UM THERE'S A SECTION IN THE LOCAL GOVERNMENT CODE THAT REQUIRES MUNICIPALITIES WITH A POPULATION OF OVER 20,000 TO ADAPT AN IRRIGATION ORDINANCE. ADDITIONALLY, THAT SECTION UM.
551.6 OF THE LOCAL GOVERNMENT CODE REQUIRES THE IRRIGATION ORDINANCE THAT WE ADOPT IS AT LEAST AS STRINGENT AS T C Q REQUIREMENTS FOUND IN CHAPTER 3 44. SO LAST YEAR, OUR POPULATION SURPASSED 20,000 OFFICIALLY WHEN THE 2020 CENSUS RESULTS CAME OUT IN THE SPRING. AND LAST FALL, WE CAME TO YOU AND PASSED PHASE ONE OF OUR IRRIGATION ORDINANCE. UM, AND THAT ORDINANCE, UM GET US INTO SUBSTANTIAL COMPLIANCE WITH THE THC ACUTE RULES WITH ONE EXCEPTION, UM SO IT WAS ASKED AT THAT TIME THAT WE COMPLETED A PUBLIC OUTREACH PROGRAM. TO INFORM OUR CITIZENS OF WHAT WAS COMING WITH PHASE TWO OF THAT ORDINANCE. WE HAVE COMPLETED THAT PROGRAM. AND ANTICIPATE BRINGING PHASE TWO OF THE IRRIGATION ORDINANCES TO YOU. ON THE AGENDA FOR THE NEXT COUNCIL MEETING. SO PHASE. ONE OF THE ORDINANCE WAS A FAIRLY COMPREHENSIVE IRRIGATION ORDINANCE THAT COVERED UP A HOST OF THINGS, INCLUDING, UM, LICENSE CHECKING, REQUIRING A PERMIT. SO WE HAVE BEEN REQUIRING THE ANNUAL TESTING. UM AND, UH SENIOR BACKFLOW INSPECTOR TRAVIS KAMAL AND OUR PUBLIC WORKS DEPARTMENT HAS DONE A FAIRLY EXTENSIVE PUBLIC OUTREACH PROGRAM, STARTING EVEN BEFORE PHASE ONE OF THE ORDINANCE. UM HE MET WITH THE PRESIDENT AT THEIR QUARTERLY MEETING HE SENT OUT HOST OF BROCHURES TO ALL THE RESIDENTS WITH SEPTIC PERMIT OR SEPTIC SYSTEMS. UM THEY PUT INFORMATION ON THE PUBLIC WORKS WEBSITE. UMS OF PHONE CALLS AND EMAILS AND HE'S MET WITH A GREAT DEAL OF A GREAT MANY RESIDENTS TO EXPLAIN THE REQUIREMENTS. UM SO AS WE MOVED INTO PHASE TWO PHASE TWO OF THE IRRIGATION ORDINANCE WILL BE, UM IT'S JUST ONE LINE ITEM.UM THAT'S WHAT I DO IS IF YOU HAVE AN IRRIGATION SYSTEM ON A PROPERTY THAT ALSO HAS A SEPTIC SYSTEM. UM THAT IRRIGATION SYSTEM. UM IS A DESIGNATED HEALTH HAZARD, AND THAT'S A DEFINED TERM AND IN THE IRRIGATION ORDINANCE, UM AND BECAUSE IT'S A HEALTH HAZARD.
