[2. Receive an update from the Public Works Department. (FJ)]
GONNA HAVE AN UPDATE FROM THE PUBLIC WORKS DEPARTMENT. FRANK JARMAN. THANK YOU FOR JOINING US, FRANK. OH, I WILL SAY THAT MOST FOLKS I HAVE TO GIVE IT GIVE IT TIME LIMIT TO I'M GONNA GIVE YOU A TIME THAT YOU CAN YOU NEED TO EXPAND A LITTLE BIT, YOU KNOW, BECAUSE YOU I KNEW YOU'D BE DONE IN THE FIRST MINUTE. YEAH NO, THANK YOU, FRANK CONSTANTLY. I APPRECIATE IT. BUT WE'VE BEEN DOING WHAT WE'RE AT. THE PUBLIC WORKS. IT'S BEEN VERY EXCITING. REALLY TREATED HAS GOTTEN A LOT BETTER. AND TO SEE YOU. I WANT TO START OFF WITH MCDONALD. HEART YOU CAN SEE 29 TOTAL. EMPLOYEES. UNDERWATER. THIS ALSO INCLUDES OUR ENVIRONMENTAL COORDINATOR. I'M SORRY. THAT INCLUDES OUR ENVIRONMENTAL COORDINATOR. FOG TECHNICIAN AND IRRIGATION SPECIALIST KIND OF TOUCH ON THE IRRIGATION SPECIALIST LATER, OUR FAULT TECHNICIAN GOES TO RESTAURANTS CHECKS GREASE TRAPS, WHERE THE ONLY METROPLEX TOWN THAT DOES THAT WE ACTUALLY NOT JUST MANIFEST WE GO. WE LOOK AND MAKE SURE THAT THAT FAT GREASE AND OIL DOES NOT GET A NURSERY SYSTEM. 98% OF ALL, UH, SEWER BACKUPS ARE CAUSED FROM OIL FATS AND GREASES. HERE'S OUR WASTEWATER. THERE'S ONLY 17 EMPLOYEES. AGAIN WE ALL HAVE. WE HAVE A SUPERINTENDENT AND THE[00:10:04]
SUPERVISOR CREW LEADERS THAT DO THE WORK. STREETS. VERY LEAN. WE'RE DOWN TO PEOPLE, BUT WE'RE HOPING TO GET THEM FILLED THIS WEEK. WE START WITH THE SUPERINTENDENT. WE HAVE TWO SUPERVISORS. WE JUST ADDED STREET SUPERVISOR FOR SIGNS AND SIGNALS, WHICH HAS BEEN A VERY BIG HELP. WE'RE HAVING A LOT OF PROBLEMS WITH THE PROSPER TRAIL . PRESTON INTERSECTION. I'M SURE YOU ALL KNOW ABOUT IT. WE ARE ON TEXTILE. WE'VE BEEN CALLING THEM ALMOST DAILY. THEY DO KNOW THEY HAVE A PROBLEM. IT ISN'T THE CONTROLLER. THEY ARE GOING TO CHANGE IT. WE KEEP ASKING THEM WHEN, BECAUSE I KNOW CHIEF DOESN'T LIKE SENDING PEOPLE OVER THERE EVERY SO OFTEN, BUT WE ARE ON TOP OF IT. WE KNOW IT AND WE'RE PUSHING AS HARD AS WE CAN WITHOUT. ROUGHLY EVERY FEATHERS.UH SOME OF THE ACHIEVEMENTS ACCOMPLISHES THAT WE'VE GONE THROUGH LAST YEAR. SIXTH STREET . EXCUSE ME, SIX STREET, CROWN COLONY AND PACE WORK. WE TOOK THE ASPHALT MADE CONCRETE RESIDENTS WERE I'M SORRY. OKAY RESIDENTS WERE VERY HAPPY WITH THIS, ESPECIALLY THE ONE ON PACE WORK. THEY HMM. HAD A ROAD THAT WAS BARELY PASSABLE. ARE ADOPTED. STREET SIGN ARE ADOPTED STREET PROGRAM IS ONGOING. WE NOW HAVE 36 STREETS ONLY 28 AREL WANTED TO GET OUT EVERY QUARTER AND PICK UP TRASH ON A NICE STREET. JUST LET ME KNOW. WE PROVIDE BAGS, GRABBERS AND VESTS. WE NOW HAVE CERTIFIED WATER PROFESSIONAL DOESN'T NEED DESIGNATIONS FOR TWO OF OUR EMPLOYEES. AND WHAT THAT MEANS IS THEY'VE TAKEN ALL THE COURSES THROUGH. THROUGH TEAK AND THROUGH TEXAS A AND M AND ONLY RIGHT NOW, THE LAST TIME I CHECKED, THERE'S ONLY 220, THE STATE OF TEXAS. WE HAVE TO BY THE ANOTHER FOUR MONTHS. WE'RE GOING TO HAVE TWO MORE. ARE WE'VE COMPLETED OUR EMERGENCY RESPONSE PLAN AND RESILIENCE PLAN THAT'S MORE OR LESS AFTER THE I THINK IT WAS TWO YEARS AGO , WHEN WE HAD THE WINTER STORM, THE E P A AND THE GOVERNMENT CAME BACK AND SAID, WE WANT A PROGRAM SO WE HAD TO GIVE HIM A PROGRAM. THE ONLY THE ONLY PROBLEM WE HAVE WITH THAT PROGRAM IS A DIESEL GENERATOR AT CUSTER. WE ONLY CARRY ABOUT 1000 GALLONS OF DIESEL, BUT WE WERE ABLE TO SUPPLEMENT IT WITH THE SCHOOLS. DIESEL TOO, BECAUSE WE HAVE TO RUN FOR 48 HOURS. WE'RE SO AND HOPEFULLY IN THE NEXT YEAR. WE'LL HAVE THAT BECAUSE WE'RE GONNA HAVE OUR FEELINGS STATION INSTALLED. OUR IRRIGATION ORDINANCE. PHASE ONE WAS ADOPTED LAST YEAR, AND THIS YEAR WE'RE BRINGING THE SECOND PART TOO. YOU WORKING WITH WITH PEOPLE UPSTAIRS? WE HAVE MAINTAINED OUR SUPERIOR PUBLIC WATER SUPPLY FOR 16 YEARS NOW.
AND IT'S SOMETHING TO BE PROUD OF. AND WHEN ONE OF THE THINGS I KEEP HAVING FUN WITH YOU ON HIS THE RAILROAD CROSSING, REPAIR IT PROSPER TRAIL. HE GOT THE DRAWINGS DONE, AND WE STEPPED IN AND GO GOT IT FINISHED FOR HIM CARRIED HIM ACROSS THE LINE ON THAT ONE. SOME OF THE ACHIEVEMENTS THAT WE DO WE SMOKE TESTED IN THE SUMMER, YOU'LL SEE SMOKE COMING OUT OF THE GROUND.
THAT'S WHERE SMOKE TESTING WE SMOKED, TESTED ABOUT 70. YOU CAN SEE 69,000 IN YOUR FEET. WE FOUND 41 DEFICIENCIES. SO NOW WHAT WE'LL DO IS WE'LL GO THROUGH AND FIX THOSE DEFICIENCIES. THE BEST WE CAN, SOME OF THEM. WE PUT ON A LIST 2 TO 3 YEARS. SOME OF THEM AREN'T THAT BAD. WE HELP THE SPRING CLEANUP, WHICH, AS YOU CAN SEE THE AMOUNTS OF PAPER THAT WE SHREDDED 5100. WE HAD £2200 OF ELECTRONIC AND £40,000 OF TRASH. YEAH THAT SPRINKLE VALUATION PROGRAM THAT WE JUST STARTED. STAFF HAS COMPLETED 194 EVALUATIONS. THIS IS WHERE WE GO TO YOUR HOME. WE WORK WITH YOU WITH YOUR IRRIGATION SPRINKLER. IT'S SPRINKLER SYSTEM. AND SO FAR WE HAVE YET FOUND ONE THAT WAS THAT NEEDED ADJUSTING. WE GO THROUGH EVERY ZONE. MAKE SURE IT'S WATERING ENOUGH NOT TOO MUCH. SO AND THAT'S AND WE'VE PROBABLY GOT 200 PEOPLE WAITING TO GET IT DONE. COME ON. THERE WE GO. THIS IS THE FUN ONE. THE CHALLENGES. NEXT YEAR. WE'RE GOING TO HAVE TO HAVE AN EFFECTIVE CONSERVATION MONITORING ENFORCEMENT PROGRAM.
UH STRINGENT, INEFFECTIVE MEASURE WILL BE NEEDED TO MAINTAIN PROPER WATER FOR THE SUMMER OF NEXT YEAR. 23 TOOK . WE ARE MAXED DAY WAS 18 MILLION GALLONS. THAT. AND WHAT ? THAT'S NOT WHAT SCARES ME. IT WAS THE RATE THAT WE HAD TO RUN. WE HAD TO RATE RUN AT A RATE OF
[00:15:06]
33 MILLION GALLONS PER DAY. SO THAT DOESN'T MEAN WE CAN SUPPLY 33 MILLION GALLONS. WITH OUR SYSTEM. WHERE. AT THE LIMIT ABOUT 19 TO 20 MILLION. WITH THE CURRENT HOW IT'S CONFIGURED. SO WE ARE UPDATING THE. OUR WATER CONTROL PLAN OUR MEASUREMENTS WITH NORTH TEXAS. EVERY FOUR YEARS. THIS IS THE FOURTH YEAR THAT WE HAVE TO DO IT. RIGHT NOW, ONE OF THE BIGGEST THINGS WE ALSO HAVE IS HIRING. WE HAVE SEVEN PEOPLE IN WATER. SEVEN WASTEWATER INTO THE STREETS. AS SOON AS WE GET THEM TRAINED, TRAIN THEM UP. NO, IT'S A MARKET FOR THEM. I'M TALKING WITH T E X OR EXTENSION. AND THEY'RE NOT SEEING THE EMPLOYEES LIKE THEY USED TO COME FOR TRAINING.THEY'RE SAYING IT'S A DYING FIELD. I HOPE I HOPE THEY'RE WRONG. WE HAVEN'T WE HAVE TO DO WORK ON OUR CITY WORKS IN ONE CAMP TO INTERROGATE THEM. NOT IN INTEGRATED IN, BUT IT IS AN INTERROGATION. TRYING TO GET IT ARE WIND CAN SYSTEM IS WHAT WE WHEN WE CAMERAS ARE SEWER. WE CAN PUT IT. WE WANT TO BE ABLE TO TAKE IT TO OUR CITY WORK SYSTEM. POKER BUTTON, PUT IT AND SAY WE JUST DID THIS LINE AND DROP THAT VIDEO. SO IF WE GO BACK, WE CAN JUST HIT THAT LINE AND EVERYTHING COMES UP RIGHT NOW SAID HE WORKS IS REALLY GOOD. WE CAN DO A LOT WITH IT.
BUT THAT COMBINATION WE'RE STILL HAVING PROBLEMS WITH AS YOU ALL KNOW, MATERIAL SHORTAGES. LEAD TIMES. I THINK IT'S JUST A COUPLE OF WEEKS AGO. THE TRUCK. TRY THE SWEEPER. 89 10 MONTHS AND THEY'RE NOT EVEN GIVE ME A DATE YET AND THEY'VE GOT THIS. WE'RE WORKING WITH G. I S WE STILL HAVE A LOT OF MISSING ASSETS WHEN I SAY ASSETS, WATER LINES, SEWER LINES. MAN HOLDS VALVE STUFF LIKE THAT HAD JUST, YOU KNOW, GROWING TOWN. ANOTHER ONE IS TO EC Q AND EPA KEEP COMING UP WITH NEW RULES AND REGULATIONS THAT WE HAVE TO STAY WITH. A LOT OF IT'S BEEN IN WATER TESTING. WE HAVE A VERY LARGE AND COMPETENT WATER TESTING GROUP FOR THAT. WHAT.
TOUCHING. WHAT'S NEXT IS WE ARE WORKING ON HI POINT DRIVE IS SUPPOSED TO BE DONE IN MARCH MARCH, APRIL, PROBABLY DONE JANUARY AT LEAST. YOU'RE GONNA IRRIGATION ORDINANCE COMING NEXT TIME. WE'VE GOT BECAUSE THE SMOKE TESTING AND OUR TV WE HAVE MANHOLES TO RE TO REDO. WE'RE JUST PUTTING THE FINAL DATE. DATA IN ON THE DATA COLLECTION SYSTEM FOR THE PAVEMENT. THAT PROGRAM WILL PROVIDE US THE ABILITY THAT WHEN WE CAN PUT NUMBERS IN. WE CAN DECIDE AT WHAT LEVEL DO WE WANT TO REPLACE IT AT REPLACEMENT, YOU KNOW, GIVE US A 5 10 15 YEAR PROGRAM ON WHERE WE ARE RIGHT NOW. WE'RE WORKING WITH CONTRACTOR ON THE FUELING STATION NOT REAL HEAVY YET BECAUSE YOU STILL HAVE TO FIGURE OUT WHERE IT'S GOING TO GO INTO PUBLIC WORKS AND PARK SITE. AND WE'RE ALSO GOING TO BE WORKING AT PUBLIC WORKS FOR PROFESSIONAL CERTIFICATIONS. BUT RIGHT NOW, WITH 15 DOWN. IT'S HARD TO SEND PEOPLE TO A LOT OF CLASSES. BUT NOW WE'RE TRYING TO KEEP JUST TO KEEP THE LICENSES UP. SO THAT WAS KIND OF OFF. WE'RE JOINED UP AS WE CAN. SO IF I HAVE ANY QUESTIONS, ANY QUESTIONS, I'M HERE TO ANSWER THEM. THANK YOU. THANK YOU.
THANK YOU VERY MUCH. THANK YOU VERY MUCH. QUICK QUESTION. I'M SORRY HE WAS TRYING TO GET OFF.
UH, YEAH. SO I DIDN'T SEE ANYTHING REGARDING THE PUBLIC WORKS FACILITY. MASTER PLAN. IS THAT SOMETHING? YES THAT THAT'S GOING ON. WE'RE DAN AND I ARE WORKING ON IT. RIGHT NOW. IT'S A PUBLIC WORKS AND PARKS MASTER PLAN. OKAY WE'RE PROBABLY WE'VE HAD SEVERAL MEETINGS WITH THE ARCHITECT AND THE WITH FREEZING NICHOLS. THEY JUST SENT ME SOMETHING THIS MORNING. I HAVEN'T LOOKED AT IT YET. BUT YES, THAT IS ONGOING. IT'S PROBABLY 25 30% OKAY, PERFECT.
THAT'S THAT'S PERFECT. JUST FOR CLARIFICATION, YOU SAID ON THE CHALLENGES AND TRENDS. THE TOWN CAN CAME IN. THE MAXIMUM IS 33 MILLION GALLONS A DAY AND WE'RE AT 18. OKAY SO ABOUT TWO THIRDS OF OUR CAPACITY. NO NOT SORRY. THEY WENT UP TO A HIGH RATE OF 33 MILLION GALLONS. THAT'S OKAY . WHAT IS YOUR HIGHEST WEIGHT CLASS? 18 MILLION MOSTLY PUMPED IN ONE DAY. WHAT'S YOUR RATE CAPACITY? YOU SAY 33 33. THAT'S THE MAP. THAT'S A MATCH. WE MIGHT BE. YOU KNOW, IF THE TANKS ARE A LITTLE LOW, WE COULD PROBABLY GET A LITTLE BIT MORE. BUT IT'S NOT JUST YOU KNOW, IT'S JUST NOT. WE CAN'T PUMP 33. YOU HAVE TO, YOU KNOW, IT'S BECAUSE OF I HAD A GUY ALL SUMMER LONG
[00:20:02]
WORKING FROM 10 TO 6. AND SCATTER. MANIPULATING IT. UH PROBABLY EVERY 15 TO 20 MINUTES.FILL THE TANK OUT WEST TO FILL THE ONE NONPROFIT TRAIL ONE IN CRAIG. KEEP THIS PUMP OFF THAT PUMP ON OUR BIGGEST THING IS REDUNDANCY. DURING THE SUMMER. THERE'S NO PUMPS NOT RUNNING. IF ONE GOES DOWN. IT'S THE WRONG ONE THAT COULD HURT US. ENGINEERING IS UNDER CONSTRUCTION. FOR THE LOWER LOWER PLANK. ONCE THE LOWER PLAINS IN. BUT THAT'S 2024. IT'S BRAIN, RIGHT? GREAT. ANY OTHER QUESTIONS, FRANK QUESTION IN REGARDS TO PRESTON ROAD AND SPECIFICALLY ON THE MEDIANS. DO WE MAINTAIN THE CONDITION OF THE MEDIAN. LIKE OKAY. UH ARE YOU ASKING THE LANDSCAPING SIDE OR THE CONCRETE SIDE? CONCRETE CUBS ARE INTELLECTUAL THEM ASKING THEM. WE DO PUT THE MEETING ALERTS AND WE JUST GOT THAT WE ORDERED IT BACK IN, UH, APRIL. I THINK, MEGAN AND IT CAME IN ABOUT ABOUT SIX WEEKS AGO BEFORE WEEKS AGO. OKAY ONCE WE GET CAUGHT UP WITH THE POTHOLES PAINTING SIGNS. WE'RE GOING TO START REPLACING BECAUSE THERE'S A LOT OF THEM REPLACING. OKAY BECAUSE I'VE JUST NOTICED RECENTLY THAT THE THAT THEY'RE CHIPPING. I DON'T KNOW IF PEOPLE ARE HITTING THEM OVER AND OVER. THEY ARE OKAY BECAUSE THE ACTUAL PIECES ARE GETTING OUT INTO THE ROAD, AND IT'S LIKE IT LOOKS LIKE THERE'S ALMOST LIKE A FAILURE OF THOSE, BUT IT MAY JUST BE A REGULAR USE BECAUSE IT'S SUCH A HIGH A LOT OF IT'S RETURNING, BUT SOME OF ITS FROM CRACKING. OKAY, OKAY, THANKS. ALL RIGHT. THANK YOU, FRANK FRANK. I'M GOOD. THANK YOU APPRECIATE IT. ALRIGHT THE NEXT AGENDA ITEM IS THE CONSENT
[CONSENT AGENDA]

[Items 8 - 11]
OKAY AGENDA. ITEM NUMBER EIGHT. CONSIDER AN ACT UPON AWARDING RFP NUMBER TWO ZERO 2 2-58 DASH A FOR MEDICAL ADMINISTRATIVE SERVICES ONLY IF EFFECTIVE JANUARY 1ST 2023 AUTHORIZING THE INTERIM TOWN MANAGER TO EXECUTE ALL DOCUMENTS FOR THE SAME MR JAMES EDWARDS ARE HR DIRECTOR.GOOD EVENING. UM, THANK YOU FORR ALL FOUR ITEMS. OKAY? OKAY SO WE'LL OPEN NUMBER NINE AS WELL CONSIDERING ACT UPON AWARDING RFP NUMBER TWO ZERO 2 2-59 DASH A FOR FULLY INSURED DENTAL BENEFITS. INSURANCE EFFECTIVE JANUARY 1ST 2023 AUTHORIZING THE INTERIM TOWN MANAGER TO EXECUTE ALL DOCUMENTS FOR THE SAME OPENING AGENDA. ITEM NUMBER 10 CONSIDER AND ACT UPON AWARDING RFP NUMBER TWO ZERO 2 2-61 DASH A FOR PHARMACY BENEFITS MANAGEMENT SERVICES, EFFECTIVE JANUARY 1ST 2023 AUTHORIZING THE INTERIM TOWN MANAGER TO EXECUTE ALL DOCUMENTS FOR THE SAME AND
[00:25:02]
FINALLY, AGENDA ITEM NUMBER 11 CONSIDER AN ACT UPON AWARDING RFP NUMBER TWO ZERO 2 2-60 DASH, A GROUP CRITICAL ILLNESS WITH CANCER. ACCIDENT AND GROUP HOSPITAL INDEMNITY. INSURANCE AFFECTIVE. JANUARY 1ST 2023 AUTHORIZING THE INTERIM TOWN MANAGER TO EXECUTE ALL DOCUMENTS FOR THE SAME STRAPS. SORRY ABOUT THAT. ALL RIGHT? IT WAS QUITE A BIT. UM THANK YOU, MAYOR PRO TEM AND COUNCIL. UM, AS MAYOR PRO TEM HAS STATED. WE WENT OUT FOR BID FOR FOUR ITEMS. WE USE MCGRIFF, UM AS OUR CONSULTANT TO HELP US WITH THIS BID PROCESS, AND AT THIS TIME, I'D LIKE TO INVITE LANCE PENALTY UP TO KIND OF GO OVER WHAT THE BIG PROCESS WAS IN OUR RECOMMENDATION. MR MAYOR, PRO TIM, MEMBERS OF COUNCIL TOWN MANAGER COULD SEE YOU, LANCE PENLEY MCGRIFF. JUST A BRIEF HISTORY. I'VE WORKED WITH THE TOWN SINCE AROUND 2014. WHEN WE HAD ABOUT 80 EMPLOYEES AND OVERSEEING THE EMPLOYEE BENEFITS PROGRAM SINCE THEN, SO VERY BLESSED TO BE A PART OF YOUR ORGANIZATION AND ASSIST YOU WANT TO RESTATE, SO YOU KNOW AS A AS A PART OF PROCUREMENT. UH AS YOU KNOW, WE TYPICALLY GO OUT TO BID EVERY 3 TO 5 YEARS ON THE HEALTH AND WELFARE PRODUCTS, SO MEDICAL, DENTAL VISION LIFE DISABILITY. R THREE YEARS WAS UP , SO IT WAS TIME TO GO OUT TO BID. AND I'M GOING TO GO THROUGH. UH BASICALLY THE HIGH LEVEL RESULTS OF THOSE ANALYSIS.RESTATING THE GOALS AND OBJECTIVES HERE. UM WE WANT TO MAKE SURE THAT THE COSTS ASSOCIATED WITH MANAGING OUR PLAN OR COMPETITIVE. WE WANT TO MAINTAIN A COMPETITIVE EMPLOYEE BENEFITS PROGRAM FOR OUR EMPLOYEES. IT'S UH, RECRUITMENT AND RETENTION. WE'RE TALKING ABOUT THAT EVERY DAY WITH OUR CUSTOMERS. WE WANT TO PRESS PRACTICE FISCAL RESPONSIBILITY SO THAT WHEN WE COME BEFORE YOU TO SET BUDGETS, AND, UH YOU KNOW, RFP RESPONSES LIKE THAT.
WE WANT TO MAKE SURE THAT WE'RE DOING OUR DUE DILIGENCE FROM A FISCAL RESPONSIBILITY AND WE WANT TO SEEK INNOVATIVE IDEAS TO KEEP COSTS DOWN. UH SO THAT'S MY JOB IS TO HELP THE TOWN IN ALL FOUR OF THESE AREAS. AND THEN WE DO HAVE A SPECIFIC FOCUS MIDRIFF IN THE MUNICIPALITY SPACE. I WORK WITH 14 OF YOUR PEERS AROUND THE METROPLEX IN TEXAS AND OKLAHOMA, SO WE HAVE A VERY CLOSE KNIT. UH YOU KNOW, COMMUNITY OF VENUS PARTY CUSTOMERS. ALRIGHT WE'RE GONNA GO THROUGH THE, UH, THE REALLY THE FINANCIAL ANALYSIS. SO AS WE STATED THERE WERE FOUR RFP S, UH , YOU KNOW, THE FIRST ONE IS ADMINISTRATIVE SERVICES. SO WE ARE SELF INSURED. THE TOWN IS SELF INSURED. UM, OUR IS OUR CURRENT ADMINISTRATOR, UM, ARE OWNED BY UNITED HEALTHCARE, SO WE ACCESS THE UNITED HEALTHCARE NETWORK. BUT WE WENT OUT TO BID TO NOT ONLY LOOK AT THE ADMINISTRATIVE COSTS BECAUSE THAT'S A VERY SMALL COMPONENT, UH, OF THE TOWN'S OVERALL COSTS.
