED ARE BASICALLY BRINGS THE TOWN IN BASICALLY, IT'S THREE WAY AGREEMENT. OKAY, JUST TO REPEAT ALL BASEMENT ITEMS, INCLUDING A BIT ALTERNATES, THE RESTROOM BUILDING AND THE PLAYGROUND INSTALLATION. HAVING INCLUDING THE PROJECT, SO THERE WAS ABOUT IT WAS ABOUT A $45,000 CHARGE. WE TECHNICALLY ABOUT PURCHASE BUT HAVE ENCUMBERED THE FUNDS FOR THE EQUIPMENT. THE CONTRACTOR WILL DO THE INSTALLATION, SO THAT'S WHY I KEEP MAKING SURE TO CLARIFY ITS INSTALLATION. UM ONCE WE EXECUTE THE TOWN JOINDER, THE PROJECT WILL BEGIN WITHIN 30 DAYS, SO WE ARE READY TO GO. UH PROJECT CONSTRUCTION. MANY TIMEFRAMES 14 MONTHS. UM I HAVE TWO MEMBERS FROM RATLIFF TODAY. IT'S OUR PROJECT MANAGER BRAD NASH. AND AMOS ALMAGUER. I'M A GUARD. UM. HINDS DEVELOPMENT DEVELOPERS WANTED TO BE HERE TODAY THEY HAVE A MEETING OUT OF TOWN, BUT WE WANT TO MAKE SURE WE COME TO THE COUNCIL AND MAKE SURE YOU UNDERSTAND AND THAT THE RESIDENTS UNDERSTAND THAT WE ARE READY TO MOVE FORWARD ON THIS AND PROVIDE IS A QUALITY PRODUCT AS WE CAN. SO UM, WE'RE ALL COMMITTED TO DELIVERING THIS PARK. SO WITH THAT. THANK YOU ANY QUESTIONS ON THAT? BUT WE HAVE SOME QUESTIONS. YEAH. SO. WANT TO COME BACK TO THE ONE OF MY EMAIL AND MY COMMENTS AND, YEAH, POTENTIALLY TO THE RESTROOMS. SO APPRECIATE YOU STATING THAT THE RUSSIANS WERE IN THE PLANS AND WE DID PLAN TO HAVE RESTROOMS BUT FOR COST CONCERNS THEY WERE PULLED OUT.

UM I JUST HAVE A CONCERN WITH, YOU KNOW, LOCAL ASSOCIATION SHIPPING IN TO BUY RESTROOMS THAT SURE AS A TOWN WE SHOULD BE PROVIDING THE ONLY GOOD PARKS IN PLACE OF THIS SIZE. UM SO I WELL , I APPRECIATE, UM, I MEAN, THAT'S A LOT OF MONEY FROM THE ASSOCIATION TO PONY UP. UM I THINK IT'S THE BEST INTERESTS OF OUR COLLECTIVE COMMUNITY. IF WE FIND THE FUNDS FOR THOSE RESTROOMS SO THAT THEY CAN PUT THOSE ASSOCIATION FUNDS BACK TO THE KIDS PROGRAMS. UM THAT'S A CONCERN FOR ME. I JUST IT DOESN'T FEEL RIGHT. IT FEELS LIKE YOU KNOW, IT'S A IT'S A TIGHT CORNER, AND I UNDERSTAND WHY WHY THAT WAS CONCERNED. I REALLY APPRECIATE POSSIBLE STEPPING UP TO DO THAT, BUT I THINK YOU KNOW THAT'S SOMETHING I WOULD LIKE FOR US TO LOOK AT AS A COMMUNITY TO FIND THOSE FUNDS TO FUND THE RESTROOMS SO THAT YOU KNOW, MAYBE THE REDUCTION IN FEES TO THE KIDS PLAYING SPORTS. THEY CAN PUT THAT BACK INTO THOSE THOSE ITEMS. THE OTHER THING IS I'M EXCITED ABOUT THE CRICKET PITCH. THERE'S A TON OF PEOPLE WHO HAVE ASKED ABOUT CRICKET, ESPECIALLY WITH GRAND PRAIRIE'S, UH, THE DRAW THAT IT'S GETTING AND EVENTS ARE GONNA HOST THERE'S A GROWING INTEREST IN THAT IN THAT AREA AND SO EXCITED THAT WE'RE GOING TO HAVE A CRICKET PITCH IN THAT SPACE TIMING WISE. UM AND TANDEM. WE'RE LOOKING AT RAND PARK, WHICH IS FAIRLY CLOSE IN PROXIMITY. SO UM, THIS WON'T BE MINDFUL THAT WHEN WE SAID GO THAT WE RUN, AND WE GET THESE THINGS IN PLACE, BUT MY CONCERN REALLY WAS THAT WE THE PLANNING OF THE ITEMS AND THE ADJUSTMENTS TO ADD AND MAKES SENSE FOR THE 2 TO 5 TO SEPARATE THAT OUT. UM I THINK IT'S A GOOD ADJUSTMENT FOR SAND VOLLEYBALL. WHILE I WILL SAND VOLLEYBALL. I THINK THERE'S A LARGER AUDIENCE THAT LOVES PICKLEBALL CURRENTLY, HOPEFULLY IN 10 YEARS, THEY STILL LOVE IT.

