IS THERE ANYONE AT THIS TIME THAT LIKE TO PULL ANY ITEMS CONSENT AGENDA? OKAY, NUMBER 10.

I'D LIKE TO PULL FIVE AS WELL. PLEASE. OKAY? ALL RIGHT. THANK YOU. THEN COULD I HAVE A MOTION FOR THE OTHER ITEMS, PLEASE MOVE APPROVAL OF CONSENT AGENDA ADAMS , NUMBER TWO THROUGH 18.

EXCLUDING NUMBERS FIVE AND 10. OKAY HAVE EMOTION FROM COUNCIL MEMBER COTTON 2ND 2ND BY THE MAYOR PRO TEM ALL IN FAVOR. AND IT PASSES UNANIMOUSLY. OKAY? ITEM. 10 GREG. YES, SIR. SO,

[10. Consider and act upon approving the lease agreement for an Elgin RegenX Regenerative Air Street Sweeper from Kinloch Equipment & Supply, Inc., through the Sourcewell Purchasing Cooperative; and authorizing the Town Manager to execute documents for the same. (FJ) ]

YEAH. UM, FRANK, I GUESS THIS ONE'S FOR YOU. SO I KNOW THE SWEEPER SOMETHING WE'VE BEEN WANTING FOR SOME TIME. I'M JUST CURIOUS. IS THIS ONE OF THOSE THINGS? I KNOW THAT FOR? WE'VE SEEN PLENTY OF FIRE POLICE VEHICLES. I THINK THAT WE PURCHASED AND YOU GO THROUGH THE SOME KIND OF COOPERATIVE OR OR GROUP FOR THOSE IS THERE A PARTICULAR PROCESS? WE GO THROUGH PICKING CHOOSING A SWEEPER. IS THERE A MATRIX OR I'M NOT EVEN SURE HOW IT WORKS AS I HAVEN'T I DON'T THINK I'VE SEEN THIS LONG AGENDA. WE USE MANY, MANY OPTIONS WHEN PURCHASING EQUIPMENT. THE OPTION THAT WE WENT WITH. THIS IS THIS THIS PIECE OF EQUIPMENT IS A VERY HIGH. UM IT'S ALWAYS BROKEN DOWN. I DON'T KNOW HOW SENSITIVITY MAINTENANCE. THANK YOU VERY, VERY HIGH MAINTENANCE. AND THESE WERE THE ONLY PEOPLE WE COULD FIND THAT WOULD MAINTAIN IT AS WE DON'T PAY ANYTHING EXCEPT FOR WHAT'S WRITTEN UP HERE. OKAY ROOMS. AT THE END OF FOUR YEARS, WE CAN OPT TO BUY IT. MY RECOMMENDATION UNLESS IT'S PERFECT. WE DON'T HAVE ANY PROBLEMS IS LET'S GET A NEW ONE IS GETTING AROUND THE HECK OUT OF IT. OKAY, SO WE LOOKED AT JUST OUTRIGHT PURCHASING. MHM WE HAVE NOBODY TO MAINTAIN IT SO WE'D HAVE TO SEND IT OUT EVERY TIME RIGHT? AND THAT'S ALWAYS A HIGH COST, ESPECIALLY WITH THESE VACUUM

[00:10:01]

TYPES. SO THAT'S THAT WAS THE MATRIX WE USED. WE FOUND THIS. AND WE LOOKED AT AND LOOKED AT IT AND WE JUST COULD NOT. THERE WERE JUST WEREN'T THAT MANY OPTIONS. THERE WAS NOT MANY OPTIONS. THERE'S YOU KNOW, THIS WAS THE ONLY ONE WE FOUND THAT HEAD. ALL THIS. OKAY? THANK YOU . THAT'S IT, THAT'S ALL. YEAH ON THIS ITEM, I'M SUPER EXCITED, ASKING FOR YEARS TO GET A SWEEPER, SO I'M TOTALLY SUPPORTIVE. I JUST WANT TO SEE WHAT THE PROCESS WAS THERE LONG WILL IT TAKE TO GET IT? IN PLACE, FRANK. THANK YOU REBUILD. TEXT DOCTOR START TOMORROW.