BUT WHAT IS THE NETWORK LOOK LIKE? WHAT IS THE NETWORK ACCESS FOR THE EMPLOYEES? WHAT ARE THE NETWORK DISCOUNTS THAT THE EMPLOYEES AND THE TOWN ARE GOING TO RECEIVE WITH THE VARIOUS VENDORS. SO WE HAD A NUMBER OF RESPONSES. WE HAD SEVEN RESPONSES, ALL THE MAJOR MANAGEMENT HERE ORGANIZATIONS WITH THE EXCEPTION OF CIGNA RESPONDED. WE NARROWED THAT FOCUS ON THIS RFP TO, UM ARE IN TRINITY CAPTIVE GROUP. UM SO WE DID A DEEPER DIVE AT BEST AND FINAL ANALYSIS WITH THOSE TWO THOSE TWO ORGANIZATIONS YOUR INCUMBENT AND TRINITY CAPTIVE, AND THIS IS JUST THE FIXED COST COMPONENT ONCE AGAIN, A VERY SMALL COMPONENT OF THE OVERALL COST, BUT YOU CAN SEE HERE, UM ARE, UH YOU KNOW WE ACTUALLY ARE GOING TO RECEIVE SLIGHT REDUCTIONS TO CURRENT COST. BY LOOKING AT THEM FOR THE DENTAL INSURANCE THAT WE'VE GOT. WE'RE MAKING A RECOMMENDATION FOR COMING UP LATER AND ALSO THE WORKSITE BENEFITS, SO THEY THEY'VE ACTUALLY GIVEN US A REDUCTION OVER CURRENT COST. WE WANT TO TALK ABOUT PLAYING DESIGN. SO THIS RFP STARTED IN JUNE. AND WE HAVE DONE VERY THOROUGH ANALYSIS OF THE FINALISTS SPECIFICALLY, BUT ALL THE VENDORS THAT RESPONDED TO THIS RFP SO WE DO WHAT'S CALLED A REPRICING ANALYSIS. WE DO A DISRUPTION ANALYSIS. WE LOOK AT THE PROGRAMS THAT ARE AVAILABLE . ONE OF THE THINGS THAT WE THOUGHT WAS VERY INTERESTING WITH TRINITY CAPTIVE GROUP AND WHY WE BROUGHT THEM TO A FINAL SELECTION IS THEY WERE DIFFERENT . THEY'RE DIFFERENT THAN THE OTHER RESPONDERS. YOU'LL SEE THE NOTE IN YELLOW THAT ALL THE OTHER RESPONDERS, UH, AS REQUESTED IN THE RFP RESPONDED TO RFP WITH THE PLAN DESIGNS THAT WE HAVE SET FORTH TODAY AND I'LL TELL YOU THE PLANE DESIGNS THAT WE HAVE SET FORTH THROUGH TODAY ARE VERY GOOD. THE
[00:30:02]
EMPLOYEES ARE VERY HAPPY WITH THEM. IF I BENCHMARKED YOU AGAINST ALL OF YOUR PEERS AROUND THE METROPLEX WILL JUST PICK OUT TOWN OF LITTLE ELM AND CITY OF SELENA TO CUSTOMERS OF OURS VERY SIMILAR BENEFITS STRUCTURES TO WHAT YOU HAVE TODAY, AND THE EMPLOYEES ARE VERY HAPPY WITH THAT. UM WE, THE TRINITY CAPTIVE GROUP PROPOSAL ACTUALLY PROPOSED REDUCING THE HIGH DEDUCTIBLE HEALTH PLAN, WHICH IS A MAJORITY OF WHERE OUR, UH OUR EMPLOYEES ARE. I THINK 70% OF OUR EMPLOYEES ARE IN THE HIGH DEDUCTIBLE HELP PLAN WITH THE H S A SO TRINITY CAPTIVE GROUP PROPOSED REDUCING THOSE DEDUCTIBLES AND OUT OF POCKET COST. AND ALSO ON THE P P O PLAN . THEY HAVE A STRUCTURE OF REDUCING THAT DEDUCTIBLE BY HALF TO 7 50, AS WELL AS GIVING A NUMBER OF FREE SERVICES IF YOU USE THEIR PATIENT NAVIGATOR PROGRAM A COUPLE OF NOTES. I'VE GOT DOWN HERE. WE ALREADY HAVE A PROGRAM IN PLACE THAT OFFERS FREE BENEFITS TO THE EMPLOYEES THROUGH THE KEMPTON GROUP. WE'VE HAD THAT IN PLACE FOR A NUMBER OF YEARS. UM AND THE HEART DEDUCTIBLE HEALTH PLAN THAT WAS PROPOSED FROM TRINITY CAPTIVE GROUP CAN BE PROBLEMATIC FROM A COMPLIANCE STANDPOINT. SO I JUST WANT TO POINT THAT OUT, THE FAMILY DEDUCTIBLE WOULD HAVE TO BE MET. UH FULL $3000 DEDUCTIBLE WOULD HAVE TO BE MET ON ANYONE INDIVIDUALS, SO THERE'S RATIONALE. WHY WE HAVE THE PLANT IS ON SET UP. WHY WE DO IT $3000 DEDUCTIBLE FOR INDIVIDUALS, 6000 FOR FAMILY. SO ONCE AGAIN, WE DIDN'T TAKE THAT INTO ACCOUNT OF IN OUR ANALYSIS. ALRIGHT SO I'M GOING INTO OUR RECOMMENDATIONS. AND UH YOU KNOW, WE'LL ALL STOP AT THE END OR YOU KNOW YOU CAN STOP ME DOWN FOR QUESTIONS, BUT ALL OF THESE ITEMS THAT I HAVE LISTED HERE ARE MEASURABLE ITEMS LISTED IN OUR RFP. SO THERE IS A PERCENTAGE TIED TO WHETHER THE PROPOSAL MET OR DID NOT MEET SOME OF THE REQUIREMENTS WE'VE ASKED FOR IN THE RFP AND YOU'LL SEE THAT, UM ARE AND PRODUCTS WE HAVE TO RFP S THAT ARE TIED TOGETHER ON THIS SLIDE. THE MEDICAL ADMINISTRATIVE RFP AND THE PHARMACY RFP BECAUSE THOSE SERVICES ARE TO A CERTAIN EXTENT TIED TOGETHER. WE DO HAVE A SEPARATE CONTRACT WITH PROACT. THAT'S BEEN A VERY UM, GOOD DECISION THAT THE TOWN MADE IN 2021 OF THE REASONS WE LEFT BLUE CROSS TO GO TO, UM, ARE BECAUSE WE WERE ABLE TO HAVE A SEPARATE CONTRACT WITH OUR PHARMACY BENEFIT MANAGER. IT'S BEEN VERY BENEFICIAL AND YOU'LL SEE ON THE ON THE LEFT. WE'VE GOT CHECK MARKS IN EVERY AREA FOR YOU AND LAURA, VERY STRONG NATIONAL NETWORK LOTS OF PUBLIC SECTOR REFERENCES AROUND THE COUNTRY. THE PLAN DESIGNS. LIKE I SAID, THERE'S NO ISSUES WITH THE PLANT DESIGNS. THE EMPLOYEES ARE VERY HAPPY WITH THEM. THEY'RE ALSO HAPPY WITH THEIR HEALTH SAVINGS ACCOUNT CONTRIBUTIONS. SO UM ARE IS GOING TO END PROACTIVE GOING TO BE THE RECOMMENDATIONS FOR RFP 58 DASH A AND R F P 61 DASH A UM, ON THE DENTAL. UH WE, YOU KNOW, PRINCIPLE HAS BEEN A GOOD PARTNER OF OURS. WE'VE HAD A GOOD RATE THROUGH THE LAST COUPLE OF YEARS. BUT UNITEDHEALTHCARE SPLASH THE POT. AH ON THEIR RFP RESPONSE, UH, VERY GOOD RATE STRUCTURE, MULTI YEAR RATE DEAL. THEY'RE OFFERING US INCENTIVES IN OTHER AREAS TO SELECT THEM ON THE DENTAL. SO UH , THE ADMINISTRATION IS RECOMMENDING A MOVE FROM PRINCIPAL TO UNITED HEALTHCARE FOR DENTAL AND THEN THE WORKSITE PRODUCTS IS A REMINDER. THESE ARE VOLUNTARY PRODUCTS. THEY'VE BECOME VERY POPULAR. UM ALMOST ALL OF MY CLIENTS HAVE THEM IN PLACE. NOW WE'RE HAVING A LOT OF BILLING ISSUES WITH ALL STATE AND WE HAVE WE HAVE AN OUTDATED PRODUCT. IT'S CALLED IT. YOU KNOW, IT'S A CANCER PRODUCT, AND WE'VE TRANSITION THOSE PRODUCTS TO MORE OF A CRITICAL ILLNESS, WHICH IS ENCOMPASSES HEART ATTACKS AND STROKES AND VARIOUS OTHER ITEMS IN ADDITION TO CANCER. UM SO WE FEEL REALLY STRONGLY ABOUT UNITED HEALTHCARE HERE. IT'S ALSO GOING TO COORDINATE WHEN SOMEBODY HAS AN ACCIDENT THROUGH THE MEDICAL PLANET MAY COORDINATE A BENEFIT PAYMENT TO THEM IF THEY HAVE ACCIDENT COVERAGE, SO WE'RE VERY EXCITED ADMINISTRATIVELY ABOUT WHAT THAT LOOKS LIKE FOR THE EMPLOYEES. RIGHT SO I WANT TO SUMMARIZE OUR RECOMMENDATIONS HERE. MEDICAL A S O RFP TO, UM ARE THE PHARMACY BENEFIT MANAGER PROACT AND WE ARE REQUESTING THAT THE COUNCIL APPROVED IN ADDITION OF SHARKS, WHICH IS THERE'S NO COST ASSOCIATED WITH SHARKS. IT'S GOING TO BE A PERCENTAGE OF SAVINGS, BUT WE'VE WE'VE MET WITH THE BENEFITS SUBCOMMITTEE, AND THEY'VE SEEN THE NUMBERS THAT SUGGEST. SIX[00:35:01]
FIGURES AND SAVINGS FOR US TO WORK WITH SHARKS REALLY, TO TARGET OUR SPECIALTY PHARMACY COST, WHICH ARE A RISING COSTS IN OUR PROGRAM. I'M WORKING WITH SHARKS AND NEVER OTHER CUSTOMERS . AND THIS IS A VERY, UH FISCALLY MEETS THE FISCAL RESPONSIBILITY BULLET POINT THAT HAD LISTED AT THE FRONT, JUST ONE OF THOSE INNOVATIVE IDEAS THAT'S REALLY GOING TO HELP THE TOWN. AND THEN VOLUNTARY PRODUCTS ALSO, YOU HC. ALTERNATE BACK TO COUNCIL. UM THIS TIME WE DO HAVE A COMMENT, WOULD YOU? WOULD YOU MIND COMING BACK QUESTIONS? THANKS, MAYOR PRO TEM. WE DO HAVE 11 PUBLIC COMMENT. MR JASON DICKSON WOULD LIKE TO SPEAK. TECHNICALLY THE MAYOR WELCOME BEAR COUNCIL. FOR YOUR JOB.JUST IN CASE YOU HAVE A QUESTION. SO FIRST OFF JASON DICKSON 10 50 HI WILLOW PROSPER RESIDENT 20 YEARS, COUNCILMAN. UM I APPRECIATE YOUR TIME. OBVIOUSLY PRESIDENT OF TRINITY CAPTIVE GROUP. I WANTED TO COME HERE AND SPEAK ON YOUR BEHALF. AS MR BENTLEY DID STATE THIS RFP HAS BEEN GOING ON FOR QUITE SOME TIME SINCE JUNE, UM, MENTIONED A COUPLE OF DIFFERENT ORGANIZATION SHARKS. KIMPTON WE'VE WORKED WITH THE MATTER OF FACT, WHEN I SAT IN YOUR CHAIRS. I WAS ONE OF THE PROPONENTS TO BRING KEPT IT IN SO WE COULD EXPAND AND I HAVE SOME FREE SERVICES FOR THE EMPLOYEES AND TALKING WITH SEVERAL EMPLOYEES THROUGH THE YEARS AND DURING THIS RFP PROCESS, UH THEY CAME UP AND THANKED US FOR HAVING THOSE BENEFITS. UM ONE OF THE QUESTIONS THAT WE'RE GOING TO ADDRESS IS COST. THERE'S OBVIOUSLY A COST FACTOR TO IT.
BUT THE REAL QUESTION IS THE BENEFIT TO YOUR EMPLOYEES AND WHAT YOU'RE DOING AND WHAT YOU'RE OFFERING AND CAN YOU MAKE A DIFFERENCE? AND THE 250 EMPLOYEES THAT YOU HAVE ON THEIR DAILY LIVES? UH SO BASICALLY JUST WANT TO BE ABLE TO CLARIFY SOME THINGS, BECAUSE AS I'VE SAT WITH US TEAMMATES AND THAT DIES OR WANT TO GET POWER POINT. THANK YOU. THANK YOU. AS I SAT THERE, AND WHEN I'VE TALKED TO YOU AFTERWARDS GOING, MAN, I DIDN'T KNOW THAT. SO CHARLES THAT 28 PAGE PACKAGES SO YOU HAVE THE FACTS. AND YOU CAN SEE IT FOR YOURSELF. UM THE RFP WAS FOR A S O MEDICAL, WHICH STANDS FOR ADMINISTRATIVE SERVICES ONLY. AND CAPTIVE BENEFITS. THE QUESTION THAT YOU NEED TO ASK YOURSELF. IS DO YOU KNOW WHAT YOUR TOTAL MAXIMUM LIABILITY TO THE TOWN. IN OUR WORLD AND INSURANCE WORLD. WE CALL THAT A PER EMPLOYEE PER YEAR COST.
DEPENDING ON HOW YOU WANT TO SLICE AND DICE AND CHARLES, I'VE SEEN YOU SLICE AND DICE NUMBERS YEARS. WHETHER NO ONE CAN ARGUE YOU'RE SOMEWHERE BETWEEN 13,000 PER EMPLOYEE PER YEAR AND 14,000. OUR PROGRAM MEMBERS ARE LESS THAN 10,000 WITH AN AVERAGE EMPLOYEE DEDUCTIBLE OF 7 50. NOW THERE'S SOME COMPONENTS THAT MIGHT HAVE BEEN LEFT OUT DURING THE PRESENTATION. BUT AS HE MENTIONED YOU SENT OUT AN RFP. 28 PAGE RFP. THERE WAS OVER 50 QUESTIONS, AND ONE OF THE QUESTIONS I WOULD HAVE IS DID THE BENEFITS SUBCOMMITTEE EVEN SEE THOSE FINALIST PRESENTATIONS? YOU PUT THINGS INTO PERSPECTIVE. UM, YOU BUILD A ROAD. YOU HAVE IT ON YOUR ASSETS FOR 20 YEARS, YOU'RE ABOUT TO BUILD FIRST STREET. FROM CALL IT TO CUSTER. GIVE OR TAKE $20 MILLION. THAT'S A MILLION DOLLARS A YEAR. THE DECISION YOU'RE ABOUT TO MAKE IS A $4.5 MILLION DECISION EVERY YEAR. SO HOW MUCH TIME DID YOU PUT IN? PLANNING ORGANIZING PRIORITIZING. AND YOU HAVE TWO FINALISTS. I DIDN'T EVEN SEE A PRESENTATION. THOSE ARE SOME OF THE QUESTIONS WE HAD ASKED NOW. IN TRINITY CAPTIVE. THIS IS THE VERY FIRST SLIDE THAT WE PUT IN EVERY ONE OF OUR PRESENTATIONS TO EVERY ONE OF OUR CLIENTS ALL ACROSS THE COUNTRY. IT'S A SIMPLE DOLLAR BILL 30% OF EVERY INSURANCE DOLLARS GIVE OR TAKE IS FIXED COSTS, ADMINISTRATIVE
[00:40:02]
COSTS 70% OF YOUR CLAIMS. MOST CONSULTANT FOCUSED ON THE 30% BECAUSE IF THEY CAN SAVE YOU 10% WOULD BE THAT'S 3. OUR CLIENTS FOCUS ON THE 70% THAT DRIVES YOUR COST DOWN. BUT THAT WASN'T PUT IN THE PRESENTATION. AND WE'RE GONNA SHOW YOU HOW THE VARIABLE COSTS WOULD DRIVE YOU FROM THE 13 OR $14,000 PER EMPLOYEE PER YEAR COST CLOSER DOWN. LET'S SEE YOU DON'T EVEN GET TO OUR AVERAGE AT 10. LET'S SAY YOU JUST GET TO 12. WHAT WOULD $2000 PER EMPLOYEE PER YEAR. TIMES 250 IS WHAT THIS RFP IS FOR, BUT WE KNOW WHEN YOU START JANUARY ONE, YOU'RE ALREADY GOING TO BE OVER 300 EMPLOYEES. MY DUMB MASSES. THAT'S ABOUT $600,000, OR HALF A CENT TAX RATE. NOW. WHAT MAKES UP INSURANCE COSTS. WE'RE NOT GOING TO GO THROUGH THAT. BUT THE TOWN DOES BEFORE YOU MAKE A DECISION TONIGHT. I STILL HAVEN'T HEARD IN THIS PRESENTATION. WHAT'S YOUR MAXIMUM LIABILITY TO YOUR TOWN IS AND WE'LL GET INTO THAT. WE CAN GO THROUGH ALL THESE NUMBERS. WHAT? YOUR BUDGET. WHAT'S EXPECTED. THOSE ARE SYNONYMOUS. VERSUS WHAT YOUR MAXIMUM I CAN TELL YOU WHAT YOUR MAXIMUM COST IS TODAY IT'S 4.744 MILLION. NOW THAT DOES INCLUDE $280,000 WITH H S A THAT'S YOUR TOTAL PLAN COST. YOUR CLAIMS COST RIGHT NOW IS 3.5 MILLION. OKAY BECAUSE THEY USE A VARIABLE AND WE'LL GET INTO THAT IN A MINUTE. BUT YOUR HS A. YOU'RE SPENDING $238,000 A YEAR. NOW. THE QUESTION I WOULD HAVE FOR YOU. IS THAT STILL YOUR BEST USE OF FUNDS. ONE ARGUE THAT YOU COULD GIVE ALL 250 EMPLOYEES $1000 RAISE. CUT YOUR DEDUCTIBLES IN HALF. AND WE'LL GO THROUGH THOSE NUMBERS PERSON MAKING $50,000 A YEAR. IS A 2% RAISE. THIS COUNCIL IS GOING TO BE SITTING IN FRONT OF YOU THE NEXT SIX MONTHS, PROBABLY DOING A COP STUDY AND YOU'RE GOING TO BE BICKERING OVER A 3% RAISE OR 4% RAISED BECAUSE I DID IT FOR 11 YEARS. AND YOU'RE GOING TO MEASURE YOURSELF AGAINST OTHER MUNICIPALITIES AND GOING WHERE ARE WE AT THE 50TH 70TH OR 90TH PERCENTILE. WE'RE SHOWING YOU THIS ISN'T JUST ABOUT BENEFITS. THE TRINITY CAPTIVE PROGRAM IS ABOUT THE OVER TOTAL COST OF THE EMPLOYEE EXPERIENCE. SO THE QUESTION IS, WHAT IS YOUR PER EMPLOYEE PER YEAR? AT EXPECTED BASED ON YOUR OWN CONSULTANTS, NUMBERS, YOU'RE AT 55 14,005 AT MAXIMUM AT 17,007 17,040. THAT'S DOUBLE. WHERE WE ARE. IF YOU INCLUDE THE H S A 6 18,080. SO OUR PRESENTATION WAS BETTER BENEFITS CUT THE DEDUCTIBLES IN HALF AND OVER THE WAY THE SLIDE WAS IN THE RFP. SO WAS THIS ONE.SO PUT IT IN SIMPLE MATH. YOU HAVE 254 EMPLOYEES IN THE RFP. YOU HAVEN'T RENEWAL AND 4.5, BASED ON THE RFP S NOTES. MAXIMUM EXPOSURE, NOT INCLUDING THE 2 38 PUTS YOU AT THE 47. SO THESE ARE JUST SIMPLE NUMBERS, AND YOU CURRENTLY HAVE A $1500 PP. OH AND A 3000 H S A AND WE'LL TALK ABOUT THAT IN JUST A MINUTE AS WELL. SO A COUPLE OF TALKING POINTS. WHEN THE BENEFIT SUBCOMMITTEE MATT OUR NUMBERS WERE FIRM AND FINAL. UM, RS WERE NOT. THOSE ARE THE NUMBERS THAT REPRESENT 70% OF YOUR PLAN COST. WHY WAS IT NOT NOTED? AND NOT ONLY WAS IT NOT NOTED OURS WAS NOTED THAT IT WASN'T FIRM WHICH WAS NOT WHICH WAS A MISREPRESENTATION OF THE TRUTH, WHICH MIGHT HAVE THE DETERRED THE BENEFITS SUBCOMMITTEE TO GO ONE WAY OR THE OTHER. AT THE TIME. BERKELEY WAS BOTH THE TRINITY CAPTIVE AND, UM, OUR STOP LOSS CARRIER OF CHOICE.
BUT, UM, RS QUOTE WAS NOT FIRM. WE'VE ALREADY TALKED ABOUT CUTTING THE DEDUCTIBLES IN HALF.
YES WE OFFER AN ESSAY THAT IS 100% COMPLIANT, AND WE HAVE A SLIDE ON THAT WE HAVE ADDITIONAL ONES IF YOU'D LIKE TO SEE THEM. THAT WAS IN THE ORIGINAL RFP. OUR PLAN ALSO COVERS OUT OF NETWORK BENEFITS. IN ESSENCE, YOU HAVE WHAT'S CALLED AN E P O WITHOUT BORING YOU. YOUR EMPLOYEES CAN ONLY STAY IN NETWORK IF THEY GO TO A DOCTOR THAT IS NOT IN THE NETWORK. THEY DO NOT HAVE OUT OF NETWORK BENEFITS. THAT'S A BIG DEAL. THAT'S THE OLD H M O DAYS. OUR PLAN HAS BOTH IN AND OUT OF NETWORK BENEFITS. THE TOWN SENT OUT OF 28 RFP QUESTION DID THE SUBCOMMITTEE'S EVER RECEIVED THE FULL RESPONSES TO THE TWO FINALISTS UNDERSTAND? NOT ALL OF THEM? BUT A $4.5 MILLION A YEAR DECISION AND HE DIDN'T EVEN SEE THE WHOLE PRESENTATION. DID YOU EVER MEET WITH THE FINALIST? YES IN YOUR PACKET, IT SAYS THERE'S A THREE YEAR RATE GUARANTEE.
THAT IS ADMIN COST ONLY $150,000 ON A $4.5 MILLION PLAN. FIRST OFF THE RATE GUARANTEE FROM A CAPTIVE. INTEL'S INSURANCE. IF THEY JUST WANT TO ADMIN COSTS ON ADMINISTRATIVE COST WILL GIVE YOU A FIVE YEAR RATE GUARANTEE. THAT'S THE EASY STUFF. A RATE GUARANTEE ON ADMINISTRATION
[00:45:03]
COSTS MEANS ABSOLUTELY NOTHING IN OUR WORLD. PAGE FIVE AND FOR SUBCOMMITTEE. BULLET POINT THIS LATER, BUT THERE WAS ONLY A 3% DECREASE IN OUR CLAIMS, AND WE HAVE A 10 YEAR TRACK RECORD OF 10 TO 15% DECREASE. THAT'S A HUGE DIFFERENCE WHEN YOU'RE TALKING ABOUT FINANCIAL NUMBERS.AGAIN CHARLES TRYING TO MAKE A LITTLE LIGHT HEART HERE, YOU'VE BEEN ABLE TO MANIPULATE NUMBERS A LOT OF DIFFERENT WAYS, RIGHT? AND NOT SAYING YOU IN THIS CASE, BUT YOU'RE THE C P A UP THERE, SO I KNOW YOU KNOW THIS. SO OUR CLIENTS ARE SAVING THAT IT WASN'T SHOWN IN THE SPREADSHEET.
AH IT GOES BACK TO YOUR TRUE LIABILITY VERSUS WHAT WAS PRESENTED TO THE BENEFITS SUBCOMMITTEE OF 2.7 SHOWN ON OCTOBER 13TH. AH, ALSO STAFF AND CONSULTANT KNOWS THAT THERE'S LARGE CLAIMS COMING. SO WE'LL GO THROUGH SOME OF THAT. AND THEN THE SPREADSHEET DIDN'T EVEN GIVE US ACCOUNT FOR OUR RX REBATES. OR THE CAPTIVE DISTRIBUTION. WHICH IS ABOUT $400,000 THAT MIGHT HAVE MADE IT DIFFERENCE IN WHO THE BENEFITS SUBCOMMITTEE RECOMMENDED EXTEND BEFORE THE EMPLOYEE SUBCOMMITTEE. BUT THAT'S ANOTHER TOPIC. T C R G COST ARE WAY BETTER THAN 180,000 THAT WAS GIVEN TO US ON PAGE FIVE. ONCE AGAIN THE CAPTAIN DISTRIBUTION AND ANOTHER NOTE BOTH OF OUR RX AND STOP LOSS. OR ACTUAL DIRECT CONTRACTS, WHICH WILL HIGHLIGHT THAT HERE AS WELL. ANOTHER MISREPRESENTATION SO ON JUNE 19TH. THE SUBCOMMITTEE WAS SHOWN A PROJECTION OF 3.4. AND THIS IS THE WAY NUMBERS CHANGE BASED THAT WAS BASED ON A 30 MONTH AND WE'LL GO THROUGH AND SHOW YOU KIND OF HAVE NUMBERS CAN BE MANIPULATED. ON OCTOBER 13TH.