WE'RE GOING TO NEED A MORE ROBUST BACKFLOW DEVICE. WHICH IS AN RPC, OR REDUCED PRESSURE ZONE , ALSO KNOWN AT TIMES HAS REDUCED PRESSURE BACKFLOW ASSEMBLY THAT'S THE ABOVE GROUND DEVICE THAT YOU SEE. A LOT OF TIMES IT'S GET THE INSULATED BAG AND THE FAKE ROCK. IN PEOPLE'S FRONT YARDS AND THAT WILL BE REQUIRED IN PLACE OF THE DOUBLE CHECK THAT WE COMMONLY SEE ON, UM AND MORE TRADITIONAL SINGLE FAMILY ARTS. SO THIS WILL APPLY TO ALL NEW IRRIGATION SYSTEMS WHERE THEY'RE SUBJECT. IT WILL ALSO APPLY WHEN THERE'S A MAJOR ALTERATION TO THE EXISTING SYSTEM. WHICH MEANS IF YOU'RE DOING REPAIRS OR ANYTHING WHERE THE MAIN WATER LINE AND YOUR IRRIGATION LINE BECOMES LOSES PRESSURE. OPEN TO THE ATMOSPHERE THEN YOU'RE GOING TO HAVE TO REPLACE WITH THE ABOVE GROUND. RPC IN ADDITION, UM WITH THAT ANNUAL TESTING REQUIREMENT. IF THE THIRD PARTY TESTER IF THE DEVICE FAILS THE TEST AND THE THIRD PARTY TESTER NEEDS TO REPAIR THE DEVICE. HE CAN REPAIR IT IN GROUND. YOU CAN TAKE IT APART. TAKE THE TOP OFF AND HE'S GOT TO REPLACE GASKETS OR SEALS OR SOMETHING OF THAT NATURE. HE CAN DO IT, BUT HE'S GOT TO REMOVE THE DEVICE. UM AND IT'S GOING TO HAVE TO BE REPLACED WITH THE ABOVE GROUND, RPC. SO THAT IS, UH THE PROPOSED ORDINANCE AND OPENED IT UP. THANK YOU FOR YOUR TIME AND OPEN IT UP TO ANY QUESTIONS. ONLY UNDER THESE CONDITIONS RIGHT IF THEY'RE MAKING A MAJOR REPAIR OR YES, AS LONG AS THE AS LONG AS THE IN GROUND DEVICE IS TESTABLE. AS LONG AS THEY'RE NOT MAKING A MAJOR ALTERATION. IT WILL BE ALLOWED TO REMAIN IN PLACE FOR THE LIFE OF THE DEVICE. AND JUST FURTHER CLARIFYING. SO FOR REQUIRING THIS I'M ASSUMING, YOU KNOW, WITH IS THERE A GRACE PERIOD FOR THEM TO CHANGE IT OUT? HAVE YOUR ON SITE SEWER MAINTENANCE PROGRAM. OR IS THIS A SECOND INSPECTION A DIFFERENT COMPLETELY DIFFERENTLY? A TOTALLY SEPARATE RESPECT. SEPARATE OKAY? IN ADDITION TO WHAT YOU'RE ALREADY HAVING TO DO WITH THE COUNTY BECAUSE YOU HAVE TO REPORT THAT TO THE COUNTY. UM AND NOW WITH THIS, THEY WILL HAVE TO REPLACE IT IF THE DOUBLE CHECK IS UN REPAIRABLE. THEY WILL HAVE TO REPLACE IT WITH AN RPC. UM AND THAT IS A MORE AS I SAID, IT'S A MORE ROBUST DEVICE. IT'S ALSO MORE EXPENSIVE THAN MOST. IN ADDITION, IF YOU HAVE A HOUSE THAT REQUIRES SPRINKLERS WITH IT HAS A BACKFLOW DEVICE ON IT ALSO, SO YOU COULD HAVE OH, WELL. BACKFLOW DEVICE AND IRRIGATION BACKFLOW DEVICE. AND A SPRINKLER SYSTEM. BACKFLOW DEVICES REQUIRE THREE DIFFERENT INSPECTIONS ANNUALLY. THAT'S I JUST WANT TO MAKE SURE EVERYBODY IS AWARE OF WHAT WE'RE GOING DOWN TOWARDS THOSE FEES GO TO THE THIRD PARTY. WE'RE NOT NO TOWN COLLECTED $25 FEE. ALSO, I BELIEVE SO BECAUSE THEY MAINTAIN THAT DATABASE OF NO.