YESTERDAY. MILITANTS THAT WE WERE DONE. I'M SORRY. I'M SORRY , 12 MONTHS IF WE ORDER TODAY RELEASED RIGHT? I'M SORRY. I MEAN, I ORDERED METERS BACK IN APRIL. JUST GOT HIM TODAY OR YESTERDAY. WOW. OKAY HAPPY WE WILL DO EVERYTHING WE CAN TO PUT NOW I'M GONNA GET ON ACCOUNTS TO GET ME A P O FASTER. I GET IT. BASTARDS GETS INTO EVERYTHING WE CAN, BUT I WAS TOLD THIS YESTERDAY. ANYWHERE FROM 8 TO 10 8 TO 12. BE SURE TO MAKE A MOTION TO APPROVE. WE ARE STILL USING FUNDS TO PURCHASE THIS SWEEPING THAT TO BE DONE. SO YOU KNOW, IT'S NOT LIKE WE'RE NOT SWEEPING. WE JUST WANT SWEEP AS MUCH. WE'LL STILL CONTINUE THIS WITH THE AREAS WE HAVE GIVEN WEEKEND. THANK YOU. THANKS VERY THANK YOU, FRANK. AND I WOULD LIKE TO MAKE A MOTION TO APPROVE THE LEASE AGREEMENT FOR AN ELGIN. REGION X REGENERATIVE AIR STREET SWEEPER FROM KINLOCH CORPORATION, EQUIPMENT AND SUPPLY INCORPORATED THROUGH THE SOURCE OF ALL PURCHASING COOPERATIVE AND AUTHORIZED TIME MANAGER TO EXECUTE DOCUMENTS FOR THE SAME SECOND. OKAY WE GOTTA MOTION AND A SECOND BY COUNCILMAN RAY ALL IN FAVOR. MOTION PASSES UNANIMOUSLY. AND

[5. Consider and act upon approving amendments to Administrative Regulation Chapter 13 - Fund Balance. (RBS)]

THEN, UH, CHARLES, FIVE. I'M SORRY, CHRIS. ITEM FIVE. ADMINISTRATIVE REGULATIONS FOR FUND BALANCES. YEAH I THINK THE MAIN THING I DID. I DID WANT TO BRING UP AND I KNOW OF, UM WE HAVE IT IN OUR SLIDE DECK THAT LITTLE BIT MORE EXPLANATION. I JUST WANT TO MAKE SURE THAT WE WERE REALLY CLEAR AND NON STATING THIS TO THE PUBLIC IN PARTICULAR. UM THAT THIS WAS PART OF OUR OVERALL DELIBERATIONS ON THE BUDGET. WE HAVE A VERY FUN THAT BASICALLY IS SETTING ASIDE MONEY TO REPLACE VEHICLES AND EQUIPMENT. AND WE WERE NOW GOING TO CONSIDER THE BULK OF THAT IN THE OVERALL RESERVE AMOUNT, BASICALLY. UM IS THERE AN ADDITIONAL AMOUNT THAT WE CAN EXPECT TO SEE IN THE CAPITAL? DEDICATED LEVY NOW OR WAS THAT ALREADY HANDLED IN THE BUDGET? YEAH. SCOTT, EXECUTIVE DIRECTOR OF ADMINISTRATIVE SERVICES. WE DID NOT PUT IT IN THE BUDGET. UNTIL IT WAS PASSED. SO THIS WOULD FREE UP 4. OF THE GENERAL FUND BUDGET, WHICH I'M DOING THIS BY MEMORY. IT IS GOING TO BE. YOU CAN BALLPARK. SORRY. I SHOULD HAVE ASKED MILLION DOLLARS SHOULD BE ABOUT 2.5 MILLION OVER. YOU WANT TO JUST COVER THE DISCUSSION OUT OF THE FINANCE COMMITTEE ON THAT WORKERS? THIS DID PASS THE FINANCE COMMITTEE. WHAT WE WERE DOING IS LOWERING THE RATIO FROM THE 25 TO THE 21. SO YES. AND IN ADDITION TO THE VERB THAT WE WE'RE DOING THE CAPITAL DEDICATED. THAT ALSO GIVES US MORE FLEXIBILITY. SO I'M JUST I'M JUST VALIDATING, I GUESS THAT THEY AMOUNT THAT WE'RE CHANGING WHAT WILL SHOW UP IN OUR DISCUSSIONS ON HOW TO SPEND YOUR LEVEE. OKAY UM AND AGAIN, I JUST WAS REALLY WANTING TO SOCIALIZE THAT AND KIND OF PUBLICIZE THAT BECAUSE IT IS LIKE IT'S GOOD WORK THAT WE DID AND THANK YOU FINANCE COMMITTEE FOR FOLLOWING THROUGH ON THE SUGGESTIONS BECAUSE YOU KNOW, IT'S A WAY FOR US TO BIGGEST STEWARDS ARE MONEY BUT NOT HOLD ON TO TOO MUCH WHEN WE HAVE A LOT OF CAPITAL PROJECTS THAT WE NEED TO SPEND THE MONEY ON. SO THANK YOU FOR DOING THAT. AND UNLESS THERE'S ONLY DISCUSSION,D OKAY? GOT A MOTION BY COUNCILMAN CURRENT SECOND BY COUNCILMAN COTTON ALL IN FAVOR. PASSES UNANIMOUSLY. THANK YOU VERY MUCH FOR THOSE POINTS ON BOTH OF THOSE ALL RIGHT. OUR NEXT ITEM IS CITIZENS COMMENTS. I DO NOT SEE ANY CITIZENS COMMENTS FORMS . IS THERE ANYONE IN THE AUDIENCE THAT WOULD LIKE TO MAKE