THE BUDGET WAS 2.7. SO THE TOWN SAVING $700,000. BUT YOU STILL DON'T KNOW WHAT YOUR MAXIMUM LIABILITY AND WAS IT GUARANTEED. AND WAS IT TOLD THAT THE TRINITY CAPTIVE NUMBER YOU KNEW WHAT THE MAXIMUM COST WAS? AND IT WAS GUARANTEED. SO THEN, THE LAST 12 MONTHS OF CLAIMS THIS CAME OUT ON OCTOBER 11TH. 3,086,000 BUT ON OCTOBER 13TH YOUR BUDGET WAS 2.7. THE CLAIMS ALONE WAS THREE MILLION. SO HOW CAN YOUR BUDGET COST BE LESS THAN THE KNOWN CLAIMANTS? SO QUICKLY THROUGH THESE SLIDES. YOU'LL SEE. THIS IS A 12 MONTHS. THIS WAS BACK ON YOUR JULY 19. CIRCLED IT FOR YOU AT THE BOTTOM 3.7 MILLION AGAIN . THAT'S WHERE WE CAME UP WITH THE 5 14,055 PER EMPLOYEE PER YEAR COST. BUT THERE'S TWO STARS . ONE IS A 12 MONTH LOOK BACK, AND IT'S AN ESTIMATED CLAIMS. WELL LET'S LOOK AT THAT SAME REPORT ON A 30 MONTH. LOOK BACK. THAT MEANS YOUR CLAIMS HAVE GOTTEN WORSE. BECAUSE IN A 12 MONTH PERIOD, YOU WENT FROM 3.4 AT A 30 MONTH FOR THE LAST 12 MONTHS. IT'S NOW 3.7 SO YOUR CLAIMS ARE HIGHER. WE RECEIVED THE EMAIL PART PART OF THE RFP ON OCTOBER THE 11TH SHOWING YOUR CLAIMS THROUGH UNITED HEALTHCARE , AND I'VE HIGHLIGHTED THEM IN YELLOW TO EASE. THAT'S WHERE WE CAME UP WITH THE $3,086,000. I PUT A STAR THERE BECAUSE IF YOU'LL NOTICE JUST THE LAST THREE MONTHS, THESE ARE SOME OF THOSE KNOWN CLAIMANTS THAT THE STAFF KNOWS ABOUT THAT ARE GOING TO BE COMING AND AFFECTING YOUR PLAN CALLS AND WE'LL GET INTO THIS WHEN WE START TALKING ABOUT MAXIMUM LIABILITY. TO SAY THAT WE DID. YOU DIDN'T KNOW THAT YOU HAD A FIRM PROPOSAL ON OCTOBER THE 13TH. WE HAD A FIRM PROPOSAL . WE LET THE CONSULTANT NO, THE CONSULTANT RESPONDED, KNOWING YES, FIRM OPTION ONE. YES. ALL THE PRICES ARE INCLUDED. SO THIS WAS IN YOUR PACKET AT THE OCTOBER 13TH MEETING TWO DAYS LATER. SO KNOWING THAT SHE HAD A $3 MILLION IN CLAIMS OF THE LAST 12 MONTHS OR BUDGET IS NOW 2.7. AND THIS IS WITH THE RECOMMENDATION AT THE TIME. AND IT JUST STARTED. A COUPLE OF STARS THAT YOU WILL SEE ON THERE IS OUR MEDICAL CLAIMS DETRIMENT OF ONLY 3. ONCE AGAIN THAT NOTE ALONE MIGHT MAKE AN IMPACT ON THE DECISION OF A SUBCOMMITTEE. WHEN WE HAD BEGGED TO MEET, BOTH WITH THE CONSULTANT AND THE BENEFITS SUBCOMMITTEE AS A FINALIST. THOSE ARE THE REASONS BECAUSE OUR PROGRAM AS MR PENLEY MENTIONED IS COMPLETELY DIFFERENT THAN THE STANDARD INSURANCE MARKET. THE DETRIMENTS ON THE FAR RIGHT HAND SIDE. WE STARTED THOSE BECAUSE WE HAVE NO IDEA WHERE THOSE NUMBERS CAME FROM. THOSE ARE NOT OUR NUMBERS. THEY WERE NOT IN THE RFP. BUT THEY WERE PRESENTED TO THE BENEFITS SUBCOMMITTEE. FOR SOME REASON. ANOTHER PAGE IN THAT SAME 10 TO 12 PAGE PACKET.
[00:50:02]
HIGHLIGHTED IN RED AND ENLARGED IT SO YOU COULD COULD READ THE SMALL PRINT STOP LOSS NUMBERS ARE NOT FIRM. SEPTEMBER DATA IS NEEDED TO FIRM UP NUMBERS. IF I NEED TO GO BACK A FEW SLIDES TO SHOW YOU THE EMAIL THAT WE SET. OUR NUMBERS WERE FIRM. THAT MIGHT HAVE HAD A DECISION ON THE BENEFIT SUBCOMMITTEE. ANOTHER SLIDE IN HERE. AND SPEAKING WITH ONE OF THE COMMITTEE MEMBERS.ALL PLANS ARE P P O. ANOTHER. MISREPRESENTATION OF THE TRUTH. OUR RFP HAD A P P O. AND AN H S A. I KNOW HOW COVETED THE H S A IS TO THE EMPLOYEES HERE TOWN OF PROSPER. WE MADE IT VERY CLEAR.
OUR PLANS ARE FLUID IF THEY WANT TO KEEP THE H S A LET HIM KEEP THE H S A. IF THEY DON'T WANT TO KEEP THE HSCEI, DON'T WE DON'T CARE. OUR NUMBERS DON'T CHANGE. IT CAN BE A PPL. IT CAN BE AN H S A EITHER WAY. SO FOR SOMEONE WHO HAS INCLUDED ALL P P O PLANS. WAS NOT TRUE. ANOTHER REASON THE BENEFITS SUBCOMMITTEE MIGHT HAVE MADE A DECISION TO NOT RECOMMEND. SO AT THE TIME.
ON OCTOBER 13TH. BERKELEY WAS THE STOP LOSS CARRIER, WHICH IS THE SAME STOP LAST PERIOD THAT TRINITY CAPTURED, HAS PARTNERED WITH. THEIR NUMBERS WERE NOT FIRM. OUR NUMBERS WERE FIRM AND FINAL TWO DAYS PREVIOUS WHEN YOU LOOK AT THIS YOU HAVE TO ASK SOME QUESTIONS. 4.2 MILLION IS YOUR QB E RENEWAL? I'M GOING TO ASSUME THAT'S PROBABLY THE RECOMMENDATION. SINCE STAFF IN THE CONSULTANT DIDN'T PUT IT UP. SO IF YOU GIVE ME ONE SECOND.
SO IF YOU LOOK AT THE PAGE THAT I JUST HANDED OUT I'M GONNA SLIDE AHEAD AND I'LL COME BACK.
THIS IS WHAT WE LEFT OUR MEETING. OURS WERE FIRM AND FINAL. WE WERE TOLD. IT'S PROBABLY GONNA GO WITH BERKELEY AND YOU KNOW WHAT? THERE WAS A VERY SMALL SAVINGS 50 $60,000 NOT A BIG DEAL. I STARTED THIS CONVERSATION. THIS ISN'T ABOUT MONEY. THIS IS ABOUT WHAT YOU CAN DO FOR THE 300 EMPLOYEES YOU'RE GOING TO ENSURE ON JANUARY 1ST. BUT THIS IS WHAT WHAT YOU HAVE IN YOUR PLAN HAND IS KIND OF WHAT I THOUGHT WAS GOING TO HAPPEN WHEN I SAW THE AGENDA PACKAGE. THEY WERE NOT GOING TO SHOW YOU WHAT YOUR MAXIMUM COST LIABILITY IS. THEY JUST WANT TO SHOW YOU THAT. HEY WE GOT INSURANCE FOR $148,000. NO, NO, NO, NO. WHAT YOU'RE SEEING IN YOUR HAND IS PROBABLY WHAT IS GOING TO COME OUT, BASED ON THIS NUMBER RIGHT HERE. WHEN YOU PUT US SIDE BY SIDE TBS RENEWAL. SOME THINGS THAT MIGHT HAVE BEEN LEFT OUT OF THAT MEETING. OUR NUMBERS WERE FIRM. DEDUCTIBLE IS CUT IN HALF. AND THERE IS NO DISRUPTION. AND IF WE HADN'T HAD THE OPPORTUNITY TO EXPLAIN EXACTLY HOW THAT WORKS, YOU MIGHT HAVE KNOWN BUT INSTEAD OF FEARMONGERING AND SAYING, OH, EMPLOYEES ARE GONNA LOSE DOCTORS. 20,000 LIVES 80 CLIENTS ALL OVER THE COUNTRY. I'VE NEVER HAD TO TELL SOMEONE THAT THEY'RE GOING TO HAVE TO CHANGE DOCTORS.
IT DOESN'T HAPPEN. TCG HAS BOTH IN AND OUT OF NETWORKS YOU ONLY HAD IN NETWORK BENEFITS. WE DIDN'T GET THE CORRECT AMOUNT AND RX REBATES. WEREN'T EVEN SHOWN YOUR CAPTIVE DISTRIBUTIONS. PROBABLY NOT TOLD THAT YOUR STOP LOSS PREMIUM THAT YOU'RE GOING TO PAY. YOU'LL NEVER GET A CENT OF IT BACK UNLESS YOU'RE IN A CAPTIVE. TCG DOES OFFER AN H S A PLAN. THE COLLATERAL THAT THEY'VE TRIED TO PUT INTO OUR FIXED COST IS REFUNDABLE. AND ANOTHER THING IS , THERE'S NO NEW LASERS AND A RATE CAP. MAY HAVE THAT IN YOUR STOP LOSS CONTRACT TODAY. I DON'T KNOW. BUT THE QUESTION IS , WHAT IS YOUR MAXIMUM LIABILITY ? THIS IS FROM YOUR OCTOBER 13TH, WHICH IS PROBABLY WHO? YOUR COUNSEL. AND STAFF IS RECOMMENDING TO GO FORWARD TO GO IN THE FULL CONTRACT. BUT IT WASN'T PRESENTED TONIGHT. SO I CAN'T ANSWER THAT. BUT IF THAT IS YOU'RE LOOKING AT A 4.2 MILLION MAXIMUM LIABILITY. VERSUS FOUR MILLION BASED ON THEIR OWN NUMBERS. THAT'S A $200,000 SWIMMING. SO WE'RE JUST ADDRESSED WHILE WE DIDN'T DO THAT OUR NUMBERS WERE FIRM AND FINAL. WE SHOWED YOU A COUPLE OF WAYS TO CUT THE DEDUCTIBLES IN HALF. ONCE AGAIN. THE VERY FIRST SLIDE ADMINISTRATIVE COST. WE DON'T HIDE AROUND IT. OUR CLIENTS WOULD RATHER PAY MORE IN ADMINISTRATION TO SAVE ON THE BIG TICKET, WHICH IS CLAIMS AND
[00:55:03]
THAT'S WHY OUR PER EMPLOYEE PER YEAR COST OR 10,000 OR LESS, AND YOU'RE AT 14,000. BUT IF YOU'RE MAKING A DECISION BASED ON ADMINISTRATIVE COSTS ONLY YOU'RE MISSING THE BOAT. BECAUSE YOU STILL DON'T KNOW WHAT YOUR MAXIMUM LIABILITY IS. AND I'VE HEARD THERE'S SOME CONVERSATION AROUND. YOU KNOW WHAT NOBODY EVER HITS THE MAXIMUM LIABILITY . I THINK I HEARD A COUPLE OF YOU SAY THAT. WELL, LET'S JUST SAY WHAT A MULTIBILLION DOLLAR COMPANY SAYS, IS THAT IT DOES HAPPEN. BUT LET'S GO THROUGH SOME OF THE MORE NOTES THAT YOU SAW TONIGHT. WE'VE ALREADY MENTIONED WE HAVE A BIG RED X. IT SAYS THERE'S A LOSS OF DIRECT PHARMACY CONTRACT AND LOSS OF A DIRECT STOP LOSS. NO, THAT IS INCORRECT. THE TOWN OF PROSPER WOULD HAVE A DIRECT CONTRACT ON THE PHARMACY AND HAVE A DIRECT CONTRACT WITH THE STOP LOSS CARRIER. COST OF GOODS SERVICES . WE MAKE NO BONES ABOUT IT OR ADMIT COST IS HIGHER. NOW THE NETWORK DISCOUNTS. WE CAN DEBATE TILL THE COWS COME HOME, AND I WILL NOT BORE YOU. BUT I CAN PROMISE YOU THERE IS IF ANY DIFFERENCE, NO TANGIBLE DIFFERENCE BETWEEN UNITED HEALTHCARE AND AETNA NETWORK DISCOUNT. YES ON ANY GIVEN ITEM , I CAN SHOW YOU 20 DISCOUNTS THAT ARE BETTER THAN YOU HC AND I CAN SHOW YOU 20 DISCOUNT ITEMS THAT YOU HC BUT COMPARATIVELY SPEAKING. YOU'RE NOT GONNA SEE IT. BUT AT THE END OF THE DAY, OUR MAXIMUM COST WAS LESS. I PLAN DESIGNS CUT THE DEDUCTIBLE.WE GOTTA CHECK MARK THERE. AND REFERENCES, NO PUBLIC SECTOR. YOU'RE EXACTLY RIGHT. AND I'M KIND OF GLAD THEY PUT THAT HERE. BECAUSE THIS IS WHY IT'S TOO DIFFICULT TO GO THROUGH THE RED TAPE. TO HAVE TO GO THROUGH A 28 PAGE RFP. AND YOU DON'T EVEN GET TO EXPLAIN YOUR PROGRAM. SO WE DON'T GO AFTER MUNICIPALITIES. I THOUGHT. LIVING HERE FOR 20 YEARS, HAVING INVESTED INTERESTS HAVING TO SEE THE EMPLOYEES FACE THAT WE AT LEAST MIGHT BE ABLE TO TELL OUR STORY THAT DIDN'T HAPPEN. SO WHAT WAS IN OUR PROPOSAL WAS VERY SIMPLE. YOUR RENEWAL'S AT 4.5 MILLION. BUT YOU GOT TO ADD IN THE 238,000. SO IT'S REALLY AT 4.7. WE WERE AT 4.5. ONCE AGAIN. WE'RE NOT TALKING DOLLARS. I'M NOT SAYING WE'RE GOING TO SAVE YOU ANY MONEY AT ALL. WHAT I AM GOING TO SAY. IS IN AN ECONOMY. GAS PRICES ARE CRAZY. INFLATION IS THROUGH THE ROOF. YOUR EMPLOYEES . FAMILIES DON'T KNOW IF THEY CAN GO OUT TO EAT THIS MONTH BECAUSE THEY GOT TO PAY THEIR BILLS. AND YOU HAVE A CHANCE TO CUT THEIR DEDUCTIBLE IN HALF. AND BECAUSE YOU CUT THEIR DEDUCTIBLE IN HALF, YOU COULD EVEN GIVE THAT $1000 THAT YOU'RE PAYING THEM IN A RACE. SO THEY DON'T HAVE TO USE IT FOR MEDICAL. THEY COULD USE IT TO BUY GROCERIES, BUY GAS BUY DIAPERS. AGAIN YOU HAVEN'T SEEN YOUR STOP LOSS NUMBERS YET. YOU'RE GONNA MAKE A DECISION TONIGHT, NOT KNOWING IT. BUT I CAN PROMISE YOU OF OUR 700 ROUGHLY $40,000. YOU HAVE A CHANCE TO GET 420 OF IT BACK. BEFORE YOU ANSWER TONIGHT. YOU MIGHT WANT TO ASK IF YOU'RE GOING TO BE ABLE TO GET THAT BACK FROM QB. TALKED ABOUT ADMINISTRATIVE COSTS ONCE AGAIN.
THE NUMBERS GET SKEWED. YOU CAN MAKE NUMBERS SAY WHATEVER YOU WANT. BUT HERE'S THE SIDE BY SIDE COMPARISON, AND WE DON'T MAKE ANY BONES ABOUT IT. OUR ANNUAL COST IS 305,000. I DON'T KNOW. THE NUMBERS THAT I WAS GIVEN CAME UP WITH 1 78. THERE'S OBVIOUSLY SOME DISCOUNT THERE.
I'LL SAY HEY, WE'RE DOUBLE I'M OKAY WITH THAT. BECAUSE THE MONEY IS NOT IN YOUR ADMINISTRATION COST. NOW, LET'S GET BACK TO YOU NEVER HIT THE MAXIMUM LIABILITY. THIS IS FROM A MULTI BILLION DOLLAR INSURANCE COMPANY. THOUSANDS AND THOUSANDS OF EMPLOYERS. 15% OF THEIR CLIENTS HAVE AN AGGREGATE HIT OR A MAXIMUM LIABILITY. I THOUGHT IT MIGHT BE INTERESTING NOW.
THIS IS FROM OUR CAPTIVE PROGRAM. THAT YOU WERE GOING TO BE INVOLVED IN WHERE CLIENTS WERE ABLE TO GET A RETURN OF $21.9 MILLION OVER THE LAST 10 YEARS. THE NEXT BOX BELOW IT.
AND YOU HAVE SOME AND YOU AND YOUR STAFF KNOWS IT. YOU HAVE SOME VERY LARGE CLAIMS COMING.
SO TO SAY THAT YOUR YOU DON'T HAVE A CHANCE TO HIT YOUR MAXIMUM LIABILITY, AND THAT'S WHY WE'RE NOT GOING TO TELL YOU WHAT IT IS. WOULD BE A LITTLE SCARY. 75% OF OUR CLIENTS EXCEED THEIR EXPECTATIONS. IF YOU TAKE ALL OF IT, THE ONES THAT DON'T EXCEED THE ONES THAT JUST ME AND THE ONES THAT BE THE FINANCIAL PROJECTIONS. ALL CLIENTS AVERAGED TOGETHER OR 8% BELOW EXPECTED AND WE HAVE A SLIDE FOR YOU. WHAT WOULD THAT MEAN TO THE TOWN OF PROSPER? PRETTY CLOSE TO
[01:00:02]
WHERE YOU'RE AT, BASED ON THE BUDGET OF 3.5 MILLION BECAUSE I THINK YOUR BUDGET AT 3.6 SO AGAIN I STATE THIS IS NOT ABOUT COST. THIS IS ABOUT WHAT YOU HAVE AN OPPORTUNITY TO CHANGE THE LIVES OF EMPLOYEES AND EXPAND THEIR FREE SERVICES. I WAS TALKING TO THE GENTLEMAN.ABOUT A SURGERY THAT THEY HAD. IT WAS AN EMPLOYEE OF YOURS. UM AND THEY HAD TO SPEND THEIR $5500 OUT OF POCKET. AND I SAID, DUDE. I WISH I HAD KNOWN I SAID TRINITY WE'RE PROPOSING. I SAID YOU COULD HAVE GONE TO DR MUTT DR MCNUTT. AT THE TOLL ROAD, MAIN STREET AND NOT ONLY WAS IT BEEN FREE, WE WOULD HAVE PAID YOU $1000. HE GOES. DO WHAT I GO. YEAH COME JANUARY ONE YOU COULD HAVE DR MCNUTT. ROAD MAIN STREET. NOT ONLY IS IT FREE WOULD HAVE PAID YOU $1000. $6500 TO THAT EMPLOYEE. THAT'S LIFE CHANGING. IN OUR RFP. WE EXACTLY SPELLED OUT HOW WE CREATE OUR SAVINGS. SO THERE'S NO MYSTERY REPRESENTATION. THIS IS PART OF THE RFP PACKET. OUR PLAN DESIGNS AGAIN. PART OF THE RFP PACKET, REDUCING SO HOW DO WE HAVE NO DISRUPTION. IF YOU'LL NOTICE ARE OUT OF NETWORK BENEFITS. ARE EXACTLY THE SAME AS THEIR CURRENT BENEFITS. SO EVEN IF THEY GO TO AN OUT OF NETWORK PROVIDER YOUR EMPLOYEES PAY THE EXACT SAME THING THAT YOU'RE PAYING TODAY. NOW THE REALITY AND NO ONE CAN DISPUTE THIS. 95% OF ALL DOCTORS, IF THERE IN ONE NETWORK THERE AND ALL THE NETWORKS, SO NO ONE'S GONNA HAVE THAT. BUT LET'S JUST ASSUME THAT THEY DID. THEY STILL HAVE THE SAME BENEFITS THAT YOU'RE PROPOSING TO PRESENT TONIGHT. IN THE H S A WE'LL GET INTO THAT. ON THE NEXT SLIDE. WE ARE CUTTING THE A IN HALF. AND I'M NOT GONNA GIVE YOU A HISTORY LESSON ON H S A S, BUT THERE'S A THING CALLED EMBEDDED IN NON EMBEDDED AND YOU NEED TO KNOW THE FACTS. AND EMBEDDED DEDUCTIBLE. MEANS YOU HAVE A FAMILY. BUT YOU CAN STILL HAVE AN INDIVIDUAL. YOU HAVE 254 EMPLOYEES BASED ON YOUR RFP. 104 OF THEM. IN THE H ESA IN RED. HAVE DEPENDENCE SO THAT YES, THEY WOULD HAVE TO STAY AT THE SAME DEDUCTIBLE THAT YOU'RE WILLING TO STAY TODAY AT 3000. BUT THE ONES IN GREEN, THE EMPLOYEE ONLY ON THE HIGH DEDUCTIBLE. AND THE 68 ARE ON THE P P O WOULD BE ABLE TO CUT THEIR DEDUCTIBLE IN HALF. THAT REPRESENTS 60% OF YOUR POPULATION. WOULD BE ABLE TO CUT THEIR DEDUCTIBLE IN HALF. THOSE ARE THE FACTS. NOT THAT IT'S CLUNKY. NOT THAT THEY COULDN'T WORK. YOU CAN CUT YOUR DEDUCTIBLES IN HALF. EXCEPT FOR THE ONE OH FOUR AND RED. TO CUT IT AS LOW AS WE WANT. AND THAT'S NOT WHAT WE WANT TO DO. THAT'S NOT WHAT YOUR CONSULTANT YOU CAN THANK THE GREAT GOVERNMENT FOR THE RULES. SO FINAL THOUGHTS. THERE IS NO DISRUPTION TO YOUR EMPLOYEES. THEY'LL GET TO BE ABLE TO GO WHEREVER THEY WANT TO GO SEE THEIR SAME PROVIDERS. NO DISRUPTION. I THINK WE'VE HIT ON. WE'VE CUT OUR DEDUCTIBLES IN HALF ENOUGH. WE WILL EXPAND THOSE FREE SERVICES. WE HAVE EIGHT FREE SURGERY CENTERS HERE IN DALLAS FORT WORTH ALONE. SO I UNDERSTAND WHAT KEMPTON DID. JAKE KEMPTON AND I ARE VERY CLOSE FRIENDS. MATTER OF FACT, HE SAID ON THE NATIONAL EXECUTIVE COMMITTEE WHEN WE WROTE THE LEGISLATION FOR TIKKA SO I'VE BEEN IN BUSINESS WITH J. KIMPTON'S A GREAT ORGANIZATION, BUT THEY DON'T HAVE ALL THE TOOLS AND RESOURCES. WE WERE THE PIONEER IN THIS WE HAVE NOW OVER 4000 SURGERY CENTERS ACROSS THE COUNTRY. YOU HAVE EIGHT RIGHT HERE. IT'S NOT LIMITED. IT'S EXPANDING THOSE OPTIONS AND LIKE THAT, ONE EMPLOYEE SAID, HAD HE KNOWN HE COULD HAVE DR MCNUTT AT THE TOLL ROAD IN MAIN STREET. HE WOULD HAVE BEEN ALL OVER IT. SO WHEN YOU GO TO AN EMPLOYEE SUBCOMMITTEE, AND THEY SAY HEY, ARE IN CHURCH IS GREAT. WE'RE GOING TO HAVE TO CHANGE. NOBODY WANTS TO CHANGE. OR YOU GO TO HIM AND GO LOOK. WE'RE GOING TO CUT YOUR DEDUCTIBLES IN HALF. WE'RE GONNA GIVE YOU $1000 RAISE. BUT YOU GOTTA GET A NEW I D CARD. THOSE DECISIONS MIGHT BE A LITTLE BIT DIFFERENT WHEN YOU ASK IT THAT WAY. OR YOU ASK IT, DO YOU REALLY WANT TO HAVE TO CHANGE? BECAUSE IF THEY DIDN'T KNOW THAT THERE WAS NO DISRUPTION. THEY DIDN'T KNOW THAT THEIR DEDUCTIBLE IS GOING TO GET CUT IN HALF. AND I'M PROPOSING. INSTEAD OF PAYING ALL THAT MONEY, EVEN IF YOU TAKE JUST THE ONE OH FOUR AND CONTINUE TO PAY THEM $2000 S A MY DUMBASS STILL SAYS THAT'S 200 130 SOMETHING $1000. YOU CAN DO SOMETHING WITH BECAUSE YOU CUT THEIR DEDUCTIBLES IN HALF. ALL
[01:05:02]
COSTS BEING EQUAL. LET'S DON'T GET INTO THE NUMBERS. I'M NOT. I HAD TO GIVE THEM TO YOU. SO YOU COULDN'T SAY YOU DIDN'T KNOW THE FACTS ABOUT THE NUMBERS. THIS ISN'T A NUMBER SITUATION. LET'S JUST SAY IT ALL COSTS BEING EQUAL, YOU HAVE A CHANCE TO MAKE A DIFFERENCE IN AN EMPLOYEE'S LIVES. ALSO A NUMBER THAT WAS PUT IN THERE, BUT PROBABLY NOT. YOU'RE GETTING A $5000 WELLNESS CREDIT TODAY. WE'RE GOING TO GIVE THE TOWN 20,000 QUADRUPLE THAT. TO DO MORE FOR YOUR EMPLOYEES. THEN THE FIVE THAT YOU'RE GETTING TODAY. I WILL LEAVE YOU WITH THIS FINAL THOUGHT. YOU STILL DON'T KNOW WHAT YOUR TOWN'S MAXIMUM LIABILITY IS. THANK YOU. THANK YOU, MR DIXON. AH! PLANTS. WOULD YOU LIKE TO APPROACH THE STAYING THERE. MR MAYOR, PRO TIM. I'M BACK AND READY TO ANSWER QUESTIONS FOR YOU. ARE THERE ANY QUESTIONS FOR MR FINLEY? MAKES A VERY COMPELLING VERY, VERY COMPELLING. SOME OF THAT INFORMATION INFORMATION CLEARLY.IS DIFFERENT THAN WHAT I'VE HEARD. OKAY NOW, I DON'T KNOW IF JASON IS UP THERE, SAYING SOMETHING THAT'S NOT ACCURATE OR IF OR IF HE'S MISLED. OR IF YOU HAVE SOMETHING THAT ACT, BUT I DON'T I HONESTLY DON'T FEEL REAL GOOD AFTER LISTENING TO THAT, AND I KNOW JASON APPRECIATE MY CAN'T PICTURE HIM STANDING UP THERE AND OUTRIGHT LYING TO US. SO I'M I'M BOTHERING. BUT BY WHAT I HEARD VERSUS WHAT THE PITCH. I HEARD. THAT YOU KNOW, I WAS AT ONE OF THE SUBCOMMITTEE MEETINGS. I COULDN'T MAKE THE SAME WHEN I WAS OUT OF TOWN. BUT AT THAT ONE IT WAS TOTALLY TOTALLY DIFFERENT. YOU KNOW, AND THERE WAS I FELT LIKE PRE DECIDED WHEN I WALKED IN HOW THIS WAS GOING TO GO AND I DIDN'T HEAR WHAT BUNCH OF ANYTHING, HE SAID. SO I JUST MY FEEDBACK ON THAT, SO I'M REALLY UNCOMFORTABLE WITH WHERE WE ARE RIGHT NOW. IS THERE ANOTHER JUST LIKE TRAYVON TO SHOW YEAH. I MEAN, UH, YOU KNOW, I I'M NOT GOING TO SPEAK TO ANYTHING THAT MR DIXON PRESENTED BECAUSE I HAVEN'T SEEN THE PRESENTATION THAT HE PRESENTED OTHER THAN THE SLIDES THAT WERE SENT DURING THE OR FP. AND, OF COURSE, I REVIEWED EVERY ONE OF THOSE, BUT I'M NOT GOING TO SPEAK TO HIS COMMENTS REGARDING MY INFORMATION THAT THE BENEFITS SUBCOMMITTEE OF SCENE AND YOU HAVE THE ADDITIONAL, UH, DATA THAT SUGGESTED THE REALITY IS 20 YEARS IN THIS BUSINESS. 16 YEARS AT MCGRIFF SELF INSURED SELF SELF INSURANCE EXPERT. THE TOWN HAS HIRED ME TO DO A JOB. AND MY RECOMMENDATION IN THE IN THE ADMINISTRATION'S RECOMMENDATION IS, UM ARE IN PROACT FOR A REASON. THIS THIS SLIDE COUNCILMAN COTTON WAS WHAT WAS PRESENTED LAST THURSDAY AT THE BENEFITS SUBCOMMITTEE MEETING THAT YOU WERE OUT OF TOWN FOR, SO I'LL GO INTO THOSE DETAILS JUST TO GET YOUR QUESTIONS A LITTLE BIT. WE'RE A SELF FUNDED HEALTH PLAN WHEN WE IMPROVE BENEFITS WHO'S THE SELF FUNDED HEALTH PLAN? HE SAID. WE THE TOWN, OKAY. THE TOWN THE TOWN IS SELF INSURANCE, LOWER DEDUCTIBLES TO EMPLOYEES. YOU RAISE EXPENSES FOR THE TOWN. IT'S A BALLOON. IF YOU SQUEEZE IT IN ONE AREA INCREASES IN OTHERS THAT'S GONNA COST THE TOWN IN ADDITIONAL, ROUGHLY $400,000. AND I'M NOT EVEN FACTORING IN THE FREE SERVICES THAT ARE GOING TO GO ON TOP OF THAT. OKAY? THE NETWORK DISCOUNTS SAID THAT WE SPOKE OF , UM YOU KNOW, TRINITY CAPTIVE GROUP IS PRESENTING THE AETNA SIGNATURE P P O NETWORK THAT SAID IN SECOND OR THIRD NETWORK, IT'S NOT THEIR PRIMARY NETWORK.
