I THINK THAT I'M SORRY. LET ME GET IT RIGHT? THE VEHICLE THEY WERE IN ORIGINALLY WRECKED OUT. UH ONE OF THE SUSPECTS JUMPED OVER A 15 FT BRIDGE TO TRY AND ESCAPE. TO THE TOWN AND WHAT WE WORKED ON AND MONITORED AND SORT OF WHERE WE SEE THINGS GOING. IN THE INTERIM AND THEN INTO 2025. SO JUST REAL QUICK, A LITTLE BIT OF BACKGROUND ABOUT US. WE REPRESENTED A STRONG, DIVERSE GROUP OF CLIENTS. A DIFFERENT SECTORS AND INDUSTRIES. THE TOWN OF PROSPER IS THE ONLY MUNICIPALITY THAT SORRY. THE TOWN OF PROSPER IS THE ONLY MUNICIPALITY THAT WE CURRENTLY REPRESENTING. WE'RE PROUD TO DO.

SO WE'RE GOING TO TALK TO YOU A LITTLE BIT ABOUT SOME MAJOR THEMES FROM THE LEGISLATIVE SESSION. MANY OF YOU ARE PROBABLY VERY FAMILIAR WITH. YOU KNOW WHAT WENT ON THIS SESSION THERE WAS, YOU KNOW A LOT OF ACTIVITY THAT REALLY HAD TIES TO MUNICIPALITIES, WHETHER IT BE LARGE OR SMALL. WE'LL START AT THE TOP WITH THE MOST RECENTLY ENACTED PIECE OF LEGISLATION THAT RECEIVED A LOT OF ATTENTION ACROSS THE STATE, AND THAT'S PROPERTY TAXES. SB TWO WAS PASSED IN THE SPECIAL SESSION THIS SUMMER. EARLY JULY $18 BILLION PROPERTY TAX REDUCTION COMPRISED PRIMARILY OF HOMESTEAD EXEMPTIONS, COMPRESSION 20% CAP ON APPRAISALS, PROPERTIES, $5 MILLION, AND UNDER. IT'S A PRETTY DIVERSE, PRETTY BIG PIECE OF LEGISLATION, AND IT'S ACCORDING TO MANY OF THE LARGEST PROPERTY TAX CUT. AND CERTAINLY IN STATE HISTORY. BUT MAYBE PERHAPS IN U. S HISTORY, SO IT'S A IT'S A BIG ONE. AND THERE'S OF COURSE I KNOW FROM VARIOUS, YOU KNOW, INTEREST WHETHER YOU SMALL CITIES, BIG CITIES ERASE TRYING TO UNDERSTAND YOU KNOW EXACTLY HOW THAT YOU KNOW, WILL PLAY OUT OVER TIME, UH, IN TERMS OF TAX IMPACTS, SO BUT THEN YOU MOVE ON TO SOMETHING THAT'S BEEN DESCRIBED AS THE DEATH STAR BILL. HB 21 27 PREEMPTION. UM THAT BILL HAS A NUMBER OF EFFECTS THAT IT COVERS ABOUT SEVEN CODES. PRIMARY CODES ACROSS, YOU KNOW, DIFFERENT BUSINESS AND COMMERCE AG CODE INSURANCE CODE. AND YEAH, SEVERAL OTHERS. AND THAT BILL IS WHAT IT WILL DO AND WHAT IT DOES IS IT WILL REGULATE OR PROHIBIT CITIES MUNICIPALITIES FROM REGULATING ANY AREA WITHIN THOSE SET THOSE CODES SET FORTH IN THE LEGISLATION UNLESS THAT EXPRESS AUTHORITY HAS ALREADY BEEN GIVEN TO MUNICIPALITIES BY THE LEGISLATURE. AND SO THERE ARE CURRENTLY TODAY, LAWSUITS CHALLENGING THAT PIECE OF LEGISLATION. THERE'S A HEARING NEXT WEEK, AUGUST 30TH. ON THE BILL. THERE ARE OTHERS. THE CITY OF HOUSTON IS THE PLAINTIFF IN THE SUIT. BUT THERE ARE OTHERS WHO HAVE JOINED IN SO TIME WILL TELL WHAT WILL HAPPEN THERE? UM IT'S CERTAINLY IT'S FILED IN TRAVIS COUNTY, THE LIKELIHOOD THAT SOMETHING WILL HAPPEN TO FORESTALL THE IMPLEMENTATION OF THE BILL IS PROBABLY PREDICTABLY HIGH. UM WELL, IT WILL BE PROBABLY REVIEWED AT THE APPELLATE LEVEL. YOU KNOW, DOWN THE ROAD BEFORE IMPLEMENTATION ACTUALLY BECOMES EFFECTIVE. IT WOULD TAKE EFFECT SEPTEMBER 1ST UNLESS THE COURT WERE TO TAKE ACTION SOONER BROADBAND ACCESS. THIS IS SOMETHING THAT'S BEEN A HOT TOPIC. JUST QUESTION THAT NOW. WHAT IS ANTICIPATE ON THAT, BECAUSE OBVIOUSLY THE THEY FILED THE SUIT. IT WILL BE A THERE'LL BE A HEARING A HEARING ON AUGUST 30TH. IT'S UM THE IT WOULDN'T SURPRISE TO SEE AN INJUNCTION OR SOMETHING OF THAT NATURE. TAKE EFFECT, YOU KNOW, AT LEAST INITIALLY. UM WHILE THE CASE IS HEARD, MAYBE IN IN GREATER, YOU KNOW, UM YOU KNOW, I GUESS IF IT CONTINUED ON FOR SOME TIME, I DON'T KNOW THAT IT'S GOING TO BE EFFECTIVE SEPTEMBER 1ST, BUT WE'LL KNOW MORE NEXT WEEK. YOU KNOW, BASED ON THAT HEARING, UM BROADBAND, AND I'LL JUST SAY THIS TOO. I MEAN, JUST FOR THE EFFECT IT HAS ON A TOWN LIKE PROSPER THIS THIS LEGISLATION IN THIS SESSION, REALLY SOME OF THE BILLS THAT WILL TALK ABOUT, YOU KNOW, LATER ON IN THE PRESENTATION. MAY FEEL LIKE YOU KNOW, WHEN YOU LEAVE HERE THAT YOU KNOW THERE IS A SAYING, YOU KNOW THAT NO MAN'S LIFE, LIBERTY OR PROPERTY IS SAFE WHEN THE LEGISLATURE IS IN SESSION, RIGHT? UM AND MUNICIPALITIES MAY FEEL A LITTLE BIT LIKE THAT WAS THE CASE THIS SESSION, BUT I DON'T THINK IT'S THE TOWN OF PROSPER OR OTHER TOWNS LIKE PROSPER THAT ARE PROMPTING SOME OF THESE REACTIONS FROM THE LEGISLATURE. IN FACT, IT'S CONCERNS WITH LARGER MUNICIPALITIES AND POTENTIAL, YOU KNOW, NOT POTENTIAL, BUT ORDINANCES AND ACTIONS THAT ARE TAKEN IN THOSE MUNICIPALITIES. WHETHER IT BE THE BAND, YOU KNOW, GAS POWERED EQUIPMENT OR PLASTIC BAGS OR THIS OR THAT OR THE OTHER ANY OTHER, YOU KNOW, UM THE CITY. WE'RE IN IN AUSTIN , WHETHER IT'S BANNING RIDE SHARING THINGS LIKE THAT. IT'S AS HAS HAD THAT EFFECT THAT THE LEGISLATURE OF CAUSING SORT OF THIS YOU KNOW WHAT MIGHT BE, YOU KNOW, SORT OF A PIDDLE, UM,