[00:15:05]

CITIZENS COMMENT? THE PUBLIC IS INVITED TO ADDRESS THE COUNCIL. ON ANY TOPIC. HOWEVER, THE COUNCIL IS UNABLE TO DISCUSS OR TAKE ACTION ON ANY TOPIC NOT LISTED ON THE AGENDA. PLEASE COMPLETE A PUBLIC COMMENT. REQUEST FORM. AND PRESENTED TO THE TOWN SECRETARY PRIOR TO THE MEETING. NO. OUR NEXT ITEM IS THE REGULAR AGENDA ON THE REGULAR AGENDA. IF YOU WISH TO ADDRESS THE COUNCIL, PLEASE FILL OUT OF PUBLIC COMMENT, REQUEST FORM AND PRESENTED TO THE TOWN SECRETARY, PREFERABLY BEFORE THE MEETING BEGINS. PURSUANT TO SECTION 551.7 AT THE TEXAS GOVERNMENT CODE. INDIVIDUALS WISHING TO ADDRESS THE COUNCIL FOR ITEMS LISTED AS PUBLIC HEARINGS WILL BE RECOGNIZED WHEN THE PUBLIC HEARING IS OPEN FOR INDIVIDUAL INDIVIDUALS WISHING TO SPEAK ON A NONPUBLIC ITEM. THEY MAY EITHER ADDRESS THE COUNCIL DURING CITIZENS COMMENTS PORTION OF THE MEETING OR WHEN THAT ITEM IS CONSIDERED BY THE TOWN COUNCIL. OUR NEXT ITEM IS

[19. Consider appointment of Weaver and Tidwell, L.L.P. for a five-year term as external auditors for the Town’s annual audited financial statements for the fiscal year ending September 30, 2022, through 2026, and authorizing the Interim Town Manager to approve the annual engagement letter. (RBS)]