AND IT'S ROUGHLY 8% OFF FROM OUR CHOICE NETWORK THAT WE HAVE WITH , UM ARE SO THAT'S GOING TO COST THE TOWN AN ADDITIONAL HALF MILLION DOLLARS. OKAY JUST BY MAKING THAT NETWORK SWITCH, NOT TO MENTION THAT YOU'RE GOING TO LOSE 4% OF YOUR PROVIDERS. UH WE LOOKED AT THE TOWN OF PROSPER EMPLOYEES AND WHERE YOU'RE GOING . 95% OF THE DOCTORS IN HOSPITALS WILL BE COVERED UNDER THE AETNA'S SIGNATURE NETWORK. 99% ARE CURRENTLY COVERED UNDER UNITED HEALTHCARE, SO YOU'LL NEED OUT OF NETWORK BENEFITS BECAUSE YOU'RE GOING TO HAVE EMPLOYEES THAT ARE NOW GOING AND HAVING TO GO TO OUT OF NETWORK PROVIDERS. UM THE OTHER FIXED COSTS COMPONENTS. LET'S TALK ABOUT THAT FOR A MINUTE, WHETHER IT'S A DIRECT CONTRACT OR NOT WITH THE PHARMACY BENEFIT
[01:10:01]
MANAGER. IT'S WORSE THAN WHAT WE HAVE TODAY. BY 5.5. THAT'S INCLUDING. REBATE REVENUE. SO ANOTHER $140,000 AND PROJECTED EXPENSES TO MOVE TO THE TRINITY CAPTIVE GROUP PHARMACY BENEFIT MANAGER SABINE HEALTH AND THAT COMES FROM WE HAVE A SPECIFIC PHARMACY CONSULTANT. SO THAT'S NOT ME. THAT'S A PHARMACY EXPERT HIRED BY THE TOWN THAT DID THAT ANALYSIS PROJECTED. 150,000 YES, SIR. EXPENSES YES, SIR. PHARMACY UNDER THE PHARMACY PROGRAM WITH CIVILITY, ADDITIONAL EXPENSES TO THE TOWN IF WE GO WITH THE PHARMACY PROGRAM TRINITY CAMPAIGN CONTRACT. IT'S NOT AS COMPETITIVE OF A CONTRACT AS WE HAVE TODAY. UH ADMINISTRATIVE COSTS. AND MR DIXON MENTIONED THAT 117% INCREASE 218,000. UH STOP LOSS FIXED COST INCREASE $19,000 OVER OUR FIRM QUOTE THAT WE HAVE WITH OUR INCUMBENT VENDOR QB, UH, REMOVE HSCEI CONTRIBUTION. THAT'S A BIG THING FOR TRINITY CAPTIVE GROUP THEY WANT TO ENCOURAGE AND THEY'RE TELLING US HEY, LET'S JUST GET RID OF THESE HSCEI CONTRIBUTIONS BY THE WAY THAT YOUR EMPLOYEES VALUE GREATLY. SO THAT WE'RE GIVING THEM CREDIT FOR THAT. WE'RE REMOVING 233,000 AND EXPENSES. UH FOR HS A CONTRIBUTIONS. SO YOUR ESTIMATED INCREASE IF YOU AWARD TRINITY CAPTIVE GROUP THE CONTRACT TONIGHT. UH IT STARTS AT A MILLION DOLLARS. OKAY SO THAT'S THE PROJECTED INCREASE AND THEN WHAT WE HAVE DONE. PROJECTED FROM THE PHARMACY AND THE MEDICAL EVERYTHING STOP LOSS.DEMONSTRATIVE COST. YES, SIR. SO WHAT WE'VE DONE LAST AS WE'VE GIVEN THEM 100% CREDIT BECAUSE I BELIEVE THAT MR DIXON HAS A GREAT PROGRAM HERE. UM AND HE'S TARGETING OUTPATIENT EXPENSES.
AND THERE I BELIEVE. WORK WITH HIM FOR A NUMBER OF YEARS THAT I BELIEVE THAT THEY ARE REDUCING COSTS ON OUTPATIENT EXPENSES. LAST YEAR WE HAD NINE OR THE LAST ROLLING 12. WE'VE HAD $943,000 AN OUTPATIENT EXPENSES , SO I GAVE HIM CREDIT FOR 100% OF THE OUTPATIENT EXPENSES MOVING TO TRINITY CAPTIVE GROUP, SO THAT MEANS EVERY SINGLE EMPLOYEE SPOUSE IN CHILD. GOES TO HIS PROGRAMS FOR OUTPATIENT SERVICES, AND WE'RE RECEIVES A 50% REDUCTION, AS NOTED IN HIS PROPOSAL. WITH THAT WHICH IS. UNACHIEVABLE UM, BECAUSE WE'RE NOT GETTING THAT KIND OF PENETRATION FROM KIMPTON KEMPTON GROUP RIGHT NOW, AND THE PROGRAMS OUT THERE. WITH ALL OF THOSE THINGS. WE'RE LOOKING AT A MINIMUM OF $550,000 INCREASE TO THE TOWN OF PROSPER. SO YOU SAID , YOU'RE NOT GETTING THAT PENETRATION WITH TEMPLATE, RIGHT OFFER THE SAME. SERVICES THE SAME OPPORTUNITY FOR THEM TO GET THE THEY DISCOUNTED SURGICAL PROGRAMS. IT'S A SIMPLE I WON'T SPEAK TO PROVIDER BY PROVIDER, BUT IT'S A VERY SIMILAR PROGRAM FREE IMAGING FREE OUTPATIENT SERVICES. THE NETWORK IS EXPANDING WORDS. WHEN WE STARTED THIS PROGRAM, IT WAS SURGERY CENTER OF OKLAHOMA WAS THE PRIMARY OUT PATIENT FACILITY FOR SURGERIES. UM YOU KNOW THAT HAS EXPANDED INTO THE METROPLEX FREE IMAGING FREE FREE SERVICES ELSEWHERE. SO. I MEAN, THIS IS ABOUT AS DEEP OF A DIVE AS I CAN DO FOR THE COUNCIL THAT LAST POINT THIS GIVES CREDIT FOR ALL OF WHETHER WHETHER THEY GET IT OR NOT. WITH THE PENETRATION OR NOT. THAT'S WHAT YOU SAID YES, SIR. ONE OF HIS EMPHASIS WAS THE MAX WALLS. AND MAXIMUM LIABILITY RIGHT WELL AS HIS HIS THOUGHTS THAT WE HAVE SOME CLAIMS. OUTSTANDING THAT COULD PUSH US WHO KNOWS, BUT. HAVE YOU ADDRESSED THAT? YES, SIR. YES SIR. IN THE ORIGINAL MEETING THAT YOU WERE A PART OF IN THE BENEFITS SUBCOMMITTEE MEETING WE TALKED ABOUT MAXIMUM LIABILITY. UM IT IS A THERE. THERE WE BUY THAT INSURANCE FOR A REASON. THERE IS ABSOLUTELY A PERCENTAGE CHANCE. THAT WE COULD BLOW THROUGH ALL OF OUR CLAIMS AND YOU KNOW, THE INSURANCE CARRIER IS ON THE HOOK. WE DO BY AGGREGATE INSURANCE. BUT AT THAT MEETING WE TALKED ABOUT WHAT IS THE REAL NUMBER. THE MAXIMUM LIABILITY IS 25% OVER ARE EXPECTED CLAIMS. WHAT IS THAT NUMBER? I HAVEN'T HEARD THAT YET. WHAT'S THE MAXIMUM LIABILITY NUMBER? UM. I DON'T HAVE THE STOP LOSS NUMBER HERE.E INCUMBENT CARRIER Q B E THAT WE HAVE WITH FIRM QUOTES AND THE TRINITY CAPTIVE GROUP PROPOSAL.
[01:15:03]
THAT DIFFERENCE IS ABOUT $200,000 IN THE AGGREGATE LIVE OR THE. UH EXPOSURE, MAX. SO HE'S SAYING THAT THEY ARE. YOU'RE SAYING THAT THEY COULD HAVE A HIGHER WE HAVE A HIRING MAXIMUM EXPOSURE. WITH THE UH, PROPOSED GROUP VERSUS WITH TRINITY CABIN $200,000 ONCE AGAIN, NOT INCLUDING FIXED COSTS EXPENSES. HE'S $117,000 IN FIXED COSTS, EXPENSES HIGHER THAT CLOSES THE GAP VERY MUCH. IT'S A VERY SMALL WINDOW AND WE TALKED ABOUT I STILL HADN'T HEARD THAT NUMBER 70 OR $80,000, THE TOTAL NUMBER OF MAXIMUM LIABILITY UM I DON'T HAVE THAT IN FRONT OF ME.WE'RE NOT WE? WE HAD THAT DATA FOR THE BENEFITS OF DID HAVE THAT FOR THE SUBCOMMITTEE, AND WE'VE HAD IT AT THE LAST MEETING. IT'S. HE EMPHASIZED THAT THAT'S SHOULD BE IMPORTANT IS SOME IS THAT NOT SOMETHING THAT'S IMPORTANT? I TALKED LAST THURSDAY. I'VE HAD ONE CUSTOMER HIT THEIR AGGREGATE LIABILITY IN MY 20 YEAR CAREER IN SELF INSURANCE, AND IT WAS AN 80 LIFE GROUP. THAT WAS UNDERPRICED. I'VE NEVER HAD I'VE GOT 15 SELF FUNDED GROUPS RIGHT NOW TIMES, YOU KNOW. 10 PLUS YEARS OF EXPERIENCE, AND IT'S NEVER COME INTO PLAY. YOU STILL DON'T KNOW WHAT THAT NUMBER IS. WE CAN GET IT FOR YOU. COUNCILMAN PRESENTATION WE GAVE YOU BEFORE I'LL GO GET IT, RIGHT? YES, SIR. SO I HAVE A QUICK QUESTION. OKAY? SO IN WHAT YOU'RE PROPOSING OR WHAT THE RECOMMENDATION IS WITH, UM ARE THERE IS NO OUT OF NETWORK OPTION. THERE IS NO OUT OF NETWORK OPTION. THERE'S NO NEED TO 99% OF OUR EMPLOYEES GO IN NETWORK. AND WE HAVE THAT, BASED ON PREVIOUS CLAIMS, 12 MONTHS OF ROLLING CLAIMS DATA WITH OUR CURRENT PROVIDERS. HYPOTHETICALLY, THEY OR IN THE HOSPITAL. THAT'S NOT IN NETWORK.
PAGES IN NETWORK. WE HAVE RAPPEL DOCTORS, RADIOLOGISTS, ANESTHESIOLOGISTS, PATHOLOGIST AND LABS THAT IF THEY IF THERE'S A REASON AN EMPLOYEE GOES TO YOU KNOW, GETS ROPED IN IN YOUR EXAMPLE TO AN OUT OF NETWORK PROVIDER THAT'S PAID BY, UM, OURS AND IN NETWORK PROVIDER AND WE SIMPLY JUST WE, YOU KNOW, JAMES, YOU CAN SPEAK TO THAT. WE DON'T HAVE ISSUES FROM EMPLOYEES ABOUT PROVIDER NETWORK.
THAT'S BOTH P P O N AND HAD DEDUCTIBLE. YES SIR. IT'S THE SAME NETWORK IS JUST A DIFFERENT PLANE DESIGN. I'D LIKE TO HEAR FROM THE LITTLE BIT SOME COMMITTEE I KNOW. APPRECIATE YOU ANSWERING THE STATE A LOT MORE. YOU SPEAK TO THE PROCESS OF THE TEAM'S EVALUATION. WAS ALL THIS DATA PRESIDENT AVAILABLE FOR CONSIDERATION. OKAY SO THE FIRST MEETING WE HAD TRIALS. WAS ATTENDED. UM I WOULD SAY. CANDIDLY WAS INCOMPLETE. UM, A LOT OF THE NUMBERS WERE NOT FARM NUMBERS ON BOTH SIDES. SO IT WAS A LOT OF ESTIMATION. UM THE BIG THE BIG SELLING POINT AT THAT POINT WAS, UM THE ADMINISTRATION COSTS LIKE YOU HEARD TONIGHT. UM WE ASKED FOR TWO THINGS AND THAT MEETING. ONE THING WE ASKED FOR WAS FIRM NUMBERS. AND THE SECOND THING WE ASKED FOR WAS EMPLOYEE FEEDBACK. WE WANTED JAMES TO GO TO THE EMPLOYEE COMMITTEE AND ASKED THEM LIKE LOOK AT THIS PLAN. THIS CLOSURE DEDUCTIBLE. THIS IS WHAT IT COSTS. LOOK AT THIS PLAN THAT WE CURRENTLY HAVE. THIS IS YOUR DEDUCTIBLE AND EXPLAIN IT TO THE TO THE UM TO THE EMPLOYEES. WE GOT BACK MORE OF THE SLIDES THAT YOU'RE NOT SEEING TONIGHT, BUT MORE LIKE THIS WITH A LITTLE MORE IN DEPTH DETAIL. UM AND AS WELL AS THE FEEDBACK FROM JAMES SAYING THAT THE EMPLOYEES PREFER TO KEEP. THE PLAN THEY HAVE, EVEN WITH UM, THE LOWER DEDUCTIBLE. SO THAT'S THAT'S THAT WAS THE FEEDBACK THAT WE GOT IN THE SECOND MEETING. UM FOR ME. THIS NUMBER HERE KNOWING THAT ARE LOOKING AT THIS. DATA THAT CHANGING PLANS. FOR ME IF IT HAD BEEN THE OPPOSITE AND $500,000 CHEAPER THAN WHAT WE'RE PAYING NOW. I WOULD HAVE BEEN. MORE WILLING TO MAKE HIM MAKE A CHANGE FOR THE EMPLOYEES. BUT THE FACT THAT IT COSTS MORE JUST DIDN'T MAKE SENSE TO ME. I MEAN,
[01:20:02]
IT'S A IT'S ALMOST A PENNY IN THE RIGHT. SO THAT'S MY FEEDBACK THAT FIRST THAT FIRST COMMITTEE MEETING. WE DID ASK THEM TO GO BACK TO GO TO THE EMPLOYEES THAT THEN THEY I ASKED WHAT THEY PRESENTED TO THE EMPLOYEES, AND THE REPORT THAT WAS PRESENTED TO THE EMPLOYEES WAS THE SAME EXACT REPORT. I BELIEVE THAT WAS PRESENTED TO US, WHICH WASN'T EVALUATION OF THE COST TO THE TOWN. AS OPPOSED TO AT LEAST FROM THAT STUDY FROM THAT EVALUATION. I WOULD HAVE THOUGHT THEY'D BEEN SOMETHING THAT WOULD HAVE TO TALK TO THE EMPLOYEES ABOUT THEIR BENEFITS. AND THEY'RE THE DIFFERENCES IN THOSE BENEFITS, BUT INSTEAD WHAT I GOT AT LEAST THE MATERIAL I GOT.LOOKED LIKE IT WAS THE EXACT SAME PACKAGE. DIDN'T IT TO YOU ALL LOOK LIKE THE EXACT SAME PACKAGE THAT CAME TO US CLARIFY THAT IN THE MEETING THE SECOND MEETING, JAMES EXPLAIN YOU CAN EXPLAIN BETTER THAN I CAN. BUT HE DID SAY THAT HE THEY SHOWED THE PLANS SIDE BY SIDE TO THE EMPLOYEES, SO THEY DIDN'T ASK FOR THAT. AND WHAT I GOT WAS THAT THE SAME THING THAT WE'VE SENT, SO I THOUGHT IT WAS RIGHT. THE EMPLOYEES HAVE SEEN BOTH PLANS. SO I BUY SIDE. BUT THAT WAS AFTER THE SECOND MEETING THAT THEY HAVE WITH YOU GUYS. CORRECT AFTER THE FIRST NAME. I BELIEVE THE FIRST FEEDBACK WE WANTED RIGHT MEETING. WE SAID WE WANTED TO FOLLOW THE VISA. SO WE ASKED FOR THAT FEEDBACK, AND THAT'S WHY WE HAVE THIS SUBSEQUENTLY. AS MORE AND UP NUMBERS BACK FROM THE EMPLOYEE ENGAGEMENT. WHICH I DON'T REALLY WANT TO PLAY. THEY YOU. SO ALL THE DEPARTMENTS. AND I WOULD AGREE, UM THE FIRST MEETING. YOU KNOW, WE DID HAVE QUESTIONS.
THEY DID COME BACK AND PRESENTED THIS TO US LAST MEETING AND, UM MADE IT A LOT CLEARER NOW.
THERE'S BEEN A WHOLE LOT OF INFORMATION PRESENTED TONIGHT AND UM AH! FROM FOR ANSWERING THOSE QUESTIONS. THANK YOU, LANCE. I KNOW YOU'RE NOT PREPARED. MR DIXON DEFINITELY WAS. SO I MEAN, I'M I'M NOT THE INSURANCE EXPERT THAT THESE GUYS ARE OBVIOUSLY UM AND SO YOU CAN TAKE NUMBERS. IT APPEARED. AND KIND OF MAKE THEM. SAY WHAT YOU WANT. UM. SO. BASED ON BASED ON WHAT I'VE SEEN. I KNOW. YOU KNOW, WE HAVE TO DECIDE FOR OUR TOWN EMPLOYEES. WHAT WE THINK IS BEST. THE EMPLOYEES WERE TOLD TO COME BACK AND SAID THAT THEY LIKE WHAT THEY'RE DOING NOW.
BASED ON THAT. UM THE BENEFITS SUBCOMMITTEE MEETING OR THEIR RECOMMENDATION THE TOWN STAFF'S RECOMMENDATION. UM AND THE CONSULTANT'S RECOMMENDATION. I UNDERSTAND. YOU KNOW WHAT THE THIS IS A LITTLE TIME SENSITIVE AS WELL, BECAUSE WE NEED TO GET THIS FAIR OPEN ENROLLMENT SO WE CAN GET EVERYTHING SETTLED BY THE END OF THE YEAR. UM HAVING ALL THIS INFORMATION THROWN AT US AT THIS POINT. I DON'T KNOW. IT'S DIFFICULT. IT'S DIFFICULT. THAT NEEDS TO BE DONE. THAT'S WHY WE MADE IT TODAY. IT NEEDS TO BE DECIDED ON TONIGHT OR AT LEAST BY WE'RE TRYING TO GET INTO OPEN ENROLLMENT. SO. IN ORDER TO HIT THIS, SO WE HAVE A NEW PLAN. YOU'RE STARTING IN JANUARY. IT WOULD BE VERY TIGHT IF THIS WERE DECIDED NEXT TO ME. BUT ALMOST. MATTER OF FACT, WE WOULD HAVE TO PROBABLY SQUEEZE THE OPEN ENROLLMENT PERIOD, SON. IT'S MY REMEMBER IT HAD TO BE THIS MEETING BECAUSE THE FOLLOWING MEETING WOULD'VE BEEN TOO LATE. DO IT. IS THAT TRUE? THEN WE WOULD BE. WE CANNOT RECONSIDER THIS. THE NEXT MEETING, OR WE WILL BE TOO LATE WILL PUSH ENROLLMENT PAST THE I'M SORRY. GO AHEAD THAT QUESTION. UM OPEN ROOM IN THE SCHEDULE FOR MONDAY AFTER THANKSGIVING, AND WE GIVE EMPLOYEES TWO WEEKS TO GO FOR THEIR BENEFITS MAKE DECISIONS. IT TAKES THREE WEEKS. TODAY. FOR THE VENDORS TO START UPLOADING THE INFORMATION, SO IT'S READY FOR OPEN. SO IF WE DELAY THIS, IT'S GOING TO BACK EVERYTHING UP. AND WE'LL BE DOING OPEN ENROLLMENT RIGHT BEFORE CHRISTMAS. I DO REALLY QUICKLY.