SWING AND HOW CITY OR THE LEGISLATURE'S REACTING TO SOME OF THESE CONCERNS THAT ARE BEING BROUGHT TO THEM, SO WE'LL JUST HAVE TO SEE HOW THAT PLAYS OUT. OVER TIME. WE'LL TALK A LITTLE BIT MORE ABOUT SOME OF THE OTHER BILLS THAT ALSO KIND OF FIT INTO THAT, YOU KNOW, BROADER CATEGORY. BROADBAND ACCESS. THE LEGISLATURE HAS BEEN VERY ACTIVE IN TRYING TO GROW BROADBAND, YOU KNOW, DEPLOYMENT IN THE STATE? IT'S OF COURSE, IT'S SOMETHING THAT'S GOING TO TAKE FUNDING AND THE LEGISLATURE PUT 1.5 BILLION THIS SESSION INTO FUNDING FOR BROADBAND. THERE WAS A HALF BILLION PUT IN FROM CARES ACT DOLLARS IN THE PRIOR SESSION, AND THEN MANY PROBABLY HAVE SEEN THAT THE FEDERAL GOVERNMENT HAS PUT IN 3.3 BILLION TO TEXAS. FOR BEAD FUNDING FOR BROADBAND DEVELOPMENT. UH YOU KNOW, I'M SURE MANY OF YOU ARE PROBABLY WONDERING WHETHER OR NOT TOWN LIKE PROSPERO QUALIFY FOR THAT. BASED ON OUR RESEARCH, IT DOESN'T APPEAR THAT THAT'S PROBABLY GOING TO BE THE CASE FOR A NUMBER OF REASONS, BUT YOU KNOW, THERE'S A DIFFERENCE BETWEEN UNDERSERVED AND YOU KNOW , AND IN AREAS THAT HAVE NO SERVICE AT ALL. AND SO AND THEN THERE'S ALSO SOME OTHER FACTORS THAT PLAY INTO IT BASED ON BROADBAND MAPS THAT EXIST TODAY, BUT WE'LL CONTINUE TO UPDATE. YOU KNOW, STAFF AND WE'LL CONTINUE OUR DISCUSSION IF OPPORTUNITIES BECOME AVAILABLE TO PERHAPS TAKE ADVANTAGE OF SOME FUNDING IN AREAS WHERE YOU CAN ENHANCE DEPLOYMENT AND PARTS OF, YOU KNOW, OR AT LEAST AREAS THAT HAVE BEEN AROUND HERE THAT MIGHT BE ABLE TO QUALIFY. WATER INFRASTRUCTURE IS ANOTHER BIG ONE. $1 BILLION SET ASIDE FOR DEVELOPMENT, EXPANSION OF WATER DEVELOPMENT PROJECTS PROJECTS IN THE STATE. UM THOSE CAN, YOU KNOW, GO TOWARDS YOU KNOW, RURAL AREAS AND THOSE UNDER 100 50,000 IN POPULATION, BUT THE SPECIFICS ABOUT WHAT CAN QUALIFY AS IT GETS A LITTLE BIT NEARER AS YOU MOVE ALONG, AND SO, TO THE EXTENT THAT THE TOWN HAS DESIRES TO EXPLORE THAT. WE'RE HAPPY TO CONTINUE TO LOOK INTO THAT ADVISE ON WHAT MIGHT BE AVAILABLE. CERTAINLY WATER CONSERVATION AND LOST MITIGATION OR SOME THINGS THAT ARE REALLY BIG. YOU KNOW, THERE'S TALKS ABOUT DIESEL AND THINGS LIKE THAT. BUT THAT APPLIES REALLY MAINLY DOWN ON THE COAST. UM ECONOMIC DEVELOPMENT. HB FIVE, WHICH IS THE REAUTHORIZATION OF CHAPTER 3 13. MANY KNOW THAT CHAPTER 3 13 WERE EXPIRED AT THE END OF 2020. I GUESS IN DECEMBER 2020 YOU KNOW WITH IT, YOU KNOW , REALLY WAS A SORT OF THE LAST, YOU KNOW. YOU KNOW, FOR MANY BELIEVE LAST ECONOMIC DEVELOPMENT. TOLD THAT SOME YOU KNOW MUNICIPALITIES HAVE TO ATTRACT BUSINESSES. AND SO THERE WAS A PUSH TO REAUTHORIZE THAT IN IN. THAT WAS DONE. UM AND BUT IT DID NOTABLY EXCLUDE RENEWABLE ENERGY PROJECTS FROM IT. IT DOESN'T MEAN THEY'LL ALWAYS BE EXCLUDED. BUT AT LEAST FOR NOW, THEY ARE. IT'S REALLY MORE FOCUSED ON YOU KNOW, ENERGY, YOU KNOW, TECHNOLOGY INNOVATION. YOU KNOW, SO IT WILL BE CHIP MANUFACTURING THINGS OF THAT NATURE, SO IT'S REALLY REIMAGINED. I GUESS YOU KNOW, UH, YOU KNOW, 3 13 AND WILL BE SOMETHING THAT WILL BE DEPLOYED WITH MORE. UM I GUESS A LITTLE BIT MORE SPECIFICITY IN THE FUTURE WHEN IT'S USED AS OPPOSED TO MAYBE HOW IT HAD BEEN BROADLY, YOU KNOW, USED IN THE PAST, ESPECIALLY IN AREAS WHERE RENEWABLE DEVELOPMENT IS BIG, SO LIKE WIND AND SOLAR, AND THAT SORT OF OUT IN WEST TEXAS, UM SCHOOL FINANCE, OBVIOUSLY.