WITH THE COST. BUT, UM, THOSE ARE MY COMMENTS AND APPRECIATE YOUR CONSIDERATION. THANK YOU, JEFF. YEAH, UM SOME. AND MAYBE THIS IS PREMATURE, RIGHT? BUT SO YOU HAVE TWO SOCCER FIELDS ON THE ON THE CRICKET PITCH, SHE KIND OF SHARING. SHARING THE FIELD. DO YOU? DO YOU HAVE ANY IDEA HOW THAT WILL BE DIVVIED UP BECAUSE WHILE THERE IS A SHORTAGE OF SOCCER FIELDS HERE IN TOWN I KNOW THERE'S A SHORTAGE OF SOCCER FIELD OR CRICKET PITCHES IN THE METROPLEX, AND SO A LOT OF THAT. I THINK THE CRICKET PITCH WILL BE USED BY PEOPLE EVEN OUTSIDE OF OUR TOWN EVERY EVERY SATURDAY THAT I SEE A CRICKET PITCH SOMEWHERE. IT'S ALWAYS FULL. AND SO UM, I JUST I IT WOULD SEEM TO ME THAT PRACTICING SOCCER DURING THE WEEKDAYS WOULD BE PROBABLY

[01:10:09]

THE BEST IDEA AND THEN CRICKET PITCH ON THE WEEKENDS BECAUSE I DON'T THINK THERE'S ENOUGH TIME FOR THEM TO ACTUALLY PLAY A GAME. YOU KNOW, IN THE IN THE AFTER WORK, BUT SURE, ANYWAY, I JUST WHEN I SAW THAT, I THOUGHT I WONDER IF THERE'S A PLAN IN PLACE OR IF THAT'S JUST KIND OF WE'RE GONNA FIGURE THAT OUT. WHEN WE GET THERE SOMETHING WE NEED TO LOOK AT WHAT I WILL TELL YOU MOST LIKELY MOVING FORWARD. SOCCER WILL HAVE THE PRIORITY. IT'S GOING TO BE PROGRAMMED, RESERVED SPACE FOR ATHLETIC UH, FOLKS, WILL WE WILL WORK IN THE CRICKET PITCH, HOW WE CAN, WE CAN EITHER MAKE IT HAS SOME EXPERIENCE WITH THIS. MY PRIOR JOB, AND RICHARDSON WE DIDN'T STALL ONE. THERE ARE A LOT OF DIFFERENT CRICKET GROUPS. SO IT'S NOT LIKE A P Y C. WHERE WE HAVE ONE GOVERNING BODY WE GO TO AND CAN DO THE RESERVATIONS AND THINGS LIKE THAT, SO WE'VE GOT SOME WORK TO DO ON THE CRICKET PITCH. I'VE MET WITH SEVERAL OF THESE GROUPS ONE ON ONE. THEY'RE VERY EXCITED ABOUT IT. UM THERE'S A LOT OF DESIRE FOR. A DEDICATED OR THEIR OWNERSHIP.

AND SO I HAVE CONCERNS REGARDING THAT. SO I THINK WE'VE GOT SOME WORK TO DO. UM HOW ARE WE GOING TO DIVVY THAT UP? DOES IT BECOME A FIRST COME FIRST SERVED WHEN IT'S NOT BEING USED FOR SOCCER.