MAYOR PRO TEM. I WANT TO ADDRESS MR COT COUNCILMAN COTTON'S QUESTION. SO WITH QB ARE
[01:25:01]
INCUMBENT VENDOR FIRM AND FINAL QUOTE, WHICH IS A PROCESS BUT 4.497. MILLION 4.497 IS THE AGGREGATE IS OUR CLAIM EXPOSURE WITH QB EXPOSURE. DOES THAT INCLUDE ALL OTHER COSTS? NO THAT'S JUST THAT'S OUR CLAIM. I THINK THAT'S OUR I THINK THAT MIGHT BE OUR CLAIM. EXPOSURE PLUS ARE FIXED. COST I THINK, IS WHAT THAT WAS. I'M SORRY, RON. YOU STILL HAVE THAT ALL COSTS TOTAL LIABILITY. FIXED NOT FIXED. UH UM. SO THE 4.97 TO ANSWER YOUR QUESTION IS THE CLAIM LIABILITY FOR 0.497. YEAH. $417. UH THE TRINITY CAPTIVE GROUP MAXIMUM EXPOSURE, AND THIS DOES NOT INCLUDE UH, THE FIXED COST COMPONENTS OR 4.2. 66 TO 17 MILLION. UM SO IT'S 200 SOMETHING $1000 DIFFERENCE THERE SOME OF THAT EXPENSE AND ONCE AGAIN I I'M SHOWING HERE. THEIR THEIR FIXED COSTS ARE, UH, $18,000 MORE EXPENSIVE ON THE STOP LOSS COMPONENT ITSELF.ADMINISTRATIVE AND CAPTIVE COLLATERAL, MORE EXPENSIVE, SO I MEAN, COUNCILMAN TO ANSWER YOUR QUESTION. MAXIMUM EXPOSURE FOR BOTH PLANS IS A IS A I MEAN WITHIN DOLLARS OF EACH OTHER AND THE OTHER AREA HE FOCUSED ON OR THE AT LEAST GOT MY KITCHEN WAS THE PRICE FOR EMPLOYED. AND HE TALKED ABOUT 10,000 VERSES. 14,000 YEAH, SOUNDED LIKE TO ME THAT HE'S SUGGESTING THAT HIS PROGRAM IS YOU KNOW THREE OR 4000 CHEAPER PER EMPLOYEE. WHAT IS? WELL I MEAN, COUNT THEM AND LOOK AT YOU CAN LOOK AT MY ANALYSIS HERE. HE'S GONNA BE HALF A MILLION TO A MILLION DOLLARS MORE EXPENSIVE. SO WHEN WE FOCUS ON MAXIMUM LIABILITY, WE LOOK VERY SIMILAR. WHEN WE FOCUS ON ALL THE COMPONENTS OF YOUR SELF FUNDED HEALTH PLAN IN THE ACTUAL COST. HE'S GOING TO BE HALF A MILLION TO A MILLION DOLLARS MORE EXPENSIVE. YEAH, I'D LOVE TO DEFER THIS AND HAVE HIM ADDRESS. THOSE SLIDES THAT JASON PUT UP THERE TO THE SUBCOMMITTEE. WE COULD COME BACK TO THE NEXT COUNCIL MEETING. CHANGE BREAST THEN. YOU KNOW, BECAUSE THERE WAS A LOT OF COMPELLING STUFF THAT I SAW IT THERE THEN. IS, HE ADMITTED, YOU KNOW, HE HASN'T HAD A CHANCE TO LOOK AT IT. AND SO IT'S NOT. APPROPRIATE FOR THE AT THIS POINT. WHAT WILLIAMS, YOUR YOUR TOWN CONSULTANT. SO BASED ON THE INFORMATION THAT JASON GAVE US IS THERE SOMETHING IN THERE THAT YOU FEEL THAT SHOULD BE ADDRESSED THAT WE NEED TO KNOW? THAT MAKES A DIFFERENCE. IT'S NOT GONNA CHANGE MY RECOMMENDATION OR THE ADMINISTRATION'S RECOMMENDATION IN MY OPINION. WE'RE SIMPLY DELAYING OUR RECOMMENDATION BEYOND CAN MAKE A MOTION, CHARLES IF YOU IF YOU FEEL YOU MIGHT DO THAT. YEAH, I MOVED. I MOVED THAT WE TABLE THIS ITEM UNTIL THE NEXT MEETING, AND IN THE MEANTIME, GIVE LANCE AN OPPORTUNITY TO ADDRESS THE SUBCOMMITTEE. THE ITEMS THAT WERE PROPOSED AND DISPUTED ON THAT SLIDE SHOW. THAT MOTION. IS THERE A SECOND? I'LL SECOND FOR A VOTE. SECONDED BY CHRIS KERN. ALL IN FAVOR. PLEASE RAISE YOUR HAND. ALL OPPOSED. ABSTAINING. SO WE HAVE A TIE. I THINK THAT THIS THIS CAN'T WAIT UNTIL I DO THINK THERE'S VALUE AND ADD TO HAVE THIS DISCUSSION. I DON'T KNOW THAT WE CAN WAIT ANOTHER TWO WEEKS TO HAVE THAT DISCUSSION. SO I KNOW TIME IS OF THE ESSENCE. I THINK THAT MR. DIXON HAD A LOT OF COMMENTS IN THERE THAT WE NEED TO TAKE INTO CONSIDERATION. IF TRULY, THE NUMBERS WERE NOT PUT SIDE BY SIDE. I WANT TO KNOW WHY. I DO ALSO PUT A LOT OF WEIGHT AND THE FACT THAT WE HAVE PAID FOR A CONSULTANT TO DO THIS REVIEW AND YOU'VE DONE IT MANY A YEAR AND EMPLOYEES HAVE BEEN SERVED WELL, SO THAT FACTORS INTO MY DECISION AS WELL, I JUST MY NON VOTING IS THE TIMEFRAME. DO YOU THINK THAT YOU KNOW THERE'S PROBABLY SOME POINTS THAT WE NEED TO TALK ABOUT IN THERE. MY CONCERNS AT THE TIME FRAME AS WELL. AND THEN I WOULD LIKE TO KNOW MORE ABOUT EMPLOYEE. OBVIOUSLY I'M NOT ON THIS THIS SUBCOMMITTEE, SO I'M A LITTLE BIT OF A DISADVANTAGE,
[01:30:01]
BUT UNDERSTANDING THE NATURE OF WHAT? THAT QUESTION. AND I KNOW THAT'S THAT'S MY CONCERN ABOUT THE TIMELINE TO IT'S LIKE A LOT OF THESE QUESTIONS COULD BE ANSWERED TONIGHT. I'M NOT SURE THEY CAN. AND IF WE DO PUT THIS OUT OF ANOTHER TWO WEEKS OR WE JUST ABSOLUTELY DOPEY DOING BEING ABLE TO GET GET INTO THE OPEN ENROLLMENT PERIOD OR WE HOW MANY? HOW MANY QUESTIONS? ARE WE LOOKING AT HERE? YOU SAY THERE'S DISCREPANCIES AND THERE'S QUESTIONS AND YOU'D LIKE TO SEE RED INK UP THERE WITH JASON. SO WHAT ARE WE LOOKING AT? HELLO. WOULD IT TAKE YOU PREPARE FOR BUT I'M SAYING WHAT I'M WHAT I'M THINKING POSSIBLY IS. WE POSTPONED UNTIL AFTER EXECUTIVE SESSION. AND COME BACK. LET THEM HAVE A CHANCE TO POSSIBLY DISCUSS WHAT YOU'RE DOING. AND THEN COME BACK AND SEE SIDE WEST SIDE COMPARISONS. ONCE AGAIN, GUYS PREPARE THAT THERE. I'M IT'S NOT WHETHER IT'S TONIGHT OR TWO WEEKS FROM NOW IT'S NOT CHANGING. UH OUR RECOMMENDATION . I MEAN, MR DIXON, CERTAINLY, UH, YOU KNOW, CAN PRESENT HIS INFORMATION AND, UH, YOU KNOW, THAT'S FINE, BUT IT DOESN'T CHANGE ANYTHING ABOUT OUR RECOMMENDATIONS OR RECOMMENDATIONS ARE SOUND. THEY'RE FINANCIALLY SOUND. THEY MEET ALL THE RESPONSIBILITIES THAT I LAID OUT AT THE FIRST MEETING. UM IT'S SIMPLY GOING TO BE MORE COSTLY FOR Y'ALL TO MOVE TO TRINITY CAPTIVE GROUP. SO THAT'S OUT. WHAT ABOUT, UH, WHAT'S THE WHAT'S THEIR LAST ABSOLUTE DAY THAT YOU WOULD BE ABLE TO ACCEPT THIS? IF IT'S NOT THE NEXT COUNCIL MEETING IN TWO WEEKS OF 14 DAYS. WHAT WOULD BE THE TONIGHT HAS TO BE DONE, OR IS IT LIKE FRIDAY? COULD WE CALL AN EMERGENCY MEETING? WELL. THERE'S A LOT OF QUESTIONS HANGING OVER THIS AT ALL. I SAW THE RECOMMENDATIONS. I YOU KNOW? I KNOW WHAT I WHAT I WOULD DO. THERE'S QUESTIONS UP HERE. AND SO IF THERE'S ANY WAY POSSIBLE THAT WE CAN GET ALL THIS OUT AND OUT ON THE TABLE BECAUSE IT SEEMS LIKE YOU TALKED TO ONE GROUP, YOU GET THIS ANSWER. YOU TALK TO THIS GROUP. YOU GET DIFFERENT ANSWERS, AND THEN YOU GO BACK AND FORTH. IF WE COULD JUST GET AWAY WE CAN SEE EVERYTHING TOGETHER. MAYBE WE CAN COME TO A CONCLUSION. MAY. GO AHEAD, JASON YES? A COUPLE OF THINGS. WE STILL DON'T KNOW WHAT THE MAXIMUM COST LIABILITY IS. OKAY? TO SAY THAT THE NUMBERS ON THE FOURTH TO ADDRESS YOUR COMMENT ABOUT 14,000 VERSUS 10,000. YOU MIGHT KNOW SOME PEOPLE IN TOWN THAT HAVE THIS PROGRAM AND I'VE HAD IT FOR SOME FIVE YEARS FROM EIGHT YEARS, SOME 12 YEARS. BUT THEY CAN GIVE YOU THEIR NUMBERS AND SHOW YOU EXACTLY WHAT IT DOES. NOW WHAT I WOULD ASK THE SHEET THAT I PASSED OUT. I CAN GIVE IT TO YOU TONIGHT. AND YOU KNOW WHAT? I'M GOING TO DRAW YOUR ATTENTION. TO THE BOTTOM HALF OF THE PAGE, WHERE IT SAYS RX REBATE CAPTIVE DISTRIBUTION HS CONTRIBUTION. STRIKE THOSE OUT. I DON'T KNOW, WHILE I WOULD ASK IS TO HAVE YOUR TOWN FILL IN THE RED. IT'S REAL SIMPLE. IT'S CALLED A SPECK RATE. YEAH, GREAT AND THEN ATTACHMENT FACTOR. NOW. DON'T ADD DISCOUNTS. DON'T NOT ADD DISCOUNTS. PUT RAW NUMBERS BECAUSE, JEFF, YOU ARE RIGHT. CAN SHOW YOU 20 CONSULTANTS THAT VALIDATE ONE'S A LITTLE COMPANY CALLED MILLIMAN. THEY'RE PRETTY BIG FIRM. THAT ACTUALLY REALLY SAY OUR NUMBERS HOLD TRUE. SO I CAN GIVE YOU THE SAME CONSULTANT SAYING I REMEMBERS OLD TRUTH. I'M SAYING WHY THEM OUT? HAVE THE I DON'T KNOW YOUR NUMBERS BECAUSE IT'S STILL NOT SHOWN TONIGHT. BUT WHERE IT SAYS 2 53 45. HAVE YOUR TOWN STAFF FILL THAT NUMBER IN WHERE IT SAYS $7 HAVE YOUR STAFF FEEL THAT NUMBER IN WHERE IT SAYS 1149 15 HAVE YOUR STAFF FEEL THAT NUMBER IN WHEN YOU ADD ALL THOSE UP, THERE'S GONNA BE A NUMBER AND GUESS WHAT? IF WE'RE NOT THE LOWEST NUMBER ON PAPER. DON'T ADD ANY DISCOUNTS. DON'T ADD ANYWHERE I CONSULTANT OR ARE PBM ALL THAT I CAN SHOW YOU AS MANY OTHER CONSULTANTS THAT SAY THAT MY $400,000 IT IS TRUE. A COUPLE OF OTHER NOTES. AMY BARLEY. I THINK YOU'RE THE ONE THAT MS PARK COUNCIL OF ALI SAID THAT THE TWO THINGS CAME OUT OF THERE WERE FIRM. AND FEEDBACK WHERE YOU'RE TO REQUEST. WHY DID YOU HAVE TO ASK FIRM? IF OURS WAS FIRM IN YOUR MEETING. MR CLARIFY THAT, UM, ON THE PAPERWORK THAT WAS GIVEN TO US TO PRONOUNCE,[01:35:08]
BOTH COMPANIES SAID NOT FIRM LANDS DID TELL US IN THE MEETING THAT HE HAD JUST RECEIVED AN EMAIL WITH FIRM NUMBERS. WE JUST DIDN'T HAVE THE DATA IN FRONT OF US JUST TO CLARIFY. I DON'T WANT ANYBODY TO THINK THAT LANCE WASN'T HONEST WITH US ABOUT THAT HE WAS. IT JUST WASN'T ON THE DATA THAT WAS PRINTED AT THE TIME. ENOUGH LAST MINUTE. I MEAN IN IN ALL FAIRNESS. WE GOT IT.WE WERE WORKING. WE GOT THE DATA ON OCTOBER 11TH. SO THAT WAS ANOTHER THING. WHEN YOU START THINKING ABOUT THIS DECISION AND WONDERING, CAN WE GET THIS DONE IN TWO WEEKS? IT DOES TAKE TIME.
THAT'S WHY I BEG TO MEET WITH THE CONSULTANT AND WITH TOWN STAFF. THROUGH THIS PROCESS AFTER THE SEALED BIDS HAD BEEN OPENED. SO ONCE THE SEALED BIDS ARE OPEN. AND WE WERE NOTIFIED THAT WE WERE FINALISTS TWO MONTHS WENT BY. WE WOULD HAVE LOVED TO HAVE GIVEN THIS PRESENTATION THEN. BUT NOW YOU'RE BACKED INTO A CORNER. WITH THE 4.4. NON 7417 CLAIMS ONLY MAXIMUM LIABILITY. AND WE'RE SHOWING YOU 4.51088. OH, WHICH WAY DOES THE $200,000 FLIP? TAKE ALL THE HOCUS POCUS OUT OF PBM DISCOUNTS AND WE'RE NOT GOING TO GIVE YOU WE CAN SIT HERE ALL NIGHT AND GO. WHO'S GOING TO GIVE YOU MORE DISCOUNTS? JUST TAKE IT OUT.
MAKE THEM ZERO ACROSS THE BOARD. AND THEN THINK ABOUT WELL. ON PAPER, WE LOOK BETTER. WELL, IT'S NOT GONNA HOLD TRUTH. THERE WAS A COMMENT THAT DISRUPTION IN THE PERCENTAGES OF NETWORK DOCTORS AND I WANT TO REFUTE IT NOT TO BORE YOU. PERCENTAGE OF DOCTORS NOT ACCURATE IN DALLAS FORT WORTH, AND WE DID A DISRUPTION ANALYSIS ON YOUR GROUP. WE HAVE ALL YOUR EMPLOYEES CLAIMS. WE KNOW THE DOCTORS THAT THEY'RE GOING TO. THERE IS NOT THE DISRUPTION.
OKAY? SO THAT'S ANOTHER THING. HE TALKED ABOUT SHARKS. GETMAN ANOTHER 150 SHARKS HAS BEEN IN OUR PROGRAMS FOR FIVE YEARS. THIS ISN'T NEW TO US. WE'VE BEEN DOING THIS. THIS IS WHY WE HAVE A $10,000 PE PY, NOT A 14,000. BECAUSE WE'VE BEEN DOING THESE PROGRAMS. AH! YOU KNOW? THE NETWORK. IT. I HATE TO SAY IT. THE BIGGEST FACADE IS DISCOUNTS AND NOT TO GIVE YOU A BAD JOKE.
BUT WHAT WE TYPICALLY ASK, THE CFO CONSULTANT SAYS, WELL, THE NETWORK DISCOUNT THE QUESTION IS , WOULD YOU RATHER HAVE A 60% DISCOUNT OR A 40% DISCOUNT? THE ANSWER SHOULD BE OF WHAT RIGHT NOW. YOU DON'T YOU HAVE ZERO CHANCE TO AUDIT A CLAIM. ONE OF THE REASONS WE DRIVE DOWN COSTS AND OH, BY THE WAY, THE DIFFERENCE IS THAT 60 TO 40. I'LL EVEN GIVE YOU LET'S SAY IT'S A 4% 2% FRED. BUT WE AUDITOR CLAIMS SO YOU DON'T PAY WORK AGAIN. THAT'S WHY OURS IS A 10,000. BUT IF I HAD A BIG CONTINGENCY FROM UNITEDHEALTHCARE TO PROMOTE THEIR MEDICAL, DENTAL VISION AND THEIR LIFE PRODUCTS. AND MY FIRM GOT A BIG CONTINGENCY COMMISSION AT THE END OF THE YEAR. THOSE MIGHT HAVE SOME DETERRENCE OF WHY WE WOULD WANT TO PACKAGE ALL THIS TOGETHER. AND SO I JUST LEAVE YOU WITH WE TALKED ABOUT. WE HAD A SPREAD OF DEPARTMENTS.
I DON'T BELIEVE THERE WAS ONE PUBLIC SAFETY EMPLOYEE ON THAT EMPLOYEE ENGAGEMENT. OTHER EMPLOYEES THAT I TALKED TO WHO SAW ME HERE IN THE MEETING TONIGHT WORRIED HERE, AND I'M LIKE, WELL, WE'RE TRYING TO CUT THE DEDUCTIBLE IN HALF. THAT I SHOULD HAVE WHAT? THAT WOULD BE AWESOME. SO I REALLY WANT TO QUESTION WHAT QUESTIONS WERE MADE IN THE SUBCOMMITTEE. TO MAKE THEM GO. I DON'T WANT MY DEDUCTIBLE, BUT NOW I LIKE PAYING 3000. THANK YOU. THANK YOU, MR DIXON. ANY FURTHER QUESTIONS. DO WE HAVE ANY MOTIONS? MADE. ONE MR. DIXON WOULD YOU MIND SPEAKING TO THE OUT OF POCKET MAXIMUM? I THINK ABOUT IT OUT OF POCKET AS A FAMILY IS AN EMPLOYEE. THE OUT OF POCKET MAXIMUM. MUCH GREATER. YOU KNOW WHAT? WHAT IS IT? 10,000 BROUGHT IT UP? I'D LOVE TO TALK ABOUT THE OUT OF POCKET MAXIMUM.
BRIEFLY SUCCINCTLY. MAYBE. IF I HAVE IT MAY I TOOK THE PLANT IS ON. NO. HERE IT IS. WHICH PLAN WOULD YOU LIKE TO REFER TO THE 7 50 DEDUCTIBLE OR THE 1500. WHILE THE IN NETWORK. AND NETWORK IS MORE FOUR AND EIGHT. SO RIGHT NOW, YOUR OUT OF POCKET 5500. IN NETWORK, REMEMBER, YOU DON'T
[01:40:11]
HAVE OUT OF NETWORK. SO IF YOUR EMPLOYEES GO OUT OF NETWORK AND YOU DO HAVE SOME OUT OF NETWORK USAGE. THEY DON'T HAVE BENEFITS . NOT MUCH. BUT YOU'RE NOT GONNA HAVE DISRUPTION, EITHER. YOU CAN'T HAVE ONE ARGUMENT AND NOT HAVE THE OTHER. ALL OF YOUR EMPLOYEES THAT ARE IN NETWORK NOW ARE THE SAME EMPLOYEES HERE THAT ARE GOING TO BE IN NETWORK. YOU CAN'T HAVE IT BOTH WAYS. YOU CAN'T SAY WE DON'T HAVE, UH, NOT ENOUGH PROVIDERS. AND THAT THEY'RE GOING TO HAVE TO GO OUT OF NETWORK. CAN'T USE BOTH SIDES OF THE ARGUMENT. SO WHAT WE DID WE MAKE IT VERY SIMPLE. WE DO THIS ALL OVER THE COUNTRY. WE TAKE EMPLOYEES CURRENT COST IN NETWORK. AND WE MAKE THAT ARE OUT OF NETWORK. AND WE REVERSE ENGINEER BACKWARDS. SO I CAN EMPHATICALLY SAY TO A LADY TODAY AND HUMA, ARIZONA. I MEAN, LOUISIANA. I'M CENTRAL BOAT RENTALS. I DON'T KNOW WHO THEIR EMPLOYEES ARE. WHAT DOCTORS THAT THEY GO TO? BUT THERE'LL BE NO DISRUPTION. BECAUSE IT'S THE SAME COPAY. THAT THEY HAVE IN NETWORK WHEN THEY GO OUT OF NETWORK. AND THE REALITY OF THIS PLACE WAS LIKE, YEAH. DR JONES IS IN BOTH U. H C. AND AETNA. NOW. I ALSO REPRESENT UNITED HEALTHCARE. I KNOW THE NETWORK DISCOUNTS. I KNOW. THE PERCENTAGE OF PROVIDERS I'VE GOT OFF TRACK. SORRY MARKET, MR RAY. WHAT WOULD YOU WHAT WAS YOUR PARTICULAR ANSWER? BREAKFAST. WE MERGE. YOUR CURRENT PLAN IS ARE OUT OF NETWORK. SO THERE'S NO DISRUPTION.YOU'LL HAVE TO EXCUSE MY LACK OF EXPERIENCE, BUT I DON'T KNOW WHAT TO DO IF THERE IS NO MOTION. ARE THERE ANY MOTIONS? CAN I MAKE THE SAME MOTION AGAIN? AFTER THE BIKE, AFRAID, DIFFER THIS TABLE THIS DECISION FOR TWO WEEKS AND ASK OUR CONSULTANT AND STAFF TO ADDRESS THE QUESTIONS RAISED BY THE PRESENTATION BY MR WITH THE SUBCOMMITTEE AND THEN BRING IT BACK TO THE COUNCIL. THE NEXT MEETING. 2ND 2ND OR MOTION BY CHARLES COTTON, A SECOND BY CHRIS KERN. ALL IN FAVOR. ALL OPPOSED. OH, ABSTAINED. WHICH I'M SORRY.
IS THERE ANY FURTHER DISCUSSION? SO I'LL GO BACK TO WHAT I SAID EARLIER AND I WANT THE BENEFIT.