THERE'S A SPECIAL SESSION COMING , YOU KNOW, IT SEEMS LIKE BASED ON THE LEGISLATIVE TIMELINE FOR THE OTHER ACTIVITIES THAT ARE OCCURRING AT THE CAPITOL THERE. THIS WILL LIKELY BE IN EARLY OCTOBER SPECIAL SESSION TO TALK ABOUT SCHOOL CHOICE AND ESSAYS. AND THAT BUILD SAY THAT BUILT THE S B. A THEY DID NOT ULTIMATELY PASSED THE HOUSE, UH, DURING THE REGULAR SESSION, SO IT SEEMS LIKE THERE IS A LOT OF MOMENTUM MORE THAN THERE WAS PREVIOUSLY. UM BUT IT SEEMS LIKE IT IS A VERY FOCUSED AT LEAST IF IT'S GOING TO HAVE SUCCESS IN THE HOUSE SIDE, IT'LL IT'LL BE MUCH MORE PARED DOWN AND REALLY PROBABLY FOCUSED ON A LIMITED NUMBER OF STUDENTS. PERHAPS YOU KNOW, YOU HEAR, YOU KNOW SPECIAL NEEDS STUDENTS OR STUDENTS IN LOW PERFORMING DISTRICTS OR, YOU KNOW OTHER STUDENTS AND MAYBE IN CATEGORIES OF DISADVANTAGED CATEGORIES THAT WOULD BE ABLE TO TAKE ADVANTAGE OF THIS, SO WE'LL SEE WHAT COMES OF IT. THERE'S A LOT LEFT TO BE DONE BEFORE THAT.