DO WE CREATE A RESERVE A BLE SPACE THAT WE CHARGE FOR? UM THERE'S A LOT OF DIFFERENT WAYS WE CAN GO ON THAT. MY NEXT QUESTION IS THAT IS THAT SOMETHING THAT WOULD HAVE TO BE RESERVED OR IS THAT A FIRST COME FIRST SERVE TYPE DEAL? UM, BECAUSE IF YES. PASTOR IS GONNA INSTALL OR PROFIT $500,000 FOR BATHROOMS, AND THEN THEY'RE NOT ABLE TO PLAY GAMES ON IT ON A SATURDAY. IMAGINE THAT MY THINKING IS WE WOULD TREAT IT JUST LIKE WE DO FRONTIER RIGHT NOW IS THAT IT IS A RESERVED FOR THE SOCCER WHEN THEY ARE USING THE FIELDS. EVEN FRONTIER IS NOT 100% UTILIZED BY THE P. Y S C GROUPS. THERE ARE POCKETS OR OR TIMEFRAMES WHEN WE CAN, UM, MAKE THOSE AVAILABLE TO THE PUBLIC. WHETHER IT'S FOR A FEE OR WE JUST OPENED THE SPACE UP, SO WE STILL HAVE A LITTLE BIT OF WORK TO DO ON THAT, UM, ACTIVELY LOOKING AT OTHER OPPORTUNITIES FOR ADDITIONAL CRICKET PITCHES IN OUR PARK SYSTEM. BECAUSE WE KNOW IT'S I WAS JOKING WITH SOMEONE EARLIER THIS WEEK, JUST BASICALLY SAYING IT'S THE IT'S THE IT'S THE PICKLE BALL OF 22.

RIGHT. WE KNOW I'M NOW GETTING MORE CALLS ON CRICKET THAN I AM PICKLEBALL, SO I DON'T KNOW IF THAT'S A GOOD THING WE KNOW BOTH ARE VERY POPULAR. ESPECIALLY IN R, AND THEN GOING BACK TO THE DIAGRAM OF THE FIELD. YEAH. COULD YOU DO THAT? SO PARKING OVER THERE ON THE LEFT. HOW MANY . DO YOU KNOW HOW MANY SPACES THERE ARE 76 76, OKAY. UM. IS THERE AN OVERFLOW OUR PLACE? FOUR OVERFLOW. IF NEED BE, COULD PEOPLE I DON'T PARK ON COIT. IS THAT A POSSIBILITY? I DON'T THINK HE COULD PARK ON COIN. THAT'S PRETTY BUSY ROAD AND THERE'S NOT A LOT OF ROOM SO YEAH, WE'RE PRETTY TIGHT WITH THAT THERE IS ACCESS TO THE PARK FROM THE NEIGHBORHOOD ON THE EAST EAST OF THE PARK. OKAY SO I DON'T REMEMBER THE NAME OF THE ROAD, BUT THE NEIGHBORHOOD DOES HAVE SOME ON STREET PARKING. YEAH. UM. I KNOW THERE'S BEEN SOME NEIGHBORHOODS THAT HAVE, YOU KNOW, GOTTEN UPSET ABOUT PEOPLE PARKING TO PICK UP THEIR CHILDREN AFTER SCHOOL. UM IS THERE A AND AGAIN I COULD PROBABLY LOOK THIS UP, BUT JUST REALLY QUICK BECAUSE THEY'RE LIKE A PATHWAY FROM THE SCHOOL, TOO. THIS PARK. THE PIPING BAG TRAIL IF THEY PART OF THEIR EXISTING TRAIL RIGHT NOW, AGAIN THAT FEEDS THAT PLAYGROUND AND JUST THE NATURE OR THE PARK PRESERVE. UM. I'M NOT QUITE SURE ON THE MOVEMENT FROM THE SCHOOL. OKAY, ALRIGHT. SOME. WE CAN CERTAINLY LOOK INTO YEAH, JUST THAT'S PARKING JUST SEEMS TO BE A CONCERN. BUT IF THAT'S ENOUGH SPACES YEAH, IT'S GOING TO BE BUSY. WE KNOW THAT, ESPECIALLY ON WEEKENDS WHEN SOCCER'S, UH, LEAGUES WERE HAPPENING. WE ANTICIPATE THOSE PROBABLY BEING FUTURE GAME FIELDS AS WELL AS AS THEY CONTINUE TO GROW. UM SO WE'LL HAVE TO LOOK FOR OTHER OPPORTUNITIES AS WE AS WE MOVE DOWN THE ROAD. UM JUST REAL QUICK HAVEN'T BEEN ON THE PY SEABOARD FOR A NUMBER OF YEARS.

UH I WOULDN'T MAKE A SUGGESTION THAT AS WE GET MORE REQUEST AND I DON'T KNOW IF THE COOKIE GROUPS ARE ARE WHETHER IT'S ADULT OR WHETHER IT'S YOUTH OR WHATEVER. BUT IF IT IS SOMETHING WHERE THEY ARE LOOKING FOR ACCESS AND THINGS LIKE THAT THAT WE FOLLOW THE SAME. THE REASON WHY WE SET UP PY SEE MANY, MANY YEARS AGO, THE COUNCIL DID WAS TO KIND OF BASICALLY, UH YOU KNOW, ONE TO BE ABLE TO WORK TOGETHER ALL THE APPROVED SPORTS LEAGUES TO DIVVY