FOR THE HEALTH HEALTH INSURANCE WE HAVE FOR EMPLOYEES TO BE THE BEST. AND I THINK THAT WE'VE DONE THAT OVER A PERIOD OF TIME. ALL THE FAIR TO THE BENEFITS COMMITTEE JUST LIKE THEY DEFER TO ME ON FINANCE COMMITTEE STUFF. TO MAKE RECOMMENDATIONS. AND BASED ON THAT RECOMMENDATION. AS MUCH AS I FEEL LIKE. I WOULD HAVE LOVED TO HAVE ANOTHER WEEK OR SO TO DIGEST THIS MUCH LESS, YOU KNOW, 45 MINUTES OF INUNDATION. I'LL MAKE A RECOMMENDATION OF THE FINANCE SORRY OF THE BENEFITS COMMITTEE. TO PROVE PROMOTE. MOTION MOTION BY COUNCILMAN RAY WAIT A SECOND. ASK A QUESTION. SO YOU'RE SAYING. LET'S LOOK BACK TO THE BENEFITS COMMITTEE AGAIN RIGHT HERE TONIGHT. THEM RESTATE THEIR RECOMMENDATIONS. THAT WHAT I'M PARAPHRASING. SO WHAT I'M HEARING YOU SAY. I THINK THE RECOMMENDATIONS LET'S CLARIFY THE RECOMMENDATION UNDERSTAND THE MOTION. CLAIRE FATHER RECOMMENDATION WOULD BE GREAT. I'M ON THE BENEFITS SUBCOMMITTEE, AND I RECOMMEND WE GO WITH THE RECOMMENDATION OF OUR OF LANCE AND OUR HR DIRECTOR AND GO WITH THEM OR AND I'M ALL THE BENEFITS SUBCOMMITTEE, AND I RECOMMEND THAT WE DIFFER. I'LL GO BACK TO THE SLIDE THAT MR PATTERSON SHARED WITH THE BOTTOM LINE NUMBER OF $500,000 BASED ON
[01:45:03]
THAT. AND THE EMPLOYEE FEEDBACK THAT JAMES GAVE US. MY RECOMMENDATION THE DAY OF THE MEETING THAT WE HAD WAS TO APPROVE WHAT THEY ARE RECOMMENDING BECAUSE IT SAVES. I MEAN IT'S MORE EXPENSIVE TO GO WITH TRINITY CAPTIVE. IF I THOUGHT THAT WE COULD DELAY IT FOR TWO WEEKS. GET A LITTLE MORE CLARITY AROUND SOME THINGS AND STILL MEET SOME DEADLINES. I WOULD BE ALL IN FAVOR OF DELAYING. I'M CONCERNED ABOUT. I'M CONCERNED ABOUT ENROLLMENT FOR THE EMPLOYEES. I DON'T WANT TO BE AN INCONVENIENCE TO THEM BECAUSE WE WERE INDECISIVE. UM MAYBE JAMES COULD SPEAK AGAIN TO US ABOUT WHAT DOES IT MEAN? IF WE WHAT? WHAT HAPPENS ON THE TIMELINE? IF WE COME BACK TO THIS IN TWO WEEKS. RIGHT NOW WE HAVE OPEN ENROLLMENT SCHEDULED FOR UGLY. THAT'S NOVEMBER 28 THROUGH DECEMBER 9TH. IF WE DELAY THAT WE'RE GOING TO HAVE TO PUSH OPEN MOMENT BACK AND PROBABLY CRUNCH IT TO ONE WEEK. TO GIVE EMPLOYEES TIME TO REVIEW THEIR THEIR SELECTIONS. IN YOUR OPINION, IS THAT ENOUGH TIME? NO. NO, ACTUALLY, I DON'T. YOU DON'T. I'M SORRY. CAN YOU REPEAT THAT? YOU DON'T BELIEVE THAT'S ENOUGH TIME? THAT'S ENOUGH TIME FOR EMPLOYEES TO REVIEW THEIR DATA, AND I DON'T BELIEVE IT'S ENOUGH TIME FOR HR TO BE ABLE TO PROCESS EVERYTHING. AND I AGREE WITH HIM. FUN. SO WHERE I AM, I'M SORRY. SO WHERE I AM ON THIS IS I AM I WOULD LIKE IF I HAD MY PERFECT YOU KNOW? PERFECT IDEA WOULD BE TO DELAY. THIS WOULD LOVE TO DO THAT. JUST THAT WE COULD RE EXAMINE THAT. LOOK, I HEARD WHAT YOU SAID EARLIER THAT THE ANSWER MAY NOT BE ANY DIFFERENT. BUT AGAIN I VALUE OUR EMPLOYEES VALUE. THE BENEFITS ENOUGH WHERE I WOULD TAKE THAT EXTRA TIME. BUT I'M HEARING AND PLEASE CORRECT ME. I'M HEARING YOU SAY THAT WE'RE GOING TO SHRINK THIS DOWN. TO A WEEK. IF WE DELAY THIS TWO WEEKS. CORRECT AND THAT'S REALLY GOING TO GUARD IS IT ARE WE JUST SAYING THAT IT'S GOING TO HAVE SOME EMPLOYEES THAT SIMPLY WON'T BE ABLE TO COMPLETE THE PROCESS IN TIME. IS IT JUST YES, IT'S ALL THE ABOVE ITS ITS EMPLOYEES HAVING ENOUGH TIME TO GO OUT AND REVIEW THEIR BENEFITS. TALK TO THEIR SPOUSES . COME AND HR. ASK QUESTIONS BECAUSE THEY DON'T UNDERSTAND EVERYTHING. WE'RE GOING TO TRUNCATE THAT DOWN TO ONE WEEK. OKAY? I MEAN, I REALLY I REALLY WISH WE HAD MORE TIME ON THIS ONE REALLY DID IT. THAT'S PARTS ABOUT ME. BUT IF THAT IS TRULY NOT THE CASE. I WOULD SECOND COUNCILMAN REYES. MOTION. SIMPLY BECAUSE I DON'T LIKE THIS AT ALL. BUT AT THE SAME TIME. I CAN'T. I CAN'T. I DON'T WANT TO CRIPPLE. OUR EMPLOYEES OPPORTUNITIES I WOULD LOVE TO. HONESTLY, I WOULD LOVE TO HEAR. YOU KNOW WHAT THOSE QUESTIONS WERE? YOU BOYS WERE PRESENTED BECAUSE I THINK THERE IS SOME SOME AH, CURIOSITY FROM MY PERSPECTIVE ON THAT PIECE OF IT. AND THERE'S A LOT OF COMPELLING POINTS THAT MR DIXON HAS MADE.AND SO I LIKE, YOU KNOW, IT'S ONE OF THOSE THINGS THAT I HATE BEING IN THIS POSITION. BUT AT THE SAME TIME WE HAVE A BENEFITS SUBCOMMITTEE. THAT HAS GIVEN THEIR TIME JUST LIKE WE DEFER TO THE FINANCE COMMITTEE HAS GIVEN THEIR TIME THEY'RE MUCH MORE VERSED THAN I AM IN THIS AND SO I'M NOW THAT PERSONALLY, I MEANT THAT KIND OF JUNCTURE WHERE I FEEL LIKE I'VE GOT TO DEFER TO THEM. [12. Conduct a public hearing and consider and act upon an ordinance amending the Thoroughfare Plan to realign segments of Teel Parkway, McKinley Street, Gorgeous Road, Coleman Street, and the DNT Collector, amend the cross section for First Street between Coleman Street and Craig Road, rename Fishtrap Road west of Legacy Drive to First Street, and add a collector road from the DNT Collector to Frontier Park. (CA22-0002). (HW)]
IT'S A MANIC OKAY. THANK YOU. I'M LEANING INTO IT. AMENDING THE THOROUGHFARE PLAN TO REALIGN SEGMENTS OF TEAL PARKWAY AND MCKINLEY STREET, GORGEOUS. ROAD, COLEMAN STREET AND THE DNT COLLECTOR AMEND THE CROSS SECTION FOR FIRST STREET BETWEEN COLEMAN STREET AND CRAIG ROAD.RENAME FISH TRAP ROAD WEST OF LEGACY DRIVE TO FIRST STREET AND ADD A COLLECTOR ROAD FROM THE DNT COLLECTOR TO FRONTIER PARK. HUMAN WILL DO THE PRESENTATION. YES. GOOD EVENING, MAYOR AND COUNCIL. HMM BEFORE YOU OPEN THE PUBLIC HEARING, I JUST WANT TO SPEND JUST A FEW MINUTES TO RUN
[01:55:05]
REAL QUICK THROUGH THE PROPOSED CHANGES. AND THEN FIRST GETS THE ANSWER. THE QUESTION OF WHY ARE WE HERE TONIGHT TO GO THROUGH THIS PROCESS OF AMENDING THE THOROUGHFARE PLAN. AS YOU ALL KNOW, WE USE THE THERAPY. PLAYING AS A GUIDE. IT'S A MENTAL HELP WITH OUR TRANSPORTATION DECISIONS WITHIN THE TOWN. UH, BACK IN 2019, THOUGH, HOWEVER, IT WAS USED AGAINST US ON THE ZONING CASE WHERE THE CITIZENRY USED IT IN ZOOMED IN AND KIND OF TOOK IT AS MORE THAN A GUIDE. AND SO AFTER THAT, THAT CASE THAT WE WENT THROUGH THE DECISION AT THAT TIME WITH COUNCIL IS, UH, LET'S MAKE SURE TO TAKE A LOOK AT OUR THOROUGHFARE PLAN PERIODICALLY.OR AT LEAST ANNUALLY WHEN WE DO MAKE CHANGES THAT ARE EXISTING TO THOROUGHFARES OR CHANGES THAT WE KNOW THAT ARE COMING. LET'S TAKE A PROACTIVE STANCE AND CHANGE THE THOROUGHFARE PLAN AS WE GO ALONG. SO THE FIRST PROPOSED CHANGE WE HAVE OUR CURRENT LINEMAN OF TEAL PARKWAY . THIS IS JUST SOUTH OF PARVIN ROAD, WHICH IS THE RED THOROUGHFARE ON THE NORTHERN END DOWN TO PROSPER TRAIL. THIS PROPOSED AMENDMENT REPRESENTS AN ACTUAL ALIGNMENT OF TAIL PARKWAY . THIS IS THAT WAS CONSTRUCTED HERE RECENTLY, TWO LANES THAT WAS RECENT CONSTRUCTED WITH WINDSONG PARKWAY AS PART OF THEIR DEVELOPMENT. THE NEXT CHANGE. WE HAVE THE CURRENT ALIGNMENT OF MCKINLEY STREET. UH, THIS IS FROM FIFTH STREET AS PART OF THE LIVE DEVELOPMENT.
THE CURRENT PLAN SHOWED MCKINLEY STREET FROM FIFTH STREET, ACTUALLY CURVING AND CONNECTING INTO, UH COLEMAN STREET, WHERE GORGEOUS STREET IS TO THE EAST SIDE OF COLEMAN. YOU'RE PROBABLY FAMILIAR WITH THE LIVE DEVELOPMENT. MCKINLEY NOW ACTUALLY MAKES IT INTERSECTION AND GORGEOUS STREET WILL ACTUALLY BE EXTENDED FROM COLEMAN STREET WEST AND INTERSECT WITH MCKINLEY. SO THIS PROPOSED LINEMAN OR AMENDMENT IS BASED ON THEIR PLANS FOR THE CONSTRUCTION OF MCKINLEY AND GORGEOUS. THE NEXT PROPOSED CHANGES ARE ALIGNMENT OF COLEMAN STREET. THIS IS SOUTH WITH THE GATES OF PROSPER DEVELOPMENT. YOU CAN SEE MANY OF YOU PROBABLY EXPERIENCED THE OFFSET OF COLEMAN AT LOVERS. THE PLAN HAS BEEN ALL ALONG TO, UH TO, UH MOVIL COLEMAN TO THE WEST SO THAT IT DOES INTERSECT WITH THE COLEMANS SOUTH OF LETTERS LANE AT LOVER'S LANE INTERSECTION, SO WE'RE SHOWING THAT PROPOSED AMENDMENT HERE TODAY. TO ACCOUNT FOR THAT CHANGE THAT WILL ACTUALLY OCCUR WITH THE DEVELOPMENT STARVE YOU, THE PRESIDENT OF THE ECONOMY GETS A PROSPEROUS CURRENTLY WORKING ONS BACK IN 2006. THE THOROUGHFARE PLAN, WHICH I HAVE CIRCLED HERE IS IT SHOWS WHAT'S CALLED THE DNT COLLECTOR EAST OF THE DALLAS NORTH TOLLWAY THAT WAS RUNNING PARALLEL TO THE DALLAS NORTH TOLLWAY FROM FIRST STREET UP TO FRONTIER PARK WAY BACK IN 2006. THIS ALIGNMENT WAS AGAIN A COLLECTOR ROAD THAT WAS DIRECTLY BEHIND THE HOMES AND FLEXOR PROSPER. UH IN 2006, ACTUALLY, AT THE NEAR THE END OF 2006 ON NOVEMBER 14TH. THE PROPERTY. YOU CAN SEE MULTI FAMILIES OWNING IN A COMMERCIAL CORRIDOR ZONING BETWEEN THE TOLLWAY AND THE LIKES OF PROSPEROUS DEVELOPMENT NORTH OF PROSPER TRAIL THERE WAS APPROVED. IT WAS ACTUALLY A PLAN DEVELOPMENT NUMBER 35. ALONG WITH THAT DEVELOPMENT, THEY SHOW THE 60 FT RIGHT AWAY FOR THAT COLLECTOR IN ACCORDANCE WITH THE 2006 MASTER PLAN. SOME OTHER EXHIBITS THAT WERE PART OF THAT ZONING AT THAT TIME BACK IN 2006 AGAIN, YOU CAN SEE ON THE EASTERN EDGE OF THEIR DEVELOPMENT. THE 60 FT RIGHT AWAY, AS WELL AS A PLAN VIEW SHOWING THAT THE HOMES THERE LIKES TO PROSPER. HOWEVER THE CURRENT ALIGNMENT YOU CAN SEE THERE TO THE LEFT OF THE DNT COLLECTOR KIND OF GOT A LITTLE SQUIGGLY OVER THE YEARS, AND SOME OF THAT WAS BASED ON SOME TALKS WITH THE THAT SAME PROPERTY OWNER OF SOME POTENTIAL REALIGNMENT TO THE SOUTH. UH YOU MAY OR MAY NOT BE AWARE OF WHEN PRESIDENT BAPTIST CAME IN. IT DID CROSS A LITTLE BIT OF A AND ALL SET OF THE ALIGNMENT OF THAT CONTINUOUSLY ANTI COLLECTOR FURTHER SOUTH OF PROSPER TRAIL. UH WE DID LOOK AT THE POTENTIAL OF MOVING THE D AND CLICK THE ROAD A LITTLE CLOSER TO THE DNT AND IN HOPES OF MAYBE THAT COULD BE EXTENDED FURTHER SOUTH OF PROSPER TRAIL. ULTIMATELY WHAT DID HAPPEN, WAS THEY WHAT? YOU SEE THE YELLOW LINE FURTHER EAST SOUTH OF PROSPER TRAIL, WHICH IS ACTUALLY COOK LANE. WE DID DO A STUDY THE SHOW THAT WE DID NOT NEED TO CONTINUOUS DNT COLLECTOR ROAD FROM FRONTIER PARKWAY ALL THE WAY DOWN TO US 3 80 SO THAT OFFSET OCCURRED. AND WHERE WE ARE AT TODAY IS THERE'S INTEREST IN THE MULTI FAMILY ATTRACTIVELY
[02:00:03]
AND THAT IS THERE ALONG THE TOLLWAY, AND THEY'VE MADE IT VERY CLEAR THAT WE NEED TO GO BACK AND CLEAN UP THAT THEY'RE AFRAID, THEREFORE, PLAYING BASED ON WHAT WAS APPROVED BACK IN 2006, SO WE'RE ESSENTIALLY GOING BACK AND ASKING TO AMEND THE THOROUGHFARE PLAN BACK TO WHAT WAS APPROVED THEIR ZONING BACK IN 2006. AND WITH THAT WE ALSO SHOW THE PROPOSED ALIGNMENT OF THE I GUESS THE ADDITIONAL ROAD CONNECTION TO FRONTIER PARK THAT WAS DISCUSSED WITH THE COUNCIL BACK ON SEPTEMBER 13TH. THIS IS THE ROAD THAT WOULD CONNECT TO FRONTIER PARK AND BE PARALLEL WITH FRONTIER PARKWAY AND CONNECT OVER TO THE DNT COLLECTOR ROAD. ANOTHER CHANGE WE'RE SHOWING IS THE SEGMENT OF FIRST STREET BETWEEN COLEMAN AND CRAIG STREET. THIS WAS SOMETHING COUNCIL BROUGHT TO OUR EXTRA DISCUSSED EARLIER THIS YEAR CONCERNS WITH THE SEGMENT OF THIS TRAPPED BETWEEN COLEMAN AND CRAIG STREET. WE WERE DESIGNING FOR LANES WHERE WE ARE DESIGNING FOR LINES OF FIRST STREET BETWEEN THE DNT AND COLEMAN. WE HAVE FOUR LANES FROM CRAIG OVER TO PRESTON, BUT YET ARE THOROUGHFARE PLAN SHOWED A TWO LANE WITH PARALLEL PARKING IN TWIN, COLEMAN AND CRAIG. SO WE WENT THROUGH THAT ANALYSIS THAT TWO LANE ROAD WAS, IF YOU RECALL WAS A 60 60 FT RIGHT AWAY. WE WERE ABLE TO WORK THROUGH REDUCED THE RIGHT AWAY TO 56 FT, RIGHT AWAY THAT ACHIEVE A FOUR LANE UNDIVIDED SECTION WITH REDUCED LANE WIDTHS REDUCED PARKWAY WITS, WHICH THAT TIME COUNCIL SUPPORTED THAT RECOMMENDATION. OF THAT SECTION . SO TONIGHT WE'RE ASKING TO SOLIDIFY THAT AS PART OF THIS THIS THOROUGHFARE PLAN AMENDMENT THERE. AND THEN THE LAST CHANGES ON OCTOBER OCTOBER 11TH COUNCIL MEETING THE ORDINANCE WAS PASSEH TRAPPED BETWEEN THE ROAD AND LEGACY AND DIDN'T COUNTY TO RENAME THAT FROM FISH TRAP TO FIRST STREET. SO AGAIN AS WE'RE SHOWING HERE. THE PROPOSED THOROUGHFARE PLAN WITH ALL THE AMENDMENTS THAT I MENTIONED WILL INCLUDE THE CHANGING OF FISH TRAP TO FIRST STREET. SO WE DID HOLD THE PUBLIC HEARING. PNC ON OCTOBER 18TH AND THEY RECOMMENDED THE TOWN COUNCIL APPROVE ALL THE PROPOSED AMENDMENTS THAT I MENTIONED HERE. AND SO WE'RE ASKING TONIGHT FROM TOWN STAFF, BUT JUST RECOMMENDATION TO THE COUNCIL OF WARD CARBS SCHEMING APPROVED THE ORDINANCE OF MANY OF THESE CHANGES. SO BEFORE YOU OPEN THE PUBLIC HEARING BE GLAD TO ANSWER ANY QUESTIONS YOU HAVE. QUESTIONS FOR HEALING. HAVE ONE QUESTION. UM, WE'VE DISCUSSED I'M ON FIRST STREET BETWEEN CRAIG AND COLEMAN, THE ROUNDABOUT AT THE INTERSECTION THERE. WE DON'T HAVE TO DEPICT THAT ON THIS IN ORDER TO DO IT. IS THAT SOMETHING WE JUST DO WHEN IT GETS TO DESIGN CORRECT? WE CURRENTLY DON'T SHOW ANY OTHER LIKE DEPICTION OF ROUNDABOUT CITY. WE'RE ON THE THIRD FLOOR PLAN. BUT IF THAT IS SOMETHING THAT WE WANT TO, WE CAN EASILY SHOW ROUNDABOUT. THAT'S EASY ENOUGH. IF THAT IS AN ACTION YOU WANT TO ADD. WE CURRENTLY DON'T SHOW ROUNDABOUTS ON THE AIRPLANE. ABBOTT GOOD WAS GOING TO SAY ALL THESE CHANGES THAT ARE BEING MADE. THEY THEN DISCUSSED WITH THE PROPERTY OWNERS. UH YES, WE DID REACH OUT ON ANOTHER LEXA PROSPER WAS ONE WHEN WE DID TALK TO COUNCIL REACHED OUT TO THE MANAGEMENT COMPANY AS WELL AS EJECT DIXON LOOKING FOR HIS ASSISTANCE TO GET THAT NEVER HEARD BACK. FROM ANYONE THERE SO AS FAR AS THAT ONE THERE AND THEN I KNOW THE PRICE AND COMMENTS ON THE OTHER.SECTION OF THE COLLECTOR ROAD NORTH OR SOUTH AND FRONTIER PARK, WHERE YOU'LL PROBABLY GET SOME BE BACK TONIGHT ON THAT ONE FROM THE PROPERTY OWNER'S REPRESENTATIVE IN ATTENDANCE.
OKAY BESIDES THAT, A LOT OF IT'S CLEAN UP AND A LOT OF IT'SSUPPOF PROSPER, WORKING THROUGH STAR VIEW THAT REALIGNMENT PARKWAY WAS DONE WITH WINDSONG RANCH. SO A LOT OF IT YOU KNOW? SUPPORTIVE OF WHAT'S GOING ON WITH THE DEVELOPMENT. OKAY, THANKS. I HAD A COUPLE QUESTIONS ONE AT THE PLANNING ZONING COMMISSION. I KNOW THAT THEY VOTED TO APPROVE. IT WAS THEIR COMMENTS FROM CITIZENS THAT THAT MEETING THERE WERE THERE WERE NO NO WANTED TO ATTEND ITS SEPARATE COUNCIL MEMBER, RAY. THEY LOVED IT. THEY THOUGHT IT DID AMAZING JOB AND YEAH. NO THEN YOU KNOW, AND AGAIN, THEY WERE JUST, YOU KNOW, KIND OF LIKE THE COUNCIL AT THAT POINT, JUST APPRECIATIVE THAT GOING BACK THERE AND JUST TRYING TO DEDUCE CLEANUPS. SO THAT'S ONE OF MY POINT. I'M MAKING KIND OF A SHORT STATEMENT. BUT WHY ARE WE NOT UPDATING THESE WHEN WE APPROVED THE ZONING? SO LIKE IF THE ZONING CHANGE IN THE FEEDER ROAD WAS MADE, BECAUSE AND I JUST WANT TO BE CAREFUL HOW WE'RE PRESENTING THIS AND THIS MEETING LIKE THE WAY YOU PRESENTED IN THE BEGINNING, UM I THINK IT'S VERY IMPORTANT THAT THIS IS ACCURATE BECAUSE I THINK PEOPLE DO. MAKE PURCHASES, ESPECIALLY PRIVATE RESIDENTS MAKE ON THAT, AND THAT'S WHERE WE RUN INTO TROUBLE LATER, I THOUGHT WE HAD KIND OF BEEN THROUGH THAT LEARNED A LESSON AND FIXED IT. BUT STILL SOME OF
[02:05:04]
THESE FEEL KIND OF OLD, SO I'M NOT SAYING I'M AGAINST HIM NOW. I JUST FEEL LIKE WHY ARE WE NOT CHANGING IT EVERY TIME JUST LIKE WE CHANGED THE OTHER. MAPS YOU KNOW THE FUTURE LAND USE OR WHATEVER I KNOW IT'S NOT REQUIRED. BUT WHAT? WHY ARE WE NOT CHANGING THE PROCESS TO DO THAT? YEAH YOU TALK ABOUT THE BIGGEST ONE BEING THERE. THE BMT COLLECTOR. YEAH AND WE WERE WORKING AGAIN. WE'RE WORKING WITH THAT PROPERTY OWNER THAT HAD THOSE TRACKS JUST NORTH OF PROSPER TRAIL. AND THAT'S WHEN WE WERE TRYING TO AGAIN. MOVE IT FROM AWAY FROM THE HOMES IF WE MOVED IT A LITTLE FURTHER WEST IT WAS FAR ENOUGH THAT WE COULD CONTINUE SOUTH IN BETWEEN PROCESS, PRESTONWOOD BAPTIST, THIS PROPERTY AND THE BLUE STARS PROPERTY SO THAT THAT TIME THEY WERE, YOU KNOW, SUPPORTIVE OF THAT. AND SO I THINK THAT'S AT THAT TIME. THAT'S WHERE WE GOT AMENDED. AND IT WAS THE GAME JUST RECENTLY, WHERE WE'VE MET WITH THE TOMLIN, WHO OWNS THOSE PROPERTIES, AND THERE ARE NO LONGER IN SUPPORT OF THAT. PLAN ANYMORE. THEY'RE SAYING NO. WE WANT TO GO BACK TO THE WAY IT WAS IN 2006 WHEN THEY HAD THE ZONING. IN PLACE BECAUSE THAT'S KIND OF MAKING MY POINT CAME TO AN AGREEMENT BACK THEN HOW WE CHANGED IT? YES MAYBE WHEN IT WAS PRESENTED NOW AGAIN, YOU KNOW WHOEVER LIVED THERE AT THE TIME. I'M NOT SUPER CLEAR ON THE TIMING OF THE HOMES THAT ARE BUILT ALONG THERE, BUT, UM THIS IS JUST ONE OF THOSE THINGS RIGHT CONCERNS ME THAT WE HAVE PUBLIC DOCUMENTS OUT THERE. I KNOW IT'S NOT THE BIBLE AND TIMES CHANGE AND WE MAKE DIFFERENT DECISIONS, BUT I THINK IT'S IMPORTANT FOR THIS TO BE AS CLOSE TO WHATEVER WE EXPECT AS POSSIBLE AT ALL TIMES THAT'S UNDERSTOOD. ANY OTHER COMMENTS FOR STAFF. THANK YOU. THANK YOU . THANK YOU ALL RIGHT AT THIS TIME. SINCE THIS AGENDA ITEM IS A PUBLIC HEARING, I'LL OPEN THE PUBLIC HEARING AT THIS TIME. IS THERE ANYONE IN THE AUDIENCE OR ONLINE THAT WOULD LIKE TO SPEAK? SEEING NO ONE WILL KNOW. YEAH GOOD EVENING. MAYOR COUNCIL.MATT MOORE, CLAYMORE ENGINEERING . 301 SOUTH COLEMAN PROSPER, TEXAS. I'VE GOT A SHORT 24 PAGE PRESENTATION. I WANT TO MAKE UM , I KNOW IT'S THERE. NO UM, I'VE GOT COMMENTS REALLY ISOLATED TO THE COLLECTOR ROAD THAT'S BEING PROPOSED BETWEEN FRONTIER PARK. AND THE DNT COLLECTOR ROAD.
OBVIOUSLY I'M WORKING ON MANY DEVELOPMENTS THERE FRONTIER IN THE HALLWAY. MY PERSONAL OPINION IS IT FEELS LIKE THIS IS A KNEE JERK REACTION TO ADD THAT ROAD AND AT THIS TIME WE'VE GOT FRONTIER PARKWAY THAT IS UNDER CONSTRUCTION TO BE A FOUR LANE ROAD IMMEDIATELY UPON COMPLETION OF CONSTRUCTION, ULTIMATELY, A SIX LANE ROAD TO THEN GO THROUGH ANOTHER TWO LANE ROAD, 700 FT SOUTH OF THERE. JUST FEELS LIKE A KNEE JERK REACTION. I UNDERSTAND THAT TRAFFIC HAS BEEN BAD WITH THE STADIUM TRAFFIC, THE HIGH SCHOOL FRONTIER PARK. NONE OF THOSE USES HAVE HAD THE BENEFIT OF THE FOUR LANE ROADWAY THAT'S ABOUT TO OPEN HERE SHORTLY. I JUST FEEL LIKE THAT COLLECTOR ROAD IS A LITTLE BIT OF A KNEE JERK REACTION BASED ON TRAFFIC THAT WE'VE EXPERIENCED IN THE PAST. I THINK THAT WE NEED TO LET THE YOU KNOW, TRAFFIC PATTERNS WORK THEMSELVES OUT ONCE FRONTIER IS BUILT. IF THERE IS STILL AN ISSUE, THEN YOU LOOK AT IT AND COLLECT AROUND AT THAT TIME. I JUST DON'T THINK IT'S NECESSARY AT THIS POINT UNTIL WE SEE HOW FRONTIER REACTS ONCE IT'S OPENED. DON'T WE REFER TO THE COLLECTOR ROAD IS THE ROAD GOING NORTH AND SOUTH? WELL, THE WHATEVER YOU'RE CALLING THE ROAD , TRYING TO BE SURE, WE'RE CLEAR. YOU'RE TALKING ABOUT THE EAST WEST CONNECTION TO THE PARK. CORRECT. DEPARTMENT. YES.
WAS THAT BROUGHT UP AS A EMERGENCY ACCESS TO FRONTIER AT THE TIME. AND THEN LATER ON.
WHEN THEY BUILT THE BRIDGE, IT WAS DECIDED THAT THAT WAS NOT NECESSARILY OR NOW THAT THAT WAS THE ACCESS DIRECTLY INTO LAKES OF PROSPER THAT WAS CONSIDERED EMERGENCY ACCENTS AND THEN DROPPED. THERE IS NO ALTERNATIVE ACCESS BECAUSE OF THE TRAFFIC AND YOU KNOW AND ALTERNATIVE, WHETHER IT'S EMERGENCY OR PUBLIC ACCESS BECAUSE OF THE TRAFFIC. CONVERSATIONS. I DON'T THINK ANY OF THEM THE PROPERTY OWNERS WERE AWARE OF THIS UNTIL I SAW IT ON THE PNC AGENDA A FEW WEEKS AGO, SO I DON'T KNOW HOW THE NOTICES ARE GOING OUT TO PROPERTY OWNERS IF THEY ARE AFFECTED, UM THESE PARTICULAR ONES WERE NOT AWARE THAT IT WAS COMING BACK BEFORE THIS COUNCIL. UNTIL IT WAS LIKE I SAID, I'VE NOTICED IT ON THE AGENDA. ANY OTHER QUESTIONS. ANYONE ELSE TO SPEAK FOR THE PUBLIC HEARING? OKAY. IN THAT CASE, I'LL CLOSE THE PUBLIC HEARING COUNSEL DISCUSSION.