THAT DOES HAPPEN, BUT THE GOVERNOR IS STRONGLY BEHIND IT, AND THERE ARE UH OTHER MEMBERS THAT ARE REALLY PULLING FORWARD AS WELL. SO ADVOCACY STRATEGY AND JUST TALK A LITTLE BIT ABOUT WHAT THAT ENTAILED DURING SESSION. I'M SURE ALL OF YOU HAVE SEEN YOU KNOW THE STRATEGY LEGISLATIVE STRATEGY THAT THE TOWN PUT TOGETHER. IT'S VERY GOOD. VERY WELL. THOUGHT OUT. WE YOU KNOW, ARE TASKED WITH KEEPING AN EYE ON LEGISLATION THAT WOULD AFFECT THE TOWN.

WHETHER THAT BE, YOU CAN SEE THE LIST OF CATEGORIES ABOVE TRANSPORTATION INFRASTRUCTURE, ECO DEVO PUBLIC SAFETY, ESPECIALLY WHEN THERE'S OBVIOUSLY WE WERE YOU KNOW IT WAS. IT WAS A PLEASURE TO SEE YOU KNOW THE TOWN HONOR. UM THOSE SERVING THE COMMUNITY.

AND SO IT'S REALLY A LOT OF DIFFERENT, UM, FACTORS YOU KNOW, PLAYING INTO YOU KNOW THAT PARTICULAR YOU KNOW WHETHER IT BE BORDER OR MUNICIPAL, YOU KNOW, EFFORTS TO INCREASE FUNDING AND IMPROVE, YOU KNOW THE SAFETY AND ABILITY FOR OUR OFFICERS AND FIRE, YOU KNOW OFFICIALS TO DO THEIR JOB. FISCAL MANAGEMENT BROADBAND ACCESS, UM OPEN GOVERNMENT WILL TOUCH ON YOU KNOW, SOMETHING REALLY DID OPEN GOVERNMENT SPECIFICALLY THAT WE WORKED ON THAT THE CITY OR THE TOWN HAS BEEN DEALING WITH, YOU KNOW, FROM A POSTING STANDPOINT A LITTLE BIT LATER. UM MOSTLY LAND USE RELATED, BECAUSE I THINK THAT'S THE MOST RELEVANT TO WHAT YOU ALL ARE PROBABLY GOING TO BE CONFRONTING, UM, HERE SOON MOVING FORWARD AND SO KIND OF ONE OF THE CENTRAL THEMES FOR LAND USE DEVELOPMENT.