[01:15:06]

OUT THE FIELDS AND NUMBER TWO WAS ALSO TO VET INCOMING GROUPS TO MAKE SURE THAT THEY KIND OF FULFILLED THE MISSION. THAT WAS SIMILAR TO THE OTHER GROUP. SO I WOULD JUST LIKE TO SAY JUST ANYTHING THAT COMES IN THAT WHERE THEY'RE STARTING TO LEAN THAT WAY. I THINK THEY NEED TO FOLLOW THE SAME PROCESS THAT WE'VE ASKED FOR. ALL THE OTHER GROUPS THAT HAVE COME ALONG OVER THE YEARS. I DON'T DISAGREE WITH YOU AT ALL. I THINK THERE'S POTENTIAL NOTHING, NOTHING PLANNED. I'M NOT GOING TO TELL YOU. WE'VE DONE A WHOLE LOT OF LOOKING INTO IT OTHER THAN THE FACT THAT WE REALIZE THERE ARE MULTIPLE GROUPS. THEY'RE GONNA WANT ACCESS IN OUR UTILIZING OUR PARK SYSTEM RIGHT NOW, SO THAT MAYBE THERE IS AN OPPORTUNITY FOR SOME KIND OF ORGANIZATION TO COME ABOUT IN THE FUTURE. OKAY SO THE BIG THING I THINK IS WE NEED TO GET THIS PARK BUILT. AND THEN WE LIVE DANCE SORT THROUGH ALL THE ISSUES A LONG WAY. LET'S GET IT BUILT ONE QUESTION ABOUT THE CONTRACT WITH WITH HEINZ. IS THERE ANYTHING IN THE AGREEMENT THAT TALKS ABOUT A TIME FRAME? AND IF THEY AND IF THE PARK IS NOT DELIVERED IN A TIMELY MANNER? IS THERE ANY RAMIFICATIONS? BECAUSE AS YOU KNOW, THIS IS BEFORE YOUR TIME, THE ORIGINAL UM. DESIGN WAS APPROVED EVEN BEFORE I WAS ON COUNCIL, AND THEN WE'VE HAD THREE OR FOUR DIFFERENT ITERATIONS OF BUDGET AMENDMENTS AND CAPITAL FUNDS ALLOCATED FOR OVER RIDGES LIKE LIGHTS AND THINGS LIKE THAT, ALONG THE WAY , SO THIS COUNCIL HAS GIVEN ALL THE RESOURCES TO HAVE THIS BUILT . I THINK WE'VE KIND OF MET EVERYBODY IN THE MIDDLE, CONTINUING TO ALLOCATE FUNDS, AND I WANT TO MAKE SURE THAT THIS TIMELINE IS KEPT. SO I JUST WANT TO KNOW IN THE AGREEMENT.

ARE THERE ANY ARE THERE ANY YOU KNOW, HARD, HARD DEADLINES AND I WAS ASKED TO LOOK AT THAT. AND I FORGOT TO. SO LET ME I WILL TAKE THAT BACK AND, UH AND FIND THAT FIND THAT OUT, YES. OKAY ONE QUICK QUESTION. SO IF I LOOK AT THE NUMBERS IT LOOKS LIKE THE TOWN WILL SPEND ABOUT 4.497 MILLION. IF WE ACCEPT THE PASO NUMBER. IS THAT A CORRECT? NO, SIR. THAT PASS. IT WAS IN ADDITION TO THE 4.9. THEN I THINK THEN THE ACTUAL BUDGET FOR THIS IS 4.997 PLUS 500,000.

4.995. 500 IF WE CHOOSE TO ACCEPT THEIR DONATION, I THINK THAT SLIDE MIGHT BE MISCOMMUNICATED ACTUALLY UNDERSTOOD THAT BUDGET IS $5.4 MILLION. MY IF WE CHOOSE TO ACCEPT THAT MIND, AND THAT'S MY APOLOGIZE. I DIDN'T MAKE THAT CLEAR. YES CLARIFY THAT. SO I THINK WE. SO ARE THERE ANY OTHER QUESTIONS FOR DAN ON THE UPDATES HERE AND THEN JUST WHAT ARE THE PICKUP BALL AND BASKETBALL COURTS LIT? DOESN'T LOOK LIKE IT. I DON'T BELIEVE THERE'S LIGHTING ON THAT. SOCCER FIELDS ARE OKAY. THAT'S WHAT I THOUGHT I'D JUST ASK. IN THE WINTER, YOU KNOW, AND THE IT'S AWFULLY CONVENIENT. HAVE AN EVENING IN THE WELL. OKAY DO WE HAVE ANY