WELL, MY CONCERN IS YOUR CALL. WE DISCUSSED A ROAD CONNECTING THE PARK WOULD HAVE LIKED TO HAVE HAD ONE. BUT WE HAD A DEAL WORKING THAT MATT BROUGHT TO US AND THAT DEAL ABSOLUTELY PROHIBITIVE FROM GOING ACROSS THERE, SO WE MET THAT ROAD ACROSS. SO WE STOPPED THAT. NOW IF WE WAIT WE'LL HAVE THE SAME THING HAPPENED AGAIN. WE'LL HAVE ANOTHER. SOMEBODY COME UP AND
[02:10:04]
SAY, OH, WE CAN'T DO IT BECAUSE OF THIS. AND THIS SO THE MAIN I FEEL LIKE THIS. WOW. WELL MATT THINKS THAT FOUR LANES MAY SOLVE IT. I DON'T THINK IT WILL THE TRAFFIC PROBLEMS BECAUSE THE TOWN IS GETTING BIGGER. THERE'S GOING TO BE MORE USE OF THAT PARK. MORE USE OF THAT STADIUM.WHEN THE WHEN THE TWO HIGH SCHOOLS PLAY EACH OTHER, IT'S GONNA BE EVEN WORSE. BUT MY TAKE IS YOU PUT IT ON THE THIRD PAIR PLAN NOW. AND IF THE FOUR LANES DEAL SITE SOLVES IT. AND THE DEVELOPMENT. LANDOVER COMES IN WITH THE DEVELOPMENT PLAN THAT HE DOESN'T WANT THAT THERE AND WE GO FIND THAT'S GREAT. TAKE IT OFF THEN. BUT IF YOU DON'T THEN WE'RE BACK AT THE SAME POSITION.
WE WERE ON THE OTHER PART OF THE LAND. SO I THINK IT NEEDS TO BE INCLUDED ON THE THOROUGHFARE PLAN. THE COPS ON ANYTHING ELSE ON THE UPDATED THOROUGHFARE PLANE. CHARLES DO YOU HAVE A MOTION? I MOVE APPROVAL OF THE ITEM NUMBER. 12. 12. ON THE REGULAR AGENDA. OKAY. WE HAVE MOTION BY CHARLES COTTON. SECOND BY AMY BARTLEY ALL IN FAVOR. ANY OPPOSED. MOTION PASSES 61.
[13. Consider and act upon authorizing the Interim Town Manager to execute a Standard Form of Agreement between the Town and Dean Electric, Inc., dba Dean Electric, related to Construction Manager-At-Risk services for Raymond Community Park Phase 1 Project; and an Addendum to the Standard Form of Agreement between the Town and the Construction Manager-At-Risk. (PN)]
ALRIGHT THE NEXT ITEM IS ITEM NUMBER 13. AND I WILL READ THE ITEM AND THEN TURNED IT OVER THE MERE PROTEST CONSIDERING ACT UPON AUTHORIZING TOWN MANAGER EXECUTED STANDARD FORM OF AGREEMENT BETWEEN THE TOWN AND DEAN ELECTRIC DEVIATE DEAN ELECTRIC RELATED TO THE CONSTRUCTION MANAGER AT RISK SERVICES FOR RAYMOND COMMUNITY PARK. PHASE ONE PROJECT AND ADDENDUM TO THE STANDARD FORM OF RING BETWEEN THE TOWN AND DESTRUCTION MANAGER AT RISK.GOOD EVENING, MAYOR AND COUNCIL. NO PROBLEM. I'M SORRY. OKAY, GO AHEAD, MR MARTIN. THANK YOU. UM SO THE TOWN REQUESTED PROPOSALS AND RFP FROM A QUALIFIED FIRMS TO PROVIDE CONSTRUCTION MANAGEMENT RISK SERVICES. THE TOWN RECEIVED SIX RESPONSES. FIRMS ARE REQUIRED TO SUBMIT INFORMATION OR TO FACILITATE EVALUATIONS BASED ON THE FOLLOWING CRITERIA. FIRMS OVERALL ABILITY TO MEET TOWNS OBJECTIVES EXPERIENCE WITH THE SAME OR SIMILAR FACILITY CONSTRUCTION. QUALIFICATIONS OF INDIVIDUALS, INDIVIDUALS ASSIGNED OF THE PROJECT REFERENCES IN THE COST PROPOSAL. THE EVALUATION COMMITTEE WAS COMPRISED OF THREE STAFF MEMBERS REPRESENTING PARKS AND REC AND ENGINEERING. THE EVALUATION COMMITTEE SCORED EACH THE MIDDLE IN ACCORDANCE WITH THE EVALUATION CRITERIA STATED ABOVE TO DETERMINE THE TOTAL POINTS FOR EACH FIRM. IN REVIEW OF THE REFERENCES. UM AFTER THE I'M SORRY, I MUST ASK MY SPOT HERE.
BASED ON THE RESULTS, THE COMMITTEE INTERVIEWED THE TOP RANKING FIRM AFTER THE INTERVIEW AND REVIEW REFERENCES, IT WAS RECOMMENDED OF STAFF TO AWARD THE AGREEMENT TO DEEM ELECTRIC.
ALSO KNOWN AS DEAN CONSTRUCTION. CONSTRUCTION HAS DONE WORK WITH MULTIPLE MURDERS, A PALLET EASE AS WELL AS MOST RECENTLY THEY CONSTRUCTED FRONTIER PARK NORTH OF THE TOWN. THERE'S UH, YOU'VE RECEIVED THIS IN YOUR SLIDES BUT WANTED TO SHOW THIS ON THE PRESENTATION. THE CONSTRUCTION CONTRACT DOCUMENTS INCLUDED WITH THE ITEM WILL SECURE. HE ISN'T WE'RE NOT BEING CHARGED.
PRECONSTRUCTION SERVICE FEES, CONSTRUCTION PHASE SERVICE FEES AT 2.5% AND NOT DIXIE GENERAL CONDITIONS. COST OF $880,000. UM WHEN THE CONSTRUCTION DRAWINGS AND SPECS OF VACATIONS ARE NEAR COMPLETION SEEM OUR PROPOSAL GUARANTEED MAXIMUM PRICE GMP, INCLUDING CONTINGENCIES, WHICH SHALL BE THE SOME OF THE ESTIMATED COST OF THE WORK AND THE CONSTRUCTION MANAGER AT RISK FEE. GMP WELL REPRESENTED. TO TOWN COUNCIL FOR APPROVAL AT THAT TIME. UM, SO JUST TO ELABORATE A LITTLE BIT MORE ON THE TIMELINE, SO WE PRESENTED A DESIGN BACK IN JUNE AND KIND OF HAD AN IDEA OF SOME CONSENSUS MASTER PLAN. WE NOW WANTED TO BRING THE SEYMOUR ON BOARD. SO AND JANUARY WE CAN COME BACK TO YOU WITH THE, UH. STEAM ARE AS WELL AS WITH DONE AWAY WITH CONSENSUS PHASE ONE PLAN BASED ON THE FEEDBACK THAT WE'VE RECEIVED FROM YOU LAST TIME AS WELL AS FEEDBACK WE RECEIVED FROM THE LEAGUE'S, UM AND COME UP WITH A PHASE ONE PLAN WE CAN MOVE FORWARD WITHIN WITH DESIGN DEVELOPMENT AND THEN CONSTRUCTION DRAWINGS, THEN BEGIN THE BID PROCESS AND THEN START CONSTRUCTION WHEN THE FUNDS BECOME AVAILABLE IN OCTOBER. 2023. SO BUDGET IMPACT . THERE'S NO BUDGET IMPACT UNTIL THE COMPLETION OF THE CONSTRUCTION ESTIMATE AND BASED ON THE CONSTRUCTION COST ESTIMATE OF $16 MILLION THE ESTIMATED TO BE PAID TO THE SEYMOUR IS $1.28 MILLION, OR $1,280,000. WITH THAT. I'M HERE TO ANSWER ANY QUESTIONS YOU GUYS MAY HAVE ANYBODY HAVE ANY QUESTIONS? YES I DO. SORRY.
[02:15:07]
OKAY. I ALWAYS HAVE QUESTIONS. AND OKAY, SO. MY CONCERN. JUST PUT IT OUT THERE IS THAT COST WAS ONLY 40% OF THE MATRIX FOR YOUR EVALUATION. THE PERSON THAT YOU'RE RECOMMENDING DEAN CONSTRUCTION. CAME IN THIRD ON COST. OKAY, SO THERE $75,000 MORE. THEN YOUR LOWEST BID, OKAY? UM. IS THERE? WHAT IS THE RATIONALE BEHIND THE 40% MY. MY BIGGEST CONCERN IS THAT 60% OF THE BID MATRIX DIDN'T HAVE ANYTHING TO DO WITH COST AND A LOT OF THOSE ITEMS OVER OUR ABILITY TO MEET TOWNS OBJECTIVES . THOSE KINDS OF THINGS ARE A LITTLE BIT SUBJECTIVE. UM AND I'M REALLY MORE INTERESTED IN COST. SO. CAN YOU KIND OF GO THROUGH SORT OF WHAT THE RATIONALE WAS BEHIND JUST 40% BEING COST CAN GO AHEAD, MARCUS . THIS ACTUALLY, THE WEIGHTING OF THE SCORING IS SOMETHING THAT COUNSELOR HAD ESTABLISHED FOR ANY RPS. A COUPLE OF YEARS AGO, AND IT'S THE SAME METHODOLOGY SO IT DOESN'T CHANGE FROM PROJECT TO PROJECT. THE COLLECTIVE COUNCIL PUT A HIGHER EMPHASIS ON COST. THAT'S WHY THERE'S A 40% WAITING. NOW TO YOUR POINT ABOUT HAVING THE OTHER SCORES SUBJECTIVE. THEY'RE HIGHLY SUBJECTIVE, BUT THEY'RE ALSO, YOU KNOW. INDIVIDUALS THAT ARE REVIEWING THAT. ARE SELECTED. FOR THE PROJECTS THAT. YOU'RE LYING TO THOSE PARTICULAR DEPARTMENT SO UM, THE SCORING METHODOLOGY ALIGNS TO WHAT PROCUREMENT PUT IN PLACE, AND WE CAN'T CHANGE THAT FROM 1 TO 1 SO, BUT THAT WAS SOMETHING THAT THE COUNCIL COLLECTIVELY AGREED UPON. THE PERCENTAGES THINK IF I REMEMBER THAT WAS DUE TO A SPECIFICALLY A STREET PROJECT THAT WE GAVE TO THE LOWEST BIDDER. THAT TURNED INTO THE ONE COMPLICATION AFTER ANOTHER. AND WE KIND OF LEARNED THAT LOWEST ISN'T ALWAYS THE BEST. THAT BIDDER WAS ALRIGHT ARE KM WHO, IF YOU HAD READ THERE IF YOU'D GONE THROUGH THIS PROCESS WITH THEM, THERE WAS NO EVIDENCE THAT THEY WERE GOING TO FAIL AT THAT TIME. I KNOW I DEALT WITH THEM.I WORKED A LOT WITH THEM. THE PROBLEM, YOU WOULD HAVE HAD TO IDENTIFY FINANCIAL STUDY OF THE FINANCIALS CONDITION. THIS DOESN'T PROVIDE FOR ANY OF THAT. SO HOW IN THE WORLD DOES THAT FIX THAT PROBLEM, WHICH, BY THE WAY, THAT PROBLEM WAS SOLVED BY THE BOND. IT WAS ENDED UP BEING A TWO WEEK DELAY TWO MONTH DELAY IN THE PROJECT. SO I THINK MY TAKE WAS IT WAS A KNEE JERK REACTION TO DIP THE SET THIS UP. SO THAT THE WEIGHT IS SUBJECTED SO THAT THERE IS THE ABILITY TO SELECT NOT YOU END UP WITH NOT THE BEST COST, AND I HEARD HIM SAY JUST A SECOND AGO THAT ALL OF THESE FIRMS WERE QUALIFIED. SO IF EVERY FIRM IS QUALIFIED WHY ISN'T THIS A COST ISSUE? I MEAN, I CAN'T UNDERSTAND. I GUESS MAYBE YOU CAN EXPLAIN TO ME WHY. BALFOUR BEATTY. BIG BIG , UH, YOU KNOW, ONE OF THE BIGGEST FIRMS IN NORTH TEXAS DOING CONSTRUCTION WHY THEY GET A 7.83 AND THEIR ABILITY TO MEET TOWNS OBJECTIVES. AND DEAN GETS A SET 9.42. CAN YOU EXPLAIN WHY THAT IS YEAH, SO AND THEN BAKERS HERE TO HELP AS WELL. YOU KNOW, WE LOOKED AT ALL THEIR SUBMIT ALS. THERE ARE PROJECTS OF SIMILAR TYPE, AND MOST OF THEM DIDN'T HAVE THE QUANTITY NOR THE SAME SCOPE THAT WE'RE LOOKING TO DO HERE WITH THE SPORTS COMPLEX THAT DEAN CONSTRUCTION WAS ABLE CONCLUDED THAT THEY WEREN'T ABLE OR QUITE IS ABLE TO ME. THE TOWN'S OBJECTIVES. TO GIVE YOU AS FROM HOW DID YOU HOW DID YOU WEIGH THAT? I MEAN, THERE'S GOTTA BE SOME WEIGHT. IS THERE SOME MATRIX THAT SAYS WE GIVE THEM X NUMBER OF POINTS FOR HAVING DONE ONE LIKE THIS NEXT NUMBER, OR IS THIS JUST I FEEL LIKE THESE GUYS GOT A NINE POINT 42 AND THESE GUYS REALLY GET A 7.83. YEAH IT'S BEEN AND JAMES CLARK. JAMES J IS NOT HERE WITH PURCHASING. BUT YOU KNOW PART OF THE EVALUATION CRITERIA, WHICH WERE GIVEN IS BAITING BASED ON MEETING EXPECTATIONS IS HERE IF IT'S EXCEEDING OR GREATLY EXCEEDING EXPECTATIONS, SO IT'S BASED ON THE INFORMATION PROVIDED THAT SHOWS THAT THEY'RE GOING TO BE ABLE TO GO OVER AND BEYOND. AND WE BELIEVE THAT BASED ON THE INFORMATION THAT PROVIDING BASED ON HOW MANY PROJECTS THEY'VE DONE THE SUCCESS OF THOSE PROJECTS THAT THEY'RE ABLE TO GET, YOU KNOW A POINT OR TWO HIGHER, COMPARATIVELY AND AGAIN. ALL THOSE ARE STILL WAITED. SO EVEN THOUGH YOU KNOW WHAT, ALFRED WHAT'S THE POINT WORK IS A POINT WORKED. SO WHEN ONE OF YOU IS VALUING THIS AND YOU GIVE ONE FIRM A MAN AND YOU GIVE THE OTHER FIRM AND EIGHT, OKAY? SO YEAH, IT'S WEIGHTED VALUE
[02:20:06]
ASSIGNED TO THAT ONE POINT. YEAH. GO AHEAD. RIGHT SO YOU'RE CORRECT. IS THIS OBJECTIVE? ABSOLUTELY SOME OF THIS MAY BE YOU HAVE TO DO WITH IT PRIOR EXPERIENCE THAT WE MAY HAVE HAD WITH SOMEONE. I WORKED WITH A COUPLE OF THESE AND OTHER WHEN I WAS IN RICHARDSON, SO NO DOUBT, SO I'VE GOT SOME KNOWLEDGE BASED ON WHAT I KNOW THEY CAN PRODUCE. WHAT WE HAVE TO LOOK AT WHAT'S GIVEN TO US AND THAT PACKET OKAY , SO I MIGHT LOOK AT, UM AND I DON'T RECALL EXACTLY. I'VE GOT NOTES ON ON THESE, BUT I MIGHT LOOK AT THE GROUP THAT THEY'RE PROPOSING IS GOING TO BE OVER THIS PROJECT AND I'LL LOOK AND SEE WHAT PROJECTS THEY'VE DONE. THERE'S NO DOUBT EVERY ONE OF THESE FIRMS COULD THEY DO THE PROJECT SHOW? OKAY BUT WE WERE NOT ASKED TO COME BACK WITH THE CHEAPEST, RIGHT. WE WERE ASKED TO COME BACK WITH THE BEST BASED ON THE INFORMATION WE WERE GIVEN. SO AND I, BY THE WAY, I AGREE WITH YOU. I THINK THAT'S WHAT YOU DID WHAT YOU'RE ASKED TO DO. I THINK THE PROBLEM IS THE MATRIX THAT WAS CREATED IS INCREDIBLY SUBJECTIVE. AND. PUT YOU IN A SITUATION WHERE YOU ALL GET TO DECIDE. UNILATERALLY WHO WE SELECT NOT BASED ON COST, BUT BASED ON YOUR FEELING OF WHAT THE MATERIAL YOU PRESENT ON SUBJECTIVE FEELINGS, AND SO THE RISK IS THAT COULD BE BAD OR, YOU KNOW, ARE GOOD IN SOME CASES, BUT JUST SO I CAN SPEAK UP TO HERE. I DID SPEND SOME TIME WITH PURCHASING TODAY. I ALSO PULLED EVERY PROPOSAL AND LOOK THROUGH THOSE YESTERDAY AND TODAY. AND YOU KNOW WHEN YOU DO LOOK AT IT. YOU GOTTA TAKE THE PREPONDERANCE OF THE EVIDENCE KIND OF THING. AND GO. OKAY. HOW MANY OF THESE PROJECTS REALLY ARE ON ON TASK. YOU KNOW? AND I MEAN, I'VE WORKED WITH BATTLE FOR YEARS. BUILT A WHOLE LOT OF STUFF WITH HER. BUT I WOULDN'T HARM THEM. BUILD A PARK EITHER. JUST BECAUSE AGAIN, THAT'S JUST NOT THERE WILL HOUSE AND THEY DON'T REALLY HAVE EXPERIENCE IN THAT AREA. BUT I WOULD JUST SIMPLY SAY THAT YOU KNOW, AFTER LOOKING THROUGH THEM AND THE PREPONDERANCE OF THE EVIDENCE OF WHAT'S IN THOSE DOCUMENTS AND YOU LOOK AT IT, YOU'RE RIGHT. THERE'S SOME SUBJECTIVITY AND IN SOME OF THOSE SCORES BUT I GOT TO TELL YOU. THE OTHER THING I DID TO WAS ALSO PICKED UP THE PHONE AND TALK TO SOME OTHER COMMUNITIES. WHETHER UM, WHETHER WE LIKE IT OR NOT. THE THIS PROCESS. THIS KIND OF MATRIX IS USED IN MULTIPLE COMMUNITIES IN EXACTLY THE SAME WAY THEY MIGHT TWEAK SOMETHING HERE AND THERE A LITTLE BIT. THEY MIGHT CALL IT SOMETHING DIFFERENT. THEY MIGHT EVEN ADD SOMETHING WHICH WE CAN DO ALL OF THAT. UM BUT IF IT TRULY IS PRICES DRIVING IT OKAY . IF THAT'S REALLY WHERE WE WANT TO BE, THEN WE NEED TO BE PUT IN BIDS OUT THAT ARE BASED ON PRICE AND GET A GENERAL CONTRACTOR. THERE'S SOMEWHERE IN BETWEEN, TO SAY THAT PRICE IS NOT EVEN HALF OF THE VALUATION. TO ME IS A IS A CONCERN, AND IN FACT IT COST US POTENTIALLY 2 TO $3 MILLION ON ONE PROJECT ALREADY, SO THE TOWN PAID SEVERAL MILLION DOLLARS A COUPLE MILLION DOLLARS MORE. EVEN THOUGH THERE WAS A COMPETENT BITTER. THAT WAS IN SECOND PLACE BECAUSE OF THE EVALUATION OF THIS MATRIX. RIGHT ON FIRST STREET. WE'RE GONNA PAY A COUPLE OF MILLION PREMIUM.BECAUSE OF THIS MATRIX THE WAY THIS MATRIX WORKS. IT ALLOWS THE THEY THESE 60% OF IT TO BE SUBJECTED. AND I HAVE A PROBLEM THAT I THINK THAT WE NEED TO REVISIT THIS BEFORE WE AND I'VE BEEN PUSHING THIS FROM THIS LONG BEFORE YOU RIGHT BEFORE YOU UNDERSTAND PUSHING THAT THIS MATRIX IS NOT HEAVILY ENOUGH. WAITED TO COST OUR TAXPAYERS ARE TAXPAYERS. YOU KNOW? THEY MIGHT WANT THE BEST, BUT I THINK WE CAN DELIVER IF THEY'RE QUALIFIED . IF THEY'RE QUALIFIED, IF THEY'RE NOT QUALIFIED, THROW THEM OUT. BUT IF THEY'RE QUALIFIED THEN THAT NUMBER AUDIT INSTEAD OF 40% TO BE 75 OR 80% OF YOUR EVALUATION. THAT'S WHAT I'M NOT SAYING 100% AND WE CAN DO THAT. BUT IN ALMOST EVERY CASE, YOU'RE GONNA END UP WITH THE LOWEST BIDDER WITH PRICE WELL, AND THAT'S THAT'S WHAT OUR GOAL IS QUALIFIED. OKAY QUALIFIED. THEY'RE QUALIFIED.
THEN. UNLESS THEY IN IT THAT CRISIS SIGNIFICANT ENOUGH TO GET 75% OF IT. OVERRUNS THE ARREST OF IT, THEN I'M OK WITH THAT, BUT BUT THE ISSUE OF QUALIFICATIONS STILL GOING TO BE NOTHING. AIR QUOTES, SUBJECTIVE. I MEAN, THAT PORTION OF IT IS, BUT AT LEAST A LOT LESS.
UNDERSTANDING OF THE PROCESS, AND I DON'T I DIDN'T KNOW THAT ABOUT THE COUNCIL MAKING THAT CHANGE. I GUESS YOU GUYS WERE DOING LITTLE BIT BEFORE AND IT DIDN'T WORK. HMM MY UNDERSTANDING OF THIS PROCESS IS EVEN IF YOU HAD SOMETHING, I'M JUST THROWING THIS OUT THE TOP OF MY HEAD. BUT IF YOU HAD, LIKE A COST WAS 60% AND YOU WAITED ALL THE OTHER THINGS THAT 10%
[02:25:03]
THOSE OTHER 40% STILL PROTECT YOU. FROM GETTING SOMEBODY THAT MAYBE DOESN'T HAVE THE QUALIFICATIONS WHERE WE ARE REFERENCES SOMEWHAT, BUT COST WEIGHS MORE HEAVILY, AND THAT'S I GUESS WITH ALL SINCE I'VE BEEN ON COUNCIL EVERY SINGLE PROJECT WE HAVE TALKED ABOUT HAS BEEN OVER BUDGET. OR WE DIDN'T GET WHAT WE ORIGINALLY THOUGHT. WE WERE GOING TO GET FOR THE MONEY, YOU KNOW, AND I JUST THINK COST IS GOING TO KEEP GOING UP AND IT JUST IT CONCERNS ME THAT 40% OF THE COST PROPOSAL IS IN THIS EVALUATION MATRIX. WHEN REALLY, IT'S A HUGE ISSUE FOR FURTHER TOWN. BUT I MEAN, I REALIZED WE CAN'T CHANGE IT. TODAY AND THIS WAS THIS WAS THE PROCESS THE COUNCIL WANTED TWO YEARS AGO. I THINK WE SHOULD REVISIT IT. BUT THAT'S THAT'S NOT YOUR PROBLEM, OKAY? YEAH. SO FOR TONIGHT. THERE JUST NEEDS TO BE A DECISION ON THIS BID. ARE THIS REQUEST FOR PROPOSAL FOR A SEYMOUR? YEAH. AND. YEAH I WOULD SIMPLY SAY TO YOU THAT IF YOU CHOOSE NOT TO AWARD THEN. WE. PUT THINGS ON HOLD UNTIL WE CAN FIGURE OUT WHATEVER THAT MATRIX IS GOING TO BE. AND HOW YOU WANT TO ESTABLISH IT AND WHO YOU WANT TO ESTABLISH IT. YOU KNOW? THEN.WE CAN DO THAT. I SIMPLY WOULD SAY. I DON'T THINK IT WOULD BE AND AGAIN. I RELY ON TERRY HERE , BUT I DON'T THINK IT WOULD BE ALLOWABLE. FOR YOU, TOO. MAKE A CHANGE MIDSTREAM IN THIS PROJECT. SO WE WOULD NEED TO STOP. SET IT ASIDE. AND REBUILD IT. UNDER WHATEVER NEW CRITERIA WE COME UP WITH. DOES THAT BECAUSE IT'S PROVIDED IN THE RFP HOW WE'RE GOING TO EVALUATE IT. YES, SIR. THAT'S WHY OKAY. SORRY I JUST WANT TO MAKE CHANGES THAT MAKES SENSE, ACCORDING TO THE STATUTES ONCE YOU PUT IT OUT THERE, AND THAT'S THE CRITERIA. YOU MUST USE IT.
OKAY. NOW AHEAD OF TIME. YOU CAN ADJUST THAT CRITERIA WITHIN REASON, DEPENDING ON WHETHER THAT'S THE TYPE CONSTRUCTION MANAGER AT RISK CSP GENERAL CONTRACTOR THEY ALL HAVE DIFFERENT RULES. AND WE JUST WE GOTTA FOLLOW. MAKE SURE WE FOLLOW THOSE STATE REGULATION.