AT LEAST WAS, YOU KNOW, THE LEGISLATURE REALLY TRIED TO LOOK INTO AFFORDABILITY AND ACCESSIBILITY. AS YOU KNOW, HOME PRICES HAVE BEEN SKYROCKETING HERE. INTACT IS, UM SO A LOT OF THE BILLS YOU'LL SEE KIND OF FAVORITE DEVELOPERS AND LANDOWNERS, AND YOU CAN MAYBE SAY AT THE DETRIMENT TO COMMUNITY PLANNING, AT LEAST WITH THE MUNICIPAL LEVELS. SO WHAT WE EXPECT IS A LOT OF BILLS TO COME THROUGH THE DOOR. GONNA NEED SOME TWEAKING, MOVING TWEAKS MOVING FORWARD AND SEE HOW THEY WORK FROM A LOCAL GOVERNMENT STANDPOINT. FOR EXAMPLE, THE THIRD PARTY INSPECTIONS PLATT AND DEVELOPMENT PLANS THOSE ON THEY TRIED TO IMPLEMENT AS SHOT CLOCK TO WHERE THERE WHEN THERE'S NO ACTION TAKEN ON DEVELOPMENT PLAN THAT THERE CAN BE A THIRD PARTY REVIEW AND KIND OF WHAT'S MISSING IN THAT YOU CAN EITHER BE DONE BY AN ENGINEER, SOMEBODY ELSE AT THE CITY GOVERNMENT, AND SO WHAT'S MISSING FROM THAT JUST TO HIGHLIGHT A PINPOINT IS WHAT THEY DIDN'T CONTEMPLATE IS WHAT HAPPENS IF THEY COME UP WITH A RULING THAT DOESN'T FALL IN LINE WITH REGULATIONS, SO WE EXPECTED THAT BILL WILL NEED SOME FURTHER. THAT'S GOING TO HAVE SOME IMPLEMENTATION PROBLEMS AND WILL BE WANTING TO HEAR FROM THE CITY PROSPERED. UNDERSTAND WHAT THOSE ARE MOVING FORWARD SO WE CAN TAKE SUGGESTIONS TO THE LEGISLATURE. UM NONCONFORMING USES. THIS IS, FOR EXAMPLE, HAS BEEN IS WHENEVER YOU GET, LIKE, MAYBE SOME KIND OF OVERLAY DESIGN NARGIS DISTRICT SOMETHING LIKE THAT. THAT UM THAT ZONING CHANGES AND EXISTING BUSINESS THAT WAS THERE NO LONGER CONFORMS TO THAT USE THE KIND OF IMPLEMENTED SOME TYPE OF COMPENSATION SIMILAR TO EMINENT DOMAIN. WERE REQUIRED TO MAKE SUBSTANTIAL CAPITAL CONTRIBUTIONS FOR PLANT EXPANSION FOR THE DOPE RANCH.

AND BASED ON THOSE PRESSURES WERE RECOMMENDING A 7. BLENDED INCREASE AND WHAT THAT MEANS IS 6. ON THE WATERSIDE 9% ON THE WASTEWATER SIDE WATERS ROUGHLY TWO THIRDS OF OUR EXPENSE. AND SO THAT'S WHY THE BLENDED RATE COMES OUT. 7% BUT THIS IS THE PURSE RATE INCREASE SINCE 2019.

ON THE SOLID WAY SIDE. UH, WE'RE CREATING THAT WE CREATED A SOLID WASTE FUND LAST YEAR WITH THIS RFP, UH, AND THE NEW CONTRACT IN FEBRUARY 1ST OF 20 FOR THE SOLID WASTE FUND WILL BECOME SELF SUPPORTING. UH STORMWATER DRAINAGE. WE ARE ADDING TO POSITIONS BUT WE'RE NOT RECOMMENDING A RATE INCREASE. AND THEN THERE WERE VARIOUS PERSONNEL COMPENSATION CHANGES.

WE HAVE A MERIT INCREASED BUDGETED AT AN AVERAGE OF 3% AND MARKET ADJUSTMENTS OF 6% FOR POLICE 3% FOR FIRE. AND THEN ALL OTHER EMPLOYEES WHO ARE 5% BEHIND MARKET. WE WOULD ADJUST THOSE. BUT IF A PARTICULAR POSITION IS NOT BEHIND MARKET, THEY WOULD SIMPLY GET THEIR MERITS. AND THEN HERE ARE THE POSITIONS LISTED. UM HEAVY EMPHASIS ON POLICE THIS YEAR, AS YOU CAN SEE. I BELIEVE THERE WAS A ROBUST LEVEL OF SUPPORT FOR EACH STAFFING. RECOMMENDATION THAT WAS IN THERE. UM AS WELL AS THE I WANT TO ALSO BE SIGNAL MAKE IT A SIGNIFICANT DOLLAR FIGURE THAT THE COUNCIL IS ALLOCATING TO BRING STAFF MEMBERS WHO IT IS BASED ON THE MARKET STUDY. WE'RE BRINGING THAT UP TO MARKET. AND SO THAT IS THE COMMITMENT. WE TALKED ABOUT MUNICIPAL EXCELLENCE IN ALL AREAS AND SPECIFICALLY PUBLIC SAFETY.