[22. Consider and act upon Contract Amendment #1 to a Professional Services Agreement with Dunaway Associates, LLC, for additional design services related to the development of Raymond Community Park. (DB)]

OTHER QUESTIONS FOR DAN ON THIS PARTICULAR ITEM? OKAY THE DANCE SHOW CONTINUES WITH AGENDA ITEM NUMBER 22 CONSIDERING THAT UPON CONTRACT AMENDMENT NUMBER ONE TO PROFESSIONAL SERVICES AGREEMENT DONE WAY ASSOCIATES LLC FOR ADDITIONAL DESIGN SERVICES RELATED TO THE DEVELOPMENT OF RAYMOND COMMUNITY PARK. COUNCIL THANK YOU AGAIN. UM, SO COMING TO YOU TONIGHT. JUST ASK FOR A CONTRACT AMENDMENT. I'M NOT ASKING FOR MORE FUNDING RIGHT NOW. WE HAVE ENOUGH FUNDING IN THE PROJECT TO COVER THE ADDITIONAL DESIGN FEES. INITIALLY, WE HAD $1.2 MILLION FOR DESIGN. THE FIRST CONTRACT CAME IN. JUST 1.91. UH SO WE ARE ASKING TO INCREASE THAT BY THE 261 TO 50 THAT HAS TO DO WITH THINGS THAT WERE NOT INCLUDED IN THE INITIAL IN OTHER WORD COMMENTS, ASKING WHY, OR WAS THERE WAS THE FINAL PLAN. INCLUDED IN THAT I CAN TELL YOU IT WASN'T AND AGAIN THAT PREDATES ME. SO I APOLOGIZE. I DON'T HAVE A BETTER ANSWER FOR THAT. UM BUT IT DOES WITH THE PICKLE BALL AND TENNIS AREA WAS ALREADY INCLUDED IN THAT, BUT WE DECIDED TO ADD SOME AMENITIES. I KNOW GOING TO THE CONVERSATION WE JUST HAD ABOUT LIGHTING. UM WE CHOSE TO ADD A SHADE STRUCTURE RESTROOM IN COURT LIGHTING FOR THAT PICKLE BALL AND TENNIS AREA AND THEN ALSO THE NORTH PLAYGROUND WAS ALSO ADDED. THE DESIGN FOR THAT SO THAT THAT'S WHERE THE 2 61 COMES. I DON'T UM. SO WE CAN GET BACK TO THAT. I WAS GONNA SO THE PROJECT RECAP RIGHT NOW. WE DID RECEIVE A 95% PLANS. WE RECEIVED THAT LAST WEEK, AND THAT IS CURRENTLY UNDER REVIEW BY MY DEPARTMENT. UM THE BIDDING FOR ALL THE SUBS WILL HAPPEN EARLY NOVEMBER. UH WITH THE GMP HOPEFULLY COMING TO US LATE NOVEMBER. UH COUNCIL APPROVAL.

WE'LL BRING IT TO COUNSEL FOR THE GMP IN DECEMBER. AND THEN HOPE TO BEGIN CONSTRUCTION JANUARY OR FEBRUARY, AND WE'RE ASSUMING THE PROJECT IS GOING TO TAKE ABOUT 15 TO 16 MONTHS, SO

[01:20:07]

YOU CAN SEE WHAT I GET, UM, TALKED ABOUT A LITTLE BIT JUST A SLIDE AGO. THERE'S THE LAYOUT OF OUR BUDGET. INITIAL BUDGET 1.2 FOR DESIGN 18.6 FOR CONSTRUCTION WITH A TOTAL OF 19.8. WE HAD RECEIVED AN ESTIMATE BACK IN JULY WITH WITH THE INCREASE THAT I'M ASKING YOU. FOR TODAY, THE DESIGN BUDGET WILL GO TO 1.35 CONSTRUCTION IS ACTUALLY COMING UNDER WHAT WE INITIALLY THOUGHT IT WOULD. AT 17 8 WITH A TOTAL BUDGET OF 19.237. UM SO A LITTLE BIT OVER ON DESIGN, BUT DOING BETTER ON THE CONSTRUCTION SIDE WITH RIGHT NOW AGAIN. WE DON'T HAVE THE FINAL NUMBERS IN BUT WE'RE SITTING. WE'RE TRACKING TO BE TO THE GOOD OF THE LITTLE OVER HALF A MILLION DOLLARS.