RIGHT? NOT IN THIS ONE. BUT IN CSP, ITS THERE'S A LIMIT. REALLY? IS IT? SO JUST TO BE CLEAR AS I THINK I KNOW THE ANSWER, BUT I JUST WANT TO MAKE SURE I UNDERSTAND THIS. EVEN THOUGH EVERYBODY'S PROPOSED WHAT THEY PROPOSED AT THIS, THEY THOUGHT COST WAS GOING TO BE 40% REFERENCES WAS GOING TO BE 10% WE CAN'T GO BACK NOW AND GO. OKAY, WELL, YOU YOUR COST IS YOUR COSTS. LET'S JUST WAIT IT DIFFERENTLY 60% OR WHATEVER AND RE EVALUATE THE BIDS. WE HAVE YOU HAVE TO RESTART TO RESTART THAT TAKE A MOTION TO GET RID OF EVERYTHING, OR JUST.
BUT THAT MEANS FOR TONIGHT. THERE'S JUST NO ACTION. YOU CAN'T YOU CAN'T REJECT ACTION THIS BID TONIGHT. BUT IF WE VOTED TO REJECT IT IF THERE WAS A MOTION TO REJECT THE BID.
[02:30:04]
CAN WE? CAN WE NOT REJECT THE BIDS TONIGHT? REJECT THE BIDS TONIGHT. GO OUT, REBID. YOU KNOW, I RIGHT? YOU'RE SO CORRECT. IF WE DID IT COULD BE ABOUT. SO WE POSTPONED TILL NEXT MEETING BEFORE WE DO THAT POINTING CLARITY. BECAUSE THIS IS THE RECOMMENDED WE HAVE THE ABILITY TO GO BACK AND COMMUNICATE WITH THE RECOMMENDED ON THE PRICE RIGHT AND NEGOTIATE THE PRICE. YOU GOT IT. YEAH, THEY DO. YEAH, THEY DO. TO THAT.IF I MAY. SO THIS IS PART OF THE PROPOSAL, RIGHT? THIS COST. WE DON'T HAVE A GOOD CHAT. PART OF WHAT WE'RE GOING TO PAY. ANY ONE OF THESE SIX IS BASED ON WHAT AND THERE'S A CONSTRUCTION SERVICES PERCENTAGE. WHEN YOU LOOK IN THERE, AND THEY VARY BETWEEN TWO AND 4.94 POINT ONE POINT KIND OF 4.47. IS THAT IN OUR, UH IN OUR PACKAGE. QUESTION THAT WE ASKED, AND IT WAS ON AN EMAIL, SO THEY WERE 2.5. SO PROBABLY THE OTHER THE ONE UNDER THEN. THE SECOND ONE WAS 4.47, AND THE ONE UNDER THAT WAS FOR WAS FOR AND WHAT ARE THE GENERAL CONDITIONS, THEN? THAT'S THEN THAT OBVIOUSLY SWINGS THE DIFFERENCE. SO THESE GUYS HAVE A 2.5% FEE. YEAH SO THEY HAVE MUCH HIGHER GENERAL CONDITIONS, THEN. 8 80 WAS THERE TO THE GENERAL CONDITIONS. SO THE LOW WE'RE TALKING. TOTAL PROPOSAL COSTS RIGHT NOW, WHICH WAS THE 1.2 ARTHUR'S BILL AND GROUPS THEY EVER CONSTRUCTION SERVICE FEE OF 2.95. PRECONSTRUCTION SERVICE $20,000. GENERAL CONDITIONS OF 712,000. $653.84. THE NEXT THE NEXT HIGHEST WHICH WAS 100 AND 27. $1,000,276 754,000 154. THE GENERAL CONDITIONS WITH 550,777 . BUT THEY HAD A CONSTRUCTION SERVICE FEE OF 4.47. AND THEN A PRECONSTRUCTION SERVICES 10,000. $777 AND THE. CONSTRUCTION SERVICE FEE. THAT'S ENOUGH TOTAL PROPOSAL BASED ON THE $16 MILLION PROJECT CALLED. WHAT WAS THE SCOPE OF THE PROJECT GIVEN TO HIM? WAS IT ONE PHASE? WHAT WAS IT 16 MILLION, OR WAS IT BECAUSE OBVIOUSLY, THESE GENERAL CONDITIONS ARE TIED TO SOME SORT OF SCOPE, RIGHT? AND THAT'S EXACTLY WHAT WE PRESENTED TO YOU BACK IN JUNE. I BELIEVE, AND WE HAD BROUGHT BACK ONE MENU OF ITEMS. THE TIME WE HAD ABOUT $12.5 MILLION BUDGET. THAT'S RIGHT. WE HAVE GIVEN YOU KIND OF A MENU AND WE WERE TOLD FORWARD WITH ALL OF THE ITEMS WHICH WAS WAS ABOUT $16 MILLION, SO WE WERE ABLE TO REWORK THE BOND A LITTLE BIT. AND THAT'S WHAT WE WENT OUT WITH. TO GET THESE NUMBERS. 60, EFFECTIVELY A $16 MILLION TIME. WHAT'S THE TIME? I MEAN, THEY HAD TO HAVE A SCOPES. THEY KNOW THE TIME PERIOD IN ORDER TO PUT GENERAL CONDITIONS PUT 12 MONTHS, 12 MONTHS WHEN I GIVE HIM THAT TIME PERIOD, OR WERE YOU WERE THEY ESTIMATING THE TIME PERIOD BASED ON THE MONTH TIME PERIOD. AND THE R P.
IT WAS AND SO IS THE PRICE CHANGES BECAUSE THAT'S INEVITABLY WHAT'S GOING TO HAPPEN, RIGHT? SOME OF THEM ARE GONNA GO UP OR DOWN. BUT THE GENERAL CONDITIONS AREN'T RIGHT , SO THOSE THAT HAVE THE HIGHER FEES ARE GOING TO GO UP MORE OR DOWNLOAD, SO THAT BECOMES IMPORTANT IF YOU'RE TRYING TO EVALUATE WHICH WHICH YOU CHOOSE. BUT MY POINT IS I'M JUST. NOT SATISFIED WITH MAKING SELECTION TODAY ON ON THIS CHARGING SO. AT 60 WITH A 60% SUBJECTIVE YOU
[02:35:08]
KNOW, BUT BASED ON WHAT YOU JUST SAID TO THOSE THAT MEANS, THEN THE TWO LOWER COST BIDDERS.RIGHT HERE. THEY MAY HAVE HIGHER FEES. IF OUR CHRIST PRICE GOES UP. RIGHT THAT'S A FUNCTION OF OUR SCOPE WHERE WE DEFINE OUR SCOPE AND WHAT SO IT'S KIND OF A CATCH 22 THERE. AND SO, UH, I DON'T I DON'T KNOW WHERE THAT'S GONNA LAND. BUT I DO THINK THAT THAT I'VE WANTED TO PUSH THIS TO CHANGE THIS MATRIX. I THINK THE MATRIX NEEDS DISMAYED. TREATS NEEDS TO BE LOOKED AT FOR ROAD PROJECTS ONE WAY AND FOR PARK PROJECTS ANOTHER AND FOR YOU KNOW DIFFERENT TYPES OF PROJECTS BECAUSE CERTAIN THINGS ARE MORE IMPORTANT TIME DELIVERY DELIVERY TIME IS MUCH MORE IMPORTANT ON SOME ROADS. AT THE END OF DAY ON OUR CAMPUS PROJECT ON PROSPER TRAIL. IT WAS DELIVERED TWO MONTHS LATER THAN WE WOULD HAVE LIKED, ALTHOUGH WITHIN THE SCHEDULE OF THE BUDGET AND THEREFORE WE GOT IT CHEAPER, BUT IT COST US TWO MONTHS. SO NOT TOO BAD AND NEGOTIATE TRYING TO NEGOTIATE SOMETHING AND FOR THE FOR, YOU KNOW, JUST VOTE ON IT IN TWO WEEKS AND THEN IN THE MEANTIME, LOOK AT OUR EVALUATION MATRIX MOVING FORWARD. I DON'T KNOW WHAT THAT PROCESS IS, BUT.
RIGHT? MORE OF A BUSINESS. THAT REASON. ALL OF THEM ACTUALLY.
SO IF I CAN MAKE A RECOMMENDATION EMOTION. ABSOLUTELY. YOU KNOW ANYTHING THAT WE'VE PUBLISHED? CLOSE TO THE PLAYGROUND ROLES FOR WHAT'S BEEN PRESENTED AS ANY OTHER BEDS. WE FOUND THIS IS THE PERCENTAGES WE'RE LOOKING AT, SO MY RECOMMENDATION WOULD BE TO GO WITH RECOMMENDED UM FIRM. WITH THE WITH THE CAVEAT THAT I WOULD WANT TO NEGOTIATE THE PRICE A LITTLE BIT. IT'S ONE WHERE I FEEL LIKE WE HAVE SOME ROOMS IN THE YOU KNOW THE ABILITY BASED ON THIS RECOMMENDATION, KEEPING TRUE TO WHAT WE PUBLISHED IN OUR FEE. WHETHER IT'S THIS VENDOR OR ANY OTHER VENDOR, THEY ACCOMMODATED RP AS WE DEFINE IT. I DON'T THINK IT'S FAIR TO AT THE VERY END OF IT WANTS SOMEBODY'S BEEN ABOUT TO BE AWARDED. WE CHANGE THE PLAYGROUND RULES. I THINK THE PERCEPTION OF THAT HAS A CASCADING EFFECT. I'M AFRAID THAT THE PERCEPTION OF WHAT WE'RE DOING MITIGATES PEOPLE WANTING TO BE WORK OUT HERE, AND I THINK THAT IF WE REJECT ALL OF THEM AGAIN, WITHOUT SPECIFIC REASON YOU'RE NOT GOING TO HAVE TO BE ABLE TO WANT TO BED FOR IT ANYWAY. SO I WOULD MAKE THE RECOMMENDATION. TO ENTER INTO NEGOTIATIONS WITH THE RECOMMENDED FIRM. TO ALIGN ON THE PRICE THAT WE FEEL A BIT BETTER ABOUT WHAT ABOUT THE PRICE THAT EQUALS THE LOWEST VIETNAM. I THINK THAT'S A NEGOTIATION. YOU KNOW, I WOULDN'T PUT IT ON THE THRESHOLD TO MAKE HER FIRM MOTION. IF YOU DEFINE THE PRICE, THEN YOU'VE GOT SOMETHING TO WORK WITH. YEAH YOU CAN DO THAT NEGOTIATE. WE CAN'T AGREE TO WRITE THEIR PERCENTAGE IS ONE OF THE LEARN. 45. I THINK THE BEST YOU CAN DO TONIGHT. IF YOU'RE GOING TO DO THIS IS NOT TAKE ANY ACTION AND JUST GIVE US SOME DIRECTION. YOU KNOW, NEGOTIATE A LITTLE BIT DOWN BECAUSE I JUST HAVE A CONCERN AT OUR TAXPAYERS WERE PAYING MORE THAN THEY HAVE TO. THAT'S MY CONCERN AND THEN MOVING FORWARD LOOKING AT OUR MATRIX MOVING FORWARD, NOT NECESSARILY ON THIS ONE. BUT MOVING FORWARD. WE LOOK AT IT BECAUSE I THINK THIS COUNCIL IS DIFFERENT THAN THE COUNCIL THAT WAS THERE TWO YEARS AGO, AND I TO ME AGAIN WITH COSTS BEING DRIVEN UP. I THINK IT'S IMPORTANT FOR US TO LOOK AT COST. WEIGHTED HEAVILY MORE HEAVILY THAN 40. YOU THOUGHT. YEAH SO WHAT AN APPROPRIATE MOTION BE TO TABLE WITH DIRECTION TO STAFF IF THAT'S ONE OF OUR OPTIONS.
[02:40:06]
NEGOTIATED PROBLEMS. OKAY. THAT'S A QUESTION FOR YOU ALL I GUESS. THURSDAY THEY'RE HERE AND THEY HEARD YOU SO. SO ANOTHER MOTION COULD BE THAT WE TAKE NO ACTION. DIRECT STAFF. TO BRING BACK TO US, UH, THE OPPORTUNITY TO REJECT ALL BIDS. NO REVISED, REJECT OR ACCEPT THE NEGOTIATED PRICE. NEGOTIATED CONTRACTS. DO WE HAVE TO WE DO THAT? BUT YOU HAVE BOTH ALTERNATIVES ARE YEAH. RIGHT? THAT'S THE MOST. COMING BACK TO US. BUT IF IT COMES BACK TO US, AND WE'RE NOT SATISFIED, I WOULD LIKE TO HAVE THE OPTION. OF PROJECTIVE BIT. PROJECTING ALL BILLS OR ACCEPTING A NEGOTIATED PRICE, BUT THEY BRING BACK THE NEGOTIATING PROCESS. IS THAT EMOTION? WHEREVER MY MOTION WAS TO ACCEPT AND NEGOTIATE, AND BASED ON THAT NEGOTIATION, BRING IT BACK. FOR I HAVE A CLARIFICATION ON WHAT ARE WE ACCEPTING? WITH THE OPTION TO REJECT. YEAH, I WOULD PREFER NOT TO REJECT ALL BIDS. YOU KNOW, THE ONLY INCLUDE THAT ONE. BUT IF WE CAN'T REACH A MUTUAL AGREEMENT ON A PRICE THAT IS THEN THEN WE WOULD REJECT THIS ONE AND THEN AS PART OF THE PROCUREMENT PROCESS IF YOU FORMALLY REJECT ONE, YOU GO TO THE NEXT EXACTLY. IT'S THE OFFICIAL NOTICE, AND THAT WAY YOU ALIGNED TO THE PROCUREMENT LAWS. OKAY, SO WE HAVE A MOTION BY COUNCILMAN RAY. AGAIN THAT YOU'RE THE OPTION THAT IF WE CAN'T REACH AGREEMENT FROM THERE WE HAVE THE OPTION. WE DO? WE WOULDN'T SAY ALL I SAY YOU HAVE THE OPTION PER PROCUREMENT BYLAWS TO REJECT THIS ONE. AND THEN YOU LOOK AT THE NEXT ONE THAT'S RATED THE HIGHEST. THAT'S HOW THE HOW WE'VE ESTABLISHED A PROCUREMENT PROCESS. SO YOU'RE SAYING INSTEAD OF JUST REJECTED, POTENTIALLY POTENTIALLY JUST ARBITRARY, YOU KNOW, GET IF YOU CAN'T REACH AGREEMENT THIS ONE AND ACCORDING GROW PROCESS TO THE NEXT TO THE NEXT ONE, OR AT LEAST GIVE US THE OPTION. REJECT OUR VISIT MOVE FORWARD. READ IT. LIKE YOU HAVE TO SEND IT OUT FOR OUR FEE. I'LL SEPARATE IT TO THIS DAY. YEAH MY GOSH. DO YOU UNDERSTAND WHAT. YEAH HE HE HAVE TO BE THE ONE. WE HAVE TO RESPOND TO HIS MOTION. SO IS THERE A IS THERE A SECOND FOR SECOND FOR MARKET WE HAVE TO GET YES, WE HAVE TO GET A SECOND OR NOT, OR AND THEN WE CAN AMEND IT, RIGHT? YEAH. HE'S ALREADY MADE THE MOTION, RIGHT, OKAY. DO WE NEED THE MOTION DEFEATED. GO AHEAD. IF I CAN RESET IT ANY MORE CLEAR. BUT MAKE A RECOMMENDATION TO GO IN CONSTRUCTION. WITH THE ABILITY TO GO BACK AND NEGOTIATE WHAT WE HAVE IN FRONT OF US. AND. SHOULD THAT NOT SUCCEED AND BRING IT BACK THEN THE COUNCIL WOULD FORMALLY FOLLOW THE PROCUREMENT PROCESS. WOULD BE TO GO TO THE SECOND. OKAY. MOTION BY COUNCILMAN RAZORS, SECOND. NO.SECOND, THE MOTION DIES. I LIKE MR REYES MOTION, SO I'M GOING TO MAKE THAT MOTION WAS ASKED TO GLORY UP THERE. I'M GONNA ASK YOU INCLUDE THAT WE LEAVE OURSELVES WITH THE OPTION IF WE DON'T ACCEPT AND NEGOTIATED PRICE AND CHOOSE NOT TO GO FORWARD WITH A SECOND BITTER.
THEN WE HAVE THE OPTION AND HAVE IT ON OUR AGENDA TO REJECT ALL BIDS. SO WE HAVE A MOTION BY
[02:45:04]
COUNCILMAN COTTON. THE SECOND ONE SECOND THAT ONE SECOND BY CRAIG ANDREWS ALL IN FAVOR. AS OPPOSED. MOTION PASSES. THANK YOU, GENTLEMEN. THANK YOU.AND HE'S COMING TO GET. I GAVE IT. YEAH. THE MEMORY.
WE ARE SO EXCITED. I'M BACK. ALRIGHT, NEXT AGENDA ITEM IS I AM NUMBER 14 CONSIDER AND ACT
[14. Consider and act upon adopting an ordinance amending fees in the Town’s Code of Ordinances, specifically Sections 113.2 and 113.3 of the International Fire Code, contained in Section 5.03.002 “Amendments” of Article 5.03, “Fire Code”, of Chapter 3, “Fire Prevention and Protection,” and amending various fees contained in Appendix A, “Fee Schedule,” relating to Construction Permits and Fees, Sign-related Fees, Development Fees, Miscellaneous Fees, Health and Sanitation Fees, Public Works Fees, and Backflow Prevention Plan and Enforcement Fees; and repealing Section II, “Mechanical/Plumbing Permit Fees,” and Section III, “Electrical Permit Fees,” contained in Appendix A, “Fee Schedule.” (RBS)]
UPON ADOPTING AN ORDINANCE AMENDING FEES AND TOWNS CODE OF ORDINANCES SPECIFIC SECTION 113.2. 113.3 OF THE INTERNATIONAL FIRE CODE CONTAINED IN SECTION 5.3 POINT 002. AMENDMENTS OF ARTICLES FIVE POINT OH, THREE FIRE CODE. CHAPTER THREE FIRE PREVENTION AND PROTECTION AND AMENDING VARIOUS FEES CONTAINED IN APPENDIX A FEE SCHEDULE RELATING TO CONSTRUCTION PERMITS AND FEES , SIGN RELATED FEES, DEVELOPMENT FEES, MISCELLANEOUS FEES, HEALTH AND SANITATION FEES, PUBLIC WORKS FEES, BACKFLOW PREVENTION PLAN AND ENFORCEMENT FEES. AND REPEALING SECTION TWO MECHANICAL SLASH PLUMBING PERMIT FEES AND SECTION THREE ELECTRICAL PERMIT FEES CONTAINED IN APPENDIX A FEE SCHEDULE. SCOTT. ERIN COUNSELING ON JULY 26 STAFF PRESENTED TO YOU A PROPOSED FEE CHANGES. AT THAT TIME COUNCIL. AH ASK QUESTIONS PRIMARILY RELATED TO SOME OF THE DEVELOPMENT FEES AND ASK STAFF TO GO BACK AND TALK TO THE PROSPER DEVELOPMENT COUNCIL.AND GET THEIR BUY IN ON THOSE BE INCREASES. WE HAVE DONE THAT. WE HAVE ALSO SUBMITTED THE COMPREHENSIVE FEE SCHEDULE, TOO. TOWN ATTORNEY, MR WELCH AND HE'S GONE THROUGH EXTENSIVELY LOOKING AT BOTH THE EXISTING FEES AND THE PROPOSED FEES AND FOLLOWING UP AND DOING SOME CLEANUP OF THE FEE ORDINANCE, WHICH HAS BEEN DONE AND. THAT IS WHAT'S BEING PROPOSED TONIGHT. IS THAT FOLLOW UP? FROM THE JULY 26. WORK SESSION. AND MR WEBB IS AVAILABLE TO ANSWER QUESTIONS ON SPECIFIC INCREASES. IF YOU HAVE BEEN AT THIS TIME, IT'S COUNSEL HAVE ANY QUESTIONS FOR STAFF. I HAVE ONE QUESTION NOT REALLY PERTAIN TO FEED, BUT SOMEONE HIRES A CONTRACTOR AND I SAW THAT THERE WAS A THERE'S A THERE'S A FEE FOR NOT HAVING A PERMIT. WHO'S RESPONSIBLE FOR THAT, THE PERSON THAT TIRED OR THE HOMEOWNER READY. WELL, WHAT IF HE JUST ASSUMES THAT YOU KNOW YOU HIRE SOMEBODY? YOU FIGURE THAT THEY SHOULD HAVE HAD THEIR PAGE. I WOULD THINK COUNCILMAN HODGES. YES, SIR. THAT IT COMING. REPEAT IT FOR YOU. THE QUESTION. YEAH. PLEASE, PLEASE.
THE QUESTION IS I'M I'M A HOMEOWNER. I HIRE A COMPANY TO BUILD A FENCE. OKAY AND THEY DON'T GO SUBMIT A PERMIT. TO BUILD THAT. OKAY, LET'S SAY AND ENFORCEMENT COMES BY. SEASON.
YOU KNOW THERE ISN'T WHO DID THEY FIND THAT THE HOMEOWNER OR THE COMPANY THAT THEY HIRED BUT I DON'T WANT TO SPEAK FOR CODE ENFORCEMENT FOR BUILDING INSPECTIONS PERSPECTIVE, IT WOULD FALL BACK TO THE HOMEOWNER, UM OUR CODE BOOK. THE WAY THE BUILDING CODES ARE SET UP IS THAT THE CONTRACTORS HAVE THE ABILITY TO MAKE THE APPLICATION FOR PERMIT ON BEHALF OF THE HOMEOWNERS, BUT THAT HOPE THAT PERMIT IT IS. TECHNICALLY, THE HOMEOWNERS ONE OF THE OTHER THINGS THAT, UM MAKES IT PARTICULARLY DIFFICULT FOR US TO GO AFTER CONTRACTORS. GENERAL
[02:50:02]
CONTRACTORS IN THE STATE OF TEXAS IS THAT WE DON'T HAVE A GENERAL CONTRACTOR LICENSING LAW. UM WE LICENSE MECHANICAL, ELECTRICAL AND PLUMBING CONTRACTORS AT THE STATE LEVEL, BUT WE DON'T DO THAT. FOR GENERAL CONTRACTORS AT THE STATE LEVEL, SO IT'S PRETTY HARD TO HE TRACKED. TO THOSE GUYS. CONTRACTORS THAT WORK IN THE TOWN ARE PERMITTED. OR SHOULD BE. ALL CONTRACTORS THAT WORK IN THE TOWN SHOULD BE REGISTERED. THE TOWN. OKAY THAT'S BETTER TERM. THANK YOU, OKAY. AND SO IN THE EVENT THAT LET'S SAY A CONTRACTOR. START THE PROJECT.SAYS THAT. THE ESTIMATE I GAVE YOU IS NOW GOING TO COST YOU X AMOUNT OF MORE DOLLARS AND ALMOST, YOU KNOW, BLACK FORWARD HOLD HIM. HOSTAGE SAYS I CAN'T COMPLETE THIS UNTIL YOU PAY ME SOME MORE MONEY. I MEAN, THEY COULD GO TO COURT AND ALL THAT. IS THERE ANY REPERCUSSIONS BY FOR THAT COMPANY BY THE TOWN. THERE IS THE ABILITY IN OUR ORDINANCE TO TAKE ACTION. WE HAVEN'T TAKEN THAT ACTION. PREVIOUSLY THAT I'M AWARE OF OKAY, SUSPENDED REGISTRATION OR ORBAN, A CONTRACTOR. THAT'S JUST WE HAVEN'T HAD A SITUATION THAT'S GOTTEN TO THAT POINT IN RECENT MEMORY. OKAY, ALRIGHT, THANKS. QUESTION I HAVE FOR STAFF AS IT MENTIONS. WE ASKED TO GO TO PDC AND YOU GUYS DID. THERE WAS I DON'T SEE ANY OF THEM HERE. SO I'M ASSUMING THERE WAS NO PUSHBACK. SURE I WAS AT THE MEETING THIS MORNING, AND, UH, BROUGHT IT UP THAT IT WAS ON THE AGENDA TONIGHT. SPEAK NOW OR FOREVER HOLD YOUR PEACE, AND THEY ALL IN WELL, WHAT MEETING WAS THAT? DEVELOPERS? I WOULDN'T WANT TO GO TO THEY INVITED ME. DEVELOPERS COUNCIL. GET IT OUT.
THEY SENT IT OUT TWICE OR A COUPLE OF TIMES. THAT WAS ALL THE MEMBERS DIDN'T HAVE ANY FEEDBACK AND THANK YOU FOR BRINGING IT UP AGAIN THIS MORNING. THANKS. ANY OTHER QUESTIONS FOR STAFF. DO WE HAVE A MOTION? MOVED TO ADOPT AN ORDINANCE AMENDING FEES AND TOWNS CODE OF ORDINANCE AS PRESENTED BY MARCUS RICE, SECOND BY MAYOR DEPUTY MAYOR PRO TEMP CRAIG ANDERSON ALL IN FAVOR. MOTION PASSES UNANIMOUSLY. THANK YOU VERY MUCH NEXT AGENDA ITEM
[Possibly direct Town staff to schedule topic(s) for discussion at a future meeting]
IS TO POSSIBLY DIRECT TOWN STAFF TO SCHEDULE TOPICS FOR DISCUSSION AT A FUTURE MEETING.ARE THERE ANY ITEMS? THANK YOU. GO AHEAD. YOU HAVE TO KNOW THAT WE PUT IT ON. YEAH RECORDED AS BEING A PART OF MATRIX. EVALUATION MATRIX. OKAY? STAFF NOTE THAT I DON'T KNOW WHAT YOU'RE TALKING ABOUT. OH, YEAH. YOU ARE HERE. NEXT AGENDA ITEM IS EXECUTIVE SESSION. TOWN