AGENDA. ITEM NUMBER 19 AGENDA ITEM. 19 IS THE TO CONSIDER THE APPOINTMENT OF WEAVER NTED WELL , LLP FOR A FIVE YEAR TERM AS EXTERNAL AUDITORS FOR THE TOWN'S ANNUAL AUDITED FINANCIAL STATEMENTS FOR THE FISCAL YEAR ENDING SEPTEMBER 30TH 2022 THROUGH 2026 AUTHORIZING THE INTERIM TOWN MANAGER TO APPROVE THE ENGAGEMENT LETTER. BOB SCOTT COUNTY COUNCIL. UM WE WENT OUT FOR PROPOSALS FOR AUDIT SERVICES ONE YEAR EARLY DUE TO THE TURNOVER AND THE FINANCE DEPARTMENT. UH THE PART COUNCIL MEETING WE APPROVED CONVERTING THE FORMER AUDITORS PATILLO BROWN AND HILLS CONTRACT INTO AN ACCOUNTING SERVICES CONTRACT AND THEY WILL BE ASSISTING US WITH THE CLOSING OF THE YEAR END FINANCIAL STATEMENTS AND THE PREPARATION OF THOSE FINANCIAL STATEMENTS. AND SO THAT REQUIRED US TO GO OUT FOR PROPOSAL FOR NEW AUDITORS. I HAVE EMPHASIZED MANY TIMES WITH THE FINANCE COMMITTEE THAT CHOOSING AUDITORS IS NOT A STAFF DECISION. IT IS A COUNCIL DECISION. THEY ARE CHECKING UP ON US. THEY'RE REPORTING TO YOU. AND SO, UH, WE FOUR PROPOSALS RECEIVED AND THEN PRESENTED TO THE. FINANCE COMMITTEE. THE WHAT WE FELT LIKE WHAT? THE TWO MOST QUALIFIED FIRMS AND THEN THEY DID THE PRESENTATIONS AND THE FINANCE COMMITTEE MADE A DECISION ON WEAVER AND TED WELL. OKAY? ANY QUESTIONS FOR BOB? FINANCE COMMITTEE MEMBERS. COMMENTS. YEAH AT FIRST AND FOREMOST ONE THINK TOWN STAFFER BEEN TOGETHER RP AND GOING THROUGH THE REVIEW . THE TWO CANDIDATES WE MET WITH WERE BOTH QUALIFIED, AND I THINK THAT THE FINANCE COMMITTEE PUT FORTH STRONG RECOMMENDATION AND I HAD PERSONALLY HAD A GOOD COMFORT LEVEL WITH, UH THE FROM BEING, UM. PROPOSED HERE AND I THINK THAT THEY WILL, UM, VERY MUCH HELPED THE TOWN AND ITS NEXT STEPS. THANK YOU AGREE BY I'VE HAD SOME RECENT EXPERIENCE WITH THIS FIRM. THERE WAS NOTHING BUT OUTSTANDING, SO THAT SUPPORTED QUESTIONS FROM OTHER COUNCIL MEMBERS. AFTER THAT, I'LL MAKE A MOTION. TO IMPROVE. TWO POINT WEAVER INTO DOUBLE LP FOR A FIVE YEAR TERM AS EXTERNAL AUDITORS FOR THE TOWN'S ANNUAL AUDITED FINANCIAL STATEMENTS.

FOR THE FISCAL YEAR ENDING SEPTEMBER 30TH 2022 THROUGH 2026 AUTHORIZING THE INTERIM TELL MANAGER TO APPROVE THE ANNUAL ENGAGEMENT LETTER. I'LL SECOND OKAY, WE'VE GOT A MOTION BY COUNCILMAN RACE SECOND BY COUNCILMAN COTTON ALL IN FAVOR. MOTION PASSES UNANIMOUSLY. THANK YOU VERY MUCH. ALRIGHT NEXT AGENDA ITEM IS NUMBER 20 TO CONSIDER THE APPOINTMENT OF

[20. Consider the appointment of Burns & McDonnell as the solid waste services consultant to assist the Town in the writing and issuance of a Solid Waste Services Request for Proposal (RFP), and an RFP for the purchase and distribution of Town-owned solid waste containers and authorizing the Interim Town Manager to approve the related contract for services for an amount not to exceed $50,000. (RBS)]

BURNS AT MCDONALD'S AS THE SOLID WASTE SERVICES CONSULTANT TO ASSIST THE TOWN IN THE WRITING AND ISSUANCE OF A SOLID WASTE SERVICES REQUEST FOR PROPOSAL. RFP. AND AN RFP FOR THE PURCHASE AND DISTRIBUTION OF TOWN OWNED SOLID WASTE CONTAINERS AND AUTHORIZING THE INTERIM TOWN MANAGER TO APPROVE THE RELATED CONTRACT FOR SERVICES FOR AN AMOUNT NOT TO EXCEED $50,000. MR SCOTT. COUNCIL. UH, THIS AGENDA ITEM RELATES TO OUR OUTSOURCING SOLID WASTE SERVICES, THE CURRENT FIVE YEAR CONTRACT EXPIRES IN JANUARY OF 2024. AND, UH, DURING THE FIRST FOUR YEARS.