OKAY. THANK YOU. COMMENTS FROM COUNCIL. IN THE WRONG BUSINESS. NO KIDDING. IT JUST AMAZES ME. I THINK ON THE SLIDE JUST POINT OF CLARITY YOUR CONSTRUCTION IN THE TOTAL, ACTUALLY, NEGATIVE NUMBERS IN YOUR DESIGN IS A POSITIVE NUMBER. I THINK THE PARENTHESES ARE INVERTED FLIP RIGHT SHOWING THAT, UM WE'RE OVER BUDGET. SO THE GRAND TOTAL FOR THE DESIGN, WHICH IS 1.352 PUTS US 152 OVER. THE INITIAL DESIGN BUDGET OF 1.2 PERIODS. YES, SO I'M SORRY IF THAT'S.

FROM MY CLARIFICATION WITH IT WITH ADDITION OF THE. PLAYGROUND AREA IS EMPATHY OR IS STILL IN THERE. CORRECT THEATER IS NOT PART OF THIS. SO DAN ON THIS PARTICULAR ITEM AGAIN. RESTROOMS ARE AN ADDITIONAL DESIGN FOR BOTH THE NORTH PLAYGROUND THE PICKLE BALL HERE. AND I KNOW THIS IS PRIOR TO YOU. BUT THE FACT IDEA THAT WE WOULD DESIGN PARKS OF THIS SIDE AND NOT HAVE RESTROOMS. IT'S JUST IT SEEMS CRAZY TO ME. I THINK WHERE THAT COMES FROM. THE BASEBALL COMPLEX WILL HAVE RESTROOMS IN IT. BUT IF WE AND WE SHOULD GET THOSE OFF SO THEY WON'T BE OPEN. UH, SO THE ADDITION OF THE RESTROOM IS FOR THE FOLKS THAT ARE GOING TO BE UTILIZING THE PICKLE BALL . THAT'S A LARGE PIECE OF MY POINT IS SIMPLY CAN'T IMAGINE. AND THEN THE IDEA THAT WE WOULDN'T INCLUDE. FINAL PLAN IN THE I MEAN SO ANYWAY, THAT'S MY COMMENT, AND THIS IS NOT WHAT I WOULD CONSIDER ACCEPTABLE, MOVING FORWARD. ANY OTHER COMMENTS ON THIS PARTICULAR ITEM. YOU KNOW ABOUT MY COMMENT AND JUST JUST PLEASE STAY IN BUDGET. YOU LOOKS LIKE YOU'RE DOING A GOOD JOB SO FAR, AND WE'LL SEE IN DECEMBER. YOU KNOW, WE ALL KNOW HOW THAT GOES, UM I CAN'T IMAGINE A PSA PROVING ANYMORE DOLLARS ALREADY DONE AND , UM AND JUST GOSH! DONE ON TIME IN BUDGET ON TIME, BOTH PROJECTS TO THE GREAT ANY OTHER COMMENTS. OKAY AGAIN, THE DANCE SHOW CONTINUES WITH ITEM NUMBER 23 CONSIDERING I'M SORRY. THIS ONE WE DO HAVE TO. WE HAVE TO HAVE IT MOTION ON THIS ONE, SO I'LL ACCEPT THE MOTION AT THIS POINT. I MOVE TO APPROVE CONTRACT NUMBER ONE TO PROFESSIONAL SERVICES AGREEMENT WITH DUNAWAY ASSOCIATES FOR ADDITIONAL DESIGN SERVICES RELATED TO THE DEVELOPMENT OF RAYMOND COMMUNITY PARK. HAVE EMOTION BY CHARLES COTTON SECOND BY CRAIG ANDERSON ALL IN FAVOR. MOTION PASSES UNANIMOUSLY. THANK YOU FOR THAT.

[23. Consider and act upon an agreement with Nancy Lieberman Charities (NLC) for the installation of a Dream Court at Tanner's Mill Park and authorize the Town Manager to execute the same. (DB)]

ITEM NUMBER 23 CONSIDERING ACT UPON AN AGREEMENT NANCY LIEBERMAN CHARITIES FOR THE INSTALLATION OF A DREAM COURT OF TANNER'S MILL PARK AUTHORIZED THE TOWN MANAGER TO EXECUTE THE SAME YES. SO BASICALLY JUST WANT TO GIVE YOU KIND OF AN OVERVIEW. WHAT WE'RE LOOKING AT. I KNOW THE MAYOR WAS VERY INVOLVED AND BRINGING THIS TO US, UM NANCY LIEBERMAN CHARITIES DREAM COURT PROGRAM BEGAN 2010 IN REALLY WOULDN'T WHAT'S IN. IT'S REALLY A TOOL FOR THE PUBLIC TO BECOME MORE ENGAGED WITH, UH, BASICALLY YOUR GOVERNMENT ESSENTIALLY WHERE IT'S REALLY BEEN SUCCESSFUL WITH POLICE DEPARTMENTS AND BRINGING A LOT OF PLACES IT'S MAYBE MORE AT RISK KIDS GETTING THEM MORE INVOLVED WITH THE POLICE DEPARTMENT AND THE PARKS DEPARTMENT AND JUST THAT THEIR THEIR CITY OR TOWN IN GENERAL, UM WHAT WE ARE LOOKING TO DO. WE ALREADY HAVE THE BASKETBALL COURT. WHAT THIS IS GOING TO DO IS BRING A BASKETBALL COURT OVERLAY. UH AND ALSO A CURRICULUM THAT WILL PROVIDE AND SOME, UM THEY'LL HAVE SOME OPPORTUNITIES TO ALSO WORK WITH THE KIDS, BUT ESSENTIALLY MEETS A LOT OF OUR GOALS IN TOWN WITH GETTING KIDS OUTDOORS, ENGAGING IN PLAY INTERACTING, UM AND THEN THEN ALL THE GOOD THINGS THAT SPORTS WILL WILL BRING BRING YOU UM THE. THE PROJECTS. ESSENTIALLY IT'S 100 AND $50,000

[01:25:05]

PROJECT. WE ARE BEING ASKED TO PROVIDE 75 HALF OF THAT. YOU'LL SEE. WE ASKED FOR THAT IN THE BUDGET. WE ACTUALLY ASKED FOR THE FULL COST. SO THE BUDGET YOU ALL APPROVED. ACTUALLY THIS CAME ABOUT AFTER WE HAD SUBMITTED THE BUDGET. EARLY ON. WE WERE TOLD IT'S GOING TO BE 100 $50,000 PROJECT. WE PUT A LITTLE BIT OF MONEY IN THERE, TOO, FOR SOME RIBBON CUTTING AND SOME PROGRAMMING AND THINGS LIKE THAT, UH, SINCE THAT POINT AFTER YOU GUYS APPROVED OR WHEN BUDGET WENT TO BE FINALIZED. NANCY LIEBERMAN HAD CALLED US AND CAME BACK AND SAID LISTEN TO THE TOWN WILL COME UP WITH THE 1ST 75 WILL COVER THE REST OF THAT PROGRAM. SO THERE'S SOME FINANCIAL WORKING TO DO ON OUR SIDE WITH CHRIS. HE'LL HE'LL HELP US GET THROUGH THAT AND MAKE SURE THAT SHAKES OUT SO THAT WE'RE ONLY REALLY COMING UP WITH $75,000, BUT WE HAVE TARGETED TANNERSVILLE PARK. UH UM, WE HAVE THE OPPORTUNITY TO GET THIS INSTALLED AND LATE OCTOBER WITH HOPEFULLY A KICK OFF EVENT I'M TARGETING. I DON'T HAVEN'T LOOKED ANYBODY'S CALENDARS YET, BUT WE'RE LOOKING AT FIRST WEEKEND IN NOVEMBER. POTENTIALLY UH, NO. THEY'RE EXCITED. NANCY LIEBERMAN. CHARITIES ARE EXCITED TO GET THIS GOING. UM AND THEN PART OF THIS COST WILL ALSO BE AGAIN FUTURE OPPORTUNITIES FOR, UH OUR POLICE DEPARTMENT AND THEN ALSO PARKS DEPARTMENT TO ENGAGE WITH THE COMMUNITY PROGRAMMING ALL THOSE GOOD THINGS. UM WANTED TO SHOW YOU WHAT THE COURT WILL LOOK LIKE WE DID ASK ANOTHER WAS A QUESTION. IF WE COULD INCLUDE THE FIRE DEPARTMENT LOGO. I DID GET A YES ABOUT FIVE MINUTES BEFORE STEP INTO THIS MEETING.

SO WE CAN DO THAT. ALSO WANT TO LET YOU KNOW. I ASKED THEM TO FLIP THE COLOR SCHEME, ONE WITH WITH THE DARK BLUE BECOMING THE LANE AND THE LIGHT BLUE REALLY, MAINLY BECAUSE OF THE HEAT AND SUMMER, RIGHT OUT OF THE SURFACE. THE MORE REFLECTING LESS ABSORPTION. IT SHOULD BE A LITTLE MORE PLEASANT TO PLAY OUT . IF IT'S 100 DEGREES. IT'S 100 DEGREES, BUT THIS OUGHT TO HELP A LITTLE BIT. UM SO THAT'S WHERE WE ARE. THANK YOU, DAN. FOR YOU AND YOUR STAFF WORKING ON THAT.