THE CONTRACT WE'VE NOTED SEVERAL THINGS THAT WE WOULD LIKE TO CHANGE IN TERMS OF HOW THE

[00:20:03]

CONTRACT STRUCTURED. AH! OWNING CONTAINERS GIVES THE TOWN A LOT MORE FLEXIBILITY. AND SO WE.

COUNCIL HAS GIVEN US INSTRUCTIONS TO GO OUT FOR PROPOSAL AND WE HAVE LOOKED AT POSSIBLY DOING OURSELVES. I WROTE A SOLID WAYS PROPOSAL FOR FORMER, UH EMPLOYER. BUT THE PROBLEM IS, IT'S SUCH A COMPETITIVE INDUSTRY AND SO COMPLEX AND YOU WANT TO STRUCTURE THE CONTRACT. SO THAT YOU HAVE REASONABLE PENALTIES FOR POOR PERFORMANCE AND INCENTIVES FOR GOOD PERFORMANCE. AND DETERMINING EXACTLY WHAT THOSE SWEET SPOTS ARE. TO MAXIMIZE PERFORMANCE ON THE CONTRACT IS VERY, VERY DIFFICULT AND SO AH! MANY CITIES IN OUR IMMEDIATE AREA HAVE USED BURNS. MCDONALD'S SUCCESSFULLY AND, UH , THEY ONLY WORK FOUR CITIES.