YES, I HAVE. CHATTING WITH NANCY SEVERAL TIMES OVER THIS, SO THANK YOU FOR BRINGING IT TO FRUITION FOR $75,000 TO HAVE THIS AS I COMPONENT TO OUR PARSON REC DEPARTMENT, I THINK IS GREAT. SO THANKS FOR GETTING THE OTHER LOGO ON THERE. ALSO OTHER COMMENTS FROM COUNCIL I HAVE ONE. ACTUALLY IT MENTIONS THAT THERE'S GOING TO BE, UM SMOOTH ACTIVITIES OR WHATEVER PLANET COMMITTEES HOW OFTEN. WELL I DON'T HAVE AN ANSWER FOR YOU ON THAT. I THINK IT'S AS OFTEN AS WE HAVE THE RESOURCES TO DO SOMETHING LIKE THAT. OR WHAT MAKES SENSE. UM, YOU KNOW, THIS IS SOMETHING WE COULD LOOK AT AS A REGULAR UM PROGRAMMING ITEM FOR PARKS AND IRAQ OF POLICE DEPARTMENT OF FIRE, WANT TO DO SOME MORE COMMUNITY ENGAGEMENT? I THINK THERE'S OPPORTUNITY TO DO IT AS OFTEN AS WE FEEL NECESSARY OR OR MAKES SENSE THAT SUPPORT COURT THAT'S GOING ON TOP. OF THE CURRENT UM IS THAT MORE DURABLE? I GUESS, OR IS THAT WHAT I GUESS WHY? WHY WOULD YOU GO TO THAT? INSTEAD OF . I DON'T KNOW. REGULAR CONCERTS . YEAH SO I MEAN, WE'VE GOT THE CONCRETE COURT OUT THERE. I THINK IT'S IT IS SUPPOSED TO BE MORE DURABLE. IT'S A BETTER PLANE SURFACE. UM IT'S IF I DON'T MIND IF I INTERRUPT, NANCY SAID. IT'S ALSO WHAT THEY USE ON ALL OF THEIR OTHER ONES, AND THEN SO THEY HAVE THE ABILITY TO MAKE ANY REPAIRS. THE WAY IT'S CONSTRUCTED SO SPECIFIC CONSTRUCTION FOR HER ALL OF HER DREAM COURTS. OKAY, PURPOSE OF THAT. OKAY IT LOOKS LOOKS GREAT. I JUST WONDERED. YOU KNOW, IS THERE IS THERE ANOTHER CONCRETE COURT NEXT TO IT. WHAT IS IT? THERE'S ONLY ONLY HAVE THE ONE COURT OKAY THERE. THIS WOULD BE THE COURT TO PLAY ON AT THAT PARK. OKAY I WANT TO CONFIRM TO THAT'S THE REPLACEMENT OF THE GOALS. THE GOALS THAT ARE OUT THERE. I DON'T THINK ARE THE ONES THAT CORRECT. I'M SORRY.

JUST THIS. THAT FUNDING WILL INCLUDE NEW GOALS AS WELL. YES SIR, BECAUSE THOSE ARE MUCH NICER. ALL RIGHT. THANK YOU. CRAIG WOULD LIKE TO MAKE A MOTION WOULD AS A FORMER AU COACH MYSELF AND IT'S BASKETBALL STARTING COME A LONG WAY AND PROSPER. AND SO IT PLEASES ME TO MOVE TO APPROVE. AN AGREEMENT WITH NANCY LIEBERMAN CHARITIES AND I'LL SEE FOR THE INSTALLATION OF A DREAM COURT, TANNER'S MOUTH PARK AND AUTHORIZED TO TOWN MANAGER TO EXECUTE THE SAME AS A FORMER BASKETBALL PLAYER. I'D LIKE TO SECOND THAT I LOVE IT. I LOVE IT IN A SECOND. CAN I HAVE ALL IN FAVOR? MOTION PASSES UNANIMOUSLY. THANK YOU VERY MUCH. THANK YOU. THANK YOU. THANK YOU, DAN. AH! DISCUSSING CONSIDER THE TOWN COUNCIL SUBCOMMITTEE REPORTS. I DO NOT BELIEVE THERE WERE ANY SUBCOMMITTEES THAT MET OKAY.

STEPS MEETING ON NOVEMBER 9TH JUST FOR YOUR INFORMATION. OKAY. THANK YOU. NEXT AGENDA ITEM IS POSSIBLY DIRECT TOWN STAFF TO SCHEDULE TOPICS FOR DISCUSSION AT A FUTURE MEETING. AND I THINK COUNCIL MEMBER KERN, YOU HAD AN ITEM IN PARTICULAR. OKAY, REITERATION, OKAY. ARE WE OKAY? WITH MOVING ON? OKAY? THEN AT THIS TIME WE'LL GO TO EXECUTIVE SESSION. THE TOWN COUNCIL RECESS