THEY DO NOT WORK FOR THE SOLID WASTE PRIVATE SECTOR. COMPANIES SO THEY ARE PURELY OUR ADVOCATE , AND THEY WILL HELP US WITH NOT ONLY THE SCOPING OF THE RP AND WILL BE COMING BACK TO YOU NEXT COUNCIL MEETING AND WORK SESSION TO DISCUSS EXACTLY DO WE WANT TO CHANGE SERVICES? THE TOWN HAS GROWN TREMENDOUSLY IN THESE LAST FOUR YEARS. WITH A LOT OF COMMERCIAL DEVELOPMENT. AND SO HOW DID WE WANT TO STRUCTURE THE RFP TO BEST SERVE OUR CITIZENS? AND THEN ALSO THE, UH. UM OBTAINING, WE ARE ESTIMATING NOW ABOUT 25,000 CONTAINERS BETWEEN SOLID WASTE AND RECYCLING. AND THEN DEPLOYING THOSE THROUGHOUT THE TOWN AND HOW ALL THAT WORKS, SO THEY'LL HELP US WITH ALL OF THAT. QUESTIONS FOR BOB. I. JUST HAVE A QUESTION YET THE CITIES THAT YOU MENTIONED THAT THEY'VE THEY'VE SERVICED BEFORE, UM DO YOU KNOW WHO THEY ARE? MCKINNEY DAMP. THEY'VE DONE WORK FOR DALLAS HAVE DONE WORK FOR FOUR WORTH GARLAND. NOW, SOME OF THOSE CITIES THAT I MENTIONED, UH, PROVIDE THEIR OWN SERVICES IN HOUSE. BUT FRISCO AND MCKINNEY IN PARTICULAR. THEY PROVIDED SERVICES FOR, OKAY. $50,000 IS REASONABLE. IT'S A IT'S A REASONABLE COST WHEN YOU THINK THE PROCESS IS LITERALLY GOING TO SPAN ABOUT 6 TO 7 MONTHS. AND THE REASON WE'RE GOING OUT THIS EARLY IS WITH SUPPLY CHAIN ISSUES. ONE OF THE DECISIONS ACCOUNT OR HAVE TO MAKE IS DO WE WANT TO HAVE ALL NEW TRUCKS? AS YOU MAY BE AWARE , BECAUSE THE CITIZENS ARE VERY EAGER TO TELL YOU ABOUT SOME ISSUES. THERE HAS BEEN A LOT OF HYDRAULICS BILLS. ON THE STREETS. THE GARBAGE TRUCKS REQUIRE A LOT OF HYDRAULICS. AND SO WHEN YOU BUY NEW TRUCKS YOU'RE LESS LIKELY TO HAVE THOSE ISSUES. BUT THEN THERE HAS OTHER COMPLICATIONS. USUALLY YOU SEE CONTRACTS THAT REQUIRE NEW TRUCKS THAT ARE DEDICATED ONLY TO THE TOWN. ARE GOING TO BE ABOUT SEVEN YEARS BECAUSE THAT ALLOWS THE CONTRACTOR TO RECAPTURE THE INVESTMENT IN THE VEHICLE, SO THERE'S A LOT OF DISCUSSION LIKE THIS THAT WILL HAVE NEXT COUNCIL MEETING TO JUST YOU KNOW, FOR COUNCIL TO GIVE US THAT FEEDBACK. ON WHAT THEY WANT US TO BUILD INTO THE RFP. THANKS BOB, COUNCIL MEMBER. YOU MIGHT ALSO KNOW THAT. ONE OF THOSE ORGANIZATIONS HE MENTIONED SPENT CONSIDERABLY MORE THAN THAT ON THE SAME SERVICE. OKAY, SAME VENDOR, OKAY? THAT'S NICE TO KNOW. THANKS NEGOTIATED FROM DOWN A LITTLE BIT, ALRIGHT. DID OKAY. ANY OTHER QUESTIONS? CAN I GET A MOTION? YEAH I WILL MAKE A MOTION. I MOVED TO A POINT BURNS AND MCDONNELL AS THE SOLID WASTE SERVICES CONSULTANT TO ASSIST THE TOWN IN THE RIDING. ISSUANCE OF A SOLID WASTE SERVICES REQUEST FOR PROPOSAL OR RFP. IN AN RFP FOR THE PURCHASE AND DISTRIBUTION OF TOWN ON A SOLID WASTE CONTAINERS AND AUTHORIZING THE INTERIM TOWN MANAGER TO APPROVE THE RELATED CONTRACT FOR SERVICES FOREIGN AMOUNT NOT TO EXCEED $50,000. OKAY. MOTION BY THE MAYOR PRO TEM. I'LL 2ND 2ND BY THE DEPUTY MAYOR PRO TEM ALL IN FAVOR. PASSES UNANIMOUSLY. THANK YOU VERY MUCH. NEXT AGENDA

[21. Consider and act upon the appointment of members to an ad hoc select committee to consider and address the continuation of the Fire Control, Prevention and Emergency Medical Services District and the Crime Control and Prevention District, and to make recommendations to the Town Council regarding the term of continuation of said Districts, and all matters incident and related thereto. (MLS) (Part 1 of 2)]

[00:25:04]

ITEM IS NUMBER 21 TO CONSIDER AND ACT UPON THE APPOINTMENT OF MEMBERS TO AN AD HOC SELECT COMMITTEE TO CONSIDER AND ADDRESS THE CONTINUATION OF THE FIRE CONTROL PREVENTION AND EMERGENCY MEDICAL SERVICES DISTRICT. AND THE CRIME CONTROL AND PREVENTION DISTRICT AND TO MAKE RECOMMENDATIONS TO THE TOWN COUNCIL REGARDING THE TERM OF CONTINUATION OF SAID DISTRICTS AND ALL MATTERS INCIDENT AND RELATED THERE, TOO. WE HAVE A MOTION. 2ND 2ND BY JEFF HODGES ALL IN FAVOR. THE MOTION PASSES UNANIMOUSLY. THANK YOU VERY MUCH . ALRIGHT WITH THAT OUR NEXT AGENDA ITEM IS TO POSSIBLY DIRECT TOWN STAFF TO SCHEDULE TOPICS FOR DISCUSSION AT FUTURE MEETINGS. IS THERE ANYONE THAT HAS SOMETHING?
